swelling creeks tonight in the santa cruz mountains after the second full day of rain. good evening, i am jewel haener. >> i'm frank somerville. there's more on the way. we have live team coverage tonight, ktvu's chief meteorologist, bill martin is tracking when this next storm will his us. we begin with lloyd lacuesta. >> reporter: a steady rain has been falling up here in the santa cruz mountains.

about 8 inches so far, the worry now that the ground is getting saturated. there have been two mudslides reported so far that went over roads. more slides are definitely a concern. >> this is all de composed sandstone. >> reporter: one man says he put in drainage last summer. now is too late. >> if you're living on a steep hillside, and you've not put any drainage in, you're screwed. >> reporter: strong winds to topple trees and branches. there have been moo major power outages from downed wires. driving in the wet conditions continues to be a danger. just outside felton, a 21-year- old man lost control of his toyota probing, plowed into a tree and was killed. >> you just have to slow down and be a little cautious. >> reporter: the rain is proving to be a drip so far, for reservoirs in the santa

clara valley. the reservoir above los gatos is at half capacity. >> people shouldn't be concerned at what they're seeing in the reservoirs, our ground water basin is very healthy. >> reporter: san jose rainfall is now at its lowest level since 1875. water district officials say there is twice as much ground water as all ten reservoirs combined. land surveyors say it would take a week straight of rain before they would get worried. live in the santa cruz mountains, lloyd lacuesta, ktvu, channel 2 news. today's steady rain caused plenty of problems around the bay area. our cameras so you grand avenue blocked off because of flooding. as the camera was rolling, we spotted several cars going around a barricade. officers spotted those drivers

as well, and took off after them. one driver stared at road closed sign repeating again and again, he didn't think it had rained that much. over the last two days, kentfield has seen more than 4 to 6 inches of rain. the rising water, giving the u.s. geological survey, just what it needs. a nice sample of water so researchers can look at the setment headed to the bay after a big rainfall. pg and e told us just a couple of minutes ago, it has now restored power to most of the thousands of homeowners who lost service during the storm today. as patty lee shows us, outages caused by fallen trees were just one of the concerns in the east bay hills. >> reporter: in san pablo thomas is fighting a losing battle with rising water. >> been using this vacuum cleaner. water vac to suck up the water

and i intend to do that until it stops raining. >> reporter: folks who live on this tumbling hillside say they can live with flooding. they just hope the tarp that helps to keep the ground stable holds up in this storm. in arinda, the tree so massive power wasn't restored until this evening. in lafayette more than 600 customers lost power when two trees tumbled within a mile of each other. happy valley trail, which is lined with enormous mature trees was hit hard by heavy winds, rain, and outages. >> there was a power line pretty much right next to the window. scary. >> reporter: most homeowners had power back on in an hour. those who didn't had to make do. >> my husband heated some water on the barbeque, and we poured it over coffee. >> reporter: for many, it served as a valuable wakeup

bean bag round fired been an officer. olsen is suing the oakland police department. an investigation is still ongoing. a murder trial in a death. mohammed maroon ali was dating her at the time. the verdict will be read tomorrow morning at 9:30. ali was convicted of first degree murder back in 2001, but his conviction was overturned in 2009 because prosecutors had improperly dismissed a black juror. new details tonight on the so-called millionaires tax. that's the ballot initiative aimed at closing the state's budget gap. alex savidge is live. >> reporter: the governor

agreed to raise the tax rate by another penny on the dollar. those on the millionaire sales tax conceded to a sales tax increase. backers of the millionaires tax started gathering signatures just last month. but tonight, they have given up that effort and merged their plan with the governor's competing tax proposal. >> we're now unified behind one measure and need your help on getting this on the ballot. >> reporter: the governor wanted a compromise. >> had the status quo continued, we probably would have been headed for a real defeat. >> reporter: the new initiative calls for an across the board sales tax increase of a quarter of a percent. the plan would also bump up income taxes. anyone making more than $250,000 would see their rate increase by 1 percentage point. someone making over $300,000

would see a 2 percentage hike. tonight we shared this new tax proposal with people in downtown walnut creek. >> another quarter percent, so you're talking about almost 9% on everything? that's a lot. >> slashing teachers left and right. >> reporter: under the original millionaires tax plan there was no sales tax increase. >> this still has a regressive element. the sales tax will hit all of us. it will hit the 99%. >> reporter: but now the clock is ticking for the backers of this new tax proposal. they won't be able to start gathering signatures until april. that leaves them with roughly a month to collect the 1 million signatures they need to get the initiative on the november ballot. live tonight in walnut creek. ktvu, channel 2 news. we know tonight that voters turned out in record numbers during yesterday's republican primaries in mississippi and

