whyest threatening to take away their federal funding. ktvu channel 2 morning nows continues. well good morning, to you. welcome to pam cook's favorite day of the week. it's friday, january 27th i'm dave clark. >> saturday is pretty good too. >> it is. >> i'm pam cook. let's check in with steve paulson. >> we do have thick fog out there and a north wind kicking in. it will be a combination of either one for awhile. result is morning fog and then afternoon sunshine. breezy. highs in the 60s. here is sal. good morning. traffic will be busy. fog will be a problem for your morning commute. we are looking at one of our news crews as they drive along here on highway 24. and we can see the traffic is moving along well in this particular portion it's not foggy. the problem is as you drive into some areas pretty soon you

will be in thick fog. you may start off it will be clear and then you are going to be you know in fog. so again claudine wong is on fog patrol. she is heading right for it. we told her where to go. golden gate bridge pretty foggy here as you can see. now 6:00 let's go back to the desk. thank you. homicide investigators in berkeley spent the night at the scene of that city's first fatal shooting of the year and they are still searching for a suspect right now. ktvu noelle walker is at shattick and emmerson right now. >> reporter: dave, police were here until 4:30 this morning. they were investigating for more than nine hours. after going inside one of the crime scenes that second floor apartment in the building behind me i could see why it took so long. the couple allowed us inside of their home and they were quite frankly shaken to the core. they showed us their bullet riddled home.

the woman who lives there told me she went to answer a knock on the door and for some reason hesitated. went back to the bathroom to fix her hair and that's when the bullets started flying. they told us how they crawled on to the floor and crawled to safety. through this hail of bullets that pierced windows, doors, and walls. even pieces of furniture they were sitting in moments before. it appears the couples friend that works in the neighborhood was the intended target. he was coming over to watch a basketball game when the gunfire broke out. now all of this happened around 7:00 last night. police received a flood of 911 calls to report gunshots. evidence tags filled the street at the corner of emmerson and shattick. the victim was pronounced dead at the hospital and suspects are still on the loose. >> we are encouraging anyone that may have seen or heard something. we had a lot of participation of callers but sometimes the smallest thing can be the thing

that gets to the truth in a crime like this. we would love to hear from you. >> reporter: it's hard to believe quite frankly after being inside that apartment hard to believe that no one else inside that apartment died. the person that died was outside knocking on the door. again a friend of the people that lived there. reporting live in berkeley noelle walker. we have developing news right now. we want to take you live to cincinnati, ohio. these are pictures of a construction site at a casino where there has been some sort of collapse at that construction site. the fire department there in cincinnati says at least 11 people have been injured but the initial reports do not indicate how serious those injuries are or who was injured. the casino right now is being built though. it's a partnership with caesars entertainment and a spokesperson is assessing the situation right now. but roads around the casino

have been closed by police. this is a live picture in cincinnati, ohio where casino construction there has been a collapse. at least 11 people are hurt. we want to bring that to you live and bring you more information as it becomes available. 6:03. back here at home today we may find out the name of a man who's body was found near stanford hospital. the body was found yesterday morning at a construction site off quarry road next too hoover pavilion. he apparently had been dead for some time. police do not suspect foul play. nightclub goers in san francisco are warned to take precautions after an increase in thefts. inspector says thefts are common but appear to have increased in the past six months. police are encouraging club goers to keep their belongings with them and in a secure location. the bay area battle against secondhand smoke is shifting to palo alto. city leaders are considering a

tough new ordnance that would ban smoking in all public areas. sidewalks, parking lots, garages, city parks and even on the street. now the proposed palo alto ordnance would require a 20- foot no smoking buffer around all areas where smoking is banned. mountain view conducted a similar ordnance earlier this week. requests denied. san francisco sheriff ross mirkarimi will not be living with his wife and little boy for the time being. the judge refused to lift the court order barring him from having contact with his wife and two-year-old son. the latest developments in that scandal will be coming up at 6:15. a new warning for students and staff at san jose university. they sent out an alert to everybody just about 30-45 minutes ago. a man entered a dorm room in

