>> good morning. welcome to mornings on 2 it is sunday. >> good morning. big drop in temperatures. let's get to rosemary and quick look at the forecast. >> good morning. this morning temperatures are down anywhere from 10 to 20 degrees from just yesterday. the winds have calmed down. they will be back for the afternoon but definitely a frostie start. some of us below freezing. we're looking attempts to sink below normal for this time of year and a shower chance with us. this system so cold may get a dusting for some of our local mountains. i'll share all this coming up in just a little bit. >> san jose police say a fight early this morning turned into a gun battle that left one dead and two injured. it happened at the mexican restaurant at murphy avenue at oakland road. >> the shopping center is completely closed off.

police have the area closed off with crime scene tape. and police are still gathering evidence and still interviewing people about exactly what happened. three people were shot in this parking lot. one of the three victims died from his injuries at the hospital. according to a witness, the three victims have all been part of a larger group celebrating a birthday. it was just before 1:00 in the morning that that party started to get a little rowdy. the witness says he saw a confrontation break out and a group of people left the restaurant to go outside in the parking lot and that's where a fight broke out. >> the fight escalated into shots fired and officers responded to the scene to investigate the situation. >> as soon as it started getting out of hand where nobody could handle it they closed the doors and told us all to stay inside. >> now that man you heard from was performing with his band at the restaurant when this happened. after the shooting there were 150 people inside the restaurant. they were all kept inside as police were called to the

scene. they told us this is usually a family friendly rest ant. his band played here many times before and he says there's never been a problem here before. at this point police don't know the exact motive for the shooting or what triggered it but three people were shot in this parking lot outside the restaurant. one of the three died from his injuries tateyama hospital earlier this morning and police are still looking for the suspect. >> a little more than 30 minutes before the shooting police went to winston street after a man called 911 to say he had been shot. officers found him suffering from one gunshot wound and he was taken to the hospital. they don't believe the shootings are related. >> occupy protestors gathered once again, this time to demonstrate against the resent police shooting involving oscar grant's cousin. this is how 4th and international looked around

midnight. 75 to 100 protestors marched to the station in a show of solidarity with tony jones. multiple media reports say jones is the man oakland police shot last week following a chase in east oakland. police claim jones was armed with a gun. protestors tried to enter the station but police blocked people from getting inside. >> the sheriff's office is investigating the death of a man whose body was found in the delta waters. deputies made the discovery yesterday. detectives identified the victim as a 24 year old resident but they're not releasing his name. they say it is still too early to tell how he died. an autopsy is scheduled for tomorrow. >> this morning, four men are in police custody after taking over a south san francisco business. officers say the 22 year old and 23 year old and two other men went to this canal street business yesterday afternoon. police say they were there to

confront the manager who had recently fired one of them. one of the suspects pulled out a baseball bat and another pulled out a gun. after they left police swarmed the neighborhood where he reportedly lived. >> everything locked up on the streets and snipers up on the road. residents were told to smelter in place and swat teams locked down the area. he eventually surrendered and he was arrested when he tried to return to the area. the other two men with them at the business were also arrested. no one was injured in the shooting. >> a fire started is under investigation. that fire was reported last night in a trash can near lexington avenue. sheriff deputies say they found

glass from a bottle, cloth and bird residue on the road near the trash can. anyone with information is asked to call the sheriff's department. >> an 11 year old girl died just hours after getting into a fight at her elementary school. this is the memorial set up. long beach police say on friday after school she got into a fight with a girl. after the fight she started to complain her head hurt and was taken to the hospital and rushed into surgery where she died. >> they were fighting just for a boy. just for a boy. >> what do you think about that? >> it's stupid. >> an autopsy is being done to determine the cause of death. police say weapons were not used during the fight and witnesses say no one was knocked down. no arrests have been made. >> this spring dozens of oakland teachers will need to reapply for their jobs. the new policy applies to teachers at certain high schools. according to the district they need to reapply for their position which include more responsibility a shorter summer and more money. some say making them reapply is

