continues. . it is tuesday february 7th, i am dave clark. we begin with storm watch this morning and we do have some much needed rain this morning and it is causing some wind here in the bay area. it could cause trouble for the morning commute as well. we have live team coverage and following the rain in the east bay, of course tracking troubled spots here in the studio, let's start with steve paulsen with how much rain we could get, hello steve. >> and unfortunately it is splitting and not giving us too much rain, maybe a quarter inch to an inch that would be good but we have a week ended split and it is taking a lot of the moisture out of it. starting to get a little bit of

rain you can see from livermore clayton back to areas of walnut creek and there are windy conditions up to 50 miles per hour. some of the higher elevations and off and on morning rain. now, paul, you have been on walnut creek, now what is going on? >> well, it is off and on, it depends on who you ask, but it is causing wet roadways and that's a problem because with rain there has been a lot of rain related accidents. >> i probably should have been driving a little bit slower. >> he then spun out of control before going airborne.

>> he came outright behind me, i -- out right behind me, before i knew it, i am getting flipped over. >> and with rain in the forecast, remember to give yourself a lot of time because roadways are slick. also a high wind warning for san mateo bridge and san mateo hayward bridge, some gusty winds when crossing the golden gate bridge. like i said, it is on and off and it looks like it is back on and rain in walnut creek is causing slick roadways and of course you want to give yourself ample time. i don't know what is going on here but i can tell you what is going on in walnut creek but on top of the bay it is south. >> we have the bay bridge in the section of emoryville in that section of the bridge, although it is raining harder

most of the fire trucks are gone and you are looking at a group of people who are the propertity owners and they are standing with firefighters and it looks like they are peering into the back of the building to get a look at some of the damage. let's get a look at some of the damage. this is video you will see only on 2. they responded to calls about smoke coming from the building and they had to break down the door of the restaurant and once they did, you can see from this video, the flames were completely inside the building. the battalion chief said not only were there flames in the building but the building was filled with smoke and that led to some visibility issues. >> they had smoke coming off

the roof and they located the fire on the interior rear corner. >> but firefighters put out the flames about 20 minutes after the fire started and everything is under control, now they have moved onto the investigation to figure out what caused this fire. it appears the fire started possibly in an addict right above the kitchen and the firefighters are trying to figure out what happened but it does not appear anything here is suspicious. live in union city, allie rasmus ktvu channel 2 news. well the long awaited appeals court ruling on proposition 8, supporters and opponents are anxiously awaiting the big court decision. a federal appears court will

announce whether proposition 8 violates the constitution. they are talking about banning same sex marriages in california. >> well obviously we hope the 9th circuit will uphold the vote of the people. >> now this morning's decision will be a key moment in the fight over gay marriage but it is probably not the final word. they could then decide next year whether gays lesbians nationwide have the right to marry. and a possible conflict of interest by a former judge. he ruled proposition 8 was unconstitutional. he later revealed he was in a long relationship and last year, another federal judge ruled walker did not need to recuse himself and that

decision was also appealed to the 9th decision. stay with us at ktvu channel 2 news for continuing coverage and we will bring you that ruling right when it comes down. the republican presidential candidates are battling it out in three ditch states today. colorado and minnesota hold caucuses while missouri holds a nonbinding primary meaning no delegates are awarded. the one candidate polling ahead of front-runner mitt romney in at least two contests, now we are getting a better idea of what the ballot will look like when we have our presidential primary, june 5th. so far there are 24 candidates. additional candidates could be put on the bench. as we told you last week roseanne bar is registered as a green party presidential candidate and so far the person

with the most candidates are the libertarians with 9. the commute is starting to get busier. >> a lot of people can do work from home in the mornings and the system may move through and people who can go to work will be better off. i realize it is not always possible. let's look at what we have with some of these pictures. the traffic will be affected, chp quickly got out there and moved two vehicles off to treasure island and traffic is slow and we will look at the bay bridge toll plaza because when there is a crash metering lights go on and traffic is already backed up for about maybe a quarter of a mile

passed pay gates and for this time it is rather unusual and you may have to leave a little earlier to stay on schedule today. let's move to the south bay as i pull back just to see the whole south bay view with the computerized map systems. for the most part we were off to a decent start here in san jose. northbound at 280, a brand-new crash has been reported. let's go to steve. well, why wait until saturday when we have rain arriving today. unfortunately the system is splitting, takes apart some of the energy and that draws moisture right out of it. at least you are getting some rain because after today our forecast models are out in left

