news chopper 2 is first on the scene in castro valley where police open fire on a driver after an officer is pinned between two cars. good evening, i'm julie haener. >> i'm frank somerville. a police shooting tonight in castro valley, involving officers driving unmarked cars. we've learned one of the officers was injured after being pinned between two cars.

the investigation is still underway as we speak. >> reporter: investigators have set up light to help them collect evidence. it's sandwiched between two unmarked silver police cars. the alameda sheriff's department responded to a shooting here at this intersection. investigators say two berkely police officers were trying to pull over a driver in the red mercury. >> decided to take that suspect into custody. during that time, the suspect backed his vehicle, which pinned the berkely police officer between the suspect vehicle and the unmarked berkely car. >> reporter: sergeant nelson says the berkely officer suffered serious injuries to his hand and leg while he was pinned between the vehicles. about an hour ago, this woman approached us and told us the suspect is the father of her daughter and identified him as

steven moore. >> he probably didn't know it was the police at fir. he's not a violent person, so i know he did not try to hurt that officer, and i know they should not have shot him. >> how serious is the suspect's condition? >> we don't know at this point. i haven't gotten any updates from the hospital. anytime you have a gunshot wound, as we all know, you never know. >> reporter: crime lab technicians are here to do what's called a lika scam. which is a 360-degree picture of is this scene. >> we kind of freeze the scene until that's done then we pick up the car and all the things around. >> reporter: investigators have not said why they pulled over the car. i'm told moore's children are still waiting for word on their father's condition. investigators say they plan to be here for hours. reporting live here in castro valley, amber lee, ktvu, channel 2 news.

the highway patrol is cautioning bay area drivers tonight after heavy valley fog contributed to a series of chain reaction crashes in the north bay. 31 vehicles were involved in 11 separate accidents along a stretch of highway 37. we have team coverage tonight. chief meteorologist, bill martin will tell us if the fog will reform overnight. but we begin with ktvu's john sasaki in solano county and the one thing you need to do when uncovering heavy fog. >> reporter: that is an on ramp, just two miles from the scene of this morning's pile ups. more fog on the way could make the roads treacherous once again. the highway patrol is always on the lookout for dangerous driving conditions. including the kind of fog that led to this morning's pileups. >> we've never had anything remotely involving that many vehicles out here, especially on 37th. >> reporter: just before 8:00

this morning, heavy fog settled on highway 37 dramatically reducing visibility, and leading to a series of crashes. >> it was very foggy. you could see maybe 20 feet? >> at about 50 miles per hour, 45 miles an hour i was on top of the cars before i could see them. >> reporter: one after another, vehicles crashed into each other. >> the lady in back of me hit me, and pushed me into the car in front of me, but then i could just here a multitude of crashes in back of me. >> traffic just stopped completely, and the only choice i had is going into the river, i guess. >> reporter: officer rick bondersmith says it's always up to the drivers to say safe. >> in you're presented with that scenario, you have to make sure you slow down quickly. you should take caution in

moving forward. >> reporter: at a vallejo station, drivers say they are wary of fog. >> luckily, most people on the freeways slow down quite a bit. >> reporter: the chp says he found 37 calls for seven hours. and fortunately, no one was injured in this morning's incident. we've got valley fog back in the forecast tonight. conditions are not as severe as they were last night. not as much moisture at the surface. fog will reform. let's go back to the area around highway 37. this is an area where you certainly do expect valley fog. we've got light winds blowing tonight. lots of moisture at the surface. dew point temperatures in the area are 45 degrees. the temperature 47 degrees. when the temperature drops two more degrees, you're going to have fog. so fog back in your forecast tonight. we could see it issued late tonight and early tomorrow

morning. we'll run the computer model that shows you where that fog is going to be. new at 10:00, a round of job cuts in contra costa county, about 450 bank of america employees in concord received layoff notices today. the bank notified employees. the bank plans to close its fraud and claims unit and customer service center in late may. bank of america says the action is designed to consolidate operations and reduce their costs. after months of resisting, there is word that kamala harris has signed onto a proposed settlement with the nation's biggest lenders. harris was a hold out. the banks were accused of improperly processing documents and failing to provide mortgage modifications. the settlement is expected to total about $26 billion. we've learned harris is set to make an announcement tomorrow in los angeles.

