you see the apartment where the police found the two victims of the apparent murder-suicide. tonights the residents here collectively came together to grieve and ask how could a brother kill his 11-year-old sister. amazing grace ♪ ♪ ♪ >> reporter: the police chaplain at tonight's vigil for gutierrez said he had no answer for her tragic death. police say the little girl was shot and killed by her 27-year- old brother in their apartment, before he shot himself. >> i can't believe she had to go this way. she wanted to be a teacher and liked to sing. and she talked about her brother like he was a hero. >> reporter: luvero's brother, abel gutierrez, had returned to live with his family after returning from iraq. police say they were called here at the end of february, because the family was concerned about the way gutierrez was acting.

but he didn't seem dangerous at the time. >> ever since he came back, he was different. >> reporter: this woman said her dad was living in the apartment, but moved out because his nephew scared him. >> he would say he wanted to kill himself. he would ask my dad if he killed himself, if he thought my amputate aunt would hurting, he said yes. >> reporter: and police say they found physical evidence that the mother was either critically wounded or is dead. her brother spoke through an interpreter tonight. >> god hold her in his heaven. and my nephew as well. >> reporter: we are learning tonight that before returning to california, abel gutierrez was treated for ptsd at a v.a. facility in washington state. live in gilroy, ktvu channel 2 action news. and we want to show you

another picture now of the missing mother in the case. this is 52-year-old martha gutierrez, who police believe was shot and may be injured or deceased. and an iraq war veteran, speaking out. scott olsen and his attorney talked about oakland police who they say injured him on purpose. in 20 minutes, they say they proved their claims against the police. and a pilot walking away from a plane crash in palo alto today with only bumps and bruises. the helicopter made an emergency landing in the baylands at about 4:45 this afternoon, not far from interstate 101. as the pilot attempted to land, the helicopter flipped, landing on its side in the marsh. she got out safely before rescue crews arrived. nobody else was on board. police say the crash could have been much worse. >> there are electrical lines that surrounded the area. she was able to put the craft down in an area that made the

danger less. >> again, the crash was here highway 101, the palo alto police say the pilot reported injuries and was headed to the airport before crashing in the marsh. her name has not been released. the faa and agencies are investigating. and the winner of a prestigious scholarship died this morning in a freak accident. ktvu's amber lee has more on the victim who recently celebrated his 19th birthday. amber? >> reporter: frank, students and staff said the student was exceptional in many ways, living here on the campus just beyond this athletic field. his friends and the university are mourning their loss. 19-year-old kevin loly was known for his warm smile, out going personality and academic brilliant scores. he was one of only a few to

attend uc berkeley, he wanted to be a doctor. >> he really liked helping people. and he wanted to apply science and helping people together, in the medical field it seemed like the most natural. >> reporter: around 4:45 this morning, kevin was driving in oakland with three passengers when he struck a fallen tree. chp said the passengers left the car to stand on the right shoulder of the road. kevin stood by his car, shortly after, the pickup truck struck the treat, went up in the air, hitting kevin and then hitting the tree. he died at the scene. >> it is so disturbing. >> reporter: some students learned of his death sent out by the school this afternoon. there was a meeting tonight to talk about kevin, a psychologist was on hand. >> kind of like a nerdy guy. >> reporter: this student says that kevin was the first person on campus to reach out defend him. he said that kevin celebrated his 19th birthday last month. >> he came to the dorm and gave

me a piece of cake. and i really was touched because he remembered me. >> he was -- exceptional among the exceptional. >> reporter: kevin's friend told us he will remain in their hearts forever. one thing is the movie nights where they just enjoyed his company. reporting live, uc berkeley, amber lee, ktvu channel 2 action news. the wind and rain are suspected of bringing down this 70-foot tree on dolores drive, it is not clear if the tree caused any damage to the home, but nobody was hurt. the crew moving the fallen pine told ktvu this was the second downed tree they had to deal with today. and the weather caused more problems today for air travelers, numerous flights at san francisco airport experienced delays leaving or coming in today.

