>> a battle is brewing over food trucks. i'm tori campbell. this is happening in san francisco, and we'll explain why the issue is how close they can park to schools. new at noon, joining us live from san francisco to explain why there's so much debate about vendor food and children. ali. >> reporter: it smells like fried food in union plaza in san francisco, and there is a debate

going on about how close these trucks should be allowed to set up near schools. the sign on jim anglis's truck makes it clear, they sell comfort food. >> the name is bacon fakon. that's the focus. we do burgers and grilled cheese. >> reporter: he's one of more than 150 food truck vendors in san francisco. >> i park close to market. >> reporter: in san francisco, they're not allowed to set up within 1500 feet of a public, middle or high school. if a new state bill becomes law, there would be more restrictions. no food trucks within 1500 of any school, private or public. they say it's a public health issue. >> it's undermining the children taking advantage of more helpful foods in the school kafteria, the breakfast programs and lunch programs. >> reporter: they have school truck vendors in san francisco crying foul. >> school kids aren't my target

audience. there's probably a lot of fast food restaurants they could run in and get a bag of chips and soda, as easily as they could come in and get some hand-cut fries. >> it's a one-size-fits-all measure for california. >> reporter: scott weaner says because the city is so dense, under the state-wide bill, food trucks would be barred from operating in most of the city. >> the heat would be off limits, the emission and castro. >> reporter: they want to scale back existing city regulations so trucks can set up closer to schools within one city block instead of three. >> this would help us achieve balance. mr. question #4: the assemblyman says there may be balance on his bill. >> we're willing to make modifications to adapt to a high density area like san francisco. >> reporter: he says something has to be done about kids eating unhealthy food. right now, 34% of california school kids are obese. >> thank you, ali. tonight, santa claira county will consider tough nutrition

standards. the new rules would apply to vnding machines in jails and hospitals and other place. the junk food would be replaced with fresh fruit, trail mix, water and iced tea. the new standards are part of the countiy obesity prevention efforts. if approved, the rules would take effect in july. a third student died following that school shooting that has shaken a community. chardon high school remains closed. 17-year-old tj lane opened fire in the cafeteria yesterday morning. two other students remain hospitalized. the ohio attorney general spoke today saying that investigators are still looking for a motive. >> well, i think anytime you have a tragedy like this, one of the things you want to find out is if there's any warning signs, if there's anything that, you know, we need to know about this

young man. >> reporter: members of the community held a vigil last night. some students described the suspected shooter as an outcast who was bullied. he also attended the separate academy that helps at-risk students. a source says lane just told authorities he stole the gun from his uncle and has just arrived at juvenile court for an initial appearance. the death of a 10-year-old girl who died in long beach after a fight with a classmate has been ruled a homicide. joanna ramos would have turned 11 in two weeks. police say she died of blunt force trauma to the head six hours after a fight with an 11-year-old girl. the fight happened friday and lasted less than a minute. ramos died while undergoing emergency surgery for a blood clot on her brain. there's still no word on when residents pushed from their homes by that four alarm apartment fire in mount view will be allowed back in. the fire broke out yesterday at the dana gardens apartments.

there are new developments this noon time. chambers shows us how it was kept in tact. >> reporter: he was able to salvage a few item this is morning, including his couch. this after a four alarm fire ripped through his apartment. >> i just asked my insurance agent for a quote on renter's insurance, but i hadn't signed the paperwork. >> reporter: throughout the night and into the morning, three mountain view fire crews checked for hot spots at the dana garden apartment complex. at first light this morning, investigators arrived back on scene to determine what caused the fire. >> moments before investigators were able to enter the building, a portion of the roof came crashing down landing on the sidewalk. luckily, no one was injured, but it temporarily put a halt in the investigation. >> reporter: this cell phone video shows flames and smoke billowing out of an apartment.

it took 65 firefighters about an hour and-a-half to get things under control. >> in all, they were all affected, meaning no one was able to stay in their home overnight. there were another four on the lower level receiving heavy smoke and water damage. this month, fire officials met with them to tell what would happen next. >> they may be able to get their belongings, but the chance of anybody staying there now is undetermined. >> reporter: no residents were injured. however, a firefighter did suffer minor injuries. paul chambers, ktvu, channel 2 news. after a long dry spell and record warm temperatures last week, rain is finally rolling into the bay area. the front edge of the system brought a few sprinkles to arenda county this past hour. our cameras caught people getting ready for the rain. meteorologist rosemary orozco said it could be a good one tonight. you'll hear her forecast in