skeeter at oakland's city hall was unusually tight -- security at oakland's city hall was unusually tight. the mayor's comments, the security precautions and the one topic the mayor never touched. healther? >> julie, it was the pink elephant in the room. jean quan did not address the occupy oakland movement. instead, tried to shine a positive light on a city that faces many challenges. >> oakland is on the rise. >> reporter: mayor kwan used that optimistic statement to kick off her state of the city speech. >> our economy has created 5,000 new jobs in the last year. those are just the ones that we could document. our unemployment is down by 2%. >> reporter: she said sales tax revenue is up, so too is the number of building permits

issued. and the city now has money in the bank and a balanced budget. >> we reorganized the city, we cut out layers of administration. >> reporter: the mayor did not acknowledge the occupy oakland movement, which has cost the city millions and sparked recall efforts. that left those to watch the speech in a separate room. scott olsen was injured from a clash between occupy protesters and police back in october. >> i don't think mayor kwan has the guts to face me or the occupiers or the city in general. >> reporter: kwan did address crime in the city, saying the number of homicides has to be reduced. >> it's noble, it's doable. it's something that we must do as a city. and if we do it, if we do it,

we will change the cycle of violence in the city forever. >> reporter: security was beefed up after occupy oakland protesters threatened to disrupt the mayor's speech, but no problems were reported. reporting live tonight here in oakland, heather holmes, ktvu, channel 2 news. in oakland's chinatown today, a call to occupy protesters. no more violence. seniors in chinatown have lost a sense of security since the occupy protests began. community leaders say the demonstrations are especially hard on the elderly. some of whom moved here after leaving situations of war and chaos. >> they hit a helicopter. the sirens, and all the activities that they saw. just reminding them, many, many bad experiences. many expressing, they have deep

issues physically and mentally. >> the protests have greatly hurt business right in the middle of the chinese new year's celebrations. now to the race for the president. a fresh start for rick santorum after he won two republican cusses last night. he -- caucuses last night. he raised more than a million dollars today. in texas today, santorum stressed his conservative credentials, but criticizing yesterday's prop 8 ruling, around attacking supporters of same sex marriage. >> they want their world view to be imposed without question. if you question them, you're haters, you're bigots, and you should be, as a result of that, ostracized from the public square. >> santorum is planning a weekend of fundraisers in california, there's no word on where exactly he will appear. >> congratulations to rick santorum on a big night. but we're looking forward to the games ahead. we think we're going to pick up

the delegates. mitt romney went on the offensive. during campaign stops in georgia, he outlined why voters should endorse him. romney called them the kind of republicans who act like democrats. there is new information about the bay bridge construction project. caltran has reportedly set a target date now for the grand opening of that new eastern span. according to sf gate, they said the new span will open next year, either on, or just after labor day. the section of the bridge east of treasure island was declared seismically unsafe 20 years ago. the price tag is more than $6 million in all. plans for the top deck of the bridge to be closed during

majority are from east palo alto. maureen naylor, ktvu, channel 2 news. new information on the suspect of a shooting in newark. authorities say 61-year-old dennis bagwell will be charged tomorrow with attempted murder. the optician and apartment manager is accused of shooting the custom's officer. investigators say the motive may have been personal. the unidentified agent is hospitalized with several gunshot wounds. carlos guzmangarza has pleaded not guilty to performing liposuction without a medical license. a second woman accused him of inappropriate sexual contact. the san francisco d.a. today filed new charges after a third woman claimed he also touched her inappropriately.

