county jail where heather has learned about a loophole that let the suspected killer stay here in the united states. >> reporter: immigration officials said that they had to let the suspect go free because they say his country refused to turnover the paperwork to send him home. tonight he is back in jail here in a special area awaiting arraignment on five counts of murder. investigators spent a 4th day processing the murder scene inside this house. police chief saying today it was unbelievablely dangerous criminal who was behind the killings and tonight we learned the suspect had been ordered to leave the country five-years ago. >> in order to deport somebody the country has to accept them. . >> reporter: and cooperate something immigration officials say vietnam wouldn't do. they site the country for failing to turnover documents needed to deport the suspect. a judge ordered it upon his

release from prison in 2006 after he served eight years for armed robbery. federal law prohibited him from being held more than 180 days. ice officials say after that period if the removal can't happen they must release them. >> the court said that at some point this has to end, it's not right to hold all the people for the extended periods of time. >> reporter: he continued to report to ice officials and had no incidents until this weekend when he was arrested for the slayings of five people. >> we believe that the family at the house knew the suspect and let him in. >> reporter: police also believe they have identified the motive but aren't releasing details. >> rather than us provide the story to whoever we may talk to we want to hear it from them first. >> reporter: we have learned tonight that luck is not scheduled to be arraigned

pedestrian struck and killed last night on lombard street. the man was identified as 45- year-old thomas ferguson. at about 8:45 he was crossing the street when he was hit by a toyota. the driver stopped and cooperated with investigators. police say ferguson was not in the crosswalk when he was hit. >> tomorrow there will be another search for that missing teen from morgan hill who hasn't been seen for a week and a half. the family is getting help now from two people who know what they are going through. >> reporter: they are hanging signs and setting up a plan of action to bring sierra lamar home. the class kid first foundation flew into expand the search. starting at 8:00 a.m. tomorrow volunteers 18 and older can come to help. >> if there is anything suspicious out there at all the

. a man suspected of stabbing to death a ex-girlfriend is due in court tomorrow to be arraigned. the 25-year-old edgar vasquez is a accused of killing the 24- year-old. he was arrested after a swat team raided his home. police say he stabbed her last friday afternoon, her body was found in her family's car in front of their home. police say he had broken up with her. a 63-year-old man charged with molesting and beating to death a 13-year-old from oakland back in 1974 appeared in court today. curtis tucker is a accused of

the whale raised its head out of the water and swam away. a new study finds chocolate lovers appear to be thinner. researchers studied about a thousand men and women, all of home exercised about four times a week and had a balanced diet. they found those who ate chocolate about five times a week had a body mass index about one point lower than those who didn't eat it. the lead author said it suggests that something in chocolate may make the colories you eat less likely to turn to fat. >> how bay area wineries are fighting back after a series of gas thefts. >> and bill martin is tracking rain. how it'll affect your day tomorrow and his forecast.

. wineries have become a popular target for fuel thieves driving by its rising cost of gas. as alex savage says one has been hit more than a dozen times over the past few months. >> reporter: the vineyard has become a favorite target for fuel thieves. >> it's a tough deal out here. >> reporter: and the general manager has tried just about egg he can think of to stop them including these gas cap lock that are supposed to stop bolt cutters. >> they got bigger ones and cut this. everything we put in there, they up the ante. >> reporter: he has put up extra high februarying, put in motion sensors, even a security camera. that system did capture these images of the thief taking fuel with a piece of hose. fuel thefts in sonoma have got up 35% over just the past five months. investigators see a direct link

to the rising price of gas. at paul's wines they have started locking up their work vehicles in this shed after a string of thefts, the director said it's an easy crime, no neighbors here, just vineyards. >> people who need gas, are able to just come by and snatch it without any consequences. >> reporter: he thinks it's the same thief who has come back over and over again, taking more than 350 gallons of gas. >> this guy know what he is doing. he has made it a profession. probably making more money than us. >> reporter: in the recent cases there have been no arrests so far. alex savage. >> the cost of gas is forcing southwest to raise ticket prices. round trip will group as much as ten dollars. it's the third time they have raised fares this year.

a couple weeks ago they said they wouldn't turn a profit for the beginning of the year because of the higher cost of jet fuel. >> police have arrested three people for vandalizing delores park. they damaged construction equipment and leaving grafitti. at the time the damage was estimated at tens of thousands of dollars. the park playground is under going a renovation. police in the mission district say bike thefts down since the beginning of the year. in jana loan 50 were reported but police say so far for the first three weeks of march only 19 bikes have been reported stolen. they have stepped up their enforcement and are doing a workshop on thursday. >> several people inside a livermore nail salon were luck write when a car crashed through the length of the salon. this is a fire department photograph we can show you, look at the center of the picture. you will see the car way at the back of the store.
