to rob him. >> reporter: this taco truck would normally be open for a few more hours, but it's been shut down all day followed by a shoot out that was caught by surveillance camera. the surveillance video shows a gun battle. it appears 32-year-old omar castillas surprised the victim. castillas ran back into the truck after he was hit three times. he emerged again and was the seen slumping to the ground. the suspects fled in a car but later turned up at a hospital with one of them suffering with gunshot wounds. two are brothers, 18-year-old antwon and 18-year-old sean

more of that surveillance video at ktvu.com you can get another look at it on the video tab. and more details now, you may remember another recent shooting at a food truck in oakland. that crime just a few weeks ago on december 30th claimed the life of 5-year-old gabriel martinez. the little boy was with his father on international boulevard. police have not made any arrest in that case. authorities in northern california, siskiyou county are investigating a heist at their ohm courthouse. the sheriff's office says that someone broke in and walked out with gold nuggets. the display pays homage to the region's gold rush roots. now many say they are outraged. >> we've been violated, by all the people. it's not really the county or the thing, it's the people that

continuing coverage. ken pritchett will be reporting from nevada tomorrow and saturday as voters make their decision. prop eight the same-sex marriage plan will not be seen by the public. the court of appeals voted against releasting that video. it said doing so would undermine the authority of the court. new at 10:00, firefighters are calling a man from oakland a real hero for rushing into a burning building today to try to save a disabled man in a wheelchair. eric rasmussen live on the scene of that fire on international boulevard where he talked to the man about his daring rescue, eric. >> reporter: frank it's incredible, before this guy could get into the burning apartment. he had to jump this fence and climb a wall back there. somehow he made it up tot second floor balcony where this disabled man was already crawling out of his wheelchair. tonight this good samaritan is telling me, he doesn't even

know how he did it. >> all in one motion, jump, jump, jump, jump and got over. >> reporter: 41-year-old james jackson showed us how he sprang into action around 2:00 this afternoon when he heard a disabled man was trapped inside a burning second floor apartment. >> he said don't let me die and i said i'm not. >> reporter: johnson who's 5'9" and a former football players saw the fire when he was on his way to the gym. >> i just react ed. i didn't think, i just reacted. i was about to enter the building and as i stepped to answer, it was a big blast of flame. and i stepped back. >> reporter: but somehow, johnson was able to get back to the balcony and save the citizen. >> this is the type of citizenry we look in people, while we applaud him we certainly don't recommend his

ages. but we certainly want to recognize a hero when we find one. >> it was meant for me to be on this block for this reason. because if i wasn't, that man probably would have died in that fire. >> reporter: firefighters say the victim is still fighting for his life with burns to 80% of his body. and incredibly someone actually stole jackson's cell phone when it fell out of his pocket today during that rescue. tonight firefighters bought him a new one with their own money. we're live here in oakland, eric rasmussen. and now to contra costa county where firefighters responded to a house fire on fair born drive in pittsburgh tonight. after they put out the fire they found a man inside. he was taken to john mier medical center. what started that fire is still unknat this hour. there were tense moments as s.w.a.t. team surrounded the house while looking for suspected carjackers. it happened near lafayette

avenue. the stand off ended about 7:00 tonight with police arresting one person. this all started tonight when a man was carjacked in fremont and assaulted. the investigation continued to newark and that home under investigation. 39-year-old raul zapat died when a wall of dirt fell on top of him. criminal charges are possible. state permits are required for any trench that is 5 feet deep or more. a cal osha spokeswoman told us that the trench that collapsed on zapata was at least 13 feet deep. an oakland man is said to be recovering after a trench collapsed on him. we showed you the rescue here tonight. the contractor here also did not have the required permit. the man was buried up to his

an east bay mother is pleading with skateboarders to wear helmets after her son died this week when he was hit by a car. ktvu's debra villalon is is where the accident happened and the teenager's friends are still gathering. >> reporter: about 50 people are out here, this is the berkeley-albany border. this is a street with swift traffic eastbound though it's a 20-mile-per-hour speed limit. skateboarding was everything to 18-year-old tyler demartini and he was headed to the skate park when he collided with a park. he was taken off life support two days later. the driver who just did not see him was devastated. >> you just can't see out here,

