will, good morning. welcome to "mornings on 2." i'm dave clark. >> i'm tori campbell. it's thursday, february 2nd. in overnight news, a gun battle on the streets of oakland has both the victim and a suspect in the hospital. police say two men tried to rob a taco truck worker but the victim was armed and fought back. ktvu's claudine wong has been on the scene and i understand you've been talking to residents who heard all of this going on. >> reporter: that's right. it all happened at this taco truck. one woman said she heard fighting and yelling right around the time this all happened. another man just told us he heard the gunshot. >> about 1:00, 1:30 in the morning, and i heard about five, six real loud gunshots. i didn't -- i didn't go out -- see, my back porch is out there. you can stand on the porch. i didn't go out there to see

what was going on because i knew -- i knew. there's always shooting in this neighborhood. >> reporter: it was a gun battle. police say what he heard was a gun battle taking place between two would-be robbers and a manworking at a taco truck. here's what police think happened. >> it appears that a robbery occurred at the taco truck and that multiple people were injured, to include the operator or the worker here at the taco truck tonight. there are a couple of people, two people at local hospitals in stable condition with gunshot wounds. >> reporter: so one suspect being treated but will be facing charges in connection with this attempted robbery. the search is on for anyone else involved. we do believe there's at least one more person.

as far as the victim, his brother was out here earlier to secure the truck and he told us the 32-year-old man always works overnight and had a bulletproof vest and a gun. he says his family has owned this truck for 30 years. i asked him if he was surprised his brother fought back he said no. one resident said he had heard the victim carried a gun with him and said as far as he's concerned he's glad the victim fought back and said he would have done the same thing. claudine wong, ktvu channel 2 news. 7:03. this morning, a 50-year-old oakland man is in stable condition after he was trapped in a trench that collapsed. he was pulled to safety after three hours and now his pain -- and has pain in his chest, hip and legs. he was helping with a septic line when piles of mud fell on top of him. he was buried up to his neck.

rescuers dog with his hands. then around 8:30 last night straps were placed under the shoulders and a fire truck lifted him out of the deep trench. cal/osha is being called out to investigate. an inspector could check out the scene as soon as today. several robberies and attempted robberies on the uc berkeley campus are under investigation this morning. tara moriarty is there to tell us what campus police are telling us they are doing to make sure there's safety. >> reporter: they say they are adding plain clothes officers and also beefing up patrols around campus. we did speak to officers who say this is a great reminder to folks to tell them they are aware of the surroundings. if we fake a look at the daily californian, there's a map of where these robberies are

happening. it's in south side. this is berkeley in the yellow. and all of these boxes right here are robberies. three of them look like they are armed robberies. so again, campus police are saying that they want you to make sure of your surroundings. if we take a look at the map of the south side, this is the streets we've been talking about. >> reporter: six of these incidents happened, stretching from atherton street to the west past the residents hall to piedmont avenue. there were also three robberies north of the campus before the classes began. police say they cannot explain this rash of robberies but it could be due to an increase in students back. one woman was snatched of her iphone. again, this is important because last january there was only one robbery -- robbery reported. police want to make sure you are vigilant.

do not walk alone and do not walk after dark by yourself. tara moriarty, ktvu channel 2 news. in the next hour, a court hearing is due to begin for a san jose woman accused of dropping her son from a building. she faces charges, including one count of endangering the health of a child. the child did survive. investigators say ms. cortez is dealing with severe mental problem. today's court proceeding is to set bail and a date for a preliminary hearing. in the last couple of minutes, we got word that a distinguished high school teacher from petaluma has died. 51-year-old sara wadsworth suffered a stroke. she was declared brain dead. she was taken off life support yesterday. she taught french at petaluma high school for 26 years. she was also a tennis coach and

was last year's teacher of the year. it is 7:06. this morning a federal appeals court in san francisco will decide whether to release a videotape of the landmark proposition 8 trial. in that 2010 trial, a federal judge declared california's same-sex marriage ban unconstitutional. lawyers for the couples who challenge the van say the video should be made public. but opponents of same-sex marriage worry that trial witnesses could experience backlash if the video is released. >> 28 nays -- [ cheers ] >> the bill is expected to pass next week.

leon panetta announced a change in the time line for american combat troops in afghanistan. the obama administration now wants aftergan forces to take the lead by the middle of 2013. now, coming up for you at 7:15, we'll tell you about the backlash now coming from republicans. the government's new list of suspected terrorists who were planned -- who were banned from flying to and within the u.s. has doubled in the past year. the no-fly list has gone from 10,000 to 20,000 names. previously, a person had to be considered a threat to aviation. now you can be put on the list if you are a threat to domestic or international security or if you have attended a terror training camp. 7:0. we want to economic in with

and wise. >> happening right now, a house committee is holding a hearing looking into the controversial fast and furious gun sting program. these are live pictures of that hearing. attorney general eric holder is testifying about the program. federal a -- agents were supposed to keep track of the guns. but they lost track of the weapons and they ended up in the hands of mexican drug cartels. the family of a murdered u.s. border agent is demanding $25 million from the bureau of alcohol and firearms. that's because two of the guns involved in the fast and furious program were involved in the deadly shooting of agent brian terry two years eafg. his family claims the government's failed program

