marriage. >> for so long, gay and lesbian couples, families, and kids have endured discrimination. brick by brick, these walls of discrimination are being dismantled. >> reporter: proposition 8, the voter approved ban, is unconstitutional. >> in this country, we do not put basic civil rights to a vote of the people. and the court of appeals came through as the district court before it had done and said is this not america. >> reporter: but the decision immediately drew the ire 've those opposed to gay marriage who said it was un-american to deny the rights of voters. >> there's always disappointment when you have the judges overruling the will of the people. >> reporter: another appeal is expected.

romney came in second in missouri followed by ron paul, gang rich was not on the ballot. and the third caucus is in colorado. and during the past half-hour, the lead has been going back and forth between santorum and romney. santorum now has a small lead over romney. gingrich and ron paul trail with a total of 14%. >> biggest number for a single day in the gop race. rick santorum claimed he's the conservative candidate republicans need. >> claiming to be the conservative alternative to mitt romney. i stand here to be the conservative alternative to barack obama. republican candidates. romney leads. gingrich has 32 delegates, santorum 30, and ron paul nine. eleven 44 are needed to win the nomination. new video of a house explosion in san francisco's merced heights neighborhood. firefighters tell us the explosion happened shortly after 8:00 inside a house on capital avenue. the blast blew out the windows. there was a brief fire. and so far it does not appear that anyone was injured. a 61 year-old man from piedmont is under arrest accused of shooting a federal agent outside his home in newark earlier this morning. it's not clear if the two men knew each other. >> reporter: newark police say the arrest comes after an early-morning shooting outside

sammy writes if the church wants to -- we always hear keep religious out of government. well it goes both ways. the government should stay out of the church's business. share your opinion, follow ktvu channel 2 news on facebook. police are putting out a list on the city's most wanted. authorities today released these photos on some of the people they believe are committing violent crimes. this comes after a surge in violence in just the past week there have been 20 shootings in oakland that left five people dead and a number of others injured. oakland police also showed off today some of the guns they've recovered after they were used in crimes. they say much of the violence could be related. >> there's a few linked to two rival groups in west oakland. we need the community to step

forward with information on these acts of violence. we are learning new information tonight about a small plane crash in fresno that killed the pilot. as alex savidge reports the aircraft had been stolen from buchanan field and some say the theft wasn't that hard to pull off. >> reporter: the 1980 cessna airplane was a mangled mess after it crashed outside of fresno on sunday. the man at the control was killed on impact today he was i.d.ed as 52-year-old ray pierro. he stole the plane from buchanan sometime over the weekend. >> people steal planes. >> reporter: the rightful owner, felix johnson could not believe it when he got the call. >> he asked me you know your plane has been in an accident. i said no it should have been up here. >> reporter: even though they had 24 hours security, pierro just hopped this chain link

fence, hot wired his plane then took off. there are reports pierro first flew to stockton where he landed, bought food and then took off again. >> so like a teenager, let's steal this and go joyriding. >> reporter: after the crash, boston took this photo of the altered tail number on his stolen plane. an ntsb investigator told me today pierro was not a licensed pilot. he clipped some power lines prior to the crash. pilots are now worried about security. >> if someone wanted to get on an airport, they could get on an airport. >> reporter: according to a nonprofit aviation group, fewer than 10 planes are stolen in the u.s. every year. alex savidge, ktvu channel 2 stphuz. retailers in san francisco will no longer be allowed to hand out plastic bags coming this fall. the board of supervisors today voted to extend the current ban to all retail starting in october. then next year the ban will

include all restaurants. currently the ban only applies to chain grocery stores and pharmacies. it also includes a provision that requires stores to charge 10-cents for a paper or compostable bag. pressure testing is complete for all of its urban pipelines. crews began their tests today on 2,000 miles of pipelines in populated areas of northern and central california after that deadly san bruno pipeline disaster in 2010. testing will now begin on pipelines in remote areas. in that weather system i've been tracking has moved through the bay area. brought rain last night. is practically out of here. we head into a spring like weather pattern it's going to warm up. daytime highs tomorrow are going to be a good 10 degrees warmer. these are the highs from today.

after she fell asleep during testimony yesterday. she's been replaced by an alternate. ramos is accused of killing anthony bolonia. prosecutors describe him as an enforcer for the ms13 gang and that the shooting was a case of mistaken idea. the trial is expected to last for several months. an executive with the susan g. komen breast cancer chairman resigned today amidst a funding controversy. this morning, karen handel announced her resignation. she said she supported komen's decision to cut off funding for planned parenthood. the charity then reversed the decision amidst public relations backlash. a plan to offer a big break at state colleges and universities. plus the stiff sentence for a bay area man who set fire to a major warehouse that was storing millions of the dollars of fine wine.

this was the frightening scene that confronted fire crews this morning when a two alarm fire broke out in a two story apartment building. one mother had to lean out of a balcony to lower her baby to a firefighters after she and four children were trapped upstairs. and this helmet cam video shows the conditions inside the apartment on macelo street. firefighters were able to rescue two children.