alabama. the unofficial turn out in alabama was up 12% over the previous high. and mississippi's unofficial turnout was up by 83% over the high set back in 1988. rick santorum added to his delegate count by winning in both of those states. today, the former pennsylvania senator campaigned in puerto rico and predicted an eventual victory over front runner mitt romney. >> i suspect if we keep winning state after state after state, i'm going to be the nominee. >> reporter: exit polls show voters were overwhelmingly conservative. there are still a handful of delegates yet to be allocated. 1,144 delegates are needed to win the nomination. mitt romney with 495 delegates. santorum has 252, newt gingrich

an 89-year-old woman is the latest victim of burglars. police say the robbery happened yesterday morning at a house near thorn hill drive and mountainville boulevard. they say they pushed their way in. police say this is the latest in a series of burglaries in the area. >> when we do see suspicious activity we're trying to alert each other.

close to the city's historic murals. the parks and rec department says the dinner was within the rules. neighbors of a proposed 270,000 square foot lucas film production studio in marin county -- neighbors claim the development is a significant departure from the 1996 master plan for the area, and therefore should require a new environmental impact report. a hearing on the appeal is set for april. the u.s. military says the american soldier accused of shooting 16 afghan villagers, many of whom were women and children has now been flown out of afghanistan to kuwait. afghan officials say u.s. surveillance video shows the soldier walking up to his base, laying down his weapon, and then raising his arms in surrender. the defense secretary, leon panetta said that soldier could receive the death penalty, if

convicted. tonight, secretary panetta is in afghanistan on a trip that was actually planned before the massacre. rita williams tells you, there was a bizarre situation at the airport that forced his flight to be diverted. >> reporter: an attack on afghans investigating the killing of 16 civilians. then the bombing of afghan intelligence headquarters, and now a possible attack on u.s. defense secretary leon panetta as his plane landed in afghanistan today, an afghan interpreter hijacked a truck from a british soldier. >> he did end up on the runway ramp and ended up in a ditch. our personnel discovered that he was ablaze. >> reporter: the plane was diverted, the afghan burned over half his body, arrested. it happened on a british base. >> there are things that need to be done in the coming hours and days to keep them safer. no doubt, we will do them. >> reporter: just an hour after

ktvu has obtained documents that are raising concerns about the many ambulances that the san francisco fire department uses. >> reporter: the san francisco fire department's ambulances are under fire by those who operate them. >> a great majority of the ambulances having over 100,000 miles on them. that causes us great concern. both for the firefighter and paramedics safety, and for the public's safety. >> ringing the alarm about the aging equipment, as the department prepares to receive $6.8 million in state funds. union officials want the chief to spend much of that money on new hires, new equipment, and

new ambulances. ktvu obtained these documents from a recent internal audit that evaluated the trucks. >> reporter: 12 of 41 are listed in poor condition. 43 of the 88 defibrillators used by emergency medical technicians are 12 years or older. >> you have something that is so old that the manufacturer won't even cover its performance. >> it is an aging fleet. currently, we have five ambulances on order and shortly thereafter we'll order another five. >> reporter: they admit they don't have enough replacements or mechanics, but say patients have nothing to fear. >> the equipment is aging, but it's still operational, and safe. >> reporter: the department's ambulances will soon start responding to 80% of the life support calls that come from the 911 center. a 10% increase over last year.

it was a cold, heavy rain that fell today in many lower elevations of the sierra. while some thought it was just too soggy. others thought the conditions were great, but different. >> we don't get dumped on like this. this is what i hear being called dumped on. >> for the skiers, a very difficult year appears to be turning around, and it appears thoughts for closing up early for this season have pretty much faded away now. an owner of an east bay candy store says he wasn't worried about all the rain until he came into work. he tells us why this couldn't have happened at a worse time. >> reporter: water pouring out of the light fixture. this is what he came upon when he came into his candy store thismorning. a landlord told him a leak was

fixed. he expected to come in and see at most, a bucket of water, instead -- >> this whole place was pouring from everywhere. from the roof, from the side of the bathroom. >> reporter: when we got here, you could see rain water dripping from the bathroom door. >> all the boxes. were underwater. as you can see down there, all the candy is opened, and the boxes all wet right now. >> i saw the water was coming from the ceiling. >> reporter: the water damage and loss of the merchandise is too much for her to handle. this store means a lot for the family, and with easter right around the corner, it's now too late to get in more supplies. so this year's profits have been washed away. >> basically going to be washed out. >> reporter: it's estimated there's more than $100,000 of damage to the business.