it was a prius that hit him which are quiet cars. >> he did not have a chance. he did not have a chance. >> reporter: his mom is back at the scene. bolstered by this showing of love. >> show what happened to my son, make him an example to help prevent this from ever happening again. >> reporter: tyler like many skaters was athletic, aggressive and never wore a helmet. his girlfriend says, it never came up. >> it's like this whole cool concept like people think it's not cool. >> reporter: at the park, where tyler skated friends have inked his name on their boards. but wear a helmet? the law for little kids, it's a hassle to get uncomfortable. >> i'm always going to think about tyler and all the great times we had together. but probably with skateboarding i'm not going to wear a helmet. >> reporter: just a chance you're willing to take? >> yeah. >> do it for tyler. >> for this family, a helmet seems a small sacrifice

tv like rob dyrdek, ryan schekler, prod not wearing helmets when they skate. a cyclists charged with fatally hitting a tourist last year has now reached a plea deal. randolph ang pleaded not guilty to vehicle manslaughter last november. he was charged with the death of 68-year-old diana sherlye. the plea deal does not include any jail time instead he will perform 500 hours of community service. the topic of discussion was about the drunken brawls that have been happening in recent months. about 35 bar and restaurant owners met with police and city leaders this evening. they say everyone wants to have a safe downtown and no one wants to see more violence like last weekend when nine people were arrested. ktvu obtained exclusive videos of one of the fights. >> a few bad apples destroys the bunch. we got thousands of people

coming into this city when you have three or four people you know causing trouble. walnut creek police say they plan to add a significant number of uniformed officers to patrol the downtown on fridays and saturdays starting tomorrow night. tonight we have a fascinating and rare look inside the facebook headquarters in menlo park. ktvu's maureen naylor shows us some of the many perks employees there can take advantage of. >> reporter: inside facebook cafe at lunch today you find no indications that about 24 hours earlier the company filed for one of the biggest ipos in history. 2,000 employees line up here for free lunches on a floor made to look like a circuit board. upstairs, teams on computer monitor the social networking giant and its content. it's a rare look into the tech giant. that expansion is key to future success. >> google even years after their ipo is still struggling to try to break free in another

area where they can get more revenue. so facebook looks like they're going to be able to make money on things more than just being able to do advertising. >> perks range from free lunch to free snacks, to free phone calls. you will also find it vending machines where authorities can wipe their badge if they need a new keyboard, cell phone or charger. analysts don't think that estimations are overstated. >> they are growing faster, they have more revenue than than started with. >> reporter: right now workers work on the avenue.

the company has planned for a new plant with more cafes and a medical office. zynga which has been struggling surged gaining almost 17%. groupon grew more than 1.50. linkedin also closed up. google plans to cross reference it's user data services which includes tkpwaog google plus and others. among their concerns whether tools to control privacy are user friendly and effective. some say the meeting ended with more questions and concerns than it began.

shoppers were in a spending mood. retailers reported an increase from last year. this easily beat analyst expectations. january frequently is the time that stores offer huge sales and discounts to try to clear out their shelves for spring merchandise. the labor department says unemployment claims dropped by 12,000 last week. this puts the total number of applications at 367,000 for the week. perhaps a better indicator is the four week average which is 375,750. that is the lowest since june of 2008. the unemployment report for all of january is due out tomorrow. on wall street, stocks remained flat. the dow barely moved during trading and closed with a loss of 11 points. the nasdaq posted a small claim raising about 11 points. and wow, what a day today. record head today in santa rosa. it was such a nice day i

defendant and testified that they used to quote hunt together. >> inside this high security courtroom albert martinez described gang rituals and testified that he and edward ramos his former brother-in-law would quote hunt together for rival gang members. >> he has intimate knowledge of ms13 and ramos has key information about that gang. >> reporter: he said today he hoped by testifying in that case and in the ramos trial he will get a lighter sentence for gang activity convictions that include a stabbing in san francisco. >> a rat is a rat, that's all i can say. for someone of his character even to use as a witness, it's disgusting. >> reporter: ramos is charged with killing anthony balonia

and two sons anthony and michael driving home from a picnic. the defense claims a passenger in ramos' car killed the bolonias. the two once got arrested together, quote we picked up a gun on 20th street and were going to do something with it but we got caught with it the next day. the defense says ramos left the gang before the balonias were killed. >> we admitted he was a gang member he's not a gang member. and he hasn't been a gang member for a number of years. >> reporter: if convicted, ramos could face life in prison without the possibility of parol. rob roth, ktvu channel 2 news. police at uc berkeley are warning people to take

precautions in berkeley in a specific area. robberies have gone up, most of the robberies but not all have taken place late at night. campus police are advising people to be aware of their surroundings, remove earphones and walk with a companion if possible. the berkeley city attorney is taking action against the owner of a lot on telegraph that's been vacant for 20 years. the city told the owner and his wife to file building plans. the owner says he's tried to comply. why so many traffic cases are being dismissed. our questions led to some changes. money to make it happen. the big step today toward building the 49ers a new home in santa clara.

