they are still the san francisco 49ers, but after today, things will not be the same for the team. good afternoon. i'm tori campbell. the story in a moment but, first, oakland police are searching for the gunman who shot and killed a man who was pushing his one-year-old son down the street in a toy car. it happened near the corner of

56th avenue and east long street in a longwood garden housing complex. the child was not hurt in the shooting. someone nearby grabbed the child and ran to saved. the man was shot in the head and died at the scene. the gunman escaped in a car and the investigation continues. police are still looking for suspects in an early morning shooting in richmond. officers found the 35-year-old man slumped behind the wheel of a porsche suv at south virginia street. he was shot four times he was air lifted to john muir hospital in walnut creek on is expected to survive. oykus universal will reopen on mon day some of the classes will be held in the same classes where the shooting occurred. but nursing students will be allowed to take classes in

another campus. university officials are trying to work out details with another university. san francisco's suspended sheriff was in court for a brief hearing today. ross mirkarimi is trying to stop the city attorney from representing the mayor in this case. lorraine blanco is live with the details. >> reporter: it took minutes for the judge to confirm his temporary ruling. but sheriff mirkarimi left smiling. the sheriff smiled as he left court today even after the judge denied his petition. >> i have not stopped in my desize for what i think will be a forward thinking sheriff department in san francisco. that's one of the main reasons why we are working so hard.

>> reporter: mirkarimi's american argued that the city's attorney can't fairly represent the mayor and the city. the charter says that the city attorney is supposed to represent the ethics commission. they decided they don't want to do that. they would rather carry water for mayor ed lee. we think that's wrong. >> reporter: the deputy city attorney says that's a tactical move. he is not surprised. >> i think he is in danger and serious jeopardy of removal. of course, it serves him to try and short circuit that prospect. >> reporter: mirkarimi and his attorney will be back in court trying to stop that. but if they are unsuccessful, they will stop that process. if not, the proceedings will move forward.

>> thank you, lorraine. excitement turned to anger and frustration after word spread that a tweet sent from sierra lamar's account was hoax. someone posted a message on the missing teenager's tweet account. the tweet was deleted but not after it sparked hope among friends who saw the tweet. investigators say that it came from someone who hacked into her account or someone who knew her password. detectives returned to the reservoir in the search for the next phase. they will also include the tampa bay der son reservoir. the 15-year-old vanished on her way to school back on march 16th members of e bay area sailing community say there could be changes following last weekend's deadly accident during a yatch race. five of the eight people on board the sail boat called low speed chase died or were lost

at sea on saturday. a friend of the crew says he wants to change race rules and require participants to wear the same type of electronic monitor device used to find boats that are adrift at sea. there is some concern for boat owners who worry that the accident could lead to civil lawsuits. >> this will leave a lot of people spooked come next year and they will probably be a few less boats on the start line. >> generally, boat owners do not require their crew to sign waivers to protect them from liability. 16 teenagers were hurt where cars crashed head on. chp says a 15-year-old girl was behind the wheel and speeding when she lost control of the car on the curve. all the car's okay pants were taken to the hospital except

for the driver who fled the scene and is still at large. no one was arrested at the crash and officials say that alcohol was not a factor four people were hurt when a car plunged off an 'em bankment on interstate 580. we broke you the pictures this morning on 2. officials say that the car was going eastbound when it crashed into the brush a little before 6:00 a.m. one person was trapped inside the car and had to be freed by rescue crews. after over five years of work, the ground breaking ceremony for the new 49ers stadium is now just hours away. ktvu's alex savage joins us live to show us the work already done including a mini stadium. >> reporter: good morning, tori. a large crowd expected here. 1500 invited guests, from politicians to ex-players. they will be coming here to the site of the new 49ers stadium.