joe west hall and groped someone. he was last seen on the third floor. the university says police are on the scene. students in that residence hall should lock their doors, stay inside. lorraine blanco is on her way to san jose state to gather more information. we'll have a live report coming up in the next 20 minutes. cal train is considering asking san mateo county voters to approve a sales tax increase to help cut down the deficit. increased ridership gave cal train a 25% increase in revenues last year. the agency still faces an operating deficit. cal train will conduct surveys in the coming months to see if voters in san mateo county would approve a sales tax increase. another idea on the table is for a sales increase in all three counties served by cal train. that would be santa clara, san mateo, and san francisco. 6:06. if you haven't been out there is fog this morning. it's effecting the commute and sal is checking on things now.

>> yes. as a matter of fact we do have some breath busy commutes out there. no major problems. this is highway 4. you can see highway 4 traffic is moving along pretty well and the fog is not here in contra costa county. so if you are driving in this area at least you don't have to deal with poor visibility. if you are driving far you might have to deal with fog as you get closer toward the inner core of the bay. let's take a lack at the foggy bay bridge. foggy bay bridge toll plaza. visibility is bad. if you are driving on the peninsula, so far so good. a little bit of fog on the san mateo bridge and heading up and down san mateo county on 101. 6:07 let's go to steve. >> sal, thank you. some areas have fog. others don't. just had a nice tweet from west coast pete. he said crystal clear out here. for some there is fog but it is moving south. and that north wind up to 30 miles an hour. so some areas get the fog and

some don't. the system responsible for it is flying out of the picture. we'll have sunshine later on. 38-52. santa rosa temp continues to go down. 41 would not be secure surprised if they get an upper 30. and 58-68 sunny and breezy. reason being the system digging down to the east of us we just saw it. as we head south high pressure builds into the north. before that get there is we have to deal with that fog. north wind is already showing itself. mount diablo gusts to 50. in the valley gusts 15-20. concord showing fog. other areas clear skies. big differences until the temps. 40-50s. 51 fairfield. now the north wind not too strong at the surface. napa did have one and now they are calm. fairfield instead of north has gone to three. high pressure eventually will

happening now republican presidential candidate newt gingrich is appearing at a campaign event in miami. want to take you live there this morning. he is speaking at the latin builders association. gingrich and mitt romney the two front runners are running neck and neck in the latest polls heading into florida's primary on tuesday. 6:12. today president obama continues his state of the union tour. this morning he's talking about being able to afford to go to college. ktvu alison burns is live in our washington, d.c. newsroom with the star roy.

alison. >> reporter: dave, the bottom line here is president obama wants colleges and universities that keep costs under control to get more federal money those that are a bad value to get less. the students at the university of michigan are eager to see the president. here is video of many of them camped out to get tickets to this mornings speech. just about 30 minutes ago the secretary of education went on tv to put colleges and universities on notice that change is coming. >> we want to make sure great efforts get rewarded. >> reporter: here's a live look at the room where the president will be speaking. looks like standing room only. the white house just e-mailed me a blueprint of the president's plan. it also includes incentives for schools that insure more low income students finish their education. more live coverage of the president's speech during my next update in an hour. for now we are live in washington, d.c. alison burns.

now 6:13. secretary of state hillary clinton says if president obama is reelected, she will not stay on in her position. >> i think after 20 years and it will be 20 years of being on the high wire of american politics and all of the challenges that come with that it would be a good idea to just find out how tired i am. >> secretary clinton did not rule out returning to politics in the future. san francisco sheriff ross mirkarimi won't be staying with his wife or little boy any time soon. a judge refused to lift the court order that bars him from having any contact with his wife and two-year-old son while he awaits charges. he won't get any special treatment just because he's sheriff. mirkarimi spoke outside the courtroom shortly after that ruling. >> this has been enormously crushing the fact that i haven't been able to see my

