part of the story. >> reporter: just a short while ago sheriff mirkarimi emerged from his office and said he will not step down. >> i do not believe that the conduct that i have taken, taken responsibility for constitutes official misconduct within the meaning of the law. i look forward to making my case to the ethics commission and the board of supervisors. >> reporter: this statement comes just as mayor ed lee gave ross mirkarimi an ultimatum. he said resign or hell have him removed from office. sheriff mirkarimi is suspended, an appointed sheriff will be taken his place until all of this gets sorted out.

the next step is that sheriff mirkarimi gets to have a meeting with the ethics commission. that's the latest from city hall, back to you. let's go back now to city hall listen in to mayor ed lee issuing this right now. >> you know i have taken great care to respect the legal process and the integrity of the legal proceedings. none of these proceedings have concluded. i have carefully reviewed the city chatter, conducted my own review of the evidence and consulted with legal council. i also met with sheriff m irkarimi yesterday to give him an opportunity to resign.

i informed him of my intent to remove him from the office for official misconduct. he has chosen not to resign and now i must act. i have asked the city attorney to prepare the appropriate documents and notify the board of supervisors and ethics commission. i have informed the sheriff that he will be served charges tomorrow. as public officials, our first responsibility must always be to fulfill the obligations entrusted to us by the people of san francisco and we must always be held to the highest legal and ethical standards. sheriff mirkarimi's action and confection of guilty fall below the standards of decency rightly needed from public officials. i take this action from every conviction i am doing on what is the best interest of the people of san francisco and

acting on a firm legal basis. to that end i will be appointing long time veteran vicki hennessey as sheriff upon the suspension of sheriff mirkarimi. for the past 20 years she has served as director of our department of emergency services. i am confident that vicki hennessey will provide a leadership presence at the sheriff's department. i know she will support our deputies and staff in the department who have been working diligently to continue the good work of our sheriff's department. please have vicki if you will. >> thank you, i know i stand before you today amidst difficult times for the city and especially for the sheriff's department. i am very grateful for the confidence of mayor lee in

mirkarimi and removing him from office. just a moment ago we met very briefly the woman who will be serving as interim sheriff. this comes as mayor ed lee said essentially that he is charging ross mirkarimi with misconduct. what he has admitted to, ross mirkarimi has is official in his opinion is official misconduct therefor he is moving to suspend him right away. >> developments are coming very quickly here. we just heard from ross mirkarimi who said he will not be stepping down. just moments ago we showed you the mayor says he will remove from office. there was another news conference scheduled and we were supposed to be hearing from eliana lopez, ross mirkarimi's wife. but it turns she was a no show. instead her attorney paula kaney showed up and said lopez is no longer willing to speak. she says lopez wants her husband to remain in office and that she's very upset by the entire situation. including a piece in the city's

going through. what's the family saying tonight. >> reporter: frank that's right i spoke to sierra's sister on the phone. she told us they feel helpless and they just can't sit at home so they decided to do their own search. this is you tube video of sierra lamar smiling and laughing last year at disneyland. friends put the video online to let the world know she's missing. back in the neighborhood where she lives, investigators went door to door to see if they could glean any information from neighbors. >> did i hear anything, did i see anything. i said no it's a quiet neighborhood. didn't see anything that was out of the ordinary. >> reporter: people who live here say they would often see sierra walking to the bus stop before school. authorities say their canines lost her scent at the driveway of her home. neighbors worry if somebody did take sierra as she was walking no one may have witnessed it. >> i happened to be looking out my window, no one else would

see anything out here. i mean it's not remote but it's rural. and there's just not a lot of traffic that goes by. >> reporter: sheriff's officials went back to washington high school in fremont and sobrado high school to interview sierra's classmates. investigators spent part of the day canvassing sierra's home. they have stated that sierra's father is a sex offender but he is not a person of interest. >> i think that we should focus on bringing sierra back, not place blame on anyone. >> reporter: now tonight there is a vigil planned for sierra at 8:00 p.m. at the morgan hill presbyterian church. reporting live, janine de la vega, ktvu news. three uc berkeley students and a former student were arranged today on charges

practices by banks and mortgage companies. john avalos is behind the resolution and spoke at today's rally. the city has seen at least 12,000 fore closures in just the last three years. back on wall street stocks closed lower today for just the second time in two weeks. concerns about an economic slow down in china overshadowed an upbeat report on the u.s. housing market. the dow dropped 69 points, the nasdaq was down four points. 54 delegates are at stake for the republican candidates for president and we're giving you a live look here from gettysburg pennsylvania. the senator and supporters are rallying here at the gett yburg hotel. a lot of people assembled but no one speaking on the microphone just yet. romney came to google chicago headquarters to answer questions from users around the

