9th. topping our news, one police officer and one suspect are in the hospital this morning. that's after a police shooting. the violent incident involved undercover officers from berkeley. we are live and paul, you just spoke to the suspect's former girlfriend. what did she have to say? >> reporter: we have been trying to get information from the hospital all morning. the exgirlfriend told me that he had successful surgery last night. this is what we know about this incident. the sheriff's office investigators tells us that he was involved in a police officer-involved shooting yesterday around 5:00. at the intersection of center street and grove way. investigators say two berkeley police officers in unmarked vehicles were trying to pull him over when he backed his vehicle up and pinned one of the police officers between his car and the police vehicle. that's when another police officer shot the suspect. his exgirlfriend says she is

unclear why he was shot. >> he probably didn't know it was the police at first. he's not a violent person, so i know he did not try to hurt that officer. and i know they should not have shot him. >> reporter: now i can tell you the police officer pinned between the vehicle suffered serious injuries to his legs and hand. and his brother came up here on the scene and we will talk to him and get new information and bring that to you as soon as we possibly can. i was told by his family that they are not allowed to see their brother. they found out that he is okay and he will survive. we will bring you the latest after i talk to his brother in a few minutes. ktvu channel 2 news. overnight, underground electrical problems kept crews busy. neighbors reported hearing two explosions about an hour and a half apart at the intersection of 10th. when firefighters arrived, smoke was coming from a

manhole. power was knocked out for 37 customers for almost an hour. the cause of the explosion and power outage is still under investigation. your time now 7:02. a fire left six pets dead and their owner was hurt trying to rescue them. the fire started at a house on king street just after 11:00 yesterday morning. four dogs and two cats were trapped inside. one of the residents suffered burns. investigators say they did find a marijuana growing operation inside the house. but they're not sure if it caused that fire. well all lanes of 580 are back open now. following a rollover accident there. it happened about two hours ago. just before the grand avnue exit. chp rushed to the scene after a silver crashed and ended up on the roof. some people were hurt. they were taken to a nearby hospital. 7:03. the obama administration is

taking a lot of heat for a new rule that would require all employers, including religious schools, hospitals and charities to offer birth control to their employees. the catholic church and republicans call it an attack on religious freedom. coming up 5:79:15, -- up at 7:15, signs the white house may be looking for a compromise. a federal study is out that says it could cost about a billion dollars to increase the size of the lake, but the price is probably worth it. a study found that adding almost 19 feet to the dam, is a feasible and economically justified. the san francisco chronicle reports that would increase the capacity by 14%. but it would also require moving building, camping spots and resorts. and there's opposition from the indian tribe which is concerned that some cultural and religious sites might be

at 8:00, we have josh and a lot of different people. they'll come through here, over to the driving range. they literally just drop them off. and one thing we noticed, people come out because of the accessibility. you see the volunteer, we talked to a couple of them who just come out for the experience of it, to be here, to be a part of this. and as the golfers walk through here, people bring up autographs and things and it is really a great event because of that reason. take a look at the view from where we are standing. we have covered the event for many years and often times we are standing in damp, wet, cold conditions. not the case today. a gorgeous day. and that's expected to help attendance. if you wanted to come, there are still tickets. $60 today. $150 gets you a pass for four days through sunday. and we are going to keep an eye out on things out here. and over the next hour, things start picking up and a lot of

that they saw the suspect commit several traffic violation, but he sped off when they tried to pull him over. a good samaritan saw police chase the suspect, he brand his arms around his waist and pulled him off the bike. police arrested the suspect and found bolt cutters on hip. -- on him. traffic is getting busy. >> yeah, heart of the morning commute as you know. and if you're just about to leave the house, you know what you're getting. you know, have to leave at this time every day, you will see this at the bay bridge toll plaza. backed up for about 15 to 20 minute delay. no problems on the upper deck into san francisco. lower deck of the bay bridge looks good. this is a look at interstate 880. this does not get busy until later on. if you want to jump ahead of the crowd north into downtown oakland, it's a good time to do that. peninsula, traffic looks good

well, thankfully, most of the fog is getting wiped out or chewed up. and that's good news. we will end up with season shine and warm weather. go find your place in the sun today because it will be mild to warm, 60s to near 70 degrees. it is 7:13. a driver filming a car commercial had a close call with a deer and it was caught on tape. we're going to slow it down. there it goes. the video was filmed on the set of the commercial and it was posted on a website. it shows the driver on a closed course when out of nowhere, a deer jumps in front of the car. luckily, the driver missed the animal. that's happened to a lot of us. republicans in congress will try to overturn president barack obama's controversial requirement that employers, including catholic institutions provide birth control.