about 14 minutes. bart passengers had a brief scare and a long commute this morning after someone spotted a man with a gun. it happened around 8:00 a.m. a train operator reported seeing a man with a gun in his waist band. three trains were stopped and bart police arrived with their guns drawn. but officers quickly learned the man was an off duty police officer. police say the gun was concealed and was only briefly visible. trains were delayed about 20 minutes. the dow jones keeps flirting with the 13,000 mark today. there were some mixed economic news out this morning. consumer confidence rose dramatically this month, and there was a surge in earnings by the biggest banks, making 2011 the most profitable time for the industry in the past five years. durable goods orders were down in january, and there was a drop in december home prices that sent the index to its lowest level since 2003. as you can see a live look at the big board, the dow up 13, at

12,996, and the nasdaq is up 12. s & p is up 2. it's all about jobs in the economy, the annual breakfast of san francisco business leaders this morning. coming up, what mayor ed lee says how the city is doing right now in terms of revenue and unemployment. cal-trans is getting ready to clean up a large homeless camp in the south bay. the camp is located near highway 87 and interstate 280 in san jose. christen captain joins us live to tell us why the camp wants to close up out of this area, christian. >> reporter: we have new information in the last 15 minutes or so. we are right underneath highway 87 right near willow street in san francisco, and we just learned that the cal-trans crew is about a quarter mile to the north of where we are right now. cal-trans is targeting camps like this. you can see in the distance here underneath the overpass, some of the debris left by some of the

homeless camps in this area, and cal-trans is targeting camps like this, clearing them out and telling the homeless to move on. for a second day, cal-trans crews are targeting homeless encampments like this one, saying the homeless are crossing the freeways, and they present a safety hazard. >> homeless people have to approach it by crossing the ramp, and that poses a danger not just to themselves but to the public traffic also. >> reporter: we spoke to a man this morning who runs a homeless ministry and he says, as long as the homeless aren't hurting anyone, they should be allowed to stay under the underpasses, especially on cold winter nights. >> there's a reason they stay under the bridge. concrete retains heat. when you get up underneath the bridge and it's 50 degrees out, 40 degrees out, that concrete stays 60 degrees. >> reporter: and you can see live one of the tents here that's tucked up under the free

>> the united nations says more than 7500 people have been killed in syria in the conflict. the forces of syrian president bashad are continuing their relentless attack on the city, with dozens of people reported killed and wounded in just the past 24 hours. today, the un chief for human rights made an urgent call for immediate cease fire to allow humanitarian aid to enter the country. the fight for the republican presidential nomination heats up today with primaries in mitchell mcconnell and michigan and arizona. mitt romney is doing campaigning in michigan. polls show he's closing in on rick santorum, leaving michigan essentially a toss-up, but many analysts say it will be a huge blow for romney if he fails to win his home state. he expects to win in arizona today because in part the support of today's mormon

population. and santorum has left michigan. he is campaigning in ohio today as he turns his focus to next week's super tuesday. earlier, he defended his campaign's use of automated telephone calls to democrats in michigan encouraging them to vote against mitt romney. only republicans may go to the polls in that state's primary today, but party rules allow voters to change their affiliation temporarily on the spot. this adds a new twist to the contest and could have significant implications for romney's bid for the white house. a new national poll for the republican presidential candidates shows rick santorum maintaining a slight lead over mitt romney. santorum is favored by 36% of the voters in the george washington university poll, compared to 34% for romney. newt gingrich is third at 13%, and ron paul has 7%. san francisco mayor ed lee and members of the chamber of commerce focused on jobs and

economic growth this morning. they gathered for the annual city beat breakfast at the marriott marquis. several focused on the discussion about the growing industry. the mayor had good news about the economy, saying revenues were $121 million higher than expected in the first six months of the fiscal year. he says the thing he focuses on first every day is getting people back to work. >> i don't care if i'm called the boringest guy that's got one thing, but again, i will repeat. i come here every single day to the office asking whether or not i've created another job for somebody else. >> he says in the last year, san francisco gained more than 17,000 jobs, and unemployment has dropped from 9.5 to 7.6% during that time. three san jose employee unions have filed a complaint with the securities & exchange

commission. it's the latest fall-out stemming from the city's worst case scenario projection. the pension costs could soar to $650 million by 2015. according to the mercury news, unions claim mayor chuck reed and the city failed to reveal that number to prospective investors, when it sought bonds to renovate the airport and convention center. mayor reed calls the complaint a trick to distract voters. the so-called ex-boyfriend at the center of a sex scandal involving ala meda supervisor naddia lockear this morning the e-lover has a photo here. the scandal deepened on sunday when news broke about a sex tape of the two. it was given to lockear's husband, the state attorney general bill lockear. nadia recently entered rehab.

