good morning. welcome to mornings on 2. i'm dave clark. >> good morning, i'm tori campbell. it's thursday, april 5th. we have exclusive information this morning in the oakland vocational school massacre. tara is live at oikos university with details about the intended target and the first murder victim. good morning, tara. >> reporter: good morning. we just found out the very first victim to run out of this building, this is the spot where she fell, right here. there's a memorial that is now grown and there's still bloodstains here in the parking spot. this is the spot where officers first responded. this is where she fell. now we do want to mention that after midnight, an alert came out from the police chief, this is a facebook picture of ellen

cervellon director, the nursing director. it's a different female administrator who is not being named because she fears for her safety. her friend told us the director had an argument with goh after his tuition after he dropped out the school in the fall. cervellon was at a memorials service yesterday but declined to comment about the case. >> the only thing she is focusing on now and only thing she can talk about is the students and the families and she on the phone with them constantly, and trying to talk to the survivors, and she is just -- i don't know when she'll break down, but she is right now -- that's all she can think about is the kids. >> reporter: meanwhile, the 43- year-old suspect made his first court appearance yesterday, but cameras were not allowed inside. police say co-goh went on a shooting rampage monday morning. we did get an inside look at his cell where he stays 23

hours a day, separate from the other inmates. deputies check in on him every 15 minutes, he will remain there presumably until his trial. and he is scheduled to enter a plea at the end of the month. tara moriarity, ktvu channel 2 news. we're still learning more about the seven victims from monday's mash shooting. this is video of six of the seven people who lost their lives. police say all of them were immigrants, hoping an education would give them a better life. today the youngest victim, 21- year-old lydia sim, will be the first to be buried. last night friends and family held a funeral service for her. the service was held lasts into the at 8 at the church in hayward where sim worshipped and worked. friends say she taught sunday school there and wanted to become a pediatrician to continue working with children. she is being raid to rest in

los altos. the oakland a's are holding an overnight tailgate event called making oakland better. it begins at 7 tonight and lasts until 7 tomorrow night, just before game time. being held at corper of 66th avenue and coliseum way. stay with ktvu and ktvu.com for testimony coverage of the shooting. we're working to bring you the latest developments and we'll have more on the victim. in just about two hours from now, a desperate search will resume in hopes of finding missing teenager sierra lamar. it will be in gilroy and san martin. investigators have not told us why the search will focus on some specially trained dogs. ktvu news will bring you a live report on all of this coming up at 7:30. right now police are busy trying to identify the three suspects who they say beat up a

23-year-old man at the bart station last night. ktvu's claudine wong is out there now with a look at where this attack happened and also how passengers are reacting. claudine. >> reporter: dave, we're at the entrance to the bart station, well literary and well traveled as the commute gets underway here. show you the surveillance camera that just fits right in this entranceway. and over by where those folks are entering headed to bart trains there's a ticket agent booth close to where we're standing. this is where it all happened. and this is where passengers this morning say they're surprised to hear about this crime. the 23-year-old man was attacked here and found on the floor when police arrived. the officer says they arrived a couple minutes after the call came in and before police and fire also arrived. he said the victim was beaten badly by three men. they had fled the scene and the victim wasn't saying much

because of the condition he was in. he was taken to the hospital. passengers this morning say they are taking an extra look around this morning. >> we just used to as prudent as we can and be aware of our surroundings. well lit areas, attendant is next door to us, so -- >> at least -- >> yes. i guess -- whatever caution we can, that's about it. go on with our lives. >> reporter: i talked to police bus this is their case, bart police say it's one other witness besides the ticket agent who saw this go down. and there could be more out there. what is unclear is if they saw what led up to the beating in the attack, or if they only saw the crime once it was underway. however, remember they do have surveillance video and have a clothing description but aren't releasing that yet. we come back out here live, you're looking at the direction the suspects fled. that heads into a residential area, and then towards busy el camino real.

