year to year 52% reduction in the availability of homes for sale. property managers tell me that real estate rebound is because of a kind of perfect storm. >> the price -- interest rates, and growth, economic growth. >> reporter: he showed me the new condos, this bath unit, about 450,000, he says well below the replacement costs, the urban housing for 10,000 residents, entertainment and dining. but the image, an uphill battle, even for people working in oakland. >> putting family first, making sure people are safe. >> a lot of upsides, more than down sides. >> i think oakland is changing. a lot, and i love oakland, but san francisco, i think is still a more -- fun environment for me right now. >> reporter: that is the new battle of the bay, john fowler, ktvu channel 2 action news. and the man known as america's oldest teen died

today. dick clark suffered a massive heart attack following out patient procedure at a hospital in santa monica. he was 82. clark was a fixture for 40 years in new york's times square, helping the country ring in the new year, every december 31st. back in 2001, he appeared on talks about cholesterol screening. >> this is something you can take control of, as the doctor indicated. there are a lot of factors, but cholesterol is something you can grab a hold of and say you won't do that to me. >> among his many accomplishments, dick clark is credited with introducing the country to rock and roll on a television show, american band stand. bay area musicians remember the man who could single handedly make somebody's music career. and ktvu's rob roth is in contra costa county tonight, where one bay area musician credits his success to what

dick clark did. >> reporter: greg ken said that dick clark helped to launch his career. >> i mean i look at this, i get a lump in my throat, knowing that we wouldn't have dick clark anymore. >> reporter: he says once they started to play his song, jeopardy, it was a hit. >> he brought rock and roll into our living rooms. >> reporter: he appeared on american band stand four times. this washington his second appearance. >> also my fashion sense, you couldn't do that today, could you? >> reporter: it was during his appearance that clark mentioned a thank you letter he received from ken's father after his first appearance in 2009. >> he is a sincere guy, dashes off a letter. i treasured it. he genuinely felt thank you for having my son on your television -- radio show. dick saw it this way, this was an honest letter, that is what

touched him about it. >> reporter: ken said that clark knew music and helped nervous musicians be at ease. >> every time we were on show, he took time out, said hi, met everybody. the roadies knew him. if they know you, you know you're a good guy. >> reporter: he also called dick clark a true legend and said he would miss him. and ktvu viewers have been sharing their memories of dick clark on our facebook page. you can join the conversation at ktvu channel 2 action news on facebook. and the mother of one of the crew members killed on board the boat spoke out publicly for the first time about her son's death. ktvu's carol lou joins us, where she has been keeping in touch with his family and friends all week. >> reporter: well, she tells me she is trying not to focus on the details of what happened when her son was lost at sea.

but instead focused on the fact that he was doing what he loved. >> this is what he wanted to do. and -- he was excited, he was not scared. he was really happy. >> reporter: an accomplished sailor, jordan from loved the water, and all things outside. his mother, laura, said the best memories involved sailing. as a toddler with a life vest. >> it was funny, we have -- a nicer boat than we did when we started out. and -- i think he let all of his girlfriends think that it was his boat. >> reporter: jordan was her only child. she shows us this piece, captures the ocean and bay he recently made for her. >> and still waters run deep is how he was described. >> reporter: as well as a quiet and humble young man, who made friends in all walks in life.

she misses the future he was supposed to have. the family of his own he always wanted. >> just reaching that potential, you know, who knows what he would have accomplished? he was a wonderful person. >> reporter: and back out here live, a lot of flags are still half mast here in the north bay, also several memorials are in the works for jordan and the other sailors lost this past weekend. live in belvedere, ktvu channel 2 action news. and the highway patrol says a man was killed today when he lost control of his suv on highway 24, the accident happened about 11:40 this morning, the chp says the driver was going west when he lost control and hit a tree. the unidentified driver was pronounced dead at the scene. animal services was able to rescue a dog that survived the crash. we got word that a woman who was shot to death by her ex- husband on sunday was denied a

restraining order just a week earlier. police records show that kim conover asked for the request, a judge denied it. and on sunday, she went to see her divorce attorney to try again to get the restraining order. police say that kevin conover shot her and killed her, then turned the gun on himself. and an attorney is advising joseph nazo, who hired bill fa zz io to serve as his legal adviser, he is on trial regarding the murders of four women back in the '70s. there is no word on why nazo made the switch. and a stanislaus county county sheriff's deputy shot and killed in modesto last week laid to rest this friday. deputy robert paris was serving an eviction notice, when police say that he was shot and

killed, as well as a lock smith. the shooting led to a long standoff with police which ended when the house caught fire. ferrirao was later found dead in the house. and denying justice to those who need it the most. harris spoke at a rally in city hall this afternoon, saying that lawmakers should focus on fundamental priorities. >> it is in our courts that we make decisions about whether a woman who has been a victim of domestic violence will have access to a temporary restraining order. >> last year, the san francisco superior court announced dozens of layoffs, and the closure of about a dozen courtrooms due to the state funding cuts. and the contra costa county district attorney says that sentences have been handed down in an insurance fraud ring involving 20 defendants, the man received a seven-year prison sentences. prosecutors say he and others

faked car crashes, burglaries and personal injuries, the authorities say it cost eight million. and today, larry page again taking the witness stand in the software patent fight with oracle, page says frequently he couldn't remember seeing internal documents quoted by the lawyer. oracle claims that google illegally used software there to build the smartphone platform. and san francisco supervisors considering expanding a payroll tax break enjoyed by twitter and other big businesses. last year, a tax break was approved, moving into the mid- market and tenderloin areas. the new measure would offer tax reductions to anybody on the payroll over 5000 a year to boost hire.