creating a lot of mistrust. >> republicans are wrapping up their three day convention today. on this morning's agenda a 7:15 prayer breakfast. a second day of the convention kicked off yesterday with a town hall meeting featuring gop presidential candidate newt gingrich. he spent his time going after president obama's policies and also stressed the importance of california to the republican party. >> it is impossible for the republican party to be a governing majority without having a very significant role in california and it's impossible to fix sacramento without a strong republican party. >> former presidential candidate herman cain helped introduce gingrich as the primary's continue across the country, a new push is underway to change the day of week americans go to the polls. coming up in 7 minutes, the idea being proposed and why its

meeting some resistance. >> the days of bridge toll takers are numbered. by the end of the year they'll start testing a new system. that will allow drivers to pay with fast track or by having their license plate photographed. in february of 2013 the last toll taker will leave. once the new system is in place there it will be expanded to obey area bridges. the system is expected to save $19.2 million over the first 8 years. >> a power failure is being blamed for an hour long shut down. the power went out around 5:30 last night and then at 7:00 the highway patrol closed to repairs could be made. this caused a long back up for traffic heading east through the tunnel. the traffic got even worse later in the evening after a pick up truck collided with a sedan near the fish ranch road off ramp. no one was hurt. >> gas prices continue to surge this weekend. at some bay area gas stations

prices are closing in on 450 a gallon. it isn't likely to go away any time soon. gas station owners say the high prices aren't just hard on drivers, they are also hurting their business. >> people don't come in. we make our money inside the store. they don't come in or when they do come in they don't spend as much. >> gas price jumped about 2 cents across the bay area overnight. triple a says the average price for a gallon of regular gas is now 4.32 a gallon. in oakland, 4.26 and in san jose, the price is 4.27. >> gas prices continue to go up, weather continues to go down, temperatures, any chance of a warm up or big warm up at least later today. >> no, in fact our temperatures will continue to tumble. we're looking at areas below normal for this time of year. when we were sitting in the 70s near 80s just a few days ago. a live lookout side our doors. the sun is up, mostly blue

skies but it is chilly. we're talking 30s and below freezing in some spots for our inland and north bay and inhand east bay areas. 31 degrees santa rosa. winds aren't blowing. we don't have to worry about that if we're drive ago cross the bridges this morning. they will be back. sunny and breezy conditions for the afternoon with increasing clouds for the second half of the day. 38 in heyward right now. areas around stanford, 44 hao view, 43 san jose as well as the city. satellite radar showing you what's going on here, right? here are the clouds that will come first. the system off the coast here, it looks like right between oregon and california will be sliding down the coastline in the overnight hours. it's going to bring us just a slight chance for precip but boy is this a cold storm. snow level do you understand to about 2500 feet. some of the higher peaks could

pick up a rain/snow mix, maybe even a little dust. let's take a look at what happeneds here, we're turning mostly cloudy, first we'll see the high clouds, the soft sunshine and then by the evening hours they could thicken up just a bit. now, 3:00, 4:00 in the morning you can see monterey south going to get most of this, it's not going to be a lot but that's where most of it will fall. santa cruz mountains, the possibility there and monday afternoon into tuesday we get a break. the sierra also going to see snow all the way down into the foothills. tuesday night into wednesday morning we could wake up with wet weather for the wednesday morning drive. this continues to hold together and that will be our better shot at getting some rain. not as cold, but still we'll be chilly and we're going to remain below average in most cases. cool turning breezy once again for the second half of the day. off to a very cold start. increasing clouds for the afternoon. temperatures will struggle. take a look at the afternoon highs.

rise and shine. good morning for you. dig out the gloves and the scarf. it's going to be a chilly one this afternoon. >> a strong earthquake rattles buildings and nerves today. this video was shot right at the 5.9 quake struck. you can see lamps swaying there on the screen. television stations are reporting some minor property damage but no injuries have been reported. more fall out from the burning at a u.s. military base in afghanistan. he's now urging calm in his country after five days of violent protests. he spoke in a televised address to the station earlier this morning. 30 people died in less than one week as a result of those protests including two american nato officers. >> we have a tense week behind us.