san jose reported delays, and there were only a few delays at the oakland airport. and tracking more storms, more on what is happening tomorrow. yes, more rain in the forecast, here in time for the commutes tomorrow. let's go outside, i'll show you what we had. over the last few days, heavy rain in the coastal hills, almost a foot of rain, in san jose, on the back side of the hills, 7-hundredth of an inch of rain, less than a 10th of an inch, so you get the picture, very dry. here is what is happening tommorow as you look -- to the system to the north of us in this area. this system will make its way down and bring us rain in time for both of the commutes. one of the commutes will be wetter than the others. so when i come back we'll break it down with the latest computer model. we'll get you going. and the famous boardwalk in danger tonight, coming up in eight minutes, why crews well be up all night, making sure

the landmark is not damaged. and a man with a lucky break after the gun jam. it happened at 77th avenue and hillside street. the gunman fled and police surrounded the home in the 1700 block of 73rd avenue. police brought out a s.w.a.t. team and found out the gunman was not in the house. the victim was hit with the gun but is said to be doing okay. and san francisco police looking for help tonight in finding two men. police released these photos today. they are accused of beating a 23-year-old hayward man on january 29 in the middle of polk street. the man was helping a woman who was being bothered. initially the victim was listed in critical condition. >> he is now released and does have nonlife-threatening injuries at this time. but it will be time before he fully recovers from his injuries. >> ktvu first told you about problems along polk street during the 10:00 news last

friday. residents have complained of increased violence as area bars become more busy. and guilty on a former star player. ktvu rita williams covered the trial and was there before the results as well. >> reporter: at the san mateo courthouse was a murder case of a repeat. >> once again, 12 more citizens, so 24 out of 24 citizens said this man is a first degree murderer. that is satisfying. >> reporter: this is that man jurors found guilty of first degree murder a second time today. mohammed ali was 23 in 1999, a recovering addict and drug counselor here at project 90 in san mateo. after a relapse, he choked his girlfriend. 20-year-old tracy balitnikoff, she had just beaten her own

drug problem. in 2001, a jury convicted ali of first degree murder, but two years ago that conviction was overturned. and in the re-trial, ali's attorney argued for manslaughter. >> it was not one he planned or intended. >> reporter: after deliberations today, the jury returned the same guilty verdict. >> if he is in the community as the case shows, women are not safe. >> reporter: obviously upset, ali's father and other relatives said little. >> there is no justice here, it is all getting revenge. that is all i have to say. >> reporter: the district attorney says when mohammed ali is sentenced here on june 14th, he will ask for the same sentence he got the first time. 64 years to life. in redwood city, rita williams, ktvu. and the dow up to a four- year high after an unemployment report showed a drop in jobless claims, the dow adding 58 points, nasdaq gained 15, the

s&p topped 1400 for the first time since 2008. and a real estate tracking firm reporting a sharp increase in bay area home sales. and another tick down in price. data quick figures show a 14% increase in sales compared to a year ago. this comes as prices fell, almost 4%, it is the 17 month in a row that home prices have gone down. the median price for a bay area home is now $325,500. and pay paroling out a new credit -- pay pal with a new twice. it plugs into an iphone and allows merchants to process credit cards but doesn't work with ipads. it will be available for android devices later. pay pal will charge the merchants a 2.7 mission, which is slightly less than a competing company called square. and we're close to the release of the ipad, used to seeing people camped out at i-

to get apple's new ipad, going on sale in less than 10 hours. new at ktvu, alex savage has more, you don't have to wait until the morning? >> reporter: no, that is right, ipad fever has come to wal-mart and come early. the big box retailer will start to sell the devices at midnight tonight, eight hours before apple. this is the scene inside the wal-mart store in union city tonight. more than a dozen people lined up, anxious for the new ipad. tim napp from oakland didn't want to wait longer. >> why wait longer, i can go home, go to work like regular, have the ipad, and beat everybody else. >> there is a whole group of people there. >> i don't want to wait this case and also if i come here i just have to wait in the store. >> reporter: they have 40 of the new ipads in stock, the line growing by the minute.

