all right thank you rob. now we go to ken pritchett who tells us there was a wide range of reaction today. >> reporter: frank we are at the san francisco gay and lesbian center where a band is warming up and the stage is set for a victory party tonight. they are celebrating a victory that did not come with an easy solution but it's a victory nonetheless. >> what do we want? >> reporter: supporters waited anxiously outside the ninth circuit courthouse, many nervous about yet confident of the decision that would come down. >> this is thrilling. the court said it is constitutionally order. >> there's always disaappointment when you have judges overruling the will of the people. to protect the only institution

with their moms and dads but this was totally expected. >> reporter: after the ruling joyous gay marriage supporters marched to city hall to hear from city leaders and the audience, bruce ivy and david bowers. a couple of 31 year, legally married for the past eight before surge marriages were halted. >> we have literally followed this entire process, going to every court trial, every oral argument, every hearing. >> reporter: they know they are exstatic but they say they've noticed local opposition outside the courthouse ever present before was not there today. >> not one soul. >> there were no nasty signs across the street. >> reporter: the people we talked to today on both sides say they know they have a long fight ahead. in fact, supporters of proposition eight say they didn't expect it to happen in california they expect it to come in the supreme court.

we'll bring you more of this celebration here in san francisco which is about to get underway. back to you. lieutenant governor gavin newsom was the one who started the process of making same-sex marriage legal. he was mayor of san francisco when city hall began issuing marriage licenses for same-sex couples. >> i think fundamentally what's happened since 2004 is the human face has been put on the issue of discrimination as it relates to marriage equality in this country and i think it's changed the narrative. >> reporter: newsom from sided over the first same-sex marriages back in 2004 and again in 2008 when same-sex marriage was briefly legalized once again. lieutenant governor's newsom's reaction to this morning's decision was two

words, we won. newsom later added a tweet saying, it is a big day for marriage. >> reporter: in a statement senator feinstein said quote, i believe proposition eight was fundamentally wrong. it enshrined discrimination in our state's constitution and denied gay and lesbian californians to make the commitment to each other. as many expected supporters of the ban said they plan to appeal today's decision but first they have to raise some money. the legal defense fund writes that this decision came earlier than they had anticipated. the group says after a contentious and hard fought

year in 2011 it's resources are dangerously low. supporters also released a letter asking for contributions. the courage campaign institute says it needs $45,000 to defend today's decision. ktvu viewers have been weighing in on the prop eight ruling on our facebook page. fred says why vote for something only to have the courts overturn it. there was a reason people voted for prop eight in the first place. michelle wrote, this is just wonderful news. it hurts my hearts to think people can't love and marry who they wish. today's ruling won't take effect until two deadlines pass. more details now on what's next. backers have two weeks to appeal today's ruling to the full 11 judge panel of prop eight. and they'll have 90 days to do that. today's ruling won't take effect until those deadlines pass. be sure to stay with ktvu for continuing coverage on proposition eight.

you can also find more on today's ninth circuit decision by going to ktvu.com. there you can read the entire court decision on our website. we have breaking news. police say they arrested a man who shot federal agents in newark today. maureen naylor is here with more about the shooting and the arrest. >> reporter: the news came down about 4:30 this afternoon. police say they arrested a piedmont man with no criminal history and say he's accused of trying to murder an off duty agent who lives here and was found here outside his newark home where he lives with his wife and her daughter. the shooting happened outside the agent's home. the gunshots woke many neighbors. >> just, crack, crack, boom, boom. very quick right behind each other. >> reporter: evidence markers show where an off duty federal agent was shot once after a confrontation with a suspect. several neighbors who didn't want to appear on camera told us what they heard. >> some kind of scuffle, that

was what originally got my attention. and then within five minutes of that noise, so i would say about 5:30, 5:40 this morning. i heard three shots and then immediately after two shots. >> i heard someone say get down on the ground. after that they heard multiple gunshots. >> reporter: she says she saw a man wearing a white hoodie and baseball cap holding his leg limp away. police are not saying if the agent was targeted or if he used his work issued weapon to fire shots. >> i cannot give any information other than it's ongoing and we expect a successful collusion in this. >> reporter: the man is identified as a 61 year customs & border officer. he most recently worked at sfo. his family has asked that his

condition not be released. now police identified his attacker as another 61-year-old dennis bagwell. they say he was arrested during a traffic stop in union city. coming up at 6:00, what they are saying about the evidence found here that helped catch him. maureen naylor, ktvu news. the fast moving storm that hit the bay area this morning may be to blame for a large tree that came crashing down into a building in santa rosa. a eucaliptus tree fell on to the offices of summit. the managers of the business said he a -- the manager of the business said he arrived early this morning to find the damage. fortunately no one was in the building when that tree collapsed. a driver says he may have been driving a little fast for the slick roads and that's when his car started sliding then hit a curb and flipped over. the driver says fortunately he was able to escape and wasn't hurt. and in the bay area, storms

did cause trouble in the homes. it did little to eliminate fears we are facing a drought. rainfall totals are now historically low. >> reporter: well that is one reason why south bay water officials are so dejected, reservoirs such as lexington are well below average and our current dry spell is the area's worse ever. >> reporter: there wasn't much hope this brief rainfall would provide much relief. but the meager rainfalls barely collect on the camera lens. a big disappoint to water officials who say the small storm that blew in was more of an annoyance. the storm was still very active, causing about a dozen power outages in neighbors throughout san jose. this one at mckey road occurred after an old limb the came down on power lines. >> we have a second story, and we have the skylight so we can hear all that and the rain and everything.