it is very regretful to see the loss off life, again. >> protests appear to be calming down today. there were no reports tonight. >> in election 2012 coverage only two days until the michigan gop primary and the candidates are continuing their sprint across the state. mitt romney appeared with his wife yesterday in flint. he tried to appeal to college students saying he wants to make the economy strong r for them to they can find jobs when they graduate. rick santorum also appeared in michigan but made an appearance later in the day at tennessee. he spoke outside of chattanooga and that's where he called president obama a snob for saying he wants every child in the country to go to college. back in michigan, ron paul come pained in mt. pleasant. he continues to break with the republican platform pushing for an end to global involvement and the decriminalization of

maryland. he says he's trying to keep delegate's head of super tuesday and the gop convention. >> as primary elections continue a new push is underway to change the day of the week americans go to the polls. right now most elections take place on tuesday but a new york congressman will soon into introduce the weekend voting act which would move elections to saturdays and sundays. the idea is to get more people to vote. >> if your goal is to increase participation, don't change the system. figure out how to bring more people into the system. >> a lot of communities across america, people vote in places of worship. a lot of those places are not going to be available. >> a government study found weekend voting would not boost voter turn out. the study also found possible security issue with ballots and equipment if voting occurs over a two day period. >> the chinese government lifted its block on goggles social networking site and eight pierce to be popular with

come here, you have to see this. we came running out and i'm just so -- serendipity that he just happened to walk by my house. >> he wrapped up a 12 year journey that included walk ago cross the country six times. he says he does it in honor of his 26 year old son that committed suicide in 1999 and his daughter who died of an accidental drug overdose five years later. one woman was touched by his message of love life. >> my father committed suicide about 20 years ago and it just really touched me. my boys just happened to be look out our window and said mom come here you have to see this. so we came running out and i'm just so, you know, serendipity that he just happened to walk by my house. >> he says he has hopes his message helped save people that think about suicide. he says while he's getting too old to keep walking he plans on continuing to spread his love of life by driving.

>> hi winds are blamed for this building cop lapse. take a look it was reduced to rubble. they spent the day sifting through the debris. nobody was hurt but that neighborhood was evacuated. a high wind advisory is in effect until tonight. freezing winds are also a problem in the big apple. gusts of up to 50 miles per hour are being reported in new york city. this woman as you can see barely walking against that wind. others were bundle up and trying to keep warm as best they could. >> too cold. i want to go back to the west coast. >> there are fears that the strong gusts could bring down trees and power lines. the national weather service is advising people to clear their

a report of a fight turned into a homicide investigation this morning. good morning and welcome back to mornings on 2. >> police responded to a fight at the mexican restaurant at murphy avenue. three people were shot, one of the victims died. alley is live with what a witness saw and heard. >> it all happened more than five hours ago but the area is still closed off. police are still at the scene. [indiscernable] >> now this parking lot is where three people were shot and one of the shooting victims died from his injuries tateyama hospital early this morning. according to a witness, the three victims had been part of a larger group celebrating a birthday at the restaurant. it was just before 1:00 a.m. that that party started to get

rowdy. the witness saw a confrontation in the restaurant and a small group of people went outside into the parking lot. that's where a fight broke out and that fight escalated to gun fire. we talked to a man performing with his band inside the restaurant when this all happened. he said right after shooting in the parking lot all of the other restaurant patrons, they were kept inside the building on lock down as police responded to the crime. >> it was pretty scary because we don't -- normally when i played here before, we don't have -- we don't have rowdiness and a lot of out of control crowds like this. usually, if it's one or two people, it's dealt with right then and there and doesn't get to the point where there's several people involved and then it results in a shooting or anything. >> now police don't know why this fight broke out. they're still working on establishing a motive. we don't know if the three shooting victims are all part of the same family and extended family, what their relationship is with one another and police

are still interviewing witnesses and looking for the gunman involved. >> we have new video now. firefighters responded to the scene on lincoln avenue just after 5:00 this morning. when crews arrived they found flames shooting through the roof of the 3 story building. that fire and smoke could be seen across nearby highway 101. >> that fire was through the roof and well involved and two apartment units, when firefighters arrived here on scene, they quickly searched the building and were able to find two residents and were rescued without harm. >> no word yet on what caused that fire. the red cross is now helping the victims. >> also overnight a man was killed in a hit-and-run crash. police say a driver ran a red light around 3:30 this morning and hit another car. the driver of the car that was hit was pronounced dead at the