so it is possible that people saw them running in that direction. the investigation at this point is continuing. claudine wong, ktvu channel 2 news. time is 7:06. in overnight news, several small earthquakes shook the bay area. there were four small quakes, just north of morgan hill. the first one just after 1 this morning. the magnitudes range from 2.8 to 1.3. no word yet on damage. meantime, there were two tiny quakes near berkeley, just after 2:40 this morning. measuring 1.8 and 1.7. also early this morning, a wild crash with suspicious circumstances in oakland. police say a car lost control on southbound 880 in oakland and crashed through a fence on the right hand side of the freeway, causing injuries. the car ended up on embarcadero. a tow truck driver called to the scene said he saw the car's passengers clear the trunk and

machine up in the vineyards going. cool by noon, sun clouds possible showers here later this afternoon, mainly towards the north and east bay. highs yesterday were in the low 60s. today in the upper 50s. we topped out on temps monday, we'll bottom out today. tomorrow morning as cold but we'll start a little warm-up friday, into the weekend. but some 20s towards lake county, upper lake 25, also few mendocino county. napa close to town, a lot of temperatures near 32. also in sonoma county, mill valley fair sacks 56. palo alto, woodside, all around 38, 39. so there's some cold readings, napa and fairfield 33. san rafael at 11 to. livermore now at 39. and again san jose 42. not far away there are some upper 30s as we saw by los gatos. so cold readings in the mountains. ignore that. but this rotating around right

there, starting to produce clouds in the north. a little bit of a westerly breeze mainly northwest but more of a westerly breeze. the system is right there, it's deepening, so little settle in with more cold air for a while. that might also coming around the backside could give us partly cloudy skies. one our forecast models puts light rain on napa and also concord. so lake county, napa county, solano, maybe today, later this afternoon, few showers could pop up. it's an iffy forecast on this but we have to mention it here. breezy, come, cold morning, clouds possible showers later on today. doesn't think it will be the peninsula or the south bay but it would be to the north and east. further north, better opportunity, closer to the proximity of that system. 50s for highs or very low 60s, so temperatures very cool. santa cruz 62 although i did hear of about a 32-degree reading in santa cruz so man, that is cold on the coast for april. clearing out, cold tonight and tomorrow morning. and then looks good as we clear out saturday.

terminal at sfo, and listen for a second. they're very vocal out there, our photographers tells us they're very loud this morning, and they want to get their word across. tsa workers who they are, they started protesting just about 45 minutes ago. they tell us their goal is simply to greet passengers and inform them about some potential funding cuts, which could reduce staffing. the workers also tell us they have not been included in the talks for the exact details are still unflown. but their concern is cutbacks could make air travel less safe and create longer lines at the checkpoint. >> we can't multi-task. we can't do 10 things at once weapon have to focus on our jobs. and it has to be security. we can't take shortcuts. >> so again, about 40 to 50 workers, expected out there on the picket lines this morning. but the protest is supposed to end in just about 15 minutes at 7:30. again, this screeners are telling us that their point is

defensive coordinator gregg williams telling his players to injure some of the 49ers. >> what you just heard is williams allegedly telling his players to test kyle williams' concussion, and also take out michael crabtree's acl. a filmmaker documenting one of the saints players says he was there during the speech and he recorded it. it is 7:18. we're now learning that another attorney has been hired by george zimmerman, the man who shot trayvon martin. he says martin was not an innocent bystander, and made the mistake of attacking his client. >> he was absolutely entitled to defend himself and that's why trayvon martin is dead, not

because of racial profiling. >> zimmerman's father also talking about the alleged attack. he told fox news that his son is not a racist and was calling for help before he shot martin. zimmerman has not been charged or arrested in martin's death. people across the country continue to show their support for martin. tonight a vigil in his honor will be held in san rafael at 5:30 at the lagoon park. it's being called zero- tolerance for injustice in marin. people are asked to bring their own candles. time is 7:19. today the white house will hand in a homework assignment of sorts today. a federal judge ordered the obama administration to give an explanation for a speech the president gave on monday. ktvu's scott mcfarland is here. this is the latest skirmish in the legal battle over health reform. scott.