it's been just about a year since japan's earthquake and tsunami sent waves crashing along the california coast line. now, the warning system for any future disaster is in danger. the proposed budget from the white house for 2014 would cut 4 1/2 million dollars in funding for the agency that oversees tsunami warnings. that system includes sirens like the one seen here in pacifica, and a series of bowies that confirm if the tsunami is heading our way. the waves that hit california last year after the disaster caused $58 million in damage in santa kruz, and worried people up and down the coast. many of them feel a warning system is crucial. >> and being on the coast like this, we're very close to sea level. >> i actually saw the tsunami here at the beach. it came up about four times and hit the coach actually in

pacifica. i seen it fall and rise about three or four times. >> the warning programs were expanded back in 2004 after the indian ocean tsunami that killed 230,000 people. a martinez man is in jail charged with using craigslist to rent out four closed out homes. he's a former licensed real estate agent. prosecutors say he would post a note on an empty foreclosed home claiming the property was owned by the national alliance of homeowners for justice wrshgs he works. prosecutors say he would change the locks, and then rent out the home. authorities say at least 20 households were affected, but there could be more victims. fresh snow has finally hit the sierra, and more is on the way. yesterday's storm brought up to a foot of new snow to lake tahoe. our web veejay shot this picture snow boarding in squaw valley.

another storm moves in tonight, and officials hope all this new snow will mean a good water season. today, they're conducting their third winter snow thursday, and they'll have the results. for a slide show of the snow pictures, visit ktvu.com. good afternoon, mostly gray skies, and cool conditions outside our door, turning wet and windy and cold by tonight. giving you a live look there at some of that cloud cover already. a multi level of clouds outside our door, even a few sprinkles reported over the santa cruz mountains earlier this morning, and parts of the east bay, but the bulk of this system is still on the way. the storm track is breezy at sfo. with the gray skies out there, cool conditions and temperatures, it'll feel cool today. 54 in areas like mountain view, 51 in concord. almost everywhere you go, sitting in the low 50s.

temperatures are very similar to yesterday, but yesterday we had more sunshine. 52 in nappa, 51 santa rosa, taking a look at the bulk of this system here, still 150 miles out. it will move in, it looks like, by early evening for parts of the north bay. satellite radar showing you the system dropping out of the gulf of alaska, the first notable storm of the month. and it looks like we'll see a decent amount of rain and snow. take a look at when we do expect it to arrive. so we're mostly gray at this hour. looks like about 7:00, 8:00. it's over the north bay. this means that the evening drive should be a-okay for the most part into the overnight hours. it's sliding south. when this rain moves through, the heaviest band of the front we'll call it, so will the winds. we have gusty conditions expected by tomorrow morning, breaking away scattered showers, but still plan for a slippery and long commute tomorrow morning. the afternoon drive tomorrow looks fairly good, and although scattered showers remains in the

forecast about thursday. we're cloudy today, cool, a little breezy, with rain developing by tonight. tomorrow morning, we wake up with rain, scattered showers, snow levels down to about 2,000 feet in some cases. areas of lake county, a winter storm warning that starts for tonight. that means sierra snowed into the foothills. some of the highest elevations could pick up 1 to 3 feet of snow. and at home, we're looking anywhere from a quarter inch to half inch, from the north bay along the mountain stretch, we could see anywhere from a half inch to inch and-a-half of rain by tomorrow afternoon. forecasted highs for today, a lot like yesterday. mid-50s, a 57 expected for san jose. your extended forecast. we're going to be wet later tonight, lasting through wednesday. even a few scattered showers remain in the forecast for thursday. in time for the weekend, we're drying out. >> sounds good. thank you. >> you're welcome. new indication today that apple may have a big

13,005, s & p is up 3. apple is expected to unveil a new version of the ipad next week in san francisco. invitations went out to news organizations today with an image that showed part of an ipad screen. the event will take place next wednesday for the arts theater. apple has sold 55 million ipads since they were first introduced in 2010. >> today is national pancake day, and ms. america, laura kepler, is encouraging everyone to take part. ihop is serving free short stacks of butter milk pancakes at its 1500 restaurants around the country until 10:15 this evening. in return, they are asked to make donations to the children's miracle network. a new storm is coming and promises to bring a big storm