scene. the driver of the car that ran the red light ran from the scene and police are still searching for him. >> two airport security officers have been removed from duty for leaving a met dahl detector unattended. it was left alone for just about a minute but that was enough time for five people to walk through without being screened. officials shut down parts of the airport so they could track those people down. >> during that time, about a dozen flights were held while the security alert was in force -- while the security situation was happening. at one point i understand there was a back up at the tsa, several people waiting to go through. >> the tsa says all five people, four passengers and an airport vendor were located and rescreened. the tsa is trying to figure out why the machine was left unsupervised. >> a man is driving to get a driver's license to illegal immigrants. it would allow immigrants to be

licensed tested and insured. the last time he tried to pass a similar law it was vetoes. now he is hoping to get it to governor brown's desk. however during his campaign brown spoke out against licenses illegal immigrants saying it sends the wrong signal. >> sex crimes on public transit on the rise. last year police documented 95 sex related crimes on transit. the most common being indecent exposure. they say that number of 95 is incredibly low considering there were 370 million passengers. >> they're trying to decide the future of an 850-acre swat of land that will be home to the newest bart station. it is scheduled to open on warm springs boulevard. right now the area surrounding the station is mostly empty but officials are working on a plan

to figure out the west way to use the land. commercial and research development along with residential buildings. >> the plan for the central subway in san francisco is moving forward. the 1.7-mile track will con they can to china town. underground utilities have been moved to make way for the digging and last week more funds were approved. that whole project is expected to cost $1.6 billion. >> no decisions have been made but san jose is getting ready to welcome the oakland as. the city council has approved half a million dollars for work on a road project to help accommodate a new ballpark near hp pavilion. a's ownership wants to move the team to san jose but has to wait for approval. the giants say the move would violate it's territorial rights. >> occupy protestors teamed up

this weekend to mark the second anniversary of a country club lockout. protestors and employees demonstrated yesterday at the kastle wood country club in an attempt at political sat tiier. some of them dressed up as the 1%. they locked out union employees two years ago after failing to reach an agreement on a new contract. >> we presented them a proposal on december 22nd, 2009. they have yet to vote on that proposal. >> it was a bad offer so they were trying to reach a compromise through negotiation. >> it was used to pay 100% of health care cost but the management says it can't offset that cost anymore because of the economy and the rising price of health care. >> a dramatic rescue when a tree trimming mishap left a man dangling 30 feet in the air. he was lowered from the tree.

fire officials say the homeowner was knocked unconscious when a branch he cut hit him in the head yesterday afternoon. after being hit he was left hanging from his harness. rescue crew hearsay to wait for a ladder truck in order to get him down. the 51 year old victim was taken to the medical center where he is expected to survive. >> investigators are looking into whether the person that started the fire is going to face any fines. as we first told you yesterday here crew versus now fully controlled that napa county fire. yesterday they were still on scene monitoring hotspots. investigators say the fire started on thursday when a pile of burning brush quickly got out of control. yesterday fire crews were also out in crockett fighting a two alarm fire at a former laundromat. the fire department says the owner was working on the roof with a torch when the laundry lint caught on fire in the attic. firefighters say they didn't have to go far to get to the scene. >> we were at st. rose church

according to a witness, three shooting victims had been part of a larger group celebrating a birthday inside the restaurant. it was just before 1:00 this morning when the party got a little rowdy. a man performing at the restaurant with his band told us he saw some sort of confrontation break out inside the restaurant and then a small group of people went outside into the parking lot. >> we're going to get back up on stage to do our very last set for the night and at some point everybody got locked in the place. there was a lot of comotion going on outside. >> the fight escalated into shots fired and officers responded to the scene to investigate the situation. >> now the band member told us right after the shooting in the parking lot all of the other restaurant patrons were kept inside the building on lock down as the investigation began. police don't know why the fight broke out. they're still trying to establish a motive and we don't know at this point the relationship between the three

