a gunfight at a strip mall sends three to the hospitals tonight, one of the victims is a child. good evening everyone. i'm frank summerville. >> i'm julie hay nard. two gunman after a wild shoot out at a strip mall. it wounded three at a nail salon. we have live coverage where investigators are still on the scene trying to piece together what happened, heather? >> reporter: julie, this section of springs road remains blocked and investigators

aren't sure when it will reopen as officers have a lot to sort through. about 30 minutes ago i received an update from the police lieutenant who told me a man is in custody, they are talking with him but as of right now, no one has been arrested in this multiple shooting. the lieutenant describing it as a running gun battle taking place in front of the strip mall. now even he seemed to be taken a back by the sheer number of shots that were fired. in fact, when i asked if he could tell me how many shots, all he could say is a lot. we actually counted at least five bullet holes. it was sheer terror inside the back in style beauty salon where laura was working with a client. >> i heard it from the outside and it got louder and louder and i got on the floor and protected my baby. >> reporter: she doesn't believe the salon was the target but in the line of fire of gunman on the street. not only was the salon hit but

the business next door. witnesses say three people inside were injured including this woman, 3-year-old girl. she was too upset to talk with us and paced back and forth holding her daughter's little pink shoes. she tried to figure a way to get to oakland's children's hospital where the child was taken by helicopter. they heard gunshots and gunfire. >> it was very scary. >> reporter: how many shots? >> too many. i couldn't tell. i just got on the floor. >> reporter: you got on the floor? >> there is a lot of bullet holes in the glass and in the chairs and stuff like in the walls there is a lot of bullets and stuff in the wall. >> reporter: and the hours following the shooting frank and julie, we have watched police use a ladder to climb on top of the strip mall looking for evidence and watched them search nearby parking lots and surrounding areas. there is no additional information on the uninjures that those three people who were shot, the injuries they

suffered except the lieutenant told me one of them was shot more than once. so again, that is the very latest here, three people, two women and a little girl shot here and what that lieutenant described as a running gun battle outside this strip mall. reporting live tonight here, i'm heather hole pes, channel 2 news. only on two, a weapons bust in oakland tonight. it happened at the extended stay america hotel near the city line. our cameras saw at least three people being taken into custody about 6:45 this evening. we've been told it was an undercover operation and officers bought several handguns. police had the swat team on stand by to make sure the bust went down smoothly. a bomb squad was called after a device was discovered inside a newspaper delivery box. >> fire in the hole. >> the bomb squad was called to the road outside about 2:30

this afternoon and sent in a robot and blew up the device as a precaution they say in the end it turned out to be an older electrical type glass fuse. today's rainy weather slowed a grim search for human remains in an abandoned well east of stockton. a killer on death row says at least a dozen people are buried there. amber lee is live outside the small town where people are starting to come to grips with what serial killers did in the community. amber? >> reporter: julie, the big site is a mile up this road behind me. this is the closest the sheriff's department will allow us to get, people we spoke with around town are questioning why investigators didn't find answers sooner. it's a popular market in the small town. this evening shoppers said they can't help but think about the discovery on the outskirts of town. >> surprise and shocked. you know, it z creep me out being close to that. >> reporter: today a rainbow

stretched down toward the mass grave, rain prevented investigators from continuing to dig for evidence. the focus shifted to what they uncovered over the weekend. you can see the deep hole dug into an abandoned well. investigators found hundreds of bones and fragments and shoes, coats, a woman's ring and purse. >> right now we're focused on processing evidence and trying to determine who the items belong to. >> reporter: investigators believe the remains of perhaps 20 victims should be found here and other dig sites. they are linked to a death row inmate. the two grew up in lynn done have and been friends since boyhood. one commented suicide last month after he learned there was a map to a bounty hunter. >> when they were digging at this well we thought they were digging at the wrong well and i'm glad they kept going.

