intimidate here. another protest is scheduled for next week. and members of oakland's asian, chinese and asian- american communities called on the occupy protesters to seek peaceful ways to communicate the message, they say they want a strong, positive message, but can't tolerate the violence. they say it is very hard on the elderly who came from situations of war and chaos. >> they hear the helicopters, the sirens, and all the activities that they saw. and they're seniors, it just reminds them of many, many bad experiences. and many of them express they have issues, physically and mentally. >> others say they have lost business, and a sense of security since the protests began. coming up at 5:30, our eric rasmussen will take a look at how others react to the protests and what they hope to hear from the mayor in the

state of the city address tonight. and major development regarding the violence case against mirkarimi. we learned why mirkarimi will finally be able to see his young son again. >> reporter: well, frank that is right, with the domestic violence case just days away, the sheriff scored a victory, one that lets him see his son. >> i get to see my son, and i can't tell you how excited and grateful i am. >> reporter: the sheriff, ross mirkarimi, won the visitation rights with his son, after being barred from seeing him on january 13th, after he was arrested on domestic violence charges against his wife, lopez, today, a family court judge granted him visitation rights. >> in times that we were separated, just so i could get through, i bought little books and toys like this little fire engine. i couldn't buy a sheriff's car.

>> reporter: and the supervision will be arranged by an adult cousin. he can see his son for two hours each weekday, and up to six hours on the weekend day. >> it will be a surprise for him. >> reporter: a criminal restraining order bars mirkarimi with contact from his wife. the attorneys deny any abuse took place. prosecutors will say it is different. there will be testimony from a former girlfriend of mirkarimi, showing a common pattern of violence. today, they say they're focused on the son's well-being. >> well, i have to say that i am extremely happy that theo will get to see his son. >> and now i want to be re- united. we're doing everything we can to make it happen and just make this absolute nightmare go away. >> reporter: the attorney prosecuting mirkarimi also came to the court hearing today.

the attorneys called it inference, they are making sure the sheriff is still barred from contact with his wife. reporting live, david stevenson, ktvu channel 2 action news. and a federal prosecutor will file new charges against a former danville police officer who is already facing prosecution in the scandal involving charges they say a private investigator paid him with drugs and guns to make the arrests. the federal prosecutor says the new charges will be filed before his next court day on march 20. and the unrest in syria is intense tonight. the country is seeing the worst day in almost a year since the uprising began. and while a lot of the video we have seen coming into the news room is just too graphic to show you, we can show you these pictures. and you're about to see what is happening in the city of homes, apparently in ruins, we're told

beginning may 13th in santa rosa, the bikers will go through bay area cities, including san francisco, danville, wa lnut creek, among others, they head south through sonora, clovis and bakers felted. and a group gathering outside blue shield in san francisco, they say next month blue shield will raise rates on more than 20,000 people by 15%. and the group claims that blue shield has a 3 billion surplus, consumer watch is collecting signatures for a november initiative, requiring them to disclose and justify the rate hikes before they take effects. >> blue shield's increases have just been so high. for me it has been 346% since 2005. and that is for a very, very

dividend of eight cents on common shares as reported. and california and new york agreeing to sign on to a proposed legal settlement with some of the nation's biggest mortgage lenders, some of the news organizations quote sources close to the deal, including bank of america, wells fargo, j.p. morgan chase, citybank and allied financial. they have reportedly agreed to pay 25 million to help people in trouble with their mortgages, in exchange from immunity of a narrow category of lawsuits regarding foreclosure papers. however the door would still be open for other litigation. and stocks back in positive territory today. they came as they appeared to close in on the cost cutting deal, to avoid defaulting. still, the dow added 5 points, nasdaq up by 11.

fluid. >> reporter: but we learned investigators are looking at the possibility this shooting may have been over some personal matter. authorities are not releasing his name, saying only he was stationed at san francisco international airport, working for the u.s. customs and border protection agency, and that he is in the hospital with three bullet wounds. >> he is in guarded, critical care. we're thankful he is still with us. >> reporter: bagwell worked in this apartment complex in oakland. he appears well liked by tenants and neighbors. >> he is a very kind, understanding person. i don't know what the incident was. but -- i have only found him to be very nice and honest. >> honest. >> he works a lot, i know, he would go teach and during the day he would be here up until 2:00, sometimes working on projects. >> reporter: dennis bagwell is scheduled to appear in court in fremont tomorrow afternoon,

where he is expected to be formally charged with attempted murder. reporting live, union city, rob ross, ktvu news. and police say a drug manufacturing operation appears to have set off an explosion at a mom home in san francisco last night, sending both a woman and a boy to the hospital. police say they found drug paraphernalia inside, saying that somebody was using a butane tank to manufacture the drugs, when it blew up in the home. the parents took a woman and 12- year-old boy to the hospital. officers say the woman could face criminal charges. and fog blamed for a crash. 31 vehicles were involved in 11 separate collisions near scaggs island road, early in the morning. they shut down the highway to make way for emergency