family, be with my wife, or be with my son. >> prosecutors opposed lifting the stay siting an e-mail saying mirkarimi's wife wrote to neighbor back in october. lopez writes she found her son wet, hungry, and sick after leaving him in mirkarimi's care for two hours. at one point the toddler was left alone if a car. mirkarimi's newly hired lawyer says an earlier investigation found those allegations to be untrue. no damage reported yet so far after several small earthquakes rattled part of the state. a 3.4 magnitude quake hit just before 9:30 last night. 26 miles north of santa rosa. at least five small quakes followed including a magnitude 2.3 quake. it has been two years since a magnitude 7 quake hit haiti in and now there is a new study

showing more powerful earthquakes could be on the way. fourth earthquakes with a magnitude of 6.6 or higher rocked haiti during the 1700s. they could be entering a similar period of quake activity. the state senate approved legislation that would restrict protests and earlier demonstrations. now it's aimed at preventing demonstrations by the west bureau baptist church. the church members target military funerals claiming the deaths are god's punishment for the nation's acceptance for homo sexuality. activists group are demanding that a connecticut mayor resign after his comment about latinos and tacos. they delivered 500 tacos yesterday as part of their protest against him. earlier this week a reporter

asked matero what he planned ongoing for the latino community in his town. the mayor responded he might eat tacos. he is the focus of an fbi investigation right now. 6:16. this morning police in morgan hill searching for a man blamed of a one man burglar spree. they are searching for 21-year- old jose torres. he's a young man. has a thick new york accent and tattoos over his arms and hands. police issued a $50,000 warrant for his arrest. he's wanted for at least seven home burglaries in the past month. police think he might be hiding in one morgan hill neighborhood. macworld expo continues in san francisco this morning. you will be able to check out some of the latest and hottest items related to apple products. organizers rebranded this years event macworld-iworld giving attention to the ipad

andiphones. macworld has geared toward products for apples macintosh line. the event runs through tomorrow. 6:17 is the time right now. let's check back in with sal for a look at the commute. sal. >> all right pam and dave. right now traffic is moving along pretty well despite the fog we've had a couple fender benders and stalled vehicles. again nothing rising to the major level. let's go to the live pictures. it is actually clear on highway 4. clear and a little bit brisk here on highway 4 westbound as you drive up to the willow pass grade. at the bay bridge toll plaza still thick fog. it's better from the first time we saw it earlier. you will see thick fog and slow traffic at the toll plaza. if you are drive on the peninsula you will see fog there as well. let's go to steve. thank you very much. we had a lot of fog. some of it is beginning to move out of the picture because of a northerly breeze. some pockets still exist. so a few areas are clear.

others have the fog. the system responsible for it is moving rapidly south. as it does it's creating a difference in the pressure gradiant. visibility could be absolutely lousy to a quarter of a mile to crystal clear. 40s low to mid to low 50s. just depends on any breeze or no breeze at all or any fog or no fog at all. high pressure is beginning to show itself in a big way. it will build in and give us a sunny and warmer weekend. today it's the fog first and then the wind which is cranking up some of the higher elevations. i've seen 30 right in the oakland hills. but a north wind or northwest wind will take care of this fog eventually we'll be under sunny skies. weekend looks good. the mornings will be cooler. partly cloudy and cooler on monday. thank you, steve. 19 minutes after 6:00. back to our developing news at san jose state just a short

time ago police issued a campus alert at san jose university. lorraine blanco tells us this warning involves a groper and it was inside a dorm. >> reporter: yes it was inside joe west hall. that's what we are finding out right now. i got off the phone from pat harris. you can see police on campus right now apparently they are searching the area looking for the suspect. they sent out a tweet just after 5:00 a.m. describing the suspect as a male in his 20s wearing black clothing. he tried the doors in joe west entered a room and groped a female victim. they are getting a bunch of calls from witnesses that were around the scene when it happened. apparently it happened around 3:30:00 a.m. and the woman immediately called police as soon as it happened. joe west hall it houses about 650 residence. single and double occupancy

rooms. it has first year students, transfer students, returning students. we talked to a student that was in joe west hall at the time. of the incident and he said he was woken up in the middle of the night around 3:30:00 a.m.. had heard about it. it happened on the third floor and i'm just hearing we have some sound an interview i just did from pat harris. let's hear what she had to say about what is happening with the students right now and what they do to protect them. >> we do everything we can to protect their safety. however, keeping in mind we are in a large city, we all need to take proper precautions for our personal safety locking doors is really important in that regard. >> reporter: and again you can see police right now they are searching campus at this point. they are searching the residence halls as well as other places on campus. they are looking far male in