the trial of the man accused of gunning down a father and two sons in san francisco continued today with the defendants brother-in-law saying drive by shootings were forbidden by the ms13 gang. edwin ramos is and alleged ms13 gang. today ramos's brother-in-law testified that drive by shootings were forbidden for all ms13 clicks because of the risk of injurying innocent bystanders. also today the judge dismissed a juror who had dosed often at times during yesterday's testimony. that juror was replaced by an alternate. tonight the city of oakland is investigating how hack were able to gain the addresses of

city council members everyone -- members even the chief of police. that information is already being abused. >> reporter: one council member said she got a phone call at 4:00 in the morning. this is everything the group anonymous has posted. it goes from dates of birth to home phone numbers to home addresses. some people on this list are more concerned about it than others. >> citizens of oakland, anonymous has been watching. >> reporter: just days after releasing this online video, hackers associated with the group anonymous have followed it up by releasing information of oakland city leaders including newly appointed police chief jordan. >> i didn't feel good about it but i know that comes with the turf. i've done all i can to protect myself and my family. >> reporter: jordan confirmed the hacking is under investigation and council member conohan says she's

already been targeted. >> i got a call from one at 4:00 in the morning and i ended up hanging up on them. it's a nuisance, but a phone call is not a threat to my security so i'm not worried about that. >> reporter: it says this latest cyber stunt is retailuation for the city handle of oakland protest. but council member ignacio de la fuente says the response is not enough. >> i think it is a red herring to say that that we are not standing strong. >> one council member noticeably spared in all this by anonymous was rebecca capland. anonymous thanked her for her

support. capland's staff re refused to make a comment. eric rasmussen, ktvu news. the stormer owner of a wine storage was sentenced for setting his wine storage on fire. prosecutors say he was trying to hide the fact that he sold 800 bottles of wine that did not belong to him. an investigator goes step by step how they made the case against mark anderson. owners of bar and grill at walnut creek is set to go before the city to ask council members to lift restrictions on selling alcohol. back in december, the city commission reduceed the hours the lounge can serve alcohol. the owners plan to appeal that

decision tonight. boy not your typical ending at the ski slopes in the sierra. take a look at the picture we have. a glider pilot was forced to make an emergency landing at a ski run. a pilot and two passengers took off and had to land right on the slopes. the resort wasn't too happy about it but the sheriff said no criminal charges will be filed and in fact, they say the pilot did as good a job to land in finding a low populated to land. >> the wind really never materialized. we had gusts up to 35 miles per hour but it was basically below criteria level. so the winds weren't really as strong as suspected. and the rainfall accumulation less than expected as well. we expected a half inch to an inch and a half in the north bay.

bay area weekend. i'll see you back here. there will be no criminal charges filed in a case in which a teenage hockey fan seen here was injured at a san jose sharks game back in december. the santa clara county district attorney's office today announced there's not enough evidence to determine who committed the act that resulted in the injuries or whether it was intentional or accidental. maggie herber said she suffered a concussion after a woman hit her in the head during that game. a plane that crashed in fresno was actually stolen here in the bay area. the evidence investigators found in that plane and what they say that evidence means. the vote is in, the decision that city leaders made about expanding the the plastic bag ban. the new service that lets you use facebook and linkin to pick who you sit next to.

san francisco is now set to expand it's plastic bag ban to all retailers and restaurants. they decided to expand the ban then to restaurants next year. currently only large grocery stores and pharmacies in the city are prohibited from hand out plastic bags. the new ordnance includes a provision that requires stores to charge customers 10-cents for paper and compostable bags.

flying the nation's skies will soon become safer and friendlier. the u.s. traffic control system is getting a make over. >> you don't realize half the time that you're not realizing without this technology. how many airplanes that are out there that you don't see and they're pretty close to you sometimes. >> reporter: the speeds switch up the switch from radar to gps technology. it requires all planes be fitted with gps technology. the change is meant to allow planes to take off and land closer together. >> you can get easier take off and landings without all the taxing time. you can get a more direct rout and save on fuel costs. >> reporter: the $63.4 billion bill funds the faa for four years. that is a big change from the past five years when the agency was funded through 23 gap

hours after a appeals court called prop eight unconstitutional, supporters are still celebrating. we're going to take you to the castro district. members of the american's rights are speaking out. the center says for 10 years the center has been the home where we can come to connect with each other and celebrate our victories. today is no different. this is the scene where ken pritchett was live at the beagaining of the newscast -- at the beginning of the newscast. you see people are speaking. it's a community celebration that's happening after the decision that happened right here in san francisco. inside city hall, dennis herr era held a news conference celebrating today's milestone for same-sex rights. he's been involved with the fight for marriage equality since back in 2004.

last year in the entire u.s. there was only one airplane that was stolen. on the campaign trail, three states are holding caucuses today. missouri, minnesota and colorado. today mitt romney stumped for votes in colorado. romney proposed budget cuts to the u.s. military. >> we should increase our naval construction from nine ships a year to 15. we should increase our purchases of f35s. we should add 100,000 troops to our military and we should finally give our veterans the care they deserve. romney has a strong lead in the polls in colorado but is trailing slightly to rick santorum in minnesota. recent polls show santorum in second place in colorado.