a strong earth quake measuring 7.4 rumbled through mexico city. the earthquake also damaged roads and bridges. this truck was crushed when an overpass collapsed in the quake zone. the earthquake struck about 11:00 this morning. it was centered east of acapulco and it shook buildings in downtown mexico city. this was the scene in mexico city just after that earthquake. hundreds of workers and residents all evacuated into the streets. some neighborhoods lost power and telephone service. so far no deaths or injuries have been reported but one official estimated that 60 homes were destroyed and 800 others were damaged. here in the bay area a lot of people with relatives in mexico spent the day trying to reach their loved ones and ktvu's john sasaki is live in the mission district in san francisco now with their story, john. >> reporter: frank this is 16th and mission here and the

mission district is bustling with people from mexico and other countries. as you can see people are going about their business during the afternoon rush hour. many people still don't know about the quake, others may know the 7.4 earthquake happened but are relieved there were no casualties. we met the mayor and we talked to a woman from mexico working at a taqueria. both are worried about any damage and casualties. >> hopefully everyone is okay. i'm concerned, i'm from over there. my family is from over there. but yeah hopefully everything is all right and everyone is okay. >> we are waiting for official information gradually it's coming. fortunately in general terms there are no victims at this point. there are not any kind of people injured and it's very important to consider because the earthquake was pretty

petitioning the united nations to stop the practice of solitary confinement. they also question the living conditions as well as prisoner medical files. right now 4,200 inmates in california state prisons are being held in isolation. despite the recent rains, the marin county declared an emergency. this season through february saw a 33% of normal rainfall along with unusually warm temperatures. they say the conditions dried grassland that farmer depend on to feed their livestock. the snow continues to melt away on the sierra's highest peak. mount hamilton, you can still see traces of snow up there. the mountain received a good deal of snow from last week's snow but with today's sunshine and warmer conditions you can see there that all that snow

more mild temperatures. daytime highs tomorrow are going to make it into the 60s, maybe the upper 60s. there's cold air, this is the open cumulous. it's going to drop down as we get into saturday. on thursday this area is going to lay across us and open the door for this very unstable air. at least that's how it's playing out in the computer run. we'll watch it closely for you. as we get into this afternoon, we have the cloud cover tonight about 10:00, you have cloud cover. maybe drizzle showing up. this model isn't picking it up but the models have a hard time simulating the drizzle events. and then as we get into tomorrow morning, increasing clouds, right that's wednesday morning but still looks pretty dry to me. then you get into wednesday afternoon. you get some clearing, a little bit of drizzle up north and you get the picture. as we go through time we're waiting for this system that is waiting to roll in on thursday. we're going to talk about that

the transportation security administration is responding to a widely watched video of a 3-year-old on a wheelchair getting a pat down. the video has sparked criticism from those who say that it's further evidence that the tsa procedures are excessive. pat downs of kids 12 and younger are unlikely but still possible says the faa. the child's father says he recently decided to post the video after watching it again and getting emotional about what happened. anise parker tweeted she was more than an hour late from houston to sfo and one hour late with a remark about a merger with continental.

southwest and united have been vying for houston international. amelia airhart who when it was really hard she decided she was going to break all types of limits. social limits, gravity limits. >> the search for airhart's plain is as difficult as the feat. there's new evidence some of the wreckage may have been spotted on the corral reef. now scientists, engineers, aviators and salvagers are

looking for that plane using robotic technology. airhart and her november gator took off on july 2nd, 1936. she was the first pilot man or woman to attempt to fly around the world. the 10 day expedition to search for amelia airhart's plane begins in july. it will be funded by private donors. actor jamie wayland was part of a gang on the street and was seen on surveillance video holding a bottle full of gasoline and a rag for a wick and was found guilty of violent disorder. he has now been sentenced to two years in jail. wayland played the bully craig in six of the harry potter

it's safe for now. but work to keep the santa cruz board watch protected isn't over yet. >> we'll get to the santa cruz boardwalk situation in a moment. but first we have developing news. things are moving very quickly in the case against sheriff ross mirkarimi. >> and you've seen it play out right here on ktvu channel 2 news at 5:00. >> the sheriff said he was not resigning and the sheriff answered in no terms. >> reporter: the mayor's actions just under a half hour ago caps aty hall show down between he and the sheriff.

now yesterday we learned that the mayor met with ross mirkarimi in his office right there and gave him 24 hours to resign or face misconduct charges over his conviction yesterday for misdemeanor false imprisonment. take a look at these pictures just after 4:15 today, mirkarimi emerged from his office and announced he would not resign and would take his chances with misconduct charges. the mayor anuanced he is suspending the -- announced he is suspending the sheriff. >> i have carefully reviewed the city charter, conducted my own review of the evidence and consulted with legal council. i also met with sheriff mirkarimi yesterday to give him the opportunity to resign. i informed him of my intent to fulfill my duties pursuant to the charter and move to suspend and remove him from the office for official misconduct.

