for a robbery and carjacking suspect. police have cordoned off the area and they are keeping everyone back from the home. the s.w.a.t. team is in place. police say that the man is wanted for several robberies, including a home invasion. neighbors say that the house police have surrounded may be one that's for sale and vacant. police are surrounding that home in san jose where they believe the carjacking and robbery suspect is holed up. we have a crew on the scene and we'll bring you updates throughout this newscast as things change and complete coverage on ktvu channel 2 news at 5:00. we just got new information on a murder-suicide in gilroy involving an iraq war veteran. policejanine de la vega is live. >> reporter: police found the car at the crime scene and were

able to determine that a violent fight occurred inside that car. gutierez's mother, 52-year-old martha gutierez is either critically injured or death based on the evidence they have found. police searched gutierez's car a 2003 green mustang and found that a firearm was discharged inside that car. martha gutierez's phone was found inside that car. police found the body of the 11- year-old daughter lucera and abel gutierez. police believe he shot his little sister and killed himself. family members say that abel gutierez suffered from posttraumatic stress disorder. >> i know he used to blame my aunt for him not being in -- that's all i knew. >> reporter: gutierez was an

iraq war veteran and was in the army but was suffering from depression. there is a growing vigil in front of the apartment complex where lucera was killed. people left mementos. we are supposed to be getting updated information from police on what they are doing to search for lucero luna's mother, martha gutierez. we'll have that coming up at 5:00. >> janine, thank you oakland s.w.a.t. teams converged on a home around can 12:30 this afternoon. this happened in 87 and birch in east oakland, not too far from international boulevard. officers were heavily armed, until they went into the house, served several warrants and were able to take five people

into custody. >> rosemary says that heavy rain is on the way but as you can see from the picture, the widespread rain is falling right now. the rain is, in facts bringing out umbrellas all over the bay area and winds could also pick up soon. keep an eye on the bay area peaks. we are told there could be some snow on them by the end of this weekend. outside our doors at this hour, storm tracker showing you that rain is very widespread, just littered with green around the area. we have winds picking up as well, we'll turn breezy at times. 61 degrees right now, san jose, 56 in oakland, livermore dry at the moment but you can see that is about to change. scattered showers on the way to the area. the north bay continues with light rain starting early this morning and we are already seen quite a bit of accumulation in areas like santa rosa, .45. farther south you go, the less.

san jose could use some rain, not picking much at all with this last week forth of storms. san francisco, 13. again, the heaviest rain is on its way. looks like it could hit us in time for the evening drive home. we'll take a look at that model to show you what to expect. >> rosemary, thank you. the recent rainy weather washed out the works on muni and transit line. they were supposed to shut down some rails. the rail work is now set to take place the follow weekend, that is weather permitting. an alameda county judge this morning refused to block the release of a report on pepper spraying of protesters at u.c. davis. new, the decision and what happens now. tara moriarty has more on when the report might be released. >> reporter: the judge did give the okay for the release of the

renoso report. basically, what this means is that details of the pepper spraying incident will eventually be revealed to the public. not sure when judge emilio greo said that the public had a great interest in this. he was pushing for the end of the day for the release but attorneys with u c davis wanted to discuss it with their client first. this is not the news that the police union wanted. police under fire for their handling of the protest. lawyers for police tried to block the university from releasing this report because they felt portions of it violated officers' privacy. a temporary restraining order on march 6th cut by former california supreme court cruz renoso to release its findings to the u c davis community. that 12-member task force was created to investigate the pepper spraying. we felt that much of the report dealt with administration desist, not with action by

individual police officers. there were portions of the report that he did not make a ruling on just yet. he is likely to give attorneys to for the police union to appeal this ruling on april 2nd. san francisco's d.a. is expressing concerns over this week's plea deal in the sheriff's plea case. he is not convinced that the sheriff feels he is guilty. he plans to raise these concerns at the sentencing on monday. his attorney says that his plea should not be questioned. meantime, victims advocates are expressing outrage over the plea deal. they are upraged that he remains sheriff. they are demanding that city leaders take immediate steps to

actor jorge cleaney and his father were arrested in front of the sudanese embassy in washington, d.c. he was there to bring what he calls war crimes in sudan. clooney met with president obama and testified before congress. he and the other protesters accuse the sudanese president to block aid. a u.s. soldier is flown into the u.s. today. the solder is expected to arrive there this morning in kansas. back now to our top story.

