you'll hear why herzog did not turn in his friend. we've been hearing about a rash of shootings in oakland for days. when gun shots rang out in east oakland today, it brought out the reality of street violence. now a mother who moved her baby out of the way just in time. rita? >> unless you live in a killing zone it's hard to imagine how fragile life can be. a hot friday at high noon in a neighborhood handy man known as bo dean was snoozing in this chair when suddenly men with guns yelled at him to wake up. he ran and the gunfire began. >> pop, pop! they emptied them. >> reporter: those are tears of relief, not grief. tamara's one-year-old daughter, amera, was not hit.

>> she's just started walking. she was standing at the screen door. something said pull her from the scene door. >> reporter: she did. her baby lived. >> there's two bullet holes this big through the screen door. >> reporter: the mom, baby, and toddler, her increase, were all there. the driveway is littered with a dozen bullet casings. >> they heard a bunch of gunfire. they turned the fire and saw several people running. one individual was running with a gun. >> reporter: police chased the gunman over two blocks away. they arrested this young man who said he was 18 and told me he was scared. police say he came out of the backyard having shed his shoes and clothes and gun. >> does it look like it was fired? >> yes, when we recovered it, the action was out, suggesting it ran out of bullets. >> reporter: police are looking for a second gunman. the intended victim, he was not hit

in the barrage of bullets and ran away. >> i don't care where he is. i just thank god the kids didn't get shot and i didn't get shot. >> reporter: so it goes, living in oakland's so called hot spot. >> firefighters are still trying to completely surround a 200-acre wild fire. the fire is only 50% contained after threatening several homes yesterday. we have live team coverage tonight. we begin with john fowler who is live in napa county this evening. >> as you said, fire officials have confirmed it's 50% contained and started right here at this agricultural burn that we've learned appears to be illegal. >> eagle scouts, knowing a thing or two about fire, i would say yesterday was not the best day to have a burn day. >> reporter: as helicopters and

ground crews mop up his afternoon. officials told me there was no notification for a burn here. that's a violation. we've also learned a land scape contractor burned brush and stumps here. witnesses telling us no one appeared to be at the burn site attending it until it was out. that's another violation. winds were well over the limit for approved burns. >> conditions were right yesterday evening and we had a large wild land fire. >> reporter: winds are dying now and the air is cooling. firefighters just told me the 50% containment number likely will go up this evening. they say the unnamed contractor could be liable for possible criminal violations. john fowler, ktvu channel 2 news. >> cal fire told ktvu it may deploy it's plane

fleet ahead of schedule because of the fires. cal fire is now looking at moving some of its aircraft to their southern air base within the next couple of weeks. the agency owns 23 air tankers, 11 helicopters, and 14 spotter planes. >> bill martin joins us now with what he's seeing. >> that wind advisory was in effect yesterday, not in effect today. the wind direction now is coming out of a weatherly direction or southwesterly. that's a cooling direction and also adding humidity to the fire zone. yesterday the humidity was around 10, 12%. today it's at 36%. any firefighter will tell you that's not that dry and good news for them. temperature today got to 77 degrees. a very, very different situation if you're a firefighter, you're really appreciating the big change in the weather.

we're also seeing a big change in our temperatures. numbers will fall off toward the weekend. >> it turns out it was oxygen tanks in an elderly woman's carry-on bag that caused an evacuation at a terminal at sfo today. just before 11:30 this morning, screeners found the tanks as the woman try today go through security. they initially thought they might be bombs and their fears were heightened when they questioned the woman and she said she didn't pack her bags and didn't know what was in there. 10 flights were delayed. >> crews removed a boat today after police say the driver ran aground in a drunk boating incident. a huge crane lifted the boat, la bon bon off the rocks this afternoon. the witness saw the boat leave the dock at jack london square. >> they're kind of obeying the speed limit out here. slowed down a bit, just puttered out.

>> after the boat crashed, police arrested 37-year-old tanesia thompson for possession of stolen property. >> ashton kutcher was with police during a massive child pornography sweep yesterday. he was invited to join the task force. authorities served search warrants. he's a founder of an organization which hopes to end child sex trafficking. kutcher and the director both went along on the child porn sweep. >> david stevenson joins us live in san francisco with photos that he obtained today that could play a central role in a criminal trial. david? >> prosecutors today release d these photos of the sheriff's

wife. even as legal analysts said, their case may be at risk. san francisco sheriff had little to say on the first day of his domestic violence trial, but these images speak volumes about the case. the stills are taken from a videotape. a day after he allegedly grabbed his wife's arm hard enough to leave the bruise seen here. prosecutors hope to show a jury the video along with an e-mail lopez sent to madison during a family trip to monterey. we're coming back tomorrow and ross will work again and i'll have my life and peace back. madison responded, controlling and withholding money, trying to isolate you from friends and family. i know ross doesn't realize it yet, but he's about to find out or deny forever he's an abusive husband. lopez is denying her husband abused her and that the

commute. san francisco municipal group is holding meetings to discuss the plan for the upcoming two-year budget. they face a $19.6 million deficit for the next fiscal year. the meetings will be held in march and april. the first is on march 3rd at the agency's headquarters. >> gunfire breaks out at a mall. >> lieutenant governor gavin newsom stirs up controversy by saying his own job should be eliminated. the debate over the powerful position he says isn't powerful enough. talking about her daughter, an employee who worked last night. >> this is big crime. >> reporter: after repeat ed attempts to reach concord police, we can only say tonight that the department is not releasing the suspect's names. they were charged with assault with a deadly weapon and battery. we tried contacting jcpenney officials and have not heard back from them. jade hernandez. >> a san ramon man accused of beating his mother with a baseball bat appeared in court today. the attack happened monday in san ramon. the mother suffered several strikes to her head and body but doctors say she is expected to survive. ricks is being held in the contra costa county jail in lieu of $1 million jail. >> a less invasive prenatal

test created by doctors at sanford is expected to be available to pregnant woman next week. it can detect problems with the fetus as early as 10 weeks in to pregnancy. it would replace amniocentesis and cvs. >> 29 schools have reported outbreaks of noro virus since january and 21 long-term care facilities have had outbreaks. there have been no quarantines or required closures this year. health officials say the single most important thing you can do to stop norovirus is to wash your hands. alcohol based sanitizers don't kill the virus.