this has ignited a heated battle. >> reporter: that's right. republicans here in congress and catholics across the country say it's about religious freedom. president barack obama seems to be standing firm for now, but a spokesman says the president wants to work with the concerned parties. the rule does not take effect until next year, but the battle is raging here at the capitol. >> this has nothing to do with contraception. this is about whether or not the government should have the power to have a faith-based organization that they have to pay for something that they teach members shouldn't be doing. we are here to stand up for the women of america. who deserve to have access to free preventive care through their health insurance. and we want to thank president barack obama for making that possible. >> reporter: now california is one of 28 states that already requires employers that offer health insurance provide contraceptive coverage. but the arch bishop of san francisco is still urging local

catholics to make their views known to lawmakers here on capitol hill. reporting live from washington, d.c., ktvu channel 2 news. >> as you heard her say, san francisco's arch bishop has written a letter. it's going to be given out at all masses this weekend. in the letter, he calls the new rule on birth control, and i'm quoting, an alarming and serious matter that negatively impacts the church and the united states directly and that strikes at the fundmental right to religious liberty for all citizens of any faith. unquote. he encourages people to email or write the white house, calling for the reverse of the regulation. the pentagon is changing its rules to allow women to serve in more jobs closer to the front line. under the new rules expected to be announced today, women will be able to serve in roles which were once considered to be

close to combat. women will still not be allowed to serve in infinitary combat units. they'll likely go into effect this summer if congress agrees to the changes. republicans are expected to approve a report critical of both the bush and obama administrations for releasing detainees from guantanamo bay. some have reengaged in hostile activity. it calls for restrictions imposed by congress on further prisoner transfers to remain in place. reporteds show the solar energy company sold off assets at drastic reductions just to make quick cash. the washington times is reporting the failed company sold off almost $60 million of inventory for less than $20 million. the last sale happened two days before the company announced plans to file for bankruptcy

last year. now a professor says it's not unusual for troubled companies to sell off assets to try to improve. the house in washington is due to pass a republican bill to ban thousands of federal officials from insider trading. however, democrats say they're not happy about a key part that's being removed. it would require people who collect information from congress and then sell it to investment companies to register. however, wall street fought against that provision. federal agos say they have busted a major drug trafficking operation in the bay area. a camera captured exclusive video of agents serving search warrants throughout the nine counties the sweep netted 33 arrests. drugs and $100,000 in cash were seized. police believe the raid will have ripple effects on other crime organizations.

the two-year investigation involved wiretaps and undercover drug buys. 911 logs reveal new information about the day a washington state man blew up his home, killing himself and his two young boys. a social worker called 911 on sunday to report she was locked out of the home when she dropped off the boys for a visit. and she told the dispatcher she could smell gas and feared for the boys' lives, but the logs show nearly eight minutes passed before emergency crews were dispatched to the home. the call was categorized as routine instead of emergency. when crews arrived, the home was already in flames. well, video of a mysterious flash in the sky in russia has gone viral. cam which you are video, i don't know what this is, -- amateur video, i don't know what this is, it shows a flash. obviously people driving could see it, but didn't know what caused it. authorities say the explosion

the san jose mayor will deliver the state of the city address tonight. we are live outside city hall. and earlier, you spoke to the mayor. how does he rate san jose's recovery from the recession so far? >> reporter: well, on a scale of one to ten, he gives his city a five. and he's made it clear in order to solve the budget crisis, we need to pass pension reform. he says the city is stairing at

$245 million in retirement cost. and that's a number that's tripled over the past decade. it means budget short falls, service and job cuts. san jose has four brand new libraries and a police substation that it can't afford to open. fire stations are on brownout rotations and there's a backlog for road repairs of hundreds of millions of dollars. >> they have taken pay cuts and everybody took a 10% pay cut. and they have soldiers on as good professional, serving the people. so we are going to reck noise that today. >> reporter: -- we're going to recognize that today. >> reporter: city officials have slashed taxes on new construction and tenant improvements to attract development. he will deliver the state of the city address at 6:30 tonight. and we talked about the future of the aids in san jose. what the mayor had to say about that. ktvu channel 2 news.