these are live pictures of developing news happening in a san jose neighborhood where a standoff has been ongoing since the early morning hours. this is a live look at what's happening near the scene, near the 5600 block of blossom avenue, just off blossom hill road. we are talk being an area that's south of highway 85. you can see a number of police officers, some who appear to be in s.w.a.t. gear in the street there. you can tell the street is closed down because there is an intense operation underway. there is essentially one home that's surrounded. it's the target of this investigation but an entire neighborhood is being affected due to this standoff with the robbery and carjacking suspect. police have kept everybody away from that home in question here and they are telling us that the man they are after is wanted for several robberies including a home invasion. we have been on the scene here, getting more information and neighbors say that the home that police have surrounded may be one that's actually for sale and is vacant right now. but here are live cameras showing you a picture of intersenses. there are some cars going through but they do not have an

option of turning on to that street where a police officer and is standing. this is happening in the 5600 block south of highway 85. a number of police officers there. police vehicle, some are in s.w.a.t. gear. again, we are staying on top of this developing news story. if we have any significant developments, we'll bring them to you here at noon. certainly, we'll have a complete story for you coming up on ktvu channel 2 news at 5:00. now to the north bay where napa firefighters spent the night putting out a huge house fire. it broke out in that home on mustang road. the home was fully engulfed in flames when firefighters arrived. an elderly man was sleeping inside. he woke up to the sound of fire and smokey deck fors. he was able to get out of this house. investigators say that the fire started inside the garage where gunpowder and ammunition was being stored. that set off a string of explosions. >> i was in bed and i heard sounded like firecrackers. i looked out and saw the orange glow up above my house and came

out and the garage was completely on fire. >> no one was injured. the cause of the fire is still under investigation. the jury this morning handed up its verdict in the case of an ex-student at rutgers university accused of spying on his gay roommate leading to that roommate's suicide. >> knowing that the conduct constituting invasion of privacy will cause tv to be intimidated because of sexual orientation, guilty or not guilty? >> guilty. >> in all, 20-year-old dharun ravi was found guilty of all 15 counts against him including hate crime allegations. he could face ten years in prison and deportation to his native country, india. prosecutors say he use add web cam to spy on his roommate in an intimate moment with a date. when clemente, the roommate,

found out, he jumped off the george washington bridge. neighbors say a ford expedition suv crashed through a fence surrounding a vacant lot and hit a pole in oakland. neighbors say that the suv drove off but officers caught up with the passengers two blocks away. pg&e responded to the scene to help clear the mess. contra costa county former cop his responding to allegations that a woman who ran a -- ran a brothel did so with the knowledge of the sheriff. she said that he received some payments of every week a magnitude 2.5 quake struck two miles north of crockett according to the usgs.

it was recorded just before 8:00. there were no reports of any damage or injuries pg&e and the california parks foundation are looking for volunteers. they are wanted to help with the annual earth day restoration and cleanup. earth day ace saturday april 14th. there are projects all across the bay area. click on the links we have for you on the links section at ktvu.com despite all the recent rain, a water emergency has been declared in the city of helena. the city says it does not have enough water stored to meet demands. water emergency takes effect next thursday. officials say that water restrictions will probably stay in effect at least through the end of june, regardless of rainfall. people who run santa cruz beach boardwalk are keeping a weary eye on the san lorenzo river. heavy rains changed the course of the river and threatened to

flood the amusement park. people there say that the river has gone down a little bit today. they also credit work they did building up a berm twoop the river and boardwalk and keeping out water. crews continue to work on that berm today. wet and breezy weather expected to remain over the friday. steady rain at this time. that is going to increase. a live look there, san jose, mostly gray skies. and within that san jose has not picked up a whole lot. can't even find an accumulation for san jose. the santa cruz mountains, anywhere from a foot to a foot half. so far with another inch or two possible with all this rain, as you can see, from the bay area. wind coming from the south breezy at times and they will continue to increase over the course of the day. we are continuing to watch the front as it slides and whit does, it's going to increase

the wind and bring us breezy conditions, anywhere from 20 to 25. we have been watching this off the coast. it's going to begin shifting over the weekend. eventually, we will see the rain come to an end but for today, it is going to be steady at times and it looks like it could be moderate to heavy in time for the evening drive. 5:00 or so, over the north bay. it's going to begin to slide south by 6:00 or 7:00. hopefully if you do have a drive, it will be early on and it will be by the house. the golden gate, the bay brain, the carcinnas, we are looking at pretty solid conditions. notice the north bay beginning to get a break but elsewhere, we have moderate rain continuing to fall. santa cruz mountains, again, susceptible to perhaps some minor flooding, maybe even a minor mudslide. if you are headed to the sierra, today is not the day to do it we have a winter storm warping that will begin a little bit later this afternoon.

this morning. storm expected for the 164th am parade in san francisco but the parade is happening, rain or shine. it begins at 11:30 tomorrow. pat raid ends at the civic center plaza where there ace festival going until 5:00. corned beef is a popular st. patrick's day treat. demand is much higher this year. the restaurant usually prepares 1000 pounds of corned beef but this year, it's preparing up to 1500 pounds when we get back, when the bay area's only remaining team in march madness will be playing today and we have an update for you on little leaguers up in the north bay who are the victims of thieves.

looking live here at the numbers from the new york stock exchange. can you see the dow jones industrial average down by just a few points, still comfortably above that important 13,000 mark. the s&p is on track for its best week in almost three months. a big jump in the prices at the pump helped drive up consumer cost last months. the consumer price index rose .4% in february. that's the largest increase in 10 months. gas prices account for most of the gains, rising 6%. many people in petaluma are now pitching in to help the little league team that became the target of a heartless crime. last weekend, someone broke into the team's equipment shed