>> reporter: dave, the federal judges from texas ordered the white house to hand in the explanation, three pages in length, and single spaced. mr. obama during questioning and answer on monday made a comment, confident the supreme court won't take the extraordinary step of every turning the health reform law. that quote is what got the attention of the federal judge from texas, who said the president seems to be questioning the authority of the federal court system. the u.s. attorney general defending the president's words this week and suggesting he will respond to the judge. >> i think that what the president said a couple days ago was appropriate. he indicated that we obviously respect decisions that courts make under our system of government. >> the court -- the judge in texas is hearing a lesser case regarding health care. the supreme court ruling on the major landmark health reform case expected here in washington in late june.

scott macfarlane, ktvu channel 2 news. aetna insurance says they made a mistake saying doctors were no longer covered and patients would center to find new doctors or pay more for nature health care. aetna now says it's sending out retraction letters. in the meantime, customers who have any questions should call the customer service phone until on the aetna id cards. surprising new information about the foods you eat. food safety experts say there's ammonia in many of our foods, and not just in ground beef. the last month fast-food chains and supermarkets stopped serving meat that was treated with ammonia after critics started labeling it pink slime. the compound was approved in 1974 for food consumption, and you can find it in cheese, baked goods and chocolate

over sacramento, that's just feedback but there will be a possibility of showers north and east later on. the main story how cold it is this morning. napa, lot of reports of low 30s there. kenwood 29. and lakeport now 26. so there are critical minimums here, which is why the wind machines in vineyards this morning. little system coming down might produce a few showers towards lake county, maybe solano county. you can see right there, it would only be today. by tomorrow morning it will be just be closure and cold and we'll kick this system out of here and conditions look better into the weekend. but a breezy, cool day. sunny for a while, then partly cloudy later on. 50s mainly for temperatures upper 50s are very, very low 60s. extended outlook has few showers to the north and east but then looks good friday, saturday, most of sunday. increasing clouds on monday.

it's set to begin in 90 minutes, the santa clara county sheriff's office will resume its search for sierra lamar. lorain orlando joins us live to let us another with the the search will take place. >> reporter: good morning. volunteers have posted fliers all over morgan hill, on every corner here. you can see one next to me over here, and across the street over there along with some yellow ribbons. sierra's family is doing everything they can to bring the teen home, and sheriff's deputies are doing the same. last time volunteers searched the area on sunday, they found clothing that didn't turn out to be hers. today about 20 members of the santa clara county sheriff's search and rescue unit will be looking for evidence south of her home in san ma tin and morgan hill. they'll bring canines trained to find human remains. sierra lamar has been missing almost three weeks now. the 15-year-old mother says if anyone else can help, her

been replaced by barcodes. to get people with smart phones immediate links to photos, phone numbers and other critical information in missing persons cases. facebook and twitter have proven to be valuable high-tech tools in the search for missing children. today the youngest victim of monday's mass shooting at an oakland university will be laid to rest. and we want to show you six of the seven people who lost their lives at oikos university in oakland. police say all of them were immigrants, hoping an education would give them a better life. and today 21-year-old lydia sim will be laid to roast in los altos. at the same time, we're finding out more about the other people killed in that rampage. 33-year-old -- came here from india two years ago. she was just two months away from graduating as a licensed nurse. the people who knew her say she'll be remembered for her desire to give back. >> she had so much compassion

appointed to his case. this is day 11 of a strike by engineers at one of san francisco's biggest hospitals. the people who maintain meld equipment and generators and refrigerators at california pacific medical center took over webster and clay treatments last night. they say they were without a contract for 18 months, and deserve better wages than what cpmc is offering them. >> i've been working here for 33 years. this is the first time they have forced me to walk the streets. >> the medical center says it has offered what it thinks is a fair wage for the current economic times, but the engineers have rejected it. both sides told ktvu they want to get back to the bargaining table, but there's no timetable for that to happen. today cpmc takes its proposal to build a 555-bed hospital at the site of the old cathedral hill hotel, in the

planning commission. the medical center would make transit and pedestrian safety improvements as well as invest in community clinics according to a deal that the mayor's office, even if the planning commission gives its approval for the plan the board of supervisors would still have to sign off on it. two accused bank robbers are in jail this morning. they're accused of a holdup in tracy. the two suspects are identified as 40-year-old leroy colbert of fresno and 42-year-old george beazley of martinez. they're accused of robbing a bank in downtown tracy yesterday morning. police arrested the two men shortly after the holdup and say they recovered the stolen money. investigators say they may have also robbed a bank in livermore two weeks ago. look at this, an oakland market now red-tagged after that van crashed right into this. this caused a lot of damage as you can see to the black and