vehicles. the drivers suddenly came to a halt due to the accidents. >> traffic just stopped completely. and -- the only choice i had is going into the river i guess. >> the cars were all stopped. i pulled to the side, the lady in back of me hit me and pushed me into the car in front of me. but then i could just hear a lot of crashes. >> officers said it appeared that all the injuries were minor. now the chp also issued fog advisories for several bay area bridges this morning. it looked like this at the toll plaza right at 8:15. fog slowed here and on other bridges as well. other bridges were included in the advisories. and weather creating magnificent but also dangerous conditions along the pacifica shoreline today. that is what the surf looked like earlier today. some of the waves came crashes down on the end of the peer. and with the folkses getting

closer, the peer was later shut down. two men who had enough of fishing were surprised to see the waves. >> we hoped this morning when we came out here, it was pretty much evident that we were not going to do anything today. >> reporter: surfers also avoided the area, moving to the more sheltered cove down shore. we have more postings on the report on our home page. and what the fog did to others, let's talk to bill martin, this is what you talked about yesterday? >> yes, waves, fog, the fog is coming back, we'll see more valley fog tomorrow morning. and out there when it happened at 37 by black point and going over towards sears point, that is a low-lying area, there is a lot of moisture. the dew points get high, you get a lot of fog formation with low visibility, let's take a look. there is the area, this is one area, but i mentioned this last

night, you know the areas that are similar to this, but this area is famous, low-lying, marshland, cool temperatures, low lying, a lot of moisture, you get fog right down on the ground. that is what is happening again tomorrow morning, i don't think it will be as widespread as it was this morning. but again, dangerous conditions in the central investigate, they are call it fog, radiation fog and valley fog, all the same thing, a function of light winds, lots of moisture at the surface and very cool nights. so tonight, cool temperatures, at which fog well form. mainly in the upper 30s, mid- 30, tonight, 37 degrees in santa rosa, dew point temperatures at 37 degrees, you will see fog. anywhere that the dew point temperatures met, fog will form. and that is why i discussed fog out towards fairfield, antioch and livermore. and when you are used to driving in it, you go oh you know what you're doing. but all of a sudden the visibility, if you are in a low-

lying area, you can go from maybe a dozen yards or 30 yards or so down to 10 yards because the fog drops low, in a shallow area, so be ready for it. a wake-up call for all of us. we talk about it, but it is brought to light in a situation like this morning. dense visibility, not as dense as this morning. but the fog will be there early in the morning. and last night there was fog forming in santa rosa as early as 10:30. so the fog will already be in place. when i come back we'll look at the overall forecast, a few sprinkles in the five-day forecast. i'll tell you where it is. we'll look at the bay area week, and chinese new year is around the corner, we'll have that on channel 2 action news. and we'll get you straight with the weather forecast there. the internet is buzzing with sightings of an alleged water monster, you may call it iceland's very own version of the lochness monster.

some way. again, this intersection is groveway and center street in castro valley. that is closed, the investigation is just starting, we'll have updates and stay on top of the story. a federal appeals court today said that a stanford student can sue the government as she was mistakenly put on the no-fly list. she had gone to a conference in january of 2005. on her return she was detained for a day at sfo. ibrahim has since been stopped from flying to the u.s. because she is on the government's no- fly list. a lower court threw out her lawsuit, claiming her constitutional rights were violated. but today, the ninth circuit court of appeals overturned the decision. coming up later, a new program launched at sfo, looking at how frequent fliers can move through security more quickly.

that san francisco is the greenest city in america. they say the city's clean taxi program not only met the goal to reduce the emissions by 20%, but more than doubled the goal. >> we have exceeded the 20% goal and now have a 49% number. >> reporter: with an increase in taxi cabs, newsom listed the benefits as lower gas price photo drivers, lower maintenance costs for companies, and cleaner air audio . and house democrats announcing legislation to make the fruit juices safer, establishing the same limits on lead and arsenic that were to be in drinks. the report followed that 10% of apple and grape juice samples found 10% more lead than in bottled water. >> i can't give up my pure

. complete bay area news coverage, starts right now. this is ktvu channel 2 action news at 6:00. good evening, i'm julie haener. and i'm frank somerville. we begin tonight with developing news at this hour, right now news chopper 2 is over castro valley, where there has been an officer-involved shooting. we first brought you this about a half hour ago, and here is what we know as of right now. according to the alameda county sheriff's office, a suspect was shot at the intersection of grove and center. we watched as a man was loaded onto an ambulance, we're also told that an officer was injured. our noel walker is heading out to the scene right now. and to update you on the situation we have been following in hayward. sa
