a developing story wrapping up in oakland after the search for a gunman forced the evacuation of a school. good afternoon. i'm tori campbell. a a developing news out of the oakland, police say they have taken an armed suspect into custody near a maxwell park elementary school. this is video from news chopper 2 taken a few minutes ago. the students at maxwell park international academy on fleming avenue were evacuated

as a precaution. we just got word those stiewlgts are now returning to class. police say the man was armed with a shotgun. it's not clear what he was doing with the weapon. officers had been looking for him since about 11:00 a.m. and caught up with him just about 15 minutes ago in the 2800 block of monticello avenue. police have arrested an armed man and students evacuated from maxwell park international academy have now returned to class. in sonoma county a house fire claimed two lives early this morning. the fire happened at a home on west gate lane in penn grow not far from petaluma. we're live with new details on this investigation. >> reporter: good afternoon. those two bodies were badly burned according to the sheriff's investigators. they were found inside a home just up this road in a rural area known as penn grove just

outside of pet lima. sheriff's investigatorser still up there trying to determine the cause of this fire. the narrow dirt road leading up to the cause was blocked off by crime scene tape early this morning after this fire killed two people. sheriff's investigators have not positively identify the bodies. neighbors told us the two people who died were an elderly woman in her 90s and her son who lived in the home with her. sheriff's investigators don't know how the fire started but are treating thises is a crime scene. >> right now we're not seeing anything suspicious. we're not seeing any signs of foul play. it's still an ongoing investigation. >> reporter: neighbors tell us when this fire first broke out it was around 12:30 a.m., flames were shooting 30 feet in the air above some of those trees. the home is surrounded by over grown brush a and trees. one body was found in the bedroom, a second body found in a living area of that home. neighbors say the family who

lives here has owned this property for decades. because the bodies were so badly burned, the coroner will need to do an autopsy to positively identify the victims. back to you. there are a couple of fire in the east bay this morning that had firefighters scrambling. flames broke out just before 3:30 a.m. at a home and art gallery in berkeley. everyone inside made it out alive. at first the situation looked far worse when firefighters arrived, they saw the tail of a plane sticking out of the roof. the aircraft was just a piece of art and had nothing to do with the fire. >> we were asleep. somebody rang the bell and said, look out window. you could see the flames. he ran outside and turn on the garden hose. >> an investigation is underway into the cause of the blaze. art supplies and some flammable liquids stored in a locker made

it difficult to put the flames out. two firefighters were treated and released for minor injuries. the red cross is helping four people after an apartment fire in oakland. firefighters were called to 37th street around 4:00 a.m. a resident tipped over an oil lamp while making a snack. oil spread and the curtains caught fire. everyone escaped safely. many folks are taking a few moments to enjoy the sun at the berkeley marina today. some families showed up with fishing poles to enjoy what feels lying spring in the middle of winter. others were out walking or soaking up the rays including some visitors from new york. >> this is spectacular. what a gorgeous day. >> i like it. i really like this weather. i like it either way. i like this a lot. >> temperatures are expected to push into the 60s with clear

skies. mark tamayo joins us now with more details. >> temperatures off to already a warm start. this afternoon we could be talking a few neighborhoods getting close to 80 degrees. look at some of the current numbers. 60s and already the 70s in this 12:00 hour. santa rosa right now 76 degrees. they could approach the upper 70s, if not 80 this afternoon. typically february we should be talking about very coal storms. that is not the case for today. it will be tough to beat that record of 80 degrees in san francisco. it is always an event when san francisco anytime of the year is in the 70s. that will be happening this afternoon. san jose approaching the record of 7 #. i'm forecasting 78. i'll let you know how long this warming trend will continue and highlight the one temperature change you can expect for the

weekend. toll booth collectors are on alert after two armed robberies at the carquinez bridge in the last week. the most recent one happened early yesterday morning. the highway patrol says someone drove up, pulled out a gun and took off with some money. there were three robberies at the end of last year. there are plenty of security cameras at the toll booths. officers are examining surveillance footage and following up on what they say are strong leads. scientific tests support a tip from a convicted serial killer. dna test results confirm the human remains found in calaveras county are those of murder victims cyndi vanderheiden and shaw veal wheeler. investigators found their bones earlier this month after getting a tip from convicted serial killer wesley shermantine. wesley shermantine and his partner in crime are tied to as many as 20 killings.