white liquor store on fruit veil avenue. all happened about 8:30 last night. the driver hit another car first. then went through a fence, and then into that store. police say the driver and two other people ran away. a federal appeals court in san francisco ordered mediation in a 13-year legal battle over gun shows at the alameda county fairgrounds. they banned gun shows after a shooting in 1998 that left eight people injured. the state supreme court is already upheld the ban. however, gun show promoters are fighting it on constitutional grounds. 7:36. san jose police are issuing a community alert for a fake police officer who has been robbing people. he has robbed three people near arroyo park in northeast san jose and hellyer avenue and paradise drive. in the latest incident tuesday, the suspect walked up to a man at the footbridge near sunset

and stowe, flashed a badge, patted him down and demanded his wallet. >> someone came up and showed you a badge and asked you for your wallet, what would you do? >> -- see i.d. >> the fake cop is described as asian, around 30 years old, 5 feet 7 inches tall, and about 170 pounds. he targets spanish speaking immigrants. if you're stopped by someone fitting this description, try to get someone's attention and call 911. time is 7:37. the young man being called a hero this morning for his quick response to a suspected drunk driving crash in san jose. the ktvu news was first there on that scene yesterday morning. investigators say a woman smashed her car into this house on el rose avenue, causing a gas leak and then a brief evacuation. now officials say austin riley saw the woman slumped unconscious at the wheel, moments after this crash.

and then the 19-year-old smashed out her car window with a rock, reached in, turned off the car's ignition, and called for help. time is 7:37. movie director francis ford coppola is suing a restaurant in novato over its name. the movie director who lives in the north bay says the restaurant called -- italian kitchin fringes on his trademark for the name atovola, referring it a style of service at his restaurant. the owners of the restaurant have tried to get their own trademark but so far haven't been able to do it juppe the battle goes on to keep the gold dust lounge open, despite a legal setback. and yesterday the city's his for, commission voted against giving a landmark designation for the bar in union square. however, a city supervisor plans to introduce a new proposal expect week that could possibly override that

stocks slipping over renewed fears the european debt crisis, especially spain and their ability to push through cost- cutting programs at a time when the economy is heading for another recession. live look the the big barred, the dow currently down, nasdaq down 2, s&p down 1. the numbers are coming back because there's some good news, another sign the job market is getting stronger. firsttime claims for jobless benefits fell to 357,000 last week. that's down 6,000 from the week before. and tomorrow the labor department releases the big march unemployment numbers and signs jobless rate could go down again. a federal prosecutor for brazil has filed another lawsuit against san ramon based chevron. that's after the brazilian government reported another leak in an offshore oil field.

was taken curing the incident and now whether he's competent to stand trial. prosecutors say there's reason to believe he may suffer from a mental disease. he is charged with interfering with a flight crew. a berkeley shopper got quite a scare when a man cut him with a knife. it happened yesterday at a 99- cent only store in san pablo and university avenues. police say the shopper got into an argument with the man who pulled a knife and injured the shopper. the victim was not hurt too badly, and refused medical treatment. police arrested the suspect with the knife. this incident is just the latest example of a spike in violence in berkeley. the daily californian reports there have been several shootings and three homicides this year. there was just one homicide all of last year in berkeley. this is a murder in south berkeley last week. many who live in that neighborhood say their area is being neglected, but police say they allocate a lot of

resources to south berkeley. the richmond police racial discrimination trial continues today. defense attorneys for police chief christmas news and the richmond police department said the claims of seven black officers accusing the department of discrimination are ridiculous. they say the officers work to undermine the chief. the officers alleged there was a hostile work environment. jury deliberations will begin after today's rebuttal. no comment yet from administrators at oikos university about the possibility the school could lose its accreditation. the state department of consumer affairs tells ktvu it has nothing to do with the shooting rampage over monday. 41% of graduates there pass a national nursing exam last year. the state average is about 75%. state regulators are adding the school has had trouble paying back loans. the school's website there says classes are cancelled until

good morning. welcome back to mornings on 2. it is thursday, april 4th. we have exclusive information about the oakland vocational school shooting massacre. ktvu's tara moriarity is at oikos university now to tell us about the first of the murder victims and where that attack occurred. tara. >> reporter: police fun to the very first victim, lying in a parking lot, next door to oikos university. you can see it how far she ran from the front door over to the parking lot. two people were actually standing over her waving down police that morning. and you can see how far she ran before she collapsed. now flowers sit in the parking space, marred by bloodstains, just yards from oikos university. that female victim was the first to be transported to the hospital. we also want to mention that just after midnight, an urgent alert came out from the police chief. howard jordan says the intended