there is a major shakeup at diamond foods of san francisco. the company put its ceo and chief financial officer on administrative leave. the reason is walnuts. an internal investigation found the company improperly accounted for about $1,800 in payments to walnut growers. stocks dropped 42% in afternoon trading. the dow gained 5 points and closed at its highest level since may of 2008. one thing holding the market back is talks stalled on greek's debt issues, because of cuts to pensions. facebook revealed detail basis the pay of top executives in amended paperwork for its initial public offering today. it says mark zuckerberg will earn a half million dollars a year in salary.

is poised to become the seventh state to legalize same-sex marriage. >> bill 3269 is declared passed. >> the washington house voted 55-43 to approve the legislation following two hours of heated debate and the governor has promised to sign that legislation into law. one of the 14 california same sex couples who sued to overturn prop 8 is getting a divorce. robin tyler and diane olson got married during the period where same-sex marriage was legal in california. but the two filed for divorce last month. tyler said her marital problems were no different than those faced by straight couples. we now know how much gold was stolen from the courthouse last week. it works out to more than $608,000. this surveillance video was

taken february 1 when thieves broke into the courthouse and took the gold from the display cases there. a man suspected of stealing copper and brass fixtures from two contra costa county cities was arrested. he was arrested after a metal recycler reported him. he is accused of stealing fixtures in pittsburg and antioch. the family of a 73-year-old san francisco man who disappeared and died last year has now filed a wrongful death lawsuit. he was missing for ten days last february after taking a shuttle bus to his assisted living facility. his family says he was dropped off at the wrong location, left standed in the cold, and left wandering for days. he had died from hypothermia. >> they had a substitute driver who didn't know the route,

didn't know where he was going to be dropping off his client and didn't really speak the language very well. and that resulted in gross negligence. >> the lawsuit names met sam enterprises, it's driver and jewish family and children's services. they have all refused to comment on the lawsuit. several dozen parents, educators and students rallied outside the oakland meeting tonight. they say it's unacceptable the district is planning to close five elementary schools at the end of the school year. parents from lazeer are calling on the district to convert their school in a charter school. the district says the closures will save $2 million a year. chargers are dismissed in contra costa county, but that doesn't mean four former officers are free.

about an explosion in san francisco. the blast shattered the windows of the home on capitol avenue. we now know a 33-year-old woman and a 12-year-old boy suffered burns. they took themselves to the hospital. they suspected a drug lab. today, police confirmed they did in fact find drug paraphernalia inside. and that woman now may face criminal charges. in alameda county, authorities are investigating a man's death in an unincorporated area of hayward as a homicide. the body of an african american man was found near hampton road and western boulevard, just after 7:00 a.m. today. the remains were near bart tracks in an area known for homeless camps. so far, the man's identity is not being released. a judge in contra costa dismissed four officers involved in the scandal.

but that does not mean they're off the hook. all for men will be prosecuted in federal court for numerous felonies. and could still face state charges. in news of the world tonight, in syria -- government forces shelled the city of holmes, targeting neighborhoods where opponents live. activists say at least 50 people were killed. the european union is preparing to impose harsher sanctions against syria. this as russia is trying to resolve the crisis. in germany, europe ordered inspections of all airbus a380's. airbus has developed repair kits and insists the super jumbo jets are safe to fly.

this new order includes all 68 planes currently flying for seven different airlines. in antarctica, russian scientists have drilled into a fresh water lake more than 12,000 feet below the surface. they say the water could hold tiny organisms locked in the dark for years. there are some fears they could contaminate that lake. the office building behind me has been vacant for two years, but a just revealed tenant has the city of sunnyvale cheering. the chance for showers in the coming days. a south bay city is hoping to get a much needed boosty a new tenant moves into a vacant building. >> julie, there's no familiar logo yet on this building. >> reporter: but we're told apple has signed a lease to move 400 employees into the five story building. the development is called the sunnyvale town center. last year, wells-fargo foreclosed on the property. locals welcome the apple presence. >> i think it's going to help the community, to at least not see an empty building. >> reporter: the new housing units are vacant, and the area has had to put up with construction for the past eight years. last year, nokia moved in with 500 employees. target built a store on the property.