>> reporter: he said he got sherman to tell where the victims could be found by paying the inmates 18,000-dollar court ordered restitution and in exchange the bounty hunter says he can receive money from family and friends to buy things like a candy bar in prison. >> think about it, if he can give us 30 bodies over the next two months, it's money well spent. >> reporter: the excavation is expect today resume tomorrow morning. the bounty hunter told us the money he spent came out of his own pocket. he said he did it because he wanted answers. waiting to learn if any of the remains hold answers to cold cases in their jurisdictions. >> there is speculation among the detectives in our department, homicide detectives in our department and a lot of local jurisdictions will look at that and say we know that we

had these two working in and around the county and in and out of the state and perhaps there could be a connection there to the spree. >> reporter: and we've checked with bay area law enforcement and we're told they, too, are waiting for the out coal of the search and forensic analysis and tonight the trial that sent them to prison was held in the south bay. the unusual deal one of those men broke with the prosecutors. that story in 18 minutes. the bay area got a dose of much needed rain over the past 24 hours, unfortunately, not nearly enough to get water supplies to normal levels. the rain made driving a challenge. crews reported quick downpours and clearing. the news photographer took these pictures coming off the bridge on to interstate 680 today. the storm caused problems in the santa cruz mountains, two huge trees, one as tall as a 15 story building came crashing down. the trees damaged a large deck and just missed five homes.

a tree expert says redwood's don't usually fall but the roots of these were growing in sand stone that lacks stability. an operator welcomed a new bach of snow and resorts had to make a lot of their own snow and got fresh powder, 10 inches in some spots with a long president's day weekend coming up, it arrived just in time. and it felt like winter around here but i got to tell you, the rainfall accumulation is not a lot. look at some of these totals as the rain moved through. not an inch of rain like you might expect with a storm like this, a half inch of rain, no quarter inch of rain for most of us and less. the mountains got an inch. what does it mean for average? worry about the number that comes up at the bottom of the screen for these cities. that's the number you watch and at this time san jose at 30% of average will have a heck of a time catching up to normal as we move into the late february and

is the second time in three weeks vandals have targeted the school. last time the damage consisted mainly of broken windows, not so this time. richmond police are looking into who might benefit from the description of property. >> we're looking at possible dis-grunt led employee, maybe of the project. we're not accusing anybody but looking broadly at the picture and not just oak who are the kids that came in here and did this. >> reporter: this vandalism seems calculate. one notable example is the nozzle on this water heater was broken off in the right way to send thousands of gallons of water onto the floor. >> i don't know if a kid would know that. >> reporter: initials were painted in several different areas but they are not sure if that will point to new leads. they hope to get information by offering a 10,000-dollar reward. in richmond, patty lee, ktvu. republicans in the u.s. house of representatives reversed their course today and announced they are willing to

extend the payroll tax cut through the end of the year. a vote is still needed but this means millions of americans will likely continue to see an additional 2% in their pindot checks. the republican house leader said they didn't want workers to be saddled with a higher tax rate. president obama sent his $3.8 trillion budget plan to congress and said it makes them tough but necessary choices. >> but the main idea in the budget is this: at a time when our economy is growing and creating jobs at a faster clip, we got to do everything in our power to keep this recovery on track. >> the president says his budget would reduced and the federal deficit by $4 trillion in ten years, to accomplish that he wants to eliminate bush era tax cuts and raise the amount of taxes paid by wealthy americans and reduce military spending by eliminating navy ships and fighter jets purchases. it does include spending increases such as one for the

thursday. his lawyer said he will plead not guilty. live in san jose. >> the wife of the san francisco sheriff has apparently decided she wants to testify. she want as surrenderrances though. she wants immunity from any charges including child endangerment if her child was present and she doesn't want to be deported. the trial is set to start later this month. >> in haywood police are looking for leads in a shooting of a man this morning. police responded to reports of gun fire at 7th and c street. they found the victim's body in a driveway. they are trying to figure out a motive. so far there have been no arrests. a red vehicle was seen speeding away from the scene. the victim is a latino man in his 20s, staying at this home for the past week. no a man who served ten years