leaving one person dead and three people hurt. welcome back to mornings on 2. >> san jose's 5th homicide of the year happened early this morning outside of a restaurant. she is live this morning with us with what investigators say started it all. >> well it happened more than six hours ago but there is still an active crime scene out here. this is the parking lot of the restaurant where it all happened. you can see crime scene technicians laid out markers on the pavement. they're packing some of the evidence they gathered this morning. the parking lot is still closed off but we have seen police let some people come in to get their cars that have been stuck here where this all happened. this is where three people were shot. one of the shooting victims died from his injuries tateyama hospital. overnight this became a homicide investigation. according to a witness the three victims had been part of a larger group celebrating a birthday inside the restaurant. it was just before 1:00 this morning when according to the witness the party started to get rowdy.

performed here many times before. he never experienced a problem in the past and he says it's usually a very family friendly restaurant. police don't know why the fight broke out. they are still working on establishing a motive. at this point we don't know the identity of the victims or the relationship between the victims. as you can see, police are still out here at the scene. this parking lot is still for the most part closed off. we're told investigators are still interviewing witnesses and trying to find the people responsible for this. >> just about 30 minutes before police went to winston street after a man called 911 to say he had been shot. officers did find him with one gunshot wound. he was transported to the hospital and is expected to survive. police don't believe two shootings are related. no arrests have been made. >> an early morning fire in the north bay is under investigation. firefighters responded to the

scene just after 5:00. when crews arrived they found flames shooting out of the roof of the building. that fire and smoke could be seen across the nearby highway. no one was hurt and no word on what caused the fire. the red cross is helping the victims. >> also in the north bay, the highway patrol is investigating a fatal overnight crash. it happened just after 1:00 this morning on highway 116 just east of highway 1. no word yet on what lead up to the crash but the person that reported the crash says the driver was bleeding from the head. >> as i first showed you friday night on the 10:00 news, ktvu obtained exclusive video of police interrogation that spread new light on a killing spree. she he was arrested in march of 1999. they were the killers. they had unearthed maps drawn by him. he is on death row for murder.

those convictions were later overturned on a technicality. he committed suicide in january. amber is going through the 19 hours of tape she obtained. she will have more on the police interview tonight at 5:00 and the 10:00 news. >> an autopsy is scheduled tomorrow for the body of a man found in delta waters. they made the discovery yesterday. detectives identified the victim as a 24 year old resident but they aren't releasing his name. they say it is still too early to tell how he died. >> investigators are now looking into whether the person that started the fire will face any fines. as we first told you yesterday, right here on mornings on 2, crews fully contained the fire. yesterday cal fire was still on site monitoring hotspots. the fire started thursday when a pile of burning brush from a nearby vineyard quickly got out of control. >> yesterday fire crews were also out in crockett fighting a two alarm fire at a former

laundromat. firefighters say the owner was working on the roof when laundry lint in the attic caught fire. firefighters say they didn't have far to go to get to the scene. >> were were at st. rose church and honoring one of our firefighters that passed away. >> as a precaution crews evacuated a senior center. no one was injured in the fire. >> plans for a central subway in san francisco back on track. the 1.7-mile track will extend by connecting the station to china town. the project has been getting a lot of negative attention by people that think it is too extensive but last week more funds were approved. the whole project is expected to cost $1.6 billion. >> sex crimes on public transit right here in the bay area are becoming more common even though most crimes are still unreported.

last year police documented 95 sex related crimes on transit. the most common being indecent exposure. they say the number of 95 is incredibly low considering there were 370 million passengers in the bay area. >> after leaving a met dahl detector unattended, two have been removed from duty. they say the met dahl detector was left alone for just about a minute but that was enough time for five people to walk through without being screened. officials shut down part of the airport for the people to be shut down. >> about a dozen flights were held while the security alert was in force. while the security situation was happening. at one point i understand there was a back up at the tsa, several people waiting to go through. >> the tsa says all five people, four passengers and an airport vendor were located and rescreened. they're now trying to figure