in a bind. the five member board is required to have four votes for budgetary items. that means no other board members can miss a meeting. we have new information tonight on a story we first brought you last night on the 10:00 news. it involves the arrest of a man who worked as a nanny in the south bay. ktvu's maureen naylor found out today there are more victims. >> reporter: 41-year-old john christopher walker is behind bars after one of the campbell children told their parents about inappropriate behavior. >> he had quite a bit of access to a number of different children and preyed on their innocence and had them do things that were highly inappropriate and illegal. >> reporter: he served as a nanny for several families. there are at least eight victims from five different

families aging 9 to 17. he faces multiple molestation and child pornography charges. >> i'm picking up my daughter now, we're going to ask her if anything happened. >> reporter: he says his family considered hiring walker. >> he was like yeah i can take care of your kids too, because we're so close. i was like, no, i didn't have a good vibe about him. >> reporter: >> my biggest fear, that is, that being my number 1 fear of why i will not hire a nanny, besides having family help me. >> reporter: police say john walker has no prior criminal history. he is being held without bail, and faces 195 years to life in prison, if convicted. he could enter a plea in his next court appearance next week. wall street was pretty much

flat today. the dow jones industrial average finished 16 points higher today. the nasdaq basically unchanged. analysts say a jump in text stocks was offset by declines in banking. zinga is asking the securities and exchange commission to allow a $400 million secondary stock offering. employees could get more stock if they agreed to limit how many shares they can sell this year. zinga stock finished off slightly for the day, trading at 13.35 a share. down about 3 cents. the silicone valley business journal is reporting that facebook is looking to other sites to expand. if the plans fall through, facebook is looking at space in newark. a landmark concert in france. how the harmony it aimed to

in chicago today, former illinois governor rod blagojevich embraced the spotlight before heading to prison. >> the law as it stands right now is that i have to go do what i have to go do. >> the press conference outside of his house draw a large crowd. blagojevich even spent about 30 minutes signing autographs. blagojevich was convicted of trying to sell or trade an appointment to president obama's vacated senate seat. a california appeal's court has ruled that prison officials were within their rights when they picked the spot for a convicted serial killer to live. lauren herzog was one of the so- called speed freak killers suspected of killing as many as 19 people. he was paroled in 2010 and ordered to live in a trailer

just outside of the gates of the state prison in susanville. the city and county filed a lawsuit to move him. herzog committed suicide in january of this year. police are searching for a woman suspected of kidnapping her 5-year-old daughter. the mother, zadoka perez has made suicidal statements in the past. she and her daughter has not been seen since monday. the car is a gray 2011 honda accord coupe with the california license number 6scz277. police say perez maybe headed to the los angeles area. new details are emerging tonight about the oakland police shooting that sent a man to the hospital. oakland police now say two officers shot at the 24-year- old man around 8:45 last night near 90th avenue and birch street. police say the man had a gun

and they were chasing him on foot. they say the man threatened their lives and both officers fired at him. that man is expect today survive. the coroner's office has identified the victim of a deadly shooting in fairfield as 47-year-old clarence james. james was shot multiple times on monday as he stood in front of a home on hay street. no arrests have been made. the killing was the third homicide in fairfield in less than a week. in belgium, a day of tears and sorrow after 22 school children and since adults died when their bus crashed into the wall of a tunnel in switzerland. investigators say it is not clear yet why the bus crashed. somalia, a major security breach when a side bomber was

showers in the bay view region. your afternoon commute was a mess. tomorrow morning's commute shouldn't be a mess. this really is the story is the oragraphic lifting. on the back side of the mountains, .10 of an inch of rain. all of the rain is squeezed out on the west side of these hills. they are just dropping a lot of rain a lot of water into the san lorenzo river which comes out right here. it's a high tide about 4:30 a.m. we will watch it for you. mornings on 2 here at 4:30 tomorrow morning. they'll be tracking that as the tide drops, it should help things out, and the showers are beginning to diminish. nothing like we saw today. things have really begun to taper off. three more storms in the forecast through thursday, fry, and saturday.