earth moving is also taking place. but later today, inside that mini stadium beyond us, the team will officially break ground. in the middle of this worksite, crews have built a small replica stadium. representatives of santa clara leaders and 49ers officials will be on hand for this event. the shovels will dig into the dirt right at the future 50- yard line. many people are celebrating today, anticipating an economic boost. >> it's going to build the city in and bring jbs in. that's what we need. >> reporter: but others are not as pleased. basilia says he is worried about noise and traffic. other than that, we'll see. let's see. i don't know yet. i can't tell. i've never lived close to a stadium before. >> reporter: it took years of political wrangling to get to

this day with voters approving the project back in 2010. current santa clara councilwoman and former mayor pat mayhan helped push through this $1.2 billion stadium. >> the 49ers in november of 2006 let us know that we were their backup choice, i knew that the city could do it and i never lost faith that the city could do it. >> reporter: it may be hard to believe looking at this site but the stadium is expected to be finished in time for the 2014 season the ground breaking event gets started at 5:00 but it's only for invited guests. for that reason, the 49ers tell me they will be streaming the ceremony on their website. we are live this afternoon in santa clara, alex savage. it was tough. not a day goes by that i don't think about it. >> it was one of the worst peace time disaster in the naval history.

space shuttle discovery is now at its new home and it was welcome with a lot of fanfare this morning. thousands showed up to see the world's most traveled space ship arrive at the smithsonian national air and space museum in virginia. former senator john glen and former astronaut was there. it will be on display not only as a testament to events of our time but also as an inspiration to future generations. >> discovery met the prototype shuttle enterprise nose to nose. the discovery will take the place of the enterprise. the entreprise will be moved to an aircraft carrier in new york. there are calls this afternoon for more secret service agents to step down amid a prostitution scandal. three of the 11 agents implicated in the incident in colombia lost their jobs last night. now, some want to cee-cee

>> reporter: two men were convicted on federal charges in the bombing. timothy mcveigh was executed and terry nichols is serving life in prison. and today also marks the end of a federal rate that ended a deadly siege in waco, texas. a standoff tarted when members of the branch davidian killed four federal angst in a shootout. their building caught fire during the raid killing more than 75 people, including children. former crew members of the u.s.s. iowa gathered in richmond this morning to honor the ship mates who died when a gun turret exploded 22 years ago today. the ship bell rang 47 times, one for each man who died on april 19th, 1989. those who survived remembered. >> i was right next to the

to. registration will continue through this evening. we posted more clips of singers on ktvu.com. just look for the hot topics headline halfway down the front page. 50 students have been suspended at berkeley high school and others have been expelled because of a reported attendance scam. the bay area news group reported that the students are accused of altering their attendance record on a school computer database after paying other students who obtained the password. school officials found out about it earlier this month. the suspensions will last between one and five days. expulsions could be up to a year. well, pretty good fog bank this morning but lows in the 50s. didn't take long to see some of that burn off. fog still hanging on from the marin head land down to parts of the san mateo coast and

there is a little narrow band running parallel to the sonoma coast. just patchy fog. it's sunny as is everybody else. high pressure building in in a big way and sending everything way to the north al crow crescent city seeing some light rain, believe it or not. storm track, which is right over us now moved north. so coastal fog. it's warmer inland, a dry pattern next week. maybe middle of next week. we are talking about warmer temperatures. all those high clouds over the last couple of days out of the picture now. can you see some of that fog, still a westerly breeze for some. 20 this morning. when they go calm, that means they are warming up pretty fast. there is that little bit of fog around the sonoma coast and some on san mateo coast. most of it gone. 70s on the temperatures. 74, santa rosa with that north wind. there is the location, financial district and also south of market a little warmer than that. 70 concord, probably 70 by now

in livermore. we are seeing our first real 70s here and we'll get some upper 70s to near 80. high pressure will be over us starting today and probably most of sunday as well. we'll still have low clouds coming back tonight and tomorrow but warmer weather will start a little bit. warmer weather starting to kick in and that will continue for bay side and probably the coast as well as we head into friday and saturday. highs 70s now or 60s, a little bit too much fog for parts of the coast. near 730s this will be the first 80 since last october. yes, it's been a while. 67, alameda. berkeley, 68 degrees. almost 80 for gilroy. they will be there tomorrow. santa cruz is nice, 74 degrees. still some 50s, 60s by the coast. that fog can be a little tricky. a little warmer, friday, saturday. much cooler next week. next couple of days, here we go. up, up, up.

stocks are down for a second straight day, down over about 1%. all three indexes right now. investors are diskurmdz by employment and housing data and underwhelmed by some earnings. the dow down 115. nasdaq down 31. s&p down 12. cvs pharmacy has agreed to pay almost $14 million to dozens of california counties as part of a settlement stemming from allegations that the drug store chain illegally mishandled hazardous waste.
