let's check in with steve paulson. we had rain last night. what about this morning? >> a little bit this morning. boy was it cold out there. the wind is really cranked up. it will be a cold, blustery raw day. our system is moving. it will produce more rain. that is a cold rain coming down from mendocino county and lake county. highs today will only be in the 50s. also very cold windy at times. gusts about 35-40 miles an hour. here is sal. we have high winds on the bridge that could cause trouble on the morning commute. the highway patrol has issued a high wind advisory for the bay bridge. the advisory also applies to the benicia bridge. wind gusts could reach 35 miles an hour. and we'll be on it. we'll have expanded traffic updates to deal with with this mornings weather. this is northbound 280 getting up to highway 17. also the morning commute looks pretty good if you are driving on northbound 101 in the area.

at 6:01 let's go back to the desk. crews will continue to search for human remains connected to two convicted serial killers. they are focusing on an area in san joaquin county near the town of linden. ktvu channel 2 reporter tara moriarty has more on when crews can resume their digging. >> reporter: you know the first hint of what was to come came saturday when workers spotted a jacket with an arm bone hanging from an excavators bucket. search crews are supposed to resume their search at 8:00 this morning. we are about a mile from the location where they are digging right now. that's over the weekend. crews found more than 300 bones. saturday they found a human skull and then yesterday more bones and a woman's ring with someone's initials on it. they found the remains in a 45 deep hole. investigators sifted through

the dirt looking for any sign of the 20 victims that may have been left here. herzog hung himself last month after shermantine provided a detailed map of several locations to newspaper reporter scott smith who is allowed to view the site up close. >> there is a pair of it looks like small womens shoes tennis shoes. clearly from a person. it's gruesome. it's a horrible scene. it makes you want to cry. >> reporter: shermantine and his childhood friend herzog were called the speed freak killers for a methamphetamine killing spree. the pair grew up next door to each other may have murdered 20 people. they set up a hot line for others who think their loved ones may have been victims. i'm tara moriarty ktvu channel 2 news. our time is 6:03. a man is recovering after being shot to try to grab a gun from

a sheriffs deputy. the sheriffs department says 22- year-old terrell albert was arrested in vallejo yesterday about a half mile from the scene. deputies went to pine street to serve a warrant on another man. that's when albert tried to run away. one deputy pulled out his gun, ordered him o not to move. albert lunged to grab for his gun. he was shot in the shoulder. that deputy was not hurt. a 56-year-old shooting victim is still in critical condition this morning at john muir medical center. now he was shot friday night near a home in the area of sponos street and magnolia. two other people were shot outside of is a home saturday night. a man was wounded outside of a bar early sunday morning. so far no arrests have been made in any of those cases. this morning the ninth u.s. circuit court of appeals will hear yet another legal

challenge to california's ban on affirmative action. they filed a lawsuit specifically targeting the uc system. they want propped to overturned. it's contributing to a dramatic drop in the number of minorities on campus. the court rejected a similar challenge in 1997. students say they will rally in san francisco before this mornings 9:00 a.m. hearing. this morning president obama unvails his budget for 2013 in an appearance at a community college in northern virginia. now one proposal in the president's budget calls for community colleges and businesses to work together to train two million students in industries that are hiring right now. coming up at 6:15 the part of the president's budget that republicans are already vowing to fight. now the president will be in the bay area on thursday. he's appearing at two fundraisers in san francisco. the first is a $35,000 a plate dinner for 60 guests at the home of novelist robert mailer

anderson. after that president obama will appear at a larger event where tickets cost from $100 to $7500. our time is 6:05. we are still talking about whit knee houston this morning. the autopsy on whitney has been completed but it will be weeks before we know the exact cause of her death. whitney houston was found dead late saturday afternoon in the bathroom of her hotel room at the beverly hilton hotel in los angeles. she was there to attend a pregrammy party hosted by her long-time mentor and producer clive davis. police say family members went into the bathroom when whitney houston wouldn't respond to her calls. reportedly her bodyguard found her unresponsive in the bathtub. >> there will be no cause of death at this time because it is pending toxicology. and that could take up to six to eight weeks at this time her cause of death is deferred.

