a wildfire in wine country still burning tonight above the napa county. highly unusual in the february in the bay area. good evening i'm frank somerville. >> and i'm julie haener. tonight firefighters are keeping an eye on the fire. debra villalon is live now from the soda fire.

>> reporter: warm and windy conditions, bad conditions for a vegetation fire and that's what got away from them today. we are in the driveway of one of the homes that was threatened and where crews are keeping watch all night. but take a look just after dark. hot spots lighting the hill here and it still isn't out. >> at its peak, 100 homes were threatened. >> it just banded from there, he got away from there. >> reporter: it not occur to him this wasn't a good day for a fire. >> i guess not.

>> on a one windy day like this. >> reporter: those who almost lost their homes were startled. >> reporter: it's absolutely ridiculous when it's this windy. >> for everybody out there. one lesson to learn, first houses they are going to protect is the ones that they have done a job to protect it themselves because they know they have a chance. if they haven't, they're not going to waste their time. >> reporter: the message from fire bosses, be ready. this does not seem like a february for fires. burning more like may or june. >> no it was not. not at all. this type of weather, this type of year, it makes you wonder what's going to happen later in the year. >> reporter: whether the

landowner had the property permits is still being looked into. right now this fire is 50% contained, they hope to look at it out tomorrow at daylight. this is burning now into an isolated rocky canyon and not near any homes. debra villalon. this area has burned before in june of 1981. we went into the ktvu archives to find these pictures. 65 structures were lost, the damage was estimated as $36 million. our team coverage continues now with our chief meteorologist bill martin. bill you've been tracking these windy conditions that's still fueling this fire. and it looks like it's still windy out there. >> reporter: wind gusts in that area up to 25 miles per hour. let's take a look at the

graphic and you can see the area, the general area. the east bay hills had winds up to 25 miles per hour. we had record heat today on top of this. humidity was down to 13%. in the last hour, the national weather service has dropped the fire weather advisory. the wind advisory pardon me. so the winds are beginning to subside. when i come back here i'm going to talk about the record temperatures we saw today. and i'll tell you how the daytimes went, stay right here. we're keeping track of the progress firefighters are making tonight. bill is also updating his forecast. at 10:45, the big change you're going to see this weekend in the forecast. sheriff investigators expanded their search for additional victims of the speed

freak killers. investigators were led to the area by a map drawn by death row inmate wesley shermantine. they believe shermantine along with his accomplice the late herzog killed close to 11 people. the remains of cindy vandehheiden and chevy wheeler were found in the area. a neighbor told us she could here investigators looking. >> we're successful. we're success. , -- that's why they got the shovel and started work. it makes me think, they're going to find everyone there. a pleasanton woman was among the three people killed in a nine car pile up in southern monterey county. the crash happened just before 9:00 last night in king county.

the highway patrol says 53-year- old maria ochoa along with the driver of the car she was in and another passenger were killed when an suv crossed the center divide and crossed their vehicle. the driver of the suv was reaching for her cell phone and lost her phone. as many as 15 people were hurt in the crash. new at 10:00, a proposal to eliminate kindergarten in neighborhoods that are struggling. >> reporter: frank we're at school district headquarters where the meeting just ended. inside the board voted to take deep cuts despite large crowds asking them to reconsider. parents, students teachers and others rallied outside tonight's school board meeting to protest school closures and service cuts. the sasoon school district must

deal with an anticipated $600 million of state funds. the item that caused the biggest uproar was to eliminate kindergarten. >> speechless. what if my daughter goes to kindergarten and she struggles because she forgot everything from preschool. >> reporter: anxious parents and teachers watched the meeting. and the council announced they had taken kindergarten off the table. parents and teachers are upset and say administrators need to cut where it doesn't hurt students. >> we're here to educate the kids, that's the bottom line. and everything else is secondary. >> i'm hoping i can make it through the next three to four years, but i'll tell you i am tired. >> reporter: school district

