surveillance video. >> reporter: a shop owner allowed me to go inside and to take a videotape of the videotape. in that surveillance video there are four different angles and you can see two robbers come up foothill boulevard, they hide behind the taco truck. you don't even see the operator. he is out sweeping around a parking lot. then you see him come into frame and then the two robbers come towards him. you see one robber with his hand with a gun. and almost simultaneous you see the gun blast of the taco truck owner and one of the suspects exchanging gunfire. the owner of the taco truck hides behind his vans and continues shooting as does the robber who is now on the

ground. a few minutes later you see the robber hobble off and leave with his -- with the other robber and they disappear. a few seconds later you see the taco truck operator go into his taco truck and he apparently used a cell phone and called a friend. you see the friend come to the aid of the taco truck operator till police arrive. the police arrive 3 minutes later. all of this transpired in a matter of minutes here and we know that police have the videotape now and we are told they may have other surveillance video from other stores here in the area. it was quite a wild shoot out here about 1:30 a.m. rita williams, ktvu channel 2 news. even though both men knew each other police are saying

their shooting deaths are not connected. he was shot and killed in vallejo on tuesday. it was just a coincidence that his friend was killed in berkeley a few days earlier. >> we are going to pursue every single lead because our goal is to identify those responsible for the shooting. >> the victim's child was in the car during the child. she was not injured. the family of a man buried alive last week is considering a lawsuit. he died on saturday when he fell into a 12-foot trench and burried by dirt while working at hominid construction. the home didn't have proper permits. callogea and the city are investigating the death. cal-osha is also looking into another accident that left a

man buried in wet clay. firefighters rushed to the home last night. it took them three hours to free the worker. the man is a family friend of the homeowner who hired him. the victim's injuries were not life threatening. the nfl is kicking in $200 million for the new 49ers staidument, sealing the deal for the team to move to the south bay. 9 news reporter robert handa is live with the welcome news for the team, city and some fans. >> reporter: we are at the site where workers have been all day. this loan may not mean the stadium is a done deal but supporters are certainly acting that way. >> reporter: they predict the work will soon turn into actual consideration. national football league approved a loan for construction costs that the team and the city say completes the financing. many fans are happy.