this morning the contra costa county coroner identified the young man killed last night in a shooting in richmond. he is 25-year-old renee garcia of pinole. just before 7:00 last night, officers received numerous calls about shots fired at shields reed park. they found the area littered with shell casings. garcia was pronounced dead at the scene. police are asking for the public's help to solve the case. arraignment is scheduled for 2:00 today for a man accused of beating a berkeley hills homeowner to death. police believe the 23-year-old suspect jordan dewitt is mentally ill. they say he killed 67-year-old peter succor outside the victim's home near grizzly peak boulevard saturday night. officers have released a time line of the events in an attempt to defend their response. at 8:45 p.m. the victim called police on a nonemergency line to report a trespasser on his property.

at the same time, patrol teams were monitoring an occupy proceed he test and did not answer the trespassing call. then at 9:02, the victim's wife phoned 9-1-1 to report an attack in progress. police say officers were dispatched within a minute of that call. oakland woman was taken into custody this morning for allegedly shooting at her boyfriend. police say the woman had called police to her home near 45th street and telegraph avenue when the boyfriend came to retrieve his belongings. officers say that call had been resolved. the boyfriend returned an hour later. they say the woman then fired at the boyfriend three times from the porch. >> from what we understand, one of the occupants at some point during the return call pulled out a firearm and shot at the second individual. nobody was hurt. >> officers returned to the home and ordered everyone out of the house. the girlfriend was arrested for

assault with a firearm. police say it was an end of relationship dispute. pg&e crews have restored electrical service to thousands of customers who lost power after a transformer failed in san francisco. it happened at deboas avenue and valencia street north of the mission district. we're live at mission where businesses say illegal marijuana grow operations may be to blame for the power failure. >> reporter: that's right. the latest out here, let's start off with the fact that traffic has reopened here. all morning long traffic was blocked out here. in the last eight minutes, traffic started out down this area. you can see that pg&e crews are still working here. pg&e confirmed for thus morning that this transformer which failed could have been caused by unusual power spikes. that would include illegal pot growing operations somewhere in

the neighborhood. crews still on the scene trying to restore power and repair the burned utility pole. pg&e says this transformer failed shortly before 4:00 a.m. sending out sparks and flames and plunging nearly 2400 customers into darkness. >> pg&e was looter scene. they were shutting off the power to the area to the poles. why they were shutting down the power part of the top of the telephone pole fell down on to the high tension wires. >> out of safety concerns, firefighters waited for pg&e crews to put out the fire. then crews began working to restore power. this business was left in the dark. the owner says this is the second time in three weeks that particular transformer has failed. >> already this month transformer already got smoke. they replace already. >> he says a pg&e rep told him that an illegal marijuana growing operation was likely to blame. pg&e could not confirm this morning's outage was linked to

an illegal marijuana grow operation but did confirm that indoor pot farming can lead to power use spikes which can cause transformers to fail. >> that is a continuous safety hazard. these grow houses can provide very serious safety haz he had for the surrounding neighborhood. >> reporter: you can see that the power here at b and k electrical supply has been temporarily restored thanks to a big generator out here that pg&e rolled out earlier. pg&e tells me that customer privacy issues prevent them from digging too deeply into whether a pot growing operation may have caused all this. in the last hour i spoke with san francisco police. they say they are not searching door to door for an illegal pot growing operation. they say at this point they don't have enough information to launch an investigation. back to you. >> thank you. today the aclu and uc davis students sued the university

over last fall's controversial pepper spraying incident. the lawsuit claims campus police violated protesters' constitutional rights. occupy demonstrators were staging a sit-in when a campus police officer repeatedly blanketed them with pepper spray. the suit accuses the uc administration and police of failing to properly train and supervise officers. uc davis officials told us they have not yet seen the lawsuit but they said attorneys for the university and the plaintiffs are in conversations. we're following a terrible tragedy involving the deaths of dozens of people and injuries to hundreds. mark tamayo is back soon with more on this spring-like weather forecast. a san francisco woman facing eviction gets good news. how a last minute reprieve has given her new hope. a packed commuteer train crashed at a station in buenos aries during this morning's commute killing 49 people and injuring more than 600 others. investigators say the train came in the station too fast and hit the shock absorbing barrier at the end of the tracks. several cars crumpled together

as rail cars cut into those in front of them. it's the deadliest rail disaster in more than 40 years. italian authorities say divers have recovered the bodies of four more victims from the cruise ship that capsized last month. that came after the discovery of four other bodies just hours earlier. the ship hit a reef on january 13. the total number of confirmed dead and those missing and presumed dead is 32. when he new video into the newsroom after the pilot of a small plane was forced to make an marijuana landing in the south bay. it happened about 10:45 a.m. at reed hillview airport on cunningham avenue in san jose. the pilot of a four passenger plane radioed that he had lost power to an engine. by the time fire crews arrived on scene, the plane had landed safely. the pilot was the only person on board. president barack obama wants to cut taxes for corporations.