council voting in favor of several deals that paved the way for a construction of a new stadium for the 49ers, the most important item was the first one, final approval of a bank loan up to 950 million for the stadium. a nonrelocation agreement was also passed, requiring the 49ers to play their home games at their new stadium for at least 40 years following its opening. and the deal can only be broken under extreme circumstances. and san jose firefighters busy this afternoon, fighting two house fires just minutes apart. the first fire started in a shed on clifton avenue in north san jose. firefighters say a fire spread to the house behinded it. they quickly contained it, one person suffering smoke inhalation. 20 minutes later, a second fire on pearl avenue in san jose. >> if we get another large incident, we'll be in a world of hurt right now with the resources depleated. but we would have for help. >> reporter: nobody was hurt in

the pearl fire, firefighters say it was contained quickly, but the cause is still under investigation tonight. we now know that a san jose firefighter injured when he fell through the roof at a burning building is expected to recover. a neighbor took this photo of the firefighter before he fell through the roof this morning. he suffered second degree burns on both hands and his stomach. investigators say a candle likely started the fire in a four-plex. 17 people, including a child made it out safely. and emoryville police looking into the situation of a kidnapper. he is identified as aramo, may work as a security guard, possibly from nigeria. police say he forced the woman to get in the trunk of her own car, but that she was able to get away. authorities say last saturday he tried to rob another woman. police say if you see him call 911 immediately. and advocates against

domestic violence issued a new call today for san francisco sheriff mirkarimi to step down. members and supporters of the san francisco domestic violence group rallied at the steps of city hall. they say the case of mirkarimi is a national embarrassment and are asking that he be removed from office. >> do you want our chief jailer to be somebody who has been convicted of false imprisonment? that breaks my trust. >> mirkarimi pled guilty to false imprisonment to avoid the trial. he will be sentenced monday to three years probation, domestic violence classes, community service and fines. there is conflicting information about the fate of a marijuana dispensary in berkeley, there are reports that berkeley patients group is closing their doors following a state-wide crackdown on marijuana clubs. however, the dispensary is arguing the claims. in a statement the berkeley patients group says they're not

closing but instead looking to relocate. so far a new site has not been announced. and in santa cruz, working out looking at the swollen river, ktvu's paul chambers talked about what crews did to keep the water away, and what he did. >> reporter: the battle came down to man versus machine, and mother nature. the san lorenzo river built a sand wall. the officials say it appears to be working but it may not be so. since we have been here, at least 10-15 feet of the berm has eroded into the ocean. they are nor warning others that -- now warning others that it could erod further.

. a hat worn by an iraqi veteran who was injured last year during an oakland protest, could be key evidence. maureen naylor got a look at the hat. >> reporter: inside the oakland department today, iraq war veteran scott olsen showed us the hat he was wearing during the protest last october. news chopper 2 was over head, and highlights the moment the 24-year-old fell to the ground. >> next thing i know, i'm laying down on the ground. and people are gathered around me, trying to help me.

>> reporter: video ktvu reported on the ground shows the group rushing to help olsen, when another device was fired through the crowd. originally it was thought that olsen was hit by the gas can. now there is evidence on the bean bag round fired by an officer. >> so the bean bag shot -- indicates that whoever fired it intended to hit scott. that puts a very different light on things. >> reporter: oakland police say they can't discuss away force was used because of the ongoing investigation. >> we want people to know what happened and why it happened. so i think a lot of the questions that are out there will eventually have answers, but just can't be today. >> reporter: almost five months after his skull was fractured, he is still recovering. >> i am pleased with the progress, because when i look back at the past five months, i

couldn't speak. >> reporter: olsen's attorney plans to file a suit against the city. and leon panetta trying to repair the strained relations with afghanistan, he and the president discussed the killings of the civilians by the staff sergeant. afterwards, karzai demanded that forces leave the country. but leon panetta stuck with the 2014 timeline. >> we really did focus on the strategy for the future. and -- what needs to be accomplished. >> also today, the taliban broke off preliminary peace talks with the u.s. the negotiations were designed to set up a process with the afghanistan government. and new information tonight about the u.s. soldier accused of the massacre in afghanistan. tonight, the attorney now representing him says the soldier was upset after seeing