last night, the oakland mayor delivered her state of the city address. and she tried to focus on the positive. >> oakland is a city that faces adversity and crisis and comes back stronger. >> she praised the creation of 5,000 jobs last year and having a balanced budget with money in reserved. but she says more needs to be done to bring down the homicide rate. she called for support for her 100 block initiative that would put more police in the trouble spots. the critics are calling for other solutions. >> all we've been hearing is talk. every time you look up, accuse. hiring all these police. where the police at then? we don't need police. we need programs for these kids. >> the mayor did not address the elephant in the room, the occupy movement which has cost

the city millions. protesters threatened to disrupt the speech, but security was increased and no problems were reported. the time now 7:31. two people very lucky to be alive after their suv flipped over in the oakland hills. it happened just before midnight. the driver lost control rounding a curve and then the car flipped over. the two people inside were shaken up, but otherwise, they were okay. and police were saying alcohol was not a factor. a walnut creek man is scheduled to enter a plea next tuesday on charges that he crashed into and killed two women. the grand jury indicted the 32- year-old on two counts of vehicular manslaughter. now last november, he had a seizer as he was driving, causing him to run a red light and broadside another car. a 72-year-old woman approximate her 15-year-old daughter were

killed. prosecutors claim that he knew he could have seizers at any time. oakland police still out there searching for three men who roped a house and pistol whipped two men -- who robbed a house and pistol-whipped two men. police aren't sure exactly what was stolen from the home. they were take on the the hospital with moderate injuries two. young boys who were also in the house at this time were not hurt. it -- house at the time were not hurt. there is now a deal between the states and the biggest mortgage lenders over foreclosure abuses. new york and california were the biggest hold-outs, but a person close to negotiations say they came onboard last night. coming up, details on what will happen to families who owe more than their homes are worth and why the banks are agreeing to this settlement. bank of america plans to cut 450 jobs as it shuts down some of its operations. the bank says all of the jobs

are in the customer service, fraud and claims unit. workers were notified yesterday. and may apply for other jobs with bank of america. bank of america is looking for ways to cut 30,000 jobs across the country so it can save $8 billion a year. time now 7:33. the number of virus cases has jumped this year. five senior centers and nursing homes were forced to temporarily close after an outbreak. now the symptoms include nausea, vomiting and diarrhea. it's highly contagious. officials are stressing the importance of washing your hands a lot. a rare brain illness connected to mad cow disease may be showing up. two people were recently diagnosed with something. one of the patients died last

two days. parents are divided, a lot saying they'll keep their kids out of school. for two reason, they don't trust the school district. and a lot are angry that the favorite teachers have been transferred out. en emotional day here. and that's the latest. back to you. >> thank you. a 19-year-old high school student pleads not guilty to charges that he tried to rape a redwood city teacher. now the alleged attack took place at summit high school late last month. prosecutors say he held the teacher at knife point until another teacher interrupted the attack. he remains in jail on a million dollars bail. he is due back in court next month. a woman is facing charges of animal cruelty, accused of throwing a dog out of a third story window. it allegedly happened sunday afternoon at an apartment in san francisco's mission district. a witness told police they saw

the 22-year-old throw the dog out the window. police say the dog is recovering, but is still being checked for possible internal injuries. it is 7:37. caltrans has set a target date to wrap up construction on the eastern section of the bay bridge. the bay area toll authority says it hopes to have the new span open on or just after labor day next year in 2013. they say before the gran opening, crews will have to close the bridge for about four days to make some final reconfigurations and just a reminer, there's a major closure on the upper deck of the bay bridge next friday, february 17th through tuesday morning, february 21st over president's day weekend. hoping the traffic will be reduced at that time. >> you're reminding us. and sal, you have been reminding us because it will come, and nobody told me. you have been telling us.

they have been in recession for years and many analysts warn it could make the situation worse. protesters have been taking to the streets, venting their anger about the measures. the latest report from the u.s. labor department is better than most analysts expected. 35 8,000 people filed for new jobless benefits last week near a four-year low. and it's down 15,000 from the week before. economists had forecast an up tick in unemployment claims. so all this has been helping stocks, at least a little bit. relief is on the way for hundreds of thousands of homeowners right here in california. pam cook is in the news room with a big announcement that happened a couple memos augurers good morning. i watched as eric holder made the announcement and he had strong words. the settlement, about a million homeowners under water on their

mortgages will have their loans reduced. california attorney general says that translates to hundreds of thousands of home owners here in california and she says the relief totals $18 billion for california. thousands of homeowners who were kicked out already will also get a monetary settlement said to be about $2,000. now there are some conditions. the agreement covers loans written between 2008 and 2011 and the banks involved are, there they are on the screen, bank of america, jp morganchase, wells fargo, citi group and alley financial. in the announcement, the attorney general says the banks didn't just hurt the borrowers, they directly contributed to the downward spill of the u.s. economy. the settlement calls for major overhaul of policies and procedures that will be enforced by an independent monitor. now, how do you know if qualify? we have a link posted on our

after a police shooting. the violent incident involved undercover officers from berkeley. we just spoke to the suspect's brother. paul, what did he say? >> reporter: dave, the family told me they have been here all night long. they identified the victim, excuse me, the suspect as steven moore. they say they believe the police have a beef with the family because the family has a past with the police. >> always a situation. not just one officer going to show up, but four or five or seven, for what? just for questioning somebody. because we're moores. they know who we are. they're going on our past. >> reporter: now yesterday, steven moore had another run-in with police. investigators tell us that two berkeley police officers in unmarked vehicles were trying to pull moore over at the intersection of center street and grove way. investigators say moore then backed the vehicle up and