in prison for killing his roommate is under arrest accused of killing another roommate. the man was found dead last wednesday in haywood. michael wyatt shared the home with him and gave up to police yesterday. investigators say he was stabbed to death after an argument. >> an appeals court will recore the ban on affirmative action. >> reporter: if you look at the students during a change of classes on the berkeley campus today it's what you don't see that strikes you. very few african american and latino students. the current berkeley freshman class is 3% black, 11% lasano, 22% white and 42% asian. many say that proves

in tonight's special report we tell you whether we are getting the reforms that opd promised. >> reporter: the stakes have never been higher for oakland police to fight crime, restore the department's reputation and protect people's civil rights. >> this is not the police force that was -- they were ten years ago. >> reporter: lifelong west oakland resident marcus johnson said he was harassed by police around the same time that the rider scandal rocked opd when four officers were accused of beating and framing african american suspects. neither of two jury trials resulted in convictions but settling of civil lawsuit cost the city more than $10 million and taxpayers still on the look for more. we requested all of the expenses filed by monitors appointed by a federal judge. what was supposed to be a five-

year, four million dollar program has dragged out nine years costing more than $6 million. the current monitor, and his staff have billed the city for almost 1.5 million since 2010, including 70-dollar cab ride from sfo to oakland, 300-dollar parking bills, and some first class airfares, one round trip flight from virginia to san francisco cost nearly two thousand dollars. >> the officers don't pay for this. the taxpayers do. that is one of the reasons we are fed up with the police department's ability to comply with the agreement. >> reporter: one of those who drew up the first settlement with opd. he asked a judge to consider a federal take over of the department because it made barely half of the 51 reforms it promised in 2003 and has

investigators say the men may have come from a nearby car wash that was raising money for a funeral of a man killed earlier in the month. >> the dog owner had the color red and that's what prompted the whole thing. that's why they asked him if he was a -- with a gang and he said no but that wasn't good enough. >> reporter: investigators say the men punched and kicked the dog owner and then attacked the dog. the dog later died in its owner's arms. the dog was similar to this one. the future of dozens of miniature horses is in question tonight at 10:45 one family's fight to save a ranch and the 40 horses that live there. >> a six foot chain link fence in downtown -- creating quite a stir. the fence was put up by the rail transit district to keep peopl away from an old railroad trestle. business owners say that the large fence is taking away from the look of that area.

released today included another 150 million. the two billion dollar extension is designed to run from fremont to san jose, ground breaking set for april 12th. bart police will reveal a new policing structure tomorrow. it's expected to be community focused defined by five zones. the idea is that bart police officers will be able to identity problems more easily and provide a mortar getted response. >> gay rights activists celebrated in new jersey after the state senate passed a bill to let same sex coupleless marry but the governor said he will vetoo it. those in support say it's still a victory as they voted down a measure just two years ago. >> it's time. >> and in washington state, the governor signed legislation making washington the 7th united states state to legalize

suffer. >> reporter: this here is faberege and here is angel, two of the miniature horses in this small ranch and they could be forced from their home in just a few weeks. it's feeding time at love patch farms in pen grove. about 40 miniature horses live here, they are the star attraction for the many senior and children's tour group that have traveled here to enjoy the companionship of the animals. after three decades, love patch farms may be forced to close. >> i don't know what we are going to do. >> reporter: lee and her partner were able to lease back their property after going through a short sale. now the owner said unless they can come up with about $500,000 to buy it back they have to leave. >> we would like to purchase it back and continue doing the tours and the community outreach. >> reporter: they don't have the money and they can't find

another less expensive property to care for the horses. >> down in my heart i have a feeling god is with us. >> reporter: they say they feel overwhelmed and aren't sure what to do as the deadline nears. despite the financial trouble they don't want to sell their treasured animals. >> we will never, ever, bring them to an auction house, auctions are pretty much populated by kill buyers. they buy them by the pound. they don't care. >> i do a lot of praying. i know we -- pulling all the strings and turning all the buttons and make things work. i have faith. >> reporter: the property owner has tried to work with the couple to see if they can come up with a plan to move forward but so far nothing has really worked out that benefits both sides. the couple said they are trying to learn how to set up a nonprofit and look at other options so they can try to keep