officials say these cuts will accommodate the worse case scenario. but they say they won't know until november how much money they'll be receiving from the state. so they're urging parents and teachers to write to lawmakers to change the legislation. amber lee. physical education is an important part of school curriculum. coming up, a new study that shows san francisco students aren't meeting the state requirements. how many are falling short and what the schools are pledging to do ability. oakland police are investigateing the death of an elderly man as a homicide. a friend reported finding the man's body just before 7:00 this morning inside the victim's house. ktvu spoke to the relative and stunned neighbors. >> the call came in from a concerned friend it was

received to our dispatch center. we had our crime investigators on scene. >> reporter: neighbors identified the man as robertson who lived in his home for much of his life. >> stunned. >> reporter: that was the reaction of robinson's nephew a former police officer. he toll tells us his uncle used to work for a newspaper and worked all of his life. >> my uncle was the kindest, gentlest person i have ever known. >> reporter: robinson's nephew says his uncle lived alone and didn't keep any valuables in the home. >> i've never heard of a homicide. >> if he was murdered he didn't have it coming.

i can't think of any reason why anyone would want to hurt a gentle soul like that. >> reporter: every sunday, joel would go for ice cream. police are asking anyone who may have any information about this case to please give them a call. that is just one violent crime oakland police are investigating right now. in four minutes the string of shootings over the past 24 hours. we ask why guns are so easy to obtain and why children feel the need to carry them. in san francisco police are asking for help in finding a teen teenager who's been missing. he has a shaved head and was wearing a red, gray and black jacket. if you have seen him or know where he is you are being asked to call police. the number of people filing first time unemployment claims held for an all time low for

at a catholic church as police investigate the vandalism as a hate crime. a new cross was installed and blessed. police are classifying this as a hate crime because it happened on ash wednesday. oakland police have their hand full tonight investigating at least five shootings that happened in less than 24 hours. four of them happened in a span of 12 hours starting at 9:15 last night at 44th and international boulevard. three of the five took place in west oakland about 90 minutes ago on 14th street. the victim in the shooting that happened this morning at 63rd and market is identified as an 18-year-old berkeley high student. police say he was riding his bicycle about 8:15 this morning when he was shot by a gunman

who was on another bicycle. none of the five shootings is fatal. seems like gun shootings are almost a part of life in oakland. john sasaki talks to them about how do they deal with it and how do they buy a gun without a permit. >> reporter: that sixth shooted happened in west oakland and that victim called police and was tended to by paramedics. youth up vising is a center that serves as an oasis in places where crime is hard to avoid. >> i've been walking and had a gun pulled on me. it's a normal thing about being in oakland. >> reporter: he says it happens. crimes that don't surprise anyone. >> i know people who have guns

and they are under 18, and i'm like how is that possible. it's too easy, it's easy access. >> reporter: she's added she's heard of elementary school students with guns. this man says if he wanted to he could easily go out and buy a gun. >> find someone who knows where to get the guns. and give them the money. >> reporter: how much? >> like 200, depending on what kind of gun you want. >> you will find a young person with a gun and you say, what are you thinking, tell me what's going on and they say i'm afraid. i'm afraid to go to school, i'm afraid to walk in my neighborhood. >> reporter: crime and violence may be scaring some of these people out of the city. >> i made a promise to myself, when i have my girlfriend, and when my girlfriend has a baby, i'm going to leave oakland.