field. we will take what we can get but also theres nothing. you can see dry areas and there is pretty good rain at least moderate rain and there has been a coupleel of reports and you can see it falls apart and the system is moving north. this is our cloud and rain forecast. there will be cloudy skies almost all day today and most of it will be in the morning and we will take you to 9:00 by noon you can see there are pockets and it's not solid. by 5:00 back towards monterey, it makes since, this is not a good system for the sierra nevada and by 10:00, we are done. if there is not a breeze, we may have to the storm track will move way to the north near the oregon california border so wind and rain, wind for

looking good and we had an earlier crash on the bridge, that has cleared, traffic is still backed up and it is backed up early this morning. you need to back up a little bit earlier just to stay on time this morning. and on the pass, a grand line road, that is now reported to be opening the two left lanes. that traffic still looks good to fremont. >> well we have the shakes here, wind gusting near the pass and some of the higher elevations are about 25 to 30 at some of the local airports. the good news, the system made it and there is nothing seven to ten days afterwards. we will have morning rain but i

will show you, right there. right along the peninsular along the santa cruz coastline, not good. the system splits and it will take moisture away. walnut creek starting to move up towards the area, there are some draw areas, down sloping wind taking the moisture right out of it. 59 degrees, san jose 57 and gusts of 32 miles per hour and we get the morning rain and the rain will decrease as the system slides towards southern california and the system is stretching itself. there will be light rain hanging around and that's given so we have 50s and 60s on the temperatures, some of the higher elevations after today that's it. it looks like mostly sunny

police officers, one person came home found a stranger in the house stealing. that is the most recent attack and it will probably not be the last. police are asking to keep an eye on the neighborhoods and so far none of the crimes have been violent and when they were found, the invader often runs away. president barack obama is hosting the second white house science fair and gel la is a senior from month it vista high school from cupertino. she won the grand prize in math science sponsored back in december. she was invited to the white house to show her exhibits on nanno technology to fight cancer.

but unfortunately it is splitting and you can see already a distinct edge and i will zoom in a little tighter, maybe i will maybe i wouldn't. hold on, that is really bad. that means the system is move losing a lot of its punch and we do see some occasional bursts of light rain. at least it is here, we have windy conditions, let's go to sal. we had an earlier crash on the upper deck of the bay bridge and since on the incline it has been slow getting to treasurer island and westbound, they had to turn the metering lights on extra slow and all of a sudden we have a back up. traffic is already beginning to back up there as well and it is

backing up on 80 so you need extra time for the morning commute. i think the system may be moving through where you are, right paul? >> that's right, it has been steady on and off, not so much right now but it is causing the wet slick roadways which has caused some overnight accidents. this looked a lot worse than it was and the driver made it out okay. he was talking the on ramp when he said his car hydroplaned. he may have been going a little too fast. >> as it was happening, i couldn't believe it. it felt fake to me at first, but i was upside down and i thought let me get up out of here before something else happens. really i was worried about somebody else coming to hit me. >> there is high wind warnings for the san mateo bridge and

numbers of oakland government employees and officials. this includes the mayor, city administrator and council members. well the long awaited appeals court ruling is now just hours away. supporters and opponents on same sex marriage are anxiously awaiting the big court decision. joining us from outside the federal courthouse, tara? >> well kind of a nail biter and we know today aerology may not stop here. we know that today's ruling is a very important step in the history of gay marriage. we spoke to one of two plaintiffs in the original trial here that challenged proposition 8 and that was the

voter approved, and a year before the judge struck down the proposition calling it unconstitutional. >> most of us believe it violates the u.s. constitutions basic guarantees of fairness. >> we hope the 9th circuit will uphold the vote of the people. >> further complicating the 9th circuit for the coalition conservative groups they believe it should be vacated. two mourn rulings will come down at 10:00 this morning and again we will go to appeals again. or it could end up in the u.s. supreme court, we will have to wait and see. tara moriarty, ktvu channel 2

news. again the proposition 8 decision, stay with us for continuing coverage and we will bring you that ruling as soon as it comes down. san francisco police are investigating a fatal stabbing at a homeless shelter. a 44-year-old man was stabbed in the chest, he died a short time later. he fled the scene and is still on the loose this morning. it is not clear what led up to that. they are now on edge after two women were attacked on campus. it happened just minutes apart. coming up, the reason students are being told now to lock their doors. and they are keeping hours and more intact and they are trying to stop late night

drunken violence. think want to move it back from 12:30 a.m. to 9:30 p.m. and it comes as business leaders discuss options to stop the recent violence once the bar is closed. >> we will be letting everyone know in the city we are a combined group and we are one. >> reporter: business leaders plan to meet again to discuss the problem. they will meet every month and discuss progress and any other issues that come up. bart will be taking bay area transportation leaders and reporters out on a tour. they will get a close-up look at bart cars and stations even the maintenance yard in hayward. there is a political motive, they are fighting budget cuts