. police have released disturbing video of saturday night's riot in downtown oakland. the video shows occupy protesters burning flags outside the steps of city hall. you can also see demonstrators breaking into city hall to commit several acts of vandalism. the violence led to the largest mass arrest in alameda county in 30 years. >> if they are intent on causing damages and breaking out windows, then our job is to

. 7:29. as soon as today, cal/osha could send an investigator to check out a construction accident in brentwood. a man helping repair a septic line was buried up to his chest for more than three hours. ktvu's christien kafton is outside of the home where a trench suddenly collapsed. >> reporter: good morning. we're expecting a cal/osha inspector out here. the scene has been frozen. there's tennis shoes, some items left over from the rescue. over to the right, that's where the trench was. that trench is now covered up with plywood. you can see some signs on it. they are advising people not to step on the plywood. the clps happened around 5:30

yesterday afternoon, trapping him up to his chest under hundreds of pounds of wet clay- like mud. firefighters did arrive on the scene. they were able to get water via the man. he was talking at the time. it did take firefighters three hours of removing the mud by hand. finally, he was pulled to free. [ cheers ] >> he was stable, conscious, alert, answering questions. he was complaining of leg pain and some pain to his chest area. >> reporter: that man was thrown out to john muir medical center to be checked out. you can see the mud is thick and dense. if that gets packed around you, it would be very difficult to get out.

became sick. saint ignatius high school is being disinfected. that special cleaning will continue today. more than 300 students were sickened by a stomach bug that was possibly caused by the highly contagious, norovirus. security will be tight in the murder trial of a suspected gang member. the cousin of murder suspect edwin ramos is scheduled to testify for the prosecution. he's expected to provide some damaging testimony. ramos is expected -- is suspected of killing tony bologna while they were driving home from a picnic. researchers at ucsf say sugar is toxic, atickettive and -- addictive and should be regulated. according to their report, sugar contributes to 35 million deaths a year. the report suggests sugar is just as dangerous as alcohol and tobacco and should be

controlled. coming up at 7:45, pam cook will tell us what critics are saying about the report. :33. well, the california department of health has given a daily city nursing home. the $100,000 fine came after an investigation revealed a residents direct was direct -- ware -- residents care was affected by care. the usually mileage rewards are not taxable because they are r considered a rebate on the cost of a purchase. but these were given as a gift which could make them taxable. the irs has not commented on how it's gonna treat those airline rewards. 7:34. a man accused of leading san jose police on a clays that injured several officers is due

in court today for a plea hearing. police say 27-year-old alejandro gonzalez carjacked a vehicle. police say he rammed the vehicle into four police officers before the chase was ended. six others were hurt. authorities say he had a warnt stemming from a petty theft conviction. a woman who was criticallily injured in an apartment fire on monday has deid. police say 34-year-old -- died. no one else was injured but several other apartments were damaged. 7:35. a san francisco woman listed the city's homeless in her will. s.f. date.com reporting that she died at the age of 84. she didn't have any family. so the retired nurse wanted her

. the labor department reported the number of people filing initial unemployment claims continues to fall. 367,000 people filed for first- time benefits last week. that's down 12,000 from the week before. that level signals a steadily improving job market. the report came out one day before the government is expected to mark january as a solid month of hiring. the dow is down 2. nasdaq is down 13. s&p is up 2. 7:46. sugar is it as bad as alcohol? pam cook has more. >> researchers say sugar is toxic, and could be -- should be regulated. the report suggests that sugar

. there is a new survey that shows emotional reliance on the internet is a growing problem for children and teenagers. a new study shows 12% of teenagers are addicted to being online. that means they would rather be

on the internet than spend time with family and friends doing home work or even going to sleep. researchers say parents can curb that problem by just restricting the amount of time that the kids spend online. 7:53. facebook has friended wall street and filed the paperwork for its initial public offering the stock. by doing that the menlo park- based social network had to open its books to the public. it revealed earnings of $668 million on revenue of 3.7 billion. both figures are nearly double the numbers for 2010. now facebook has to find out how interested investors are in it so it can get an initial stock price. >> the real problem they have now is deciding exactly what price to offer the shares at. that will depend on the action -- on the reaction they get on the road show from investors. >> depending upon how long it takes for the review, the first stock offering could come

around the founder's 28th birthday in may. when it goes public, he's expected to earn a spot on the top ten richest americans. and state lawmakers are excited. mark zuckerberg and others will become new millionaires. they hope that will encourage people to spend money which will put more tax revenue in the state budget. one leader warns it's not clear how long it will take to start collecting the taxes. so the state should not count on that money being in the treasury.