good morning. right now traffic is going to be slow at the bay bridge. there is a little bit of a back up in the fog. you will see fog on the bridge as well. crews are trying to fish out two suvs from a minnesota lake. ice fishers often drive over the frozen lake but in this case the ice gave way. both drivers managed to climb out. one of the submerged suvs belong to a local mayor that finished his ice fishing tripe. a muni track improvement begins in san francisco that will create detours over the weekend. they will be replacing tracks at market and church streets.

drivers and bicyclists won't be able to get through that area expect eastbound on market. for muni riders service on j lines will be limited. work is expected to be completed by 5:00 p.m. on monday. 6:25. there is a controversy over aircraft noise at san francisco international airport. some of the residence are complaining about training heading to los angeles, las vegas, and phoenix. faa departure map shows the planes are supposed to fly north for four miles before heading over candle stick and heading south. >> we didn't move to a place that underneath published flight plan. there is a published flight plan and no one is following it. that is the real issue. they have a three port departure and they do not follow it because they are kowtowing to the airline.

>> sfo spokesman says planes leaving from the oakland airport also fly over brisbane. their planes are turned before candle stick to maintain a safe separation from the oakland planes. a memorial walk will be hill to raise money for a fallen vallejo police officer. he was shot and killed last november as he chased a bank robbery suspect. the suspect henry albert smith injury is due in court next week. the memorial walk starts at 8:00. participants will walk 21-miles to vacaville. registration is $30. a homicide investigation under way in berkeley. the search is on for the person who killed a man and left a nearby house riddled with bullets. we are continuing our drive around the bay area. looking for foggy conditions. we are now on the 880 in

welcome back to the ktvu channel 2 morning news. it's a bit of a cow bell there. in the new york stock exchange. they are opening it from davo switzerland. the world economic forum. there is a look back at the new york stock exchange. they are in switzerland. thus is a very big deal. economic finance leaders are all there. they are trying to reassure business leaders that the european economy will be just fine. they will be able to handle the debt problems there. i hope they can do that and reassure everybody. it has been weighing heavily on markets around the world. as we look live at the traders

on the new york stock exchange. dow jones down about 24 points. >> we'll smile and say good morning, to you. thank you for joining us here on ktvu channel 2 morning news. it's friday, january 27th i'm dave clark. >> and i'm pam cook. time is 6:30. in the news for you right now police in berkeley investigating that city's first homicide of the year. a man was shot to death last night at a nearby house -- and a nearby house was riddled with bullets. noelle walker is there right now. you looked inside that house. >> reporter: some terrifying moments. the victim in this case was over to that apartment. he was knocking on the door when he was killed in a hail of bullets. the couple who live there is graciously let us inside to see what happened. it was truly unbelievable. you can't turn anywhere without seeing bullet holes.

i'm talking about in the walls, in the door, in the window even through the house through the walls of the house. through the kitchen and out the back doors. the couple told me that they dropped to the floor and then crawled out that back door to safety but they couldn't help their friend. >> homicide detectives will do a walk through. what the evidence suggests very preliminarily is that this victim was certainly focus of someone's attention. it was not a random shooting. we don't believe the public is at risk that the suspect or suspects are long gone. >> reporter: now just before 7:00 last night police received a flood of calls to 911 to report the gunfire. investigators were here until 4:30 this morning collecting evidence in this case. so far there are no arrests in this case. but the suspects were long gone when police got here. the victim in this case was

pronounced dead at the hospital. police are not releasing his name. reporting live in borkly noelle walker. ktvu channel 2 news. a court hearing scheduled for this morning for a man convicted of killing a los gatos restaurant tour. paul garcia was pronounced in 2008 for the shooting death of mark. he was supposed to be sentenced last month but his current lawyer wants a new trial. alleging that garcia's former lawyer failed to call a key witness. the former attorney will be allowed to defend himself further postponing the sentencing. give yourself extra time for the morning commute. dense fog is being seen on the bridges. claudine wong joins us along southbound 880 as she is driving along. carefully tell us what it is like. >> reporter: very carefully. yeah we have logged a lot of miles this morning. we have gone through four