the end of this monthly. tara moriarity, ktvu channel 2 news. we're gathering more information about a story we first brought you at 4:30 this morning. police are investigating the attack and betting of a 23-year- old man at the coma bart station. claudine wong is at the station and you just spoke to someone who arrived right after the beating occurred, right? >> reporter: that's right. we talked about a couple witnesses and -- piecing together what happened this. attack happened in front of this ticket machine. we know that when it happened around 7:30 last night, there was an agent inside the booth because that ticket agent called for help. we also know there was a surveillance camera that recorded the whole thing that happened. and we know there were witnesses. i talked to one woman who did not want to go on camera who told me that the suspects ran in this direction after the beating. three of them who met up with two people across the street and then ran in the opposite direction. she said they were young likely teenagers, and she says as the

victim lay bleeding on the ground, as they ran off, she could hear them laughing. we also talked to a young woman named mikayla who says she had just gotten off the bus after the suspects took off and the bart agent was trying to keep the victim still and says everyone there was in shock talking about what had just happened. >> i didn't know, like when own the bus that's when i know that i'm like five people ganged up on him, pulled his hood over and then just started hitting him in the head. not sure if there was a weapon or maybe like -- because they're like lacerations in the face. >> reporter: she says the victim didn't say much, she was in pretty bad shape but in a few minutes police showed up. first on the scene the officers with the broadmoor police department. he told me the victim could barely talk and was just trying to stop bleeding until he could be taken to the hospital. bart's police department is handling the investigation, i talk to the lieutenant there

who told me the victim needed stitches but his injuries are not life-threatening. they are still trying to figure out what if anything led up to this brought ala tack. claudine wong, ktvu channel 2 news. in overnight news, several small earthquakes shook the bay area. there were 4 small quakes just north of morgan hill. the first was just after 1 this morning, and the magnitude range from 2.8 to 1.3. and there were two tiny quakes near berkeley just after 2:40 this morning, measuring 1.8 and 1.7. also just hours ago, a wild car crash in oakland, and it's a suspicious one. police say a car lost control on southbound 880, and crashed through a fence on the right- hand side of the freeway. the car ended up on embarcadero. a tow truck driver who was called out to the scene said he saw the cars' passengers clear out the trunk and then jump

into another car. we talked to the chp, they told us so far no arrests have been made. the hayward police department is being sued by the family of an elderly man attacked by a police dog. the review reports the 89-year- old man died soon after having his leg an dated. the dog is a full grown german shepherd named nicky. this happened last may, when police were searching for two suspects in a restaurant robbery. the dog went into the elderly man's backyard and bit him in the leg. the hayward city attorney didn't make a comment yet because he said the city had not yet been served with legal documents. the pittsburg city council approved a new zoning plan which could potentially bring an emergency homeless shelter to that city's downtown area. under state law, the city must designate an area where shelters have the right to open. the city picked 200 acre zone near the antioch border and an area near willow pass road.

as of now the city planner says there are no plans to create a new shelter. a top performing charter school in oakland will remain open, but only if it cleans up its financial and administrative problems. last night the city council board voted to keep the american indian charter school two open for five more years. but that will be revoked if problems are not fixed in the next two years. this comes after an audit found more than one million dollars in public funds was funneled to the school's founder. the school is also accused of hiring staff who did not have required teaching credentials. and we have breaking news in the north bay. there is a large house fire in petaluma this. is a live picture from newschopper 2. you can see quite a few large engines, fire engines and firemen down on the scene. firefighters there, the home is on the one thousand block of st. francis drive. it was fully engulfed when

newschopper flying over, a house fire there and newschopper 2 is showing us the video they shot a short time ago. this is a 1000 block of st. francis driver. the fire is out. and you can see firefighters there still mopping up. it took about two minutes for fire crews to get there, about a half hour to put the flames out. we're told that four people, including children, were treated for minor injuries. but this is the very latest on this developing scene from petaluma. big house fire, it's out now. some injuries, and we'll bring you more details as we get them available. in other news now, the santa clara county sheriff's office getting ready to resume a search for missing teenager sierra lamar. ktvu's lorraine blanco is there amidst it all to tell us where they'll be searching today. >> reporter: this is where sheriff's deputies are meeting right now, before they head out