. ktvu channel 2 news has just confirmed a newark police officer has just been shot. it happened a few minutes ago. he was taken to the hospital and we have no word on his condition and police are still looking for the gunman and we have a news crew heading to the scene and we will bring you the latest as we get it. here is a quick look at some of the top stories we are following. it is raining and we are on storm watch and the rain is causing some problems. overnight, a volvo flipped over after hydroplaining and as you can imagine give yourself extra time this morning. the long awaited proposition 8 is scheduled for 8:00 this morning and opponents and supporters are nervously awaiting the court decision. they will announce whether

proposition 8 violates the constitution. and three states have contests today in the republican presidential rate and colorado and minnesota have caucuses while missouri holds a nonbinding primary. union city is now under investigation. fires responded. this is video you will only see on ktvu channel 2 news. take a look at the flames, firefighters are working on it and fortunately nobody was in the building at the time and nobody was hurt. firefighters had to break down the restaurant's back door to get inside and that thick smoke created some visibility problems. >> the challenge is fast food but once you go in there, you have zero visibility and hose

lines are getting caught. it took about 20 minutes to put out the fire and it appears the fire started possibly in an addict above the kitchen but at this point it does not appear to be suspicious. president barack obama is returning money collected by family members of a mexican casino owner who left the u.s. while facing drug charges. he decided to return the donations from the brother who had skipped bail and has since been linked to violence and corruption in mexico. he may be getting closer to a nationwide settlement over foreclosure abuse. if approved, they will reduce the loan to 5 million borrowers. they would get checks and the banks involved wells fargo,

bank of america citigroup and chase. and stamford students, after two women were attacked on campus, a female student was walking through the kennedy grove area at 145 in the morning on sunday when she was tackled. a passersby saw the attack yelled and scared off the man. a man walked into an unlocked dorm room and climbed into a leaping woman's bed. police are now investigating whether these two attacks appear to be related. some downed power lines. >> yes, it has made for a messy commute and you can see utility crews are here, also a tree came down on the eastern side and this street is blocked and

they are keeping some of the crews are way from the problem. if you are in eastern san jose, your power or your friend's power may be on but some people in your neighborhood may not have power. let's move to the 880 approach to the bay bridge, still windy and it will be moderately heavy and when you get to the bay bridge toll plaza, there is a backup because of the crash. they are recovering because of the left lane westbound, that is gone, let's go to steve. some rain, into the lot, starting to ease back on the totals because the system is splitting and we have windy conditions across the board, everybody is in on that and our system continues to march forward and the main core is diving south and it is taking the energy out of it. and san jose, right back towards parts of the

peninsular, towards the san jose coastline, march right through there. that is not good. taking a lot of it away. it continues to taper off and does move north, and maybe three quarters of an inch and the wind will be around, gusts up to 50 miles per hour. three quarters of an inch, i have seen maybe a quarter or a third to a half. rainfall totals will start to taper off, a lot of mid-50s here, this will not do much as all. wind and rain, tapering off, breezy to blustery and the rain will taper off 50s and 60s and the rain today, that's it. yes, that's it and after that mostly sunny partly cloudy skies as we go to the rest of

the weekend. we have an update. breaking news from newark where an officer has been shot, allie rasmus has just arrived on the scene, allie, what do you know? >> reporter: well the information we have is very limited. we can show you, this is cruz landing in newark and you can see crime scene tape criss- crossing and it looks like a staging tent that officers have set up and i just got off the phone with the newark dispatcher and she confirms they did get a report at 550 that an officer was shot and taken to the hospital. we don't know if that officer is with newark police or with some other law enforcement agency but they are tied up at the scene and we can't ask them

more questions but i have called in and hopefully we will get more information. we can tell you it is completely blocked off to traffic and police are continuing their investigation. live in newark allie rasmus ktvu channel 2 news. time now 6:52, we have away area connection to a central valley plane crash over the weekend, assess in crashed outside of fresno. the 52-year-old pilot died on impact. the pilot stole that plane from the airfield and the real owner is an insurance agent. he told the television station he discovered his plane missing saturday but didn't know what happened and the faa called him after that crash. also tonight, alameda will get updated on reforms put into