out why the machine was left unsupervised. >> the federal trade commission received close to 279,000 identity theft complaints last year. 24% of those complaints came from people who believe their social security numbers were stolen to file for tax refunds or apply for jobs. that's 8% more compared to the year before. officials say that trend is continuing into this year with 50,000 complaints filed every week. >> for the second time, a los angeles assembly man is trying to provide illegal immigrant with a driver's license. the legislation would allow immigrants to be licensed tested and insured. the last time he tried to pass a similar law it was vetoed. now he is hoping to get it to governor brown's desk. however, during his campaign, jerry brown spoke out against licensing illegal immigrants saying it sends the wrong message. >> well, no official decisions have been made but san jose is

getting ready to welcome the oakland as. the city council approved half a million dollars for work on a road project to help accommodate a new ballpark near hp pavilion. a's ownership wants to move the team but has to wait for approval from major league baseball. the giants say the move would violate territorial rights. >> they're trying to decide the future of 850 acres of land that will be home to the newest bart station. it's scheduled to open in 2015. right now the area surrounding the future station is mostly empty but officials are working on a community plan to figure out the best way to use that land. options include commercial and research development along with residential building. >> today marks the official launch of the 75th anniversary celebrations of the golden gate bridge. the ground breaking ceremony took place exactly 79 years ago on february 26th, 1933.

there it goes. we're looking at the possibility of maybe a little bit of rain, maybe a little bit of snow. i'm going to show you the forecast here. it is going to be over areas south of -- it looks like santa cruz, mt. hamilton and monterey going to get the best possibility of moisture with this. most of us are going to remain dry. for most of us it will be the cold weather that we feel and see throughout the afternoon. the clouds will be increasing for the second half of the day. the high clouds beginning to roll in about 1:00. tomorrow morning, this is the best shot we get here it looks like. maybe a little bit of moisture over santa cruz as well as mt. hamilton and areas over monterey. snow levels expected to drop down to about 2500 feet which means our higher peaks could get a rain/snow mix. tuesday we're dry but wednesday morning it looks like wednesday is going to be or our better bet at getting wet. we'll be tracking that for you.

protesting dating violence and they're spreading the message through dance. >> yesterday a flash mob was held at san francisco's union square, bay area teens staged a flash mob in an effort to prevent dating violence. many of the dancers wore t- shirts promoting a relationship remix among young couples. >> this was really just a fun and engaging way to get the community to get involved and be aware of the subject but really what we also wanted to do is have a good time and show that we can have fun talking about the subject. >> one in every three bay area teens knows someone physically abused. the demonstration is one of many taking place across the country as part of national teen dating violence awareness and revenge month. >> time now 8:42. hollywood's biggest night is hours away. who can win big at the oscars and how you can get your hands on one of those statues.

high clouds in the forecast for the afternoon. >> police in michigan are trying to find a man that attacked and carjacked an 86 year old world war ii veteran. it's caught on camera. it happened wednesday morning at a gas station. a man walked up to him, hit him, and then drove off with his car. he then crawled inside the gas station all while passing strangers who did not offer any help. >> i didn't know if they saw me crawling. they knew something was wrong, they should have but people don't want to get involved any anything now, you know. >> he says he's just happy his attacker did not shoot him. police recovered his car and are hoping to find possible clues inside. >> news of the world, north carolina's new leader is making new threats against south korea. the central news agency reports he ordered troops to launch a strike against south korea if the south provokes the attack.

located north of greece is experiencing the heaviest snow fall in 60 years. at least 11 and a half feet have fallen in some areas. the helicopters are delivering food, medicine and livestock feed. the last time they flew over this area was back in 1999. >> the u.s. navy was boosting it's presence in the gulf. the navy is now adding guns to its destroyers and ships. the additional weapon reuben tejada is needed in case iran tries to shut down the strait. it is considered important by the united states because much of the world's oil passes through waterway. a new billboard in west valley city it cut getting attention. the billboard says bomb iran but just above those words, the billboard also says support the troops with the word troops crossed out and followed with military industrial complex. >> it would be a war that would benefit what eisenhower called the complex, this isn't a war we need to fight. >> a lot of people are buying