on an all-day search for sierra lamar. you see a sheriff's search and rescue trailer behind me ready to go at the san martin substation. they'll leak here and south in gilroy. last time volunteers searched the area on sunday, they found clothing that didn't turn out to be hers. today about 20 members of the santa clara county sheriff's search and rescue unit will be looking for evidence. them have help from specially trained canines. sierra has been missing 20 days, and the continuing effort by volunteers and law enforcement has helped her family not just technically, but also emotionally. >> there is growing concern in my heart as you know, but knowing that the search effort and all the other agencies are continuing and not stopping, it's comforting. and i just want to put that out there. it's not stopping. >> authorities believe lamar was abducted. they received more than a thousand tips. the search starts here in san

martin, and in gilroy in minute. and will last until 5:30 this evening. according to sierra's parent, another volunteer search is scheduled for this saturday. reporting live, lorraine blanco, ktvu channel 2 news. the search has gone high- tech. look at this. photos on milk cartons replaced by barcodes. they give people with smarted phones immediate connections to photos, phone numbers and other very critical information in the search for missing persons. facebook and twitter have also been very valuable tools, high- tech tools, in the search for missing people. in less than a half hour from now, the man accused of killing five people last month in san francisco will go back to court. binh thai luc will be arraigned on five counts of murder with special circumstances. he made his first court appearance last week, but at the time he did not enter ably.

according to yahoo's sports. two accused bank robbers are in jail this morning accused of a holdup in tracy. the two suspects are identified as leroy coal birth and 42-year- old george bowsly of martinez. they are accused of robbing a bang in downtown tracy yesterday morning. police arrested the two men shortly after the holdup and recovered the stolen money. investigators say the two may have also robbed a bank in livermore two weeks ago. an oakland market is now red-tagged after a van crashed into it. the accident caused quite a lot of damage to the black and white liquor store on fruitvale avenue. it all happened about 8:30 last night. the driver hit another car first, went threw a fence, then into the store. police said the dreyer and two others ran off. oakland police will probably miss this month's critical deadline involving the first occupy eviction. the police department says it doesn't have the time or the

manpower to meet the april 25th deadline to investigate the many complaints stemming from the police raid outside city hall on october 25th. the police are also likely will miss the 180-day deadline to issue its report on the big occupy protest one week later. this potentially could place the oakland police department a step closer to a federal takeover. also, a uc berkeley english professor who faces charges in the occupy cal protest is now resigned as the acting director of the university's humanity center. she's the only professor charge for letter involvement in the november 9th protest. she says her hair was grabbed and she was thrown to the ground by police. the district attorney is charged her with resisting arrest, obstructing a public place, and remaining at the scene of a riot. a federal appeals court in

san francisco ordered mediation in a 13-year-old legal battle over gun shows at the alameda county fairground. they gunned shows after shooting in 1998 that injured eight people. the state supreme court has already upheld the ban, but gun show promoters are fighting it on constitutional grounds. republican presidential candidate ron paul is in the bay area today. at 11:30 this morning the texas congressman will speak at a campaign fund-raiser at the marriott hotel on sutter street near union square in san francisco. then at 7:00 tonight, ron paul holds a town hall meeting at uc berkeley auditorium. some of his libertarian positions such as a support for legalizing marijuana and anti- war stance make him quite popular with young voters. hey, sal, i know you and newschopper 2 are watching the bay bridge toll plaza?