. good morning. a 50-year-old oakland man still recovering this morning after peaking buried alive. he was hoping to repair a septic line when a 10-foot deep trench caved in. kristin kafton is outside the home in brentwood where the scene is being protected so safety inspectors can come out and see what's wrong. >> reporter: they've frozen the scene. they now have plywood over that trench to make sure nobody else falls in. there's also some evidence over here off to the left of all of the hard work that was undertaken to rescue that man and perform that long and difficult rescue. that collapse happened at about 5:30 yesterday morning. the oakland man was working on

a september tick line when the side of the trench collapsed in on him. neighbors say the work was trapped under hundreds of pounds of wet, clay-like mud. >> we could not see his whole body. we just see his head. they have to give him oxygen tanks to keep him alive. >> reporter: by the time rescuers pulled him free, a crowd formed around him. that victim was taken to john muir medical center. coming out to the live shot, we have a closeup of some of the mud. you can just see how thick and how hard it would be if you were trapped under it. another neighbor told us that the homeowner knew the worker out here well and considered that worker and uncle. we're hearing that the homeowner was devastated by that accident. we are hearing again that cal/osha is due to come out here later on to figure out exactly what went wrong. we'll continue to follow up on the story to bring you the

according to the "times herald" kenneth warren may have known or was related to another shooting victim, 38-year-old dorian wells. wells was reportedly holding his 1-year-old daughter when he was gunned down tuesday night in vallejo. this moving, richmond police are searching for suspects in a shooting that left the driver with a bullet wound in his back. it happened yesterday afternoon on hilltop mall road. the victim said he was driving alone when he was shot by someone in another car. the wounded man was treated at the hospital and released. police are calling on witnesses to step forward. a san francisco woman listed the city's homeless in her will. sfgate.com reports that the woman died last september at the age of 84. without any family, the retired nurse wanted her condo to be used as a shelter for the homeless. if that wasn't feasible, the city would decide how to best use the property. next week, the board of supervisors will consider a

proposal to sell the condo for $400,000 with the money going to the mayor's fund for the homeless. 8:35. the new $28 million elementary school in santa rosa may not be able to open as scheduled in the fall. there's no money to build sidewalks to the school. the money for a sidewalk along burbank avenue was supposed to come from santa rosa's redevelopment agency. but that agency along with every other redevelopment agency in california was eliminated because of california's budget deficit. without a safe route for children to walk to and from the school, the city won't allow the new school to open. >> the america's caught yacht race begins in 18 months and the san francisco supervisor behind the ground breaking hiring law is getting involved. john avalos wants to force the race organize esto hire workers from san francisco -- orkers to hire workers for -- organizers

. right know, the dow is down 17. nasdaq is up 10. s&p is flat. a computer glitch caused problems on a tokyo stock exchange this morning. there was no trade for 240 exchange-traded fund, real estate investment trusts and companies including sony. it was the first serious problem in that exchange in six years. it was fixed before the afternoon session. market officials are investigating the problem but say they've ruled out cyber terrorism at the cause. 8:44. the scene around a trench is being protected and preserved. state investigators want to

happened. >> we know the son comes to work armed and with a bulletproof vest. these two suspects did not know that. fighting back, however, did come at a price. he was hit by gunfire. three shots, one to his arm, one to his back, one to his neck. you are looking at exclusive video as he was taken away from the hospital. he actually called 911 himself after all of this happened. he is in stable condition. residents out here told us they heard fighting, yelling and then shots. >> about 1:00, 1:30 in the morning. i heard about five, six real loud gunshots and i didn't go -- i didn't -- my back porch is out there. you can stand on the porch. i didn't go out there to see what was going on because i knew. i knew there's always shooting in the neighborhood. police on the scene this moving told us at least one suspect was also hit by gunfire. he was actually dropped off at the hospital by an unknown person. but he is also now facing

suspects. sugar is toxic, addictive and should be regulated. those are the findings of a new study done right here in san francisco. pam cook has the results of this new report. good morning, pam. >> good morning. the report by researchers says 40% of normal weight people, not obese, have metabolic problems that can lead to diabetes and heart disease. they contend that sugar is the cause. now, a pediatrician who led the study says excessive sugar alter's people pie yochemistry, making them more vulnerable to an illness. the question is should the government step in? >> i think it has to start at home, with the family. parents should be restrictive and the parents are a lot of the problem, too. >> i've heard that sugar is comparable to like a drug an it's addictive. i would like to see if maybe we

could remove some of that from prepared foods. i think it would all around be more healthy for us. >> the uc study says it's going to take more than will power and the government needs to step in. it finds meshes eat and drink about 22-teaspoons of sugar every day, that's triple what we consumed 30 years ago. they also say that a lot of that sneaks into our diet in things like bred. now the -- bread. now the study suggests the fda remove sugar from the list of foods that are generally regarded as safe because that means they can be used in unlimited quantity. tori? >> thank you, pam. we were asking viewers on facebook. if they think shoe arcould have similar regulations with alcohol and tobacco. larry wrote there's no public safety issue. i say no, this is a private safety matter. joel wrote i think people shue be allowed -- should be allowed to ingest what they like.