pinned one of the police officers between his car and the police vehicle. that's when another police officer shot moore. >> why the police shot him? i do not know. i mean, he works. you know, working for us, just like you or i. and whatever the situation was, i don't know what it is. how the police got caught between his car and their car, i don't know. what was the police doing? maybe he didn't see the police there. >> reporter: now i can tell you the officer pinned between the vehicles suffered serious injuries to his leg and hand. his id and the officer who shot moore hasn't been released. there's unanswered questions in the case, like why were police officers trying to pull him over and is he tied to any investigations? we have contacted the sheriff's office, but have yet to hear back from them. >> thank you.

three san francisco police officers are recovering from injuries they suffered during a violent confrontation with a suicidal man. it happened yesterday evening in an apartment in the south of market area. investigators say the man attacked the officers after repeatedly trying to goat them into shooting him. police were finally able to subdue the man who is undergoing a mental evaluation. one police officer suffered a serious hand injury and the other two were treated for scratches and cuts. the doctor accused of critically wounding a federal agent is due in court this afternoon to face attempted murder charges. he is accused of shooting the customs officer outside his newark home early tuesday morning. and we covered the story for you on the mornings on 2. there's still no official word of a possible motive. but there's reports that his wife recently graduated from a school and he was a teacher at

killed. prosecutors claim he knew he could have seizers at any time. oakland police are searching for three men who robbed a home and pistol- whipped two men inside. it happened last night on foothill boulevard. police say it's not clear what was taken from the home. the two victims were take on the the hospital with moderate injuries. two young boys were also inside the home at the time, they were not hurt. 8:34. police investigating a rise in burglaries. the august carrier reports there have been 18 complaints since december. they got into homes through unlocked door, windows and even through dog doors. stolen items include cash, jewelry as well as electronics. residents are being told to make sure you lock everything up when you leave your house. a woman saying thank you to sanitation workers who found her lost necklace.

she says she accidentally flushed her necklace down the toil it in october. since it was very important, has sentimental value. one of her friends left a message for the sanitation department just to see if they had found the necklace and last month, employees found the necklace as they were cleaning out the pipeline. they remembered the woman's message and returned the necklace after, of course, getting it cleaned. six pets were killed in a fire and their owner was injured while trying to rescue them. the fire broke out at a house on king street just after 11:00 yesterday morning. four dogs and two cats were trapped inside. one of the residence burned his hands as he tried to rescue the pets before firefighters arrived. investigators say they found a marijuana growing operation inside the home, but they say that did not contribute to the cause of the fire. all lanes of 580 are now

back open after a rollover accident this morning. it happened about 5:00 a.m. just before the grand avnue exit. the highway patrol was called to the scene after a silver car crashed and ended up on the roof. some people were injured and taken to a nearby hospital. time now 8:36. we have a challenged morning commute. >> well, it's slow this morning. heading to san jose. a lot of people are heading down there now. no major problems, just a lot of slow traffic driving south. all of a sudden, we have a look at 880. this is typical. it slows as you cross 880 north. and you will see slow traffic up to where it clears. and kind of a tough one, highway 4 was really slow. there's a minor crash westbound 4 at willow pass road. but most of the commute is south near walnut creek. stop and go traffic south.

alive and not harmed. >> very close. a mountain lion was seen near a school. the sheriff's office says it received the report of the big cat. the person said it was near the intersection of alpine road around 11:00 yesterday morning. the school which serves 4th through 8th grade students was not evacuated, but deputies were sent to the school when classes were dismissed for the day. if you go to the beach in los angeles, you will have new rules to follow. the county is banning footballs and frisbees at the beach and anyone who violates the rule can face a $1,000 fine. the new law prohibits holes in the sand deeper than 18 inches. the idea behind the ban is protect beach goers and nearby homes. film crews have returned to half moon bay to get shots to testify big waves.

million a year. money would fund education, public safety, and infrastructure repair. some 500,000 signatures have to be gathered by april for that to qualify for the november ballot. it is 8:48. records show the solar energy company sole off assets at drastic reductions just to make some quick cash. the washington times reports the failed company sold off nearly $60 million of inventory for less than $20 million. the first sale occurred last july. the last sale in august happened just two days before the company announced plans to file for bankruptcy. a professor says it's not unusual to sell assets. a short time ago, the house passed a republican bill to ban thousands of federal officials from insider trading. but democrats are not happy about a key provision being