old man outside the coma bart stakes. he was beaten up by three people, now they're hoping surveillance video will help identify those suspects. ktvu's claudine wong is on the story all morning and you -- she just talked to someone who saw the suspects fleeing the scene? >> reporter: that's right, dave. we talked to a couple witnesses this morning about what happened here last night. this attack being describe as both brutal and brazen because of the condition of victim, left leading on a carpet that was taken away because of how much he was bleeding and how much he was hurt. prison end because it happened right in this main entranceway, in front of ticket machine. you can see it the ticket agent booth there, the ticket agent called for help. and a surveillance camera recorded it all. one witness told me that these three suspects after the attack ran off, they met up with two other people across the street and kept going and as they were running, she could hear them laughing. we also talked to another witness who says she just got off the bus after the suspects took off running and the bart

agent was still trying to keep the victim still and said everyone was just in shock talking about what happened. >> i didn't know like when identifies on bus that's when i know that i'm like five people gaged up on him, pulled this hood over, and then just started hitting him in the head. not sure if there was a weapon or maybe like -- mrs. knuckles because like lacerations in the face. >> reporter: within a few minutes, police showed up on the scene. first on scene was officer jeff, his par in her with broadmoor police department. he said the victim could barely talk he was jews trying to stop the bleeding so he didn't find out anything about what really led up to that. that victim was taken to the hospital and bart police told me that he had stitches, but is expected to be okay. in the meantime, part police just said they don't have any anything to report except they're continuing to investigate this, continuing to try to figure out what led up

to it. and continuing to look for anyone else who could provide more information. claudine wong, ktvu channel 2 news. thank you. a young man is hailed as a hero for his response to a suspected drunk driving crash in san jose. ktvu news was first on the scene yesterday morning. investigators say a woman smashed her car into a home on el rose avenue causing a gas leak and a brief evacuation. they now say austin riley spotted the woman slumped unconscious at the wheel moments after the crash. the 19-year-old then broke a car window with a rock, turned off the car's ignition, and called for help. francis ford coppola is suing a novato restaurant over its name. he lives in the north bay and says the restaurant infringes on his trademark for the name -- which refers to a style of service at his restaurant. the owners of the restaurant

have tried to get their own trademark but have not been able to do so. and the battle continues to keep san francisco's gold dust lounge open despite a setback. yesterday the city's historic commission voted against a landmark designation for the union square bar. but a city supervisor plans to introduce a new proposal next week that could potentially override the decision. the owner of the building wants to evict the bar so it can put a clothing store in its place. an argument inside a berkeley store turned into a knife attack. it happened yesterday at a 99 cents only store in san pablo and university avenues. police say the shopper argued with a man who then pulled out a knife and injured that shopper. he was not hurt badly. he refused medical treatment. police arrested the man with the knife later. violence in berkeley is on the rise. this is video from one of three homicides in the city in the

first three months of this year. the daily californian reports it was just one homicide in all of last year. there have been shootings as we in south berkly. many residents say they're now living scared in their own neighborhoods. the richmond police racial discrimination trial will continue today. defense lawyers for police chief chris magnus and the police department say the claims of seven african-american offers are ridiculous. they say the officers worked to undermine the police chief. the officers claim that there was a hostile work environment within the department. jury deliberations will begin after today's rebuttal. 10 minutes before 9:00. the pentagon says it's ready to resume a military trial of five men accused in the september 11th attacks. khalid sheikh mohammed said he was the master mind.

four other men are also to be tried for helping to plan and coordinate the attacks that killed almost 3,000 people are. the men are expected to be arraigned next month at guantanamo bay. two years ago president obama gave up efforts to try them in civilian court. the jetblue pilot who had a meltdown on a flight last week will undergo a psychiatric evaluation. a judge ordered the psychiatric exam on clayton osbon so see whether he was sane during the incident and whether he is competent to stand trial. prosecutors say there is reason to believe osbon may suffer from a mental disease. he is charge with interfering with a flight crew. san jose police warning this morning about a fake cop. he stopped at least three people, this fake cop has a badge and a police radio, and claims he is undercover. he is described as an asian man 30 years old, 5-foot 7,

weighing about 170 pounds. in one incident the suspect walked up to a man, flashed a badge, patted him down, and then asked for his wallet. when the wallet was given back, all of the cash was gone. >> we can't have people walking around basically pro tending to be the police and robbing people of their money. comply with police officers, period. but if it's -- fits the description, be very cautious and try to summon somebody's attention and dial 911. >> that suspect was said to be driving a grown minivan. aetna insurance says it made a mistake when it sent out thousands of letters to some of its california questions. the letters said many doctors were no longer covered by aetna's network and patients would have to find new doctors or pay more for the health care. aetna says it's sending out retraction letters. customers with questions should call the customer service phone number on their aetna i.d.