in tonight's special report, if you get a ticket in oak -- oakland there's a good chance you won't have to pay. tara moyrti reports. >> reporter: if you get a ticket in oakland. chances are good you can beat it if you fight it. >> once i heard the officers testimony, your cross- examination i will make the decision. >> reporter: that is if the officer shows up. >> your cases are all dismissed. >> judge colver has been on the bench here for more than a year. he estimates that oakland police do not show up about 40% of the time. >> dismissed. you got a clean report. >> thank you, thank you. >> i'm happy, he didn't show up. but i had my whole spill ready for hill. >> reporter: chief howard

jordan says last year the department became aware that it had a problem after it audited police attendance in court for several days. >> we ended up finding about five or six officers that did not show up to court that didn't have legitimate reasons. >> reporter: today kerry has been in oakland's traffic court twice. most recently last month. >> i was siting for making an illegal left turn. >> her case? >> i was a little surprised that we have not completely had a 100% turn out even after the audit that we did. >> reporter: word on the street is just say not guilty because nine out of ten they will not show up. so a lot of people know that already. >> reporter: the two traffic courts in oakland hear 32,000 cases a year. not all from oakland police. many are from the chp. >> there is a substantial number of people from chp that show up. butmy view of that is that the job. >> chp told us that the court

notifies them when an officer fails to appear and the officer is then disciplined. turns out oakland hasn't had a system like that until ktvu started asking questions. now they say they are getting one. >> reporter: the court used to deliver the subpoenas via e- mail but not all of the departments were on board with that message so they had to revert to the old way which was physically putting the subpoenas into a file like this one that was stored at the courthouse. that means for the oakland police, a court liaison actually had to walk across the street in order to pick up those subpoenas. but court officials say that wasn't being done on a regular basis. >> those are things my staff will be working on to make sure we receive the subpoenas and serve the officers on a more timely fashion. >> reporter: the judge says 2/3 of people who get traffic tickets choose to come to court. >> i'm a rig frustrated. i want to present my case -- i'm a little frustrated. i want to present my case. i want the judge to hear both

gun on a dog walker. 50-year-old gary hesterberg was taeuzed while he was walking two -- was tased while he was walking two small dogs in the bay area. the national park service says it expects to respond to spears request by the end of the week. nfl owners today approved $200 million in loan money to fund the construction of the 49ers stadium in santa clara. the 49ers say this is the last piece of the financing puzzle and paves the way for construction to begin. 49er president york says this is the largest amount the nfl has ever given to help a team finance a stadium. and santa clara city leaders are exstatic. >> this is a contribution of $200 million forward a project. the city of santa clara is not responsible for a single penny of the billion dollars for the stadium. not a single penny. >> construction on the new stadium is set to begin later this year with the goal of

opening in time for the 2015 season. east man kodak is takes stepping to pull their support of the kodak theater. the move comes just weeks before the academy award which are held at the kodak theater. keeping the name on the theater costs $4 million a year. oakland is looking for a few good teachers and tonight held a recruiting seminar. thousands of people came out to check out the job opportunity. >> we think that teaching is a great profession, that education is a great profession. and those jobs that are available should go to folks who live in oakland first. >> reporter: so far, it's placed 46 people in the district. the group began six years ago and is funded with grant money.

new video now from alameda tonight where firefighters had to get help from neighboring oakland because of two simultaneous fires. the oakland crew responding to a fire on san antonio avenue at around 8:45 p.m. firefighters say the fire started on the second story balcony at one of the homes and spread to the attic. they put it out quickly and no

one was hurt. residents from the unit where the fire started will need to find some place else to stay. the cause is still under investigation. no one was injured but several pets were killed in a house fire in martinez this evening. it happened at about 5:15 in a home on franklin canyon road. firefighters say their response was slowed because of a lack of fire hydrants in the area. they believe the fire was accidental and that it started in a front room in the home. the two adults and a child who lived there were not at home. it hasn't even opened yesterday. but a new elementary school is having to to raise funds. it costs $28 million to build but there's a problem, the $400,000 needed to add sidewalks disappeared when santa rosa's redevelopment agency was cut. and the city requires sidewalks around all of its schools. >> there's been a lot of confusion, i think statewide