from the rushing san lorenzo river. christien kafton live at the boardwalk where he learned just how close the situation came to disaster. >> reporter: let's give you a sense of where we are. let's show you right now you can see the santa cruz boardwalk here to my right. the park says it is now safe thanks in large part to this large sandy berm that we are standing on. this berm is also rehandling the san lorenzo river. the san lorenzo back on its correct channel. it could have been disaster if it wasn't for some quick thinking. crews shoveled sand back in its place finally getting the san lorenzo back on its path. >> they were about half way, about right here when they were making this levee, this break. >> reporter: last week the rain swollen san lorenzo took a sharp turn to the right instead

of running toward the ocean threatening the boardwalk. >> we built a berm, if we would have waited an hour or two more we would have had serious problems. >> reporter: this hastily built verm stopped the water. instead the park will be ready for visitors as early as this weekend. >> there was no damage to the boardwalk itself. we lost one pair of stairs to the beach. but we have many other stairs to the beach. >> reporter: now santa cruz residents are asking could it happen again? >> i've never seen this. i've been here for my whole life and i've never seen it like this before. >> reporter: although the park says it didn't miss any days of business. santa cruz beach boardwalk and the city of santa cruz are working to develop a long term strategy trying to prevent the san lorenzo river from jumping it's banks once again and

threatening the santa cruz beech -- beach boardwalk to my right. the suspect threw money out the window. the chase ended in gilroy where the men surrendered. the suspects carried out a take over robbery this morning at a wells fargo branch in san jose when officers attempted to stop the get away vehicle. police say at one point the suspects began flowing some of that stolen money out of the window. so officers had to remain on the scene to control traffic and also try to collect some of those lose bills. investigators say a gunman entered the papa murphies restaurant at about 5:30. jumped behind the counter then took off with the money. he was seen getting into a white full sized pickup truck with a lumber rack. police are asking anyone with information to contact them. this is the first evening commute during which solo

drivers can use a new express toll lane in the south bay. we have a map to show you where that new lane is. we're talking about highway 237 from south of dixon landing road to expressway in san jose. we drove that stretch earlier today at the time we did this drive, look at that lit signed there. the cost for solo drivers is $1.90. we have more video, this toll lane we're on is clear sailing but take a look at the right here. all those lanes of traffic backed up essentially this is the ride you're paying for passing through all that traffic. this lane opened up to single drivers at 5:00 a.m. today. and it looks like it's taking drivers a little while to get used to this change. >> we've noticed a lot of high speed lane changes, because that lane is open. people trying to get back over that don't belong out there. so it's accidents, a few more

accidents this morning than usual. >> these express toll lanes operate at the same hour at toll lanes from 5:00 a.m. to 10:00 a.m. normal car pool times are in effect in the evening commute. you have to have a tag for using those lanes. the charge will range from 30- cents to $6. the more congested the roadway is the higher toll you will pay. city leaders in walnut creek are considering a new proposal to block traffic from a downtown street. the plan involves shutting down most of broadway plaza to make the surrounding shopping center safer for pedestrians. it's also an effort to bring more retail space, underground parking and residential units to the area. the walnut creek council is said to discuss the proposal at a meeting this evening. let's go back live to rick santorum's campaign headquarters. he waits for returns from the illinois primary. polls closed just about more

than half an hour ago in illinois. that's where 56 delegates are at stake in the republican presidential race. newt gingrich came out swinging today with comments from actor robert deniro. he demanded an apology from the president because the incident happened at an obama fundraiser. deniro joked that america wasn't ready for another white first lady. >> everybody in the country ought to hold the president accountable when somebody at his event says something like deniro said. you see them everywhere. littering the ground. paying the homeless to pick up cigarette buds. how much they'll be getting in the city where it's happening.

santa cruz county today began a new crack down on the use of plastic bags. grocery stores, mini marts and shopping centers are banned from using plastic bags and to encourage shoppers to bring their own recycle bag, stores must charge 10-cents a bag. the city of santa cruz is considering a similar ban. volunteers in san rafael are trying something new to clean up the most common type

of garbage that litters our streets, cigarette butts. city leaders say this program not only helps clean up the streets but also helps people in need earn some money. organizers of the san rafael clean campaign say cigarette butts are one of the most toxic types of litter. >> threw one of these in a jar of water with a fish and the fish will die. so it's very important to get these off the street. the rain comes and washes them into the water. a new twist tonight in the battle over the future of drake's bay oyster company in point rays. a new report by the department of the interior is supporting the national park services scientific claims about the oyster farms. the national park service recommended that the oyster company's permit not be renewed but the owner of the oyster farm criticized what he called a paid for review and says he

