an ex-girlfriend takes center stage at the pretrial court battles in the ross mirkarimi domestic abuse allegation. good afternoon. i'm tori campbell. we have breaking news to start. there is a report now out of the east bay about an elderly man driving his car into a creek. newschopper2 is live over the scene. this happened in alameda county near castro valley.

fire officials say a man in his mid-80s somehow managed to live his lexus down an 80-foot drop into a creek. rescue crews pulled him from the wreckage alive but there's no word yet on his condition. officials say a guardrail above the creek was not damaged so they are really not sure how the car ended up in the creek. here is a map to show you exactly where this accident happened. it's off east castro valley boulevard near five canyons parkway. that's in an unincorporated area of alameda county, near castro valley. if we get any more information on this story during this newscast, we'll bring it to you. our other top story, the ross mirkarimi abuse charges case takes a turn today. allie rasmus joins us live to let us know what we've learned about a decision, whether one

has been made. allie? >> reporter: well, no decision has been made. we just found out about ten minutes ago that the hearing and the decision has been made. christine flores is an ex- girlfriend of ross mirkarimi. she describes herself as a tv actress. and we did research and she was interviewed by ktvu 2 some years ago. prosecutors want flores to testify against the sheriff in his domestic violence trial because flores had said and had been reported that she had been physically abused by mirkarimi when the two had a relationship back in 2007 to 2009. judge wong met privately with flores and the attorneys. the hearing lasted for a couple of hours and the judge was going to decide whether flores could testify in the trial but the hearing was continued.

>> today's hearing was not concluded. there was a need to continue. there was not enough time. the reason, mirkarimi's attorney had to catch a plane to leave town. >> reporter: now, sheriff mirkarimi is facing misdemeanor domestic violence charges. jury selection starts on monday. that's still the plan, we're told. 185 jurors have been told to report for jury. the judge is expected to continue the hearing and make some sort of decision as to whether or not christina flores will be allowed to testify. live in san francisco, allie rasmus, ktvu channel 2 news. >> thank you, allie. the nevada county coroner

released the name of the man citying who got caught -- who got caught in an avalanche. rescuers found him pinned beneath a tree. he suffered multiple broken bones and other injuries. he later died at the hospital. authorities are stressing safety. a lot of people are expected to head to the mountains. the resorts are expecting big crowds following the first big snowstorm. longs may be long at the lifts but there probably -- >> we've marked down a lot of products. >> i can't wait. it's been a long winter. i haven't been able to use my

>> reporter: in hayward, claudine wong, ktvu channel 2 news. and the nation's largest gay rights group, the human rights campaign, has named a key figure in the right against came's proposition 8 as its new president. 38-year-old chad griffin was brought in to lead the no on 8 campaign and later spearheaded the legal challenge. he worked for clinton's campaign and served in the white house for two years before he head a charitable foundation for rob reiner. supporters of same-sex marriage have asked a federal court to turn down the request for a second look at the ruling that threwout proposition 8. the three-judge panel -- that through out proposition 8.

there was an appeal before an 11-judge panel. they file the paperwork and asked the judges to reject the call for a new hearing. talks have broken down between the mt. diablo school district and its teachers' union. an impasse was declared after negotiations field. union leaders had proposed a one-time 3% payment with no furloughs. but the district offered less than half of that amount and only if the governor's tax proposal passed. san jose's veterans memorial is getting ready to reopen. this video show esthe memorial near the city's -- shows the memorial near the city. the memorial closed down after vandals caused $25,000 worth of damage to it. but thanks to a $5,000 donation from the police officers association, the memorial is expected to reopen soon.

schedule. the $1.1 billion-dollar golden gate bridge approach project has a $54 million defcy. the shortfall is due to anticipated state and federal funding which failed to come true. under a tentative agreement, the mtc will contribute ding 34 million. the san francisco transporttation authority will chip in $10 million for sales tax revenue and caltrans will add another $10 million to project. the alameda county coroner has identified the motorcyclist killed in a crash in oakland. the 22-year-old, jessie boyer, of el sobrante was thrown off a connector ramp between 80 and 880 and he land on the road below. he was reportedly speeding and lost control of the motorcycle prior to the crash. two days after tornadoes killed 13 people in the west, possible

stocks down slightly as the session dave investors little reason to push indexes higher. oil fell 1.7% down below $107 a barrel of a iranian media reported an explosion at a saudi arabia pipeline. the dow is on track for its third losing week this year. taking a live look at the big board, the dow down just 4, 12,976. nasdaq is down 12. s&p down 4. san francisco-based yelp went public today and immediately the stock price soared. yelp employees helped open the new york stock exchange. shares jumped 65% since going on sale. they started at $15 this morning. right now it's trading at about $24.85. yelp's ipo is expected to raise $96 million. people who demanded apple pay more attention to working conditions at its assembly plants in china may soon be