regarding what was going to happen with those funds and which projects could go forward, monday we received final word from the city that those funds were not available to us. the district superintendent says they can't dip into the money for the sidewalk because that money is earmarked for school billings. in news of the world, in egypt, violence erupted in cairo. demonstrators say police just stood by and did nothing to stop yesterday's soccer riot that left 74 people dead. all this is just adding to the anger directed at egypt's military rulers in implementing safety. john and wanda casllas were found dead in their home. the two had moved from texas and funded a church. one of their sons was the first

san jose talked about his latest project. >> he basically said he met this young 20-year-old who had started up this company called facebook. he was asked to do a mural with him. >> reporter: before facebook, 11 years ago kho did the walls of a friend's hair salon in san jose. a 50 feet long, 18 feet high mural that captured some of cho's graffiti beginnings in los angeles. >> i always told dave from the beginning, i said everything dave touches turns to gold. so you know what it's not a surprise to me. >> reporter: friends say david kho talked about how mark zuckerberg disagreed with some of his paintings but cho would not compromise. his works already sell for more than $50,000. lloyd lacuesta, ktvu channel 2 news. federal officials are cracking down on counter fit

merchandise. they say they've seized $5 million worth of fake merchandise and 16 that stream unmerchandised -- aragon says it will no longer sell its lap band weight loss devices to the 1-800-get- thin campaign. five patients have died since 2009 following lap band surgeries. the california department of insurance is investigating the centers for alleged insurance fraud. federal regulators disclosed initial square inside steam generators at the santa rosa plant in san diego county. they say hundreds of tubes that carry radio active waters that

have walls that have worn away some by almost 30%. the tubes were recently replaced in that reactor and the one shut down a few days ago because of a very small leak. meantime the california public utilities commission has re -- rejected a pg & e request for the diablo canyon nuclear power plant. the cost is $85 million. pg & e says it will attempt to reopen this request at a later time. high speed train supporters rallied in sacramento today saying that a high speed rail line to los angeles will put californians back to work. >> the longer we wait, the more it's going to cost. this is our generation's project. we're going to pay for it. we're going to build it, we're going to ride it and it's woát it to us. >> reporter: college students joined construction workers in a show of support saying that the project will create tens of thousands of jobs. many in the central valley where unemployment right now is over 18%. also today, the high speed rail

authority appointed dan richard to be its new chairman. the city's of brentwood and oakley have taken control of 18 miles of state route 4. the stretch of road runs from state route 150 mainstream interchange to marsh creek road. caltrans had control of that stretch of road before, city leaders say they can now make fast local decisions about how to maintain that road. and it did feel like april today. temperatures a good five to 10 to 15 degrees above average. your friday is going to be almost as nice. maybe a degree or two cooler. we go outside and i'll show you how the sunset looked. we have a lot of pictures into the weather center this evening of the sunset out at pacifica and other places. just a beautiful night. overnight lows are going to be chilly. you notice it outside right now. a jacket will be needed. the issue will be in the

afternoon when it warms into the mid- and upper 60s. a lot of those jackets are going to be left behind in school. it's going to warm up a lot in the afternoon. a lot of times, kids, i used to do it too, you would forget your jacket at school. mostly sunny and mild tomorrow. waiting on the rain. weekend is not going to rain but next week we have rain lined up. looks like some where around tuesday and wednesday i'm going to show that to you. i've been tracking a bunch of systems out there. what we've been getting from these weather systems are large ocean swells. it's not giant but it's good size and it's moved across the pacific. the next few days the swells remain rather large and they're coming down. thewet -- the weather systems that are going to be going over us are moving in tuesday into wednesday. we notice the clouds adds we head into sunday night. a few more clouds sunday into monday. more clouds, showers in your bay area forecast. so how much rain?

a huge crowd of children took part in a lunar new year celebration in oakland today. a magician wowed the crowd at the recreation center. the event featured traditional music and lion dance. this of course is the year of the dragon. and one of the highlights of the chinese new year celebration is of course san francisco's annual parade. this year the southwest airlines chinese new year parade is february 11th on union square. as always you can watch it live right here on channel 2, our coverage with julie haener begins at 6:00 p.m. >> and we are looking for --