his friend's leg blown off the day before while he was standing right next to him. attorney john henry brown also said the soldier enlisted right after the 911 attacks. >> i think it is of interest that we have a soldier who has a wonderful record. a decorated soldier who was injured in iraq. >> this past weekend, the staff sergeant allegedly walked into two villages and shot and killed 16 people, most of whom were women and children. he has been taken to kuwait, a move that has angered some afghanistan leaders. in six minutes, see the strong reaction in the bay area in response to the shootings in afghanistan and the demands being made by the protesters. life after american idol. we meet a bay area police dispatcher who is using her voice a different way. plus, a crabber convicted, why some of his catch should have been thrown back.

convicted estes in what the prosecutors are calling a violation of state law. prosecutors say estes brought about 45,000-pounds of crab to this fishery in 2010. the catch was inspected. they found that 991 pounds measured under six and a quarter inches. the under-sized males are supposed to be left at sea to breed with the females and continue the species. >> so if those males were then caught on a commercial size, the population would collapse. >> the law allows one percent to be undersized. experts say he had double the limit. >> reporter: experts say he faces time in jail, the lawyer says they could shift the blame from the crew. the commercial fishermen says the crabs should have been measured and tossed long before they were brought to the company. >> their first line of checking -- the first line of checking is when they pull the pot up,

. a ceremony was held today for oakland's recently appointed fire chief, teresa reed, who is the first black woman in the u.s. to lead a major city fire department. chief jordan recently served as oakland's assistant chief and has been interim chief twice before. and former illinois governor rod blagojevich now a prison inmate. before arriving at a federal prison in colorado, rod blagojevich stopped for lunch at a burger place, and is serving a 14-year sentence for corruption. he was convicted on 18 counts, including trying to sell president obama's vacated senate seat. his new home is a minimum security facility in littleton, colorado. and san leandro police

arresting three men. they say the men forced their way into a home in the 400 block of bankcroft avenue, about 7:30 last night. the men took cash and gaming systemses. the victim called 911 to report the robbery and also said she was following the suspect's car. that information helped the police catch the three men and recover the stolen goods. and in news of the world tonight. a swiss captive for nearly a year by the taliban turning up at an army post today. they say they escaped. but the taliban commanders say they were freed after a ransome was paid. the couple had been on vacation when captured. last year they appeared on a video saying the taliban was threatening to kill them. and in egypt, deadly soccer riots against top officials. a total of 74 people were killed in egypt's worst riots in 15 years. nine police officials are now charged with helping the mob,

including six generals and a colonel. egypt's officials have long been feared by civilians and are are suspected of crimes and violence. off the coast of brazil, officials say there is a new leak from an off shore oil well. late last year, about a thousand gallons of oil spilled. the size is not known, it appears to be coming from cracks on the ocean floor near the well, which has been sealed. chevron is working to seal the oil. and here in the bay area, fewer pink slips went out than expected. the mt. diablo school sent out 100 notices, union, 77, 20 for schools in antioch, the districts hope the state comes through with much needed funds so that the actual layoffs wouldn't be necessary. and in palo alto, schools looking at more substantial budget cuts. the board of education approving 2.1 million in cuts

the elementary school today couldn't talk about what is about to happen here without choking up. >> i am really sad, my first experience as a parent in the public school system. and it was just -- kind of really -- horrible. >> reporter: early this morning, the santa rosa school board voted to close down doyle park elementary school in june after 60 years. the school serves mainly low income latino students, and enrollment is low, and money is tight. >> the cost of operating the school exceeds the revenue that it generates. the district is faced with several million worth of budget cuts. >> reporter: but while doyle park is going away, a new school will open up on this very spot. the french american charter school, attracting many students from outside santa rosa, bringing in new money to the school district. >> this was a financial decision. >> closing the school is the worst thing happening to this rich country like this. >> from all sides. >> reporter: fifth grade teacher bob grove has taught in this same classroom for 3 #