counties. right now we're at 880. you can see from the freeway sign. i can tell you things have gotten better this morning out here. the man behind the camera he drove through this earlier this morning about 3:00 this morning and said it was pretty socked in. we are getting more clarity this morning. that is good news. steve has been telling us the wind will come in and kick all this fog out. we can tell you it has been a very different scene. depending on which part of the bay area we have been in. i will show you the richmond san rafael bridge. about 4:30 this morning the fog was thick there. as you cross the span it did get really soupy at certain points of the drive. we also checked in on the carquinez bridge. there was signs in very clear conditions warning people of heavy fog. it wasn't until you got on that bridge you kind of rolled into it. we also went over the benicia bridge. this is bridges that had

warnings on them. benicia bridge pretty clear. those are areas that norrally had a log of fog during foggy mornings. coming back out live and we are headed down to the 84 because that is still sort of a problematic area. some of the areas that were really socked in this morning we are talking about the 80 and the richmond san rafael area and all through contra costa county those areas have cleared up. sal castaneda has been watching all this as well for us. and sal, how are things looking from your end? >> looks better claudine. some of the wind and steve has been saying it as well some of the wind is coming in and pushing in the fog. i think steve called it chewing up the fog because i follow steve on twitter. i get his tweets. let's go out and take a look at the commute here at the bay bridge toll plaza. you can see it's foggy as you come up to the toll plaza.

no major problems if you are driving on to the bridge you will see fog. san mateo bridge also very foggy if you are driving across to the peninsula the fog will be waiting for you there as well. if you are driving to the south bay this morning on highway 101 redwood city, palo alto, mountain view, you can see traffic there looking good. the road sensors are not picking up a lot of slow traffic. let's go to steve. all right, sal. i have outdone myself with this pretty picture. some fog out there. we do have fog but other locations it's already clearing and the winds already over 50 miles an hour at mount diablo. 30 plus in oakland hills. there is a breeze from santa rosa to san jose. other areas it's clear and breezy others you have thick fog. morning fog and then sunny and breezy today. the weekend will be nice. you will notice the mornings they will be clear. if there is any fog it will be patchy. next hint of a system would be

monday. looks like a weak system. the weekend all signs say sunshine and warmer weather. system responsible for the wind is diving south. high pressure is building into the north. so it fills it. also fog. there is pockets of zero visibility to a quarter of a mile out there. watch out as the low digs south it goes down to southern california. high goes into oregon and the combination of the two gives us a breezy day after that morning fog. northerly wind 20-40 miles an hour. not that bad at the surface. in the higher elevations it's already there. 40s and 50s. i would not be surprised if santa rosa comes in at 41. and then some of napa hill about 20. it's starting and also out to the valley it has been about northwest 15-20. that has cleared out some of the fog. a north wind, northwest santa rosa. north, northeast at sfo. the wind is kicking up.

the fog doesn't have much of a chance. still pockets of it. it will be clear later on today. thick fog in the morning. breezy to windy. and temperatures in the 60s today. we're starting off 40s and 50s. mid 60s. santa rosa will go 66. livermore 63. 65 mountain view. morgan hill at 66 degrees. cold tomorrow morning but sunny and mild to warmer on the weekend and a little cool down on monday. time 6:38. the republican presidential candidates faced off with their last debate. >> these two gentlemen that are out distracting from the most important issues we have by playing petty personal politics. >> rick santorum reprimanded the front runners and why ron paul said they should all go for a bike ride. a third green company backed byes obama administration filed for

bankruptcy. the company enter one makes rechargeable batteries. it comes one year after vice president joe biden stopped by a visit. that company received a $118 million grant from the inside department. fremont solyndra and beacon power on the east coast also declared bankruptcy after getting help from the federal government. there are two groups gathering signatures to recall oakland's mayor. yesterday an organization called recall jean quan now got the go ahead to begin its petition drive. another group ban collecting signatures last month. the fist group to obtain 20,000 signatures will have their name on the ballot. critics question her leadership skills. police in vallejo are investigating a string of break ins at businesses on sonoma boulevard. more than half a dozen businesses were broken into.