>> with apple taking a building there, and putting their name in sunnyvale, i think will help attract other businesses. will help get this thing going. >> how long apples stay in sunnyvale is unknown. apparently apple has run out of space in cupertino. the sunnyvale town center offers a nearby caltrain station. macy's is a main stay of a shopping center in transition. and murphy avenue is a historic downtown that now has a future. >> a couple years ago, it was pretty bad. people couldn't even come down here because the streets were torn up. >> now the hope is more people will fill the bars and restaurants and shop in the stars. this dash restaurant is adding a patio dining area, anticipating more patrons. >> space you know, if apple is doing good, you feel the ripple effect everywhere. >> reporter: the word is that apple will move in some time

after july. live in sunny value, lloyd lacuesta, ktvu, channel 2 news. google is facing an old foe in a lawsuit. c net is reporting that the electronic privacy information center, or epic, has filed a lawsuit against the federal trade comission to block the changes. the lawsuit filed by epic over google's email policies was settled last year. epic says google's new privacy policies would violate that agreement. arnold schwartzenegger is returning to his roots as a movie star. he's teaming up with sylvester stallone in the tomb. it features schwartzenegger and stallone, both as inmates, with stallone designing an escape. the film begins shooting this spring. children from all around the bay area were treated today to one of the world's most

popular musical performances. ♪ [ music ] opera san jose staged a free performance. about a thousand students from 16 schools packed into the california theater. the performance was a dress rehearsal before the show opens this weekend. it's also part of the opera san jose's k through 12 school outreach program. waiting on fog out there. early this morning, we had problems on highway 37. fog should reform again tonight. dew points are high. i don't have reports of fog yet, but it will get here. we go outside and i'll give you the spots. certainly toward the davis area. that causeway coming across toward sacramento. fairfield, antioch, and up into the north bay. valley fog up in the forecast. that is the main thing that will impact you tomorrow. look for fog early morning, especially in the spots you had it this morning.

clears off early. here's what changes. it's going to be warmer tomorrow than it was today. temperatures tomorrow, upper 60s, maybe pops in the low 70s. tomorrow, looks like a really nice day. your bay area weekend, clouds come in, maybe a bit of a sprinkle. just know that the main impact will be temperatures will trend down a little bit. we go outside, a big ridge of high pressure sets up for tomorrow. then again as we get into friday it starts to break down. that's when the clouds will come in. patchy fog, warmest day of the week will be tomorrow. this high sort of weakens enough, that the weather system moves in off the pacific. it's a weak one. it gets here friday in the morning and afternoon. the clouds increase. a light chance of sprinkles. what your going to probably see from this will be drizzle sprinkles. the morning commute should be dry. the afternoon commute should be dry. but there will be the partly

the seventh annual amgen tour of california. the elite bike race begins on may 13, and wraps up may 20 in los angeles. the first three leagues are here in the bay area. riders will visit several cities, including san francisco, san jose, and livermore. for the first time, riders will be peddling up mount diablo. the race heads northeast to seattle, big bear lake, and beverly hills. mark joins us now. it was a rough night tonight for the sharks. >> i don't think it's anything to get too worked up about.

the sharks at this point of the season, topping the standings, headed for the playoffs, but they go into these little funks. they played with no urgency at all tonight. there's a guy that played relentless, and reckless style. owen nolan. once again game started, he did not bring a lot of luck. they had to come from behind all night. joe thornton to the other joe. pavelski. now a 2-2 tie. in the 3rd, hat trick game for him. bad turnover by the sharks. and a real shoty play right there. it cost them dearly. 4-3 final. san jose on the short end. a great promotion in the nba tonight back in chicago.