wasn't even contacted. the permit for drake's bay oyster company is said to expire in november. scientists say they have a potential breakthrough in the treatment of pancreatic cancer. tumors in the pancrea create a barrier around themselves. scientists hope this will help create medicine that will stop pancreatic cancer. it involved a repositions of the small intestine next to the stomach and that allows special hormones from the small intestine to help improve insulin. a dog mauled a woman and

an update now on developing news from the illinois primary in the republican presidential race. cnn has just projected that mitt romney has won the primary there in illinois. what you are looking at is a

live picture from rick santorum's headquarters in his home state of pennsylvania. here are some of the early results with 11% reporting. mitt romney is leading with 56% of the vote. rick santorum second with 27%. ron paul third with 10, followed bid newt gingrich with seven. the headline at this hour, cnn projects that mitt romney has easily won the illinois primary. turns out the owners have sent the dog away for obedience training. the owners claim they are not trying to hide the dog from authorities. >> reporter: that's right that 90-pound dog attacked a 12- pound poodle and killed it. and attacked the dog owner. the owners of the attacking dog

my watch that the dog repeats offenses again. >> reporter: the owners say their pet has never hurt anyone or anything before. >> i just want you to know, how i feel and my heart goes out. >> reporter: the owners claim they were not aware the neighborhood was on the look out for their dog and that they were not trying to hide their pet by sending it to gilroy. but were simply trying to address what they recognized as troubling behavior. >> now back here live at huntington park you can see that folks bring their kids and dogs here. many tonight say they are relieved that this attacking dog has been located but say they will not feel spirally safe until -- feel entirely safeing in their dog is taken into custody. volunteers are posting fliers to try to find whoever shot a young hawk. a fish and game ward discovered the injured hawk in san martin. an x-ray revealed that it had been shot in the chest with a pellet gun. the hawk is being cared for in

the wildlife center of silican value. the vets are trying to decide whether to remove the pellet or let the bird heal. a group is offering a reward for information leading to an arrest of the shooter. hawaiian airlines is making it easier to get away. a spokeswoman for the carrier says the new schedule is part of the expanded service being offered through it's new maui hub. members members of the eisenhower family are not so happy about a memorial. it includes giant see through tapestries. >> this is a very, very expensive design and i think we

as the next weather system tees up to come into the area. tomorrow it's not happening, tomorrow is going to look a lot like today. some clouds, maybe a little bit of a spritz in the north bay, a little sprinkle but no big deal. don't change your plans. looks like winter returns especially on saturday. out in the pacific what i'm tracking is a weather system that's going to budge in here as we get into thursday. that opens the door for the weekend event. so tonight partly cloudy. you see sprinkles up north. light winds. the winds are just variable and light out there. here's the system i'm tracking. the big one for saturday is still brewing up in the gulf and it's going to sink down with cold air. this line here is going to drop down and move through the bay area as we get into thursday. that will create a wet morning commute on thursday. light sprinkles, still no big deal. cloudy in the afternoon, partly cloudy for the afternoon commute. so here's how the computer model plays it out. 11:00 on wednesday night, you can see the rain to the north. here's that first system.

this is that thursday. overnight wednesday, there it is. thursday morning about 4:00 a.m. you have a weak frontal passage. that opens the door. thursday morning's commute i think you could have some wet roadways. as you see it's not a huge deal and that rolls out of here. the system offshore tees up and that moves in on saturday. your forecast highs tomorrow. pretty mild look at these numbers mid-60s. of course it is mid-spring. it's going to feel like it tomorrow. the five day forecast with your bay area firmly in view representing a weekend with some rain. this is a tough one because a lot of folks plan stuff and you get to spring. it's a lotover weekend plans coming up. saturday looks like it's a very wet day. >> you would say reschedule at this point. >> right now it looks like but let's get a model one more day. hollywood has high hopes of the hunger games. the hunger game social security

an emergency response team from japan is here in the bay area: they're here for disaster training as their nation continues to recover after the largest disaster. >> do you feel like spider man. >> one year after the devastating earthquake and tsunami. firefighters are will your -- learning new skills. they're learning the fundamentals of disaster response. that includes searching for victims in a pile of collapsed debris. it's a scenario that a lot of

rescuers faced during last year's japanese disaster. >> with these guys in particular, they've been through a very difficult time. i think it's notable, they are here within just over a year. and many countries would be able to be that resilient or have people come back that quickly. >> reporter: when the tsunami hit, 12 japanese firefighters were in menlo park undergoing training. they immediately returned to japan to undergo rescue efforts. now this crew will return to their homeland to try to teach their fellow firefighters rescue training. sheriff ross mirkarimi refuses to step down after the mayor gives him an ultimatum.