>> reporter: a safer city. live in oakland i'm john sasaki, ktvu channel 2 news. the rising cost of gas is fueling debate now in the presidential campaign. here in california, gas prices have gone up 23-cents in just the past week. republican candidates are blaming president obama. the president said he wants to open new areas for exploration. he also pointed to the millions of the dollars the government gives companies in the forms of subsidies. >> right now 4 billion of your tax dollars subsidied the oil industry every year. $4billion. they don't need a subsidy. >> reporter: there are several reasons for the spike in gas prices in the west. the tesoro refinery in martinez has been shut down longer than expected for maintenance. also a fire shut down another refinery in washington. plus there are the tensions with iran which is a major oil producing company. more details on how much

prices have gone up. aaa says a gallon of regular sold for four -- for $4.14 in oakland today. maryland is about to become the eighth state to legalize same-sex marriage. m. maryland's legal house of maryland passed the legislation today. governor o'malley passed the bill. and coming up at 10:45 tonight. an emotional night in the south bay. dozens of people are honored with the nation's highest civilian award and some have waited decades. in the central valley, an attempt to save malnourished chickens in an abandoned egg farm. tens of thousands of bird were found dead or dying on property leased by a bay area man.

>> late this afternoon, animal rescue groups came running. carrying dog crates, rabbit cages, anything that could hold a chicken and give it a chance at life away from here. >> it was tremendously bad and unfortunate situation. >> reporter: these are the lucky ones. several thousand chickens that have survived out of 50,000 two weeks here without water or food. a tip led authorities here to this abandoned chicken farm just outside modesto. >> they're starving, literally. >> reporter: two buildings the lenght of football fields crammed full of dead and dying egglaying henless. most of those already not dead were euthanized too far gone to save. >> these were the birds who fell down between the cracks and were living in the sewage that's below the live chickens. >> reporter: authorities say a bay area man chung leased the

mile -- number 67-miles-per- hour topped the 40-miles-per- hour in fairfield. santa rosa downtown was 80 today. yesterday it was the airport that was 80 degrees. here's the picture, not a very february like day. these are the highs from today, highs tomorrow they are coming down. daytime highs tomorrow instead of upper 70s and mid-70s are going to be in the 60s most likely in the low 70s at best. so tomorrow, it's going to be a cooler day and we cooled further as we go into the weekend. i'll be back here in just a few minutes. san francisco firefighters are teaming up to fight a health crisis facing women firefighters in their own ranks. the united fire servicewomen donated $20,000 to the firefighters cancer prevention fund. last night we told you about a high rate of breast cancer among women firefighters in the city. san francisco firefighters raised the money by selling breast cancer awareness t- shirts. she was struck and dragged by a nummi train. how trying to take a shortcut while walking her dog nearly caused a woman her life.

plus a bay area university considered a big shift in its admission policy. it's a change that will affect local high school students. comfort couldn't hurt.

a woman is remarkably good condition tonight after being dragged near the nummi train station today. ktvu's sal castaneda explains how taking a shortcut could have taken her life. >> reporter: a scary scene this afternoon. many say it's a miracle a woman survived with relatively minor injuries after she was hit and dragged by a streetcar. >> the first thing i saw was her legs sticking out. >> reporter: just before 2:00, a woman walking her dog came upon a stopped light rail vehicle at irving near second avenue. she attempted to get around the streetcar by stepping over the coupling in between the trains. >> she tended to lift the dog

up to take him over the coupling, that's when the streetcar proceeded. >> reporter: the firefighter rescue teams had to use jacks to lift the train up before the woman could be freed. >> she was done already, but i was just happy to see her, when i told her what happened, she said i'm still breathing. >> reporter: when the rescue continued a big crowd gathered. >> it took about 15, 20 minutes for the crews to lift the train enough to remove her. when crews did that, the crowd broke into cheers. >> reporter: witnesses tell me the dog was not injured. in san francisco, sal castaneda, ktvu channel 2 news. police in san francisco say

they have recovered 21 stolen bicycles after a man spotted his bike for sale on craigslist, officers arrested two people in connection with those thefts. as we reported just last week, police in the mission district were warning about a surge in stolen bikes. to find out if your bike is among those recovered call the engel side station in san francisco. 75 agents from as many as 20 different agencies participated in the operations. they made three arrests including daniel danine and a teenager from nevado. those suspects are accused of downloading child pornography as young as inat that in -- as young as infants.