street where police are investigating how a man's body arrived out here on a stomach. they have blocked off several blocks in this area between on seventh street between b and c street right now. it's possible the perimeter will be larger as the morning progresses? for now we are reporting live in hayward lorraine blanco. it's ten minutes after 6:00. a vicious attack in the south bay. the victims a man and his little dog. what police say happened to them. also the state treasure says his wife was assaulted. the person who he claims did it.

welcome back to ktvu morning news. san jose police are searching for a suspect that beat a man and killed his dog. the victim tells the mercury news he was walking his y shire terrier saturday afternoon. three young men approached him and asked if he was in a gang. he told them no and tried to run away. the men punched and kicked him and attacked and killed his dog. anyone with any information is asked to call san jose police. this morning vallejo police are expected to release new information about the search for sixed arm robbery suspects. that search lead to a standoff and house fire on friday. swat teams surrounded a home on castle wood drive for several hours looking for the suspects. while police came up empty

handed while the home caught fire. it's unclear how that fire started but the six men are wanted for robbing and beating a man who respended to an add -- responded to an ad on craigs list. president obama's budget is being delivered this morning to members of congress. but as ktvu alison burns reports, republicans already say it is dead on arrival. >> reporter: dave, that is right. president obama wants to increase taxes on the wealthy while using federal dollars to try to stimulate the economy. his plan ends the bush tax cuts, increases taxes on banks and oil companies, and boosts funding for transportation projects like highway construction and education initiatives like school modernization. with election year politics dominating the agenda he is already not getting enough support from the other side. republicans are hitting the airways saying the president's plan will hurt the economy. >> there may be individual programs we can work with the

president on. but in this totality raising taxes on small businesses and job creators and saddling future generationing with more debt is not the answer. >> here's a look at video we shot 45 minutes ago with congressional staffers picking up the budget. republicans point out the budget projects a $1.3 billion deficit. they will try to promote his plans later this morning. we'll have live coverage. for now we are live in washington, d.c. alison burns. time now 6:16. new this morning bombers targeted israeli diplomats. it happened near the same times. look at these pictures. a driver and a diplomats wife were hurt in the car blasts. security located and defused the car bomb in georgia before it went off. in the past hour israeli prime minister accused iran of the attacks.

iran blamed israel for a car bomb that killed a nuclear scientist in iran last month. also a trial started this morning for a suspected terrorist nicknamed the demolition man. omar appeared in court. you see him wearing a white robe and skull coat. he was captured last year in the same pakistani town where osama bin laden was hiding. 202 people were killed in those explosions. there was a $1 million bounty on his head. they have filed a try straining order against an exboyfriend. nadya went went to a new york hotel to see an exboyfriend. she wanted to comfort him because she thought he was going through a crisis. the exboyfriend attacked her. nadya is an alameda county

on top. phil mickelson is just incredible. he finished at 17 under par for the 40th win of his pga career. tiger woods threatened in the early round but he had three straight boggies to fall all the way to a tie for 15th place believe it or not. >> i always root for fill. he grew up in san diego. 6:18 is the time. sal has an update on breaking news in hayward. >> that is right. this police scene at 7th and c street in the eastern part of hayward somewhat close to castro valley. the police are investigating a shooting and all we know is that there appears to be a body under a bag near a police car. police aren't saying much. ktvu reporter lorraine blanco is on the scene gathering more details. the police are busy they haven't told us much. we do know the crime scene has been expanded a few times. obviously a very serious

interstate 5 saturday afternoon. the father was trying to speed away from a second driver after a heated traffic dispute. the little boy was thrown from the car and died. the father and mother suffered minor injuries. police are still looking for that second driver that sped away in a black chevy pickup. let's go back to the breaking news in the east bay. ktvu lorraine blanco is in hayward right now where all types of law enforcement officers are surrounding a neighborhood after a body was found. so what do you know? >> reporter: dave, there are several hay ward police officers and deputies from the alameda county sheriffs department. you can see them behind me. investigators are trying to determine how a man's body ended up on a sidewalk a block from where i'm standing. an officer own scene called us and got a call sometime earlier this morning of gunshots fired. they haven't yet told us if they are searching for a suspect at this time in the neighborhood. i can tell you they have

expanded the perimeter of the scene a few times since we have been out here. we are told a media relations rep from the hayward police department is on the way as we speak. several blocks on seventh street between b and c are blocked off right now. while police investigate a mans body on a sidewalk. reporting live in hayward lorraine blanco ktvu channel 2 morning news. federal appeals court will hear arguments this morning challenging california's ban on affirmative action. allie rasmus joins us now from the uc berkeley campus with how students plan to show their support for overturning the band. >> reporter: a group of students that describe themselves only as a coalition of under represented students of color here at the university. they plan on having a rally in front of sprawl hall about an hour and a half from now. rally is in opposition to have california proposition 209 which prevents colleges and universities to consider race and ethnicity a factor.