the president says he wants to lower the corporate tax rate from 35% to 28%. he says that will make u.s. corporations more competitive around the world. at the same time, mr. obama says he wants to do away with many loopholes and tax code provisions that allow corporations not to pay taxes on money they earn in other countries. a new government watchdog agency has begun an investigation into bank over draft fees. the c sierm financial protection bureau says banks collect billions every year on over draft fees. they can run more than $30 every time your account goes in the red. the agency wants to know if banks are processing customers' largest transactions first as a way of of generating over draft fees and if banks are not explaining the fees clearly enough. >> we think he it's time for wells fargo to take responsibility for the damage that they have done. >> clergy from many disciplines

gathered in front of a san francisco wells fargo on this ash wednesday in response to a report on city foreclosures. the audit showed that 83% of the foreclosures studied were in violation of at least one state law. the religious leaders came with a big jar of ashes to sprinkle in front of the bank because they want wells fargo and other major lending institutions to repent. they're demanding an immediate freeze on foreclosures until a full investigation is completed. a san francisco homeowner got good news this morning about eviction proceedings against her. >> thank you. >> as supporters rallied around her, monica kenny received a fall from nan fannie mae saying the agency was delaying her eviction for two weeks. that's so they can look into reportses that wells fargo is willing to restructure her loan to avoid foreclosure. kenny lost her job two years ago and was scheduled for

eviction today. >> there are people that you can go to. there are people who care about what's going on with you. you just need to reach out. don't be ashamed. that was my problem is that i felt ashamed. >> as we showed you had live on the morning news, supporters gathered at 6:00 a.m. at her house hoping to pressure fannie mae into the reprieve that just came a few hours later. san francisco sheriff ross mirkirimi returns to court today for the final hearing before his trial on friday. today would likely be the day lawyers could announce a deal to avoid a costly trial in this highly publicized domestic violence vase. prosecutors and defense lawyers say they are eager to present their case to a jury and there appears little hope of a last minute deal. both sheriff ross mirkirimi and his wife have denied the charges. a norovirus quarantine has been lifted at an outpatient clinic for veterans in

martinez. the virus struck at the beginning of february at the martinez veterans affairs clinic. health fishes shut down the facility almost two weeks ago on february 9. patients can stay at the center while they recover from surgery. it was back open yesterday. contra costa county libraries say they're having a hard time keeping up with the growing popularity of digital books. the county has nearly 3,000 e- books and audio books available to loan. this week more than 2,500 of them are checked out. people on the waiting list for some of the most popular books may not get them until summer. librarians say their newest challenge is figuring out the rites balance of books and digital versions to buy with their limited budgets. it does not feel like a february day out there with already sunshine and temperatures soaring back up to the 70s.

san francisco already in the lower 70s. it will just be today and tomorrow the warmest days of the week. current numbers, san jose right now 72, still a few sis sigh to report, fairfield and napa, santa rosa closing in already. this is a -- already closing in on 80 degrees. they could max out in the upper 70s if not 80 for this afternoon. so in general most areas about 6 to 12 degrees warmer than yesterday's readings. temperatures have been soaring. this has been the trend with temperatures a couple days ago, we were in the 50s. tuesday we warped up. that trend will continue today with widespread 70s expected across the bay area. tomorrow pretty much the same deal, could be a little warmer. then we'll cool things off beginning friday and into the weekend. but with that offshore flow developing, this will trigger

some stronger winds. already did having in the north day hills and east bay hills. there is a wind advisory for tomorrow for those two locations. winds could gust over 40. no rain clouds showing up on the five-day forecast. we have the opposite in the short term. 3:00 this afternoon, warm, 68, some neighborhoods could check in around 80 this afternoon. by 6:00 clear and mild, readings in the upper 50s to upper 60s. by 9:00 mostly clear. we'll be cooling off by 9:00, back to the 50s to 60 degrees. take a look at these numbers for this afternoon. at least in the upper 70s if not 80 in the north bay for santa rosa. san francisco and oakland in the lower 70s. pacifica in the upper 60s. san jose tops out 78. gilroy in the upper 70s. here is a look ahead. pretty much the same deal for thursday, except some stronger

u.s. stocks falling today as investors continue to worry over the details of that new bailout plan for greece. there was good news on existing home sales, riding to their highest level in almost two years. the dow is down 19. nasdaq down 12. s & p down 3. the final arrest total from san jose's mardi gras celebrations will come out later today. police indicate only moderate crowds and no major problems downtown. there were about 70 extra officers on patrol last night. the partying is over in new orleans. tens of thousands of people packed the french quarter last night to celebrate the end of mardi gras. nearly a million people took part in carnival celebrations in rio. one publisher is hoping to catch in on the linsanity over