>> it's currently the fastest growing crime in the u.s. in the last few months, 20 similar arrests have been made around the bay area. authorities say most of the suspects have no criminal records. a livermore teacher accused of having sex with a boy pled not guilty today. mary johnson was arrested january 22nd. livermore police say she had a sexual relationship with a boy who is under the age of 15. they say that relationship ended early last year. johnson is currently being held at santa rita jail. it is one of the deadliest military training accidents in years. the circumstances surrounding the collision of two helicopters and why marines risk their lives. we're monitoring that fire still burning in napa county tonight. we'll have an update for you after the break. more now on that fire that's still burning at this hour in rugged terrain in napa county above the silverado country club. firefighters remain on the scene keeping an eye on hot spots. firefighters are providing structure protection. so far the flames have burned 40 acres. the fire started at a vineyard where someone was burning debris. the wind kicks up and then kicked up the flames. the good news is those winds are expected to die down overnight. the fire is 50% contained. firefighters hope to have it fully contained by tomorrow. you can check with ktvu.com for the updates on the fire. administrators of san jose state are poised and along- standing perk for high school students in santa clara county. it's called the local area guarantee. and as ktvu maureen naylor explains it's about to go away

because of the growing popularity of the campus. >> reporter: the san jose state student who grew up in the area considers herself lucky. >> i wanted to stay close to home. >> reporter: because it can soon be harder for other bay students to stay close to home. tpár the first time in its history, san jose -- for the first time in its history, san jose is considered places a higher threshold. >> nobody thinks this is a good situation how are we don't have any choices. >> reporter: that's because the school received a record 40,000 plus applications this year. whaoáeul the csu system faces cuts. >> students should be able to get into other csu campuses. it'll be difficult if they have to travel or move. we acknowledge that. >> gas is expensive, you're not only going to pay for tuition but other expenses such as your food and your cars and dorm.

>> reporter: they shouldn't have higher thresholds if they live around here, that's what i always thought. >> everything is impacted here. even if you have a good application, you still don't get into the mayor you have. >> reporter: university leaders are expected to make this decision final tomorrow. in san jose, maureen naylor, ktvu channel 2 news. we asked viewers about san jose's plan to end that long- standing admissions process. we asked if high school students from the immediate area should get special consideration. nelson guerrero wrote yes we should. it's hard enough trying to get accepted at a state school. it's important if we don't want to leave the bay area or our family is here. another comment this one coming from sandra evans, sandra had a different take. she wrote no, being local shouldn't get somebody special consideration over others

plea in his behalf. perrero is a san jose resident. he was driving a plane similar to this one when someone said he buzzed by some cars. this was one of the deadliest military accidents in years. >> reporter: aerial pictures show the scene of a tragedy where seven marines lost their lives wednesday night when two military helicopters collided during a training exercise. the choppers involved cobra and huey helicopters much like this. the incident happened in the remote yuma training area.

it's an area favored by the military because the hot dusty conditions mimic those in war zones like afghanistan and iraq. >> training at nighttime is something that's hard to accomplish because of the visibility. >> reporter: last september a cobra chopper came down where two marines were killed. in july another marine was killed in a similar incident. >> it's a marine core model, fight like you train, train light you fight. as hard as combat is, the things we do back here training wise do have a lot of inherent risks. it will be at least 24 hours before the names of the seven killed are released. in the west coast newsroom,

a federal appeals court in san francisco upheld a california law today that allows jailers to take dna samples from anyone arrested for alleged felonies. in a 2-1 decision the ninth circuit says dna swabbing is an

intimidation tactic. an aclu lawyer says he may petition for a full ninth circuit hearing. -- as it tries to stave off millions of the dollars in potential losses. congress has been debating legislation to save the agency but it's been slow going. and today the service announced the closing of 223 mail processing plants that includes bay area plants in petaluma. the closures are expected in late may or june. proctor and gamble announced plans to cut 5,700 jobs today. the cincinnati based company says the cuts will come in plants. it will also positions in