later this morning the ninth circuit court of appeals is scheduled to hear arguments in the case to repeal prop 209. opponents of prop 209 say minority enrollment as dropped dramatically since it became law. something uc admissions officials say they have noticed. supporters say this is something california voters approved 16 years ago and not only is the measure constitutional, they say it's necessary to keep the admission process color blind an fair. this is not the first time it's being challenged in the courts. here's a timeline of the legal angling over the issue over theers. in 1996 voters approved a proposition. a year later the ninth circuit court of appeals upheld the measure as constitutional. but in 2003 in a completely separate case the u.s. supreme court declared it was okay for law schools to consider race and admissions. in light of that supreme court

ruling and new data opponents of 209 wanted to challenge the proposition again. and again that legal challenge starts later this morning in san francisco federal appeals court. live in berkeley allie rasmus. your time is 6:34. the wife of ross mirkarimi will testify. eliana lopez will cooperate and take the witness stand. however, lopez may limit her testimony if she is not granted immunity by the district attorney. canny wants lopez to be granted immunity in case she is charged with child endangerment. both ross mirkarimi and his wife have denied any domestic abuse. the battle over same sex marriage moves to new jersey this week. the state senate is set so vote on a bill to legalize gay marriages. it will take up the bill on saturday. they are confident they have

enough votes to pass the bill but republican governor chris christy has vowed to veto the measure. 6:35. last night at the grammies awards one artist took the stage more times than anyone else. >> and the grammy goes to. a little music. 21, adele. >> there was a big night for the 23-year-old british singer adele. won all six awards. now the nights other big winner the fu fighter. rock band scored five grammy awards. last nights grammy awards ceremony also included a special attribute to whitney houston that died the day before.

weather. it's not so wet it's more windy. you can see interstate 880 traffic continues to move along relatively well for this time of the morning. it is getting a lot more crowded. let's move along and take a looks at the bay bridge toll plaza. this is really kind of beginning to fill in. once you get on the bridge you will see some slow traffic on the span as well as you make your way to san francisco. and if you are driving in the south bay i think the slowest traffic in the south bay has been on 101 through san jose. the rest of the commute still looks pretty good on 85, 87, and 280. 6:38 let's go to steve. >> thank you, sir. a very good morning. cold out there. off and on rain. mainly cold and windy. that is across the board. some of the rain is hit and miss there. system is finally moving into the north. we've already had the one ban go through. there is more scattered showers slicing by. the system right up there where move toward the sierra, nevada. cooler patterns may message here today. 56 will be very popular here.

near the town of linden. ktvu channel 2 reporter tara moriarty sat the search site with more on when the search will resume and what has already been found. tara. >> reporter: over the weekend excavators pulled 300 bones from an old abandoned well. if you look off in the distance there is a flashing light down there and that is where crews are. this was all laid out in a map provided by a convicted serial killer. teams are supposed to resume their digging and sifting here at 8:00 if the weather permits. yesterday investigators sifted through the dirt of a 35-foot deep hole where the well had once been looking for any signs of the possible 20 victims that may have been left there or two other dig sites linked to death row inmate wesley shermantine and loren herzog. herzog hung himself last month.

a judge expected to rule today on whether to ease redistributions on jerry san dusky house arrest to allow the former penn state football coach to visit his 11 grandchildren. sandusky has been under house arrest since december. that's when she was charged with sexually abusing young boys during a 15 year period. highway has pleaded not guilty. a judge is set -- is expected to set a trial date for may. back here at home pleasant hill police searching now for a suspect who held up a gas station. this happened at the 76 station on monument boulevard last night. just after 7:00. police say the suspect was dressed all in black including gloves and a black mask. he had a semi automatic handgun and police say he escaped with an undisclosed amount of cash. no injuries were reported during that robbery. oakland city offices will be closed to observe abraham lincoln birthday.