police say they happened sometime between 9:00 monday -- tuesday night and 8:00 wednesday morning. and more police officers could soon be patrolling downtown walnut creek. earlier this month we reported on one fight involves 15 people outside the shiro restaurant and lounge. walnut creek's police chief is asking the city council to add two noserings to the force. if approved those officers would be placed on the downtown beat. a final decision is expected in the next few months. why petaluma police are out in force looking for law breakers. we are at san jose state university where police are searching for a male suspect accused of groping a female student in her dorm room. we'll have the latest on the search. good morning, traffic is moving along relatively well.

university and police. right lover rain? >> reporter: yes, i have. they are obviously frightened this morning. they are in joe west hall and interviewing witnesses as we speak. it said last seen third floor joe west hall residence locked doors. police on scene. now we just shot video. let's take a look at that of two females being escorted out of joe west and put into police cars. the public affairs representative on duty told us the understand accident happened about 3:30:00 a.m.. the female victim called police right away. now the school tells us there are surveillance cameras in all residence halls. right now they are reviewing video. as you can see out here live police are on scene. they are looking for a suspect. there is not a great description of the man.

opening of express lanes on 680. the lanes have been restriped. metering lanes are up and running. 6:47 is the time right now. back to sal. how is the commute? >> it's doing well in some areas where it's crystal clear and some other areas very thick fog. we have two commutes really. let's go to the first one highway 4 crystal clear from antioch all the way across the bay point. as our camera moves to the right traffic is moving along nicely. also this morning at the bay bridge the fog is getting a little better. lifting a little bit. earlier we couldn't see this much. it is backed up for a 15 minute delay at the toll splay. and this morning if you are driving on the peninsula you had fog there as well. also fog in parts of the east bay. let's go to steve. thank you very much. we do have areas of fog. a lot of it down there. just heard from david up in

nevada 39 and foggy. owen said fog and the fog horns are blaring. that's what he said. up above starting to clear out. a few high clouds left over. they are flying out of here. exit stage right really fast as high pressure builds in. the rain has cranked up the higher elevations. 25-55 miles an hour. 38 to 52. fog will not last long. 54-60 by noon. and then we go sunny side up and it will be mild to warm. the fog continues to be a really tough chore if you have to drive through it. again any breeze doesn't have much of a chance. but any time you get that fog down to zero visibility it will be with us for another hour or two. the low responsible for the breeze and also some of that fog is digging so far south now the high is building in. the high fills it with a breeze. that's why we are getting that north, northwest wind. temperatures allover the place. santa rosa will go in the 30s. if the wind dies down.

action fence the company in the -- against the company in the future. 16 people including a couple from minnesota are still missing. three people are in the hospital this morning following a dramatic rescue at san francisco ocean beach. a small boat captized shortly after sunset last night. several people took action to help the boaters that are fighting for their lives in rough seas and chilly waters. dense fog made the rescue even more difficult. the three boaters are said to be in their 30s or 40s. all three at uc medical center this morning. one in critical condition. our time now 6:55. a high surf warning for the bay area is over but it sure made people think the mavericks invitational surf competition may end soon. and it's just too soon to say when the competition might begin. there is a three month window for the mavericks contest through march 31st. once they determine conditions

are right, surfers have 24 hours to get to half-moon bay. later today vallejo high school will provide a lasting honor to one of its most famous graduates. the school will rename its renovated high school baseball room after that man there. it will be called cc sabathia field at paterson park in honor of the yankees super star pitcher. he was scouted and drafted into pro baseball during his playing days at vallejo high. both sabathia and his wife plan to be at today's ceremony. tiger woods appearance last year helped the santa clara tournament gain popularity. now it could become a pga stop as soon as next year. 6:56. sal, how is the toll plaza holding up in this friday morning? >> it's not bad. the fog is beginning to lift a little bit. we will see a little bit of slow traffic there.