brazil, china, poland and other countries. turns out oakland had to lay off fewer city workers than feared. they had to make cuts because of the loss of $28 million. yesterday 21 workers lost their jobs instead of the 80 that was first estimated. one effect will be fewer illegal dumping patrols. another will be reduced staff at recreation centers and the city's tv stations ktop. in news of the world tonight in afghanistan, outrage over the burning of a koran sparked more protests. protesters tried to run another base. the u.s. military apologized for burning the koran saying it was a mistake. 16 people were killed, some of the journalists wounded yesterday sent out a video today asking for help. edith bubie says her leg was

broken and needs surgery. two other journalists were killed in that same attack. researchers say they have discovered a flaw in an experiment that appeared to deny the laws of physics. the experiment would have proved einstein incorrect. a man shot the video while at the orlando airport. you can see the trail of smoke there and then you will see how it splits in two. this is only the second amateur video of the disaster to go public. you will recall challenger broke apart a little more than a minute after its launch from cape canaveral florida in january of 1986. all six astronauts on board died. their families were put in camps but they fought for their country, tonight they were

new at 10:00, a long overdue honor for 250 americans. they all received the medal of honor. >> reporter: i'm at the san jose war memorial. tonight some very special veterans of world war ii were finally given their just recognition. they read their names one by one. japanese americans veterans who fought in world war ii. now 70 years later they were each given congressional world medals.

>> i do need to take this. i feel real proud. >> reporter: these men served in the 442nd regimental team. the most decorated units in history. more than 1,000 american japanese served, fought and died for their country while many of their families were incarcerated in internment camps. >> we were fortunately put there without a trial or being accused of anything wrong. >> i think they should have done more to the parents that were left behind the camp. but as far as myself i'm not mad about it. i did my duty, what i was told to do and that was it. >> reporter: 150 from the bay area were honored tonight. more than half were represented

by widows or surviving family members. >> it's great for the family. >> reporter: we were in this war for one thing, to prove our loyalty. they paid tribute to those who couldn't be here tonight and for those who remain living symbols of american heros a grateful nation finally says thank you. live in san jose, lloyd lacuesta, ktvu channel 2 news. a new study from uc san francisco shows most elementary school students are not receiving enough physical education. state law requires schools to provide 100 minutes a week of physical education to children in elementary school. the uscf research shows, in san francisco 80% of schools fall short. most students receive only half

of what the schools require. >> it helps classroom behavior, memory, dismin and can improve academic performance -- discipline and can improve academic performance. only four weeks left of winter and still not looking good for the sierra snow pack. there was hardly any snow. in fact, it was the smallest amount since the 1930s. today electronic readings showed water content is only 30% of normal. surveyors plan to take physical measurements next tuesday. the next silver lining is that reservoirs are still in pretty good shape thanks to last year's epic snow pack. we're not seeing rain or snow any time soon around here. we had a second day of record high temperatures in the bay area. won't be records today. temperatures trending down toward the weekend. we go outside, we had a lot of wind. the wind advisory has been dropped but what the wind does

is it was clearing the atmosphere. you can see the sierra nevada range. you can see the white snow cap mountains from the oakland hills. that's pretty impressive. winds are still blowing out. i have gusts to 25 miles per hour offshore. those winds gusts will slowly subside. hopefully helping firefighters out in the soda fire. breezy tonight, no wind advisory. tomorrow is mostly sunny but not 80s. upper 70s. but 60s and low 70s. still very nice. over night lows are in the 40s. 39 in napa, 40 in concord. i have 60s in part of san francisco. temperatures are in the low 60s right now. that's unusual for february. you see some 50s and 60s poking along the coast. record heat second day in a row. but that high pressure weak e