gavin newsom with a new job, he well launch a weekly show next week. current says the hour long program will feature the former san francisco mayor, interviewing the notables from silicon valley, hollywood and beyond. no word yet on what time of day the show will air. and we have breaking news right now out of oakland, where a man was shot and killed, late this afternoon. what you're looking at here are live pictures from news chopper 2 of the scene at 6508 fennam street in east oakland, near the 56th avenue village, not far from international boulevard. this happened about 3:15 this afternoon, but you can still see that there are a lot of police in the area, they told us that the gunman drove off in a car at this point. they are still looking for that person. and if you live in san francisco there is a good chance your dog may have come from a puppy mill and you didn't even know it. coming up, an organization that wants to change it.

joe in san francisco, these are union workers from the city, and in the last 12 minutes you can see what is happening here. a group of close to a thousand protesters started marching from civic center plaza, approaching market street. obviously in the street here. i'm not exactly sure what street they're in, close to market street, they're marching in the street. this will create traffic problems. and if they do go down market street that is one of the most busy in the city, we'll have major traffic issues.

we'll keep our cameramen on the scene here and keep you posted on the news cast. and supporters of berkeley public radio station, picketing outside the station today ♪ ♪ ♪ ♪ >> they're calling on the parent company, pacifica radio, to cut ties with a company they say is union busting. they say they hired the jackson lewis law firm to handle the nonunion matters. there has been tension since pacifica laid off the staff of the morning show. and approving the limit on state worker pay. the legislation would cap pay at no more than what the governor makes. that is just under 174,000 a year. supporters say the state can't afford to spend anymore. in 2010, more than 1400 california state employees earned more than $200,000 a year. and a major blow today for

high speed rail in california as independent analysts recommended against funding the project, the report finds the 68 billion train relies on federal funding, but the chairman of the rail project told the assembly budget committee today it is not uncommon to launch projects such as the bart extension to san jose without all the funding in place. >> we didn't know where all the money is coming from. they still don't know where the money is coming from. it was part and parcel of the transportation world that people don't know these things now. >> the legislative analysts recommend that lawmakers approve only minimal funding to continue the stages. and a san jose woman sentenced to jail for stealing jewelry. sandy contreras went to schools and asked for children to take off their necklaces so they

could admire them. they say she replaced the jewelry with cheap costume jewelry. and a bill that would lower penalties for cocaine and heroin possession in california, clearing the first legislative hurdle. the bill was approved by committee today, making possession of cocaine or heroin a misdemeanor rather than a felony. it would reduce probation costs and jail terms. and new data suggested some dog owners may be unknowingingly supporting a cruel industry. new at 6:00, ktvu's paul chambers live in san francisco with the dark side of dog ownership in the city. paul? >> reporter: frank we're live at a place where dogs have the opportunity to run free. but according to a study released today by the san francisco spca, 30% of the puppies here in san francisco were from puppy mills. that happens often times because people are buying them on line. one of the mission to put an

end to large kill breeding facilities that usually put profits before the pet's welfare also known as puppy mills. >> the conditions are terrible often, small cages the animals are held in, about the size of a microwave, stacked six or seven high, the dogs are often never let out. >> reporter: one organization says that in the u.s., 4 million puppies are born to puppy mills a year. often they're not properlily cared for. >> if you are buying a puppy sight unseen, on line, you are almost certainly buying it from a puppy mill. >> a lot of languages are changed, for example instead of price, they will have adopt. >> reporter: the spca recommends adopting from them or a local shelter. but if you have your heart set on a breed, make sure you know where they're coming from. it could be a puppy mill. >> they will deliver them right to your home from a crate?

of the week. mid-80s, one of the warmest weeks we've seen this season, down right nice out there, let's check out the winds towards the delta in fairfield, you see the winds gusting to 17, these are live reports, live out there by antioch, winds up to 20 miles per hour, typical for this time of year out in the area, less wind, less cloud cover, and temperatures increase. rains just to the north of us, pretty cold, right here, point arena, the days get longer, jet stream going north. and what it amounts to, we head into the summer weather pattern, the jet stream to the north, high pressure dominates, we go into a dry mediterranean climate, and forecast, yellows are 70s, lots of though, mid-to- upper 70s, next day we'll see some low 80s. forecast tonight, not a lot of

fog, patchy coastal fog out there. some of that, not as much as we saw yesterday. sunny, warm as you head to thursday, the extended forecast's nice, warmer, forecast overnight lows, upper 40s, not frosty or freezing, just kind of a little cooler than mild. in the forecast, the models are bringing a little coastal fog to the coast at about 11:00 tonight, it hangs around there, the half moon bay, ocean beach right here, just patches of it. tomorrow morning, just that. no real -- issues with fog, nor cloud cover. and by the afternoon it is mostly sunny. and that is the mechanism, the clearing one of the main mechanisms for the increased temperature tomorrow. that increased temperature will continue into friday, the numbers go up mid-80s. friday the warmest day as we head through the week. the forecast highs tomorrow, nice, as we look at thursday, we look at the cities around the bay, 77, out in livermore, 79 in morgan hill, the five-day forecast, the bay area weekend
