alcohol was involved. ken pritchett, ktvu channel 2 news. oakland police are trying to figure out a motive in the death of a father dunned down while -- gunned down while working with his son. we brought you live on ktvu channel 2 news at 6:00 last night. it happened near the bart station in east oakland. investigators are going over video hoping to spot tyrell smith's killer. the family told ktvu today he was a stay at home dad and trying to turn his life around. >> you killed him with his son, you could have killed the baby. >> the mother is calling on any witnesses to please come forward. student will return to oikos university three weeks after a gunman killed 7 people there. one goh ko was arrested for shooting 10 people in all.

they saw. >> reporter: frank, we are hear at the mexican american community services agency and this is the felony complaint that was filed against the former ceo and cfo. they stole tens of thousands of dollars from employees' retirement funds. >> reporter: the district attorney announced this morning that former ceo and former cfo tricked between 50-100 employees by stealing from them. >> without their knowledge or content, $1 million for their retirement accounts was illegally diverted. >> reporter: both are being charged with grand theft. a two year investigation into what was going on at mexican american community services agency, a nonprofit agency. the district attorney says between 2004 and 2009 they

stopped making payments into employee's retirement funds, even though it continued to appear on payroll stubs. >> money to make the payments were spent on less important things, such as office supplies, food, electronics. >> reporter: the defense attorney says his client is distressed with the charges and trying to keep services afloat -- afloat. it appears the retirement contributions were used to pay for raises she received. former employees react. >> ref leaf that they would -- relief that they will be held accountable. >> reporter: it will be unknown if they will get their money back. if convicted each of them can

face three years in prison and a $10,000 fine. reporting live, janine de la vega, ktvu channel 2 news. the state public utilities commission fined pg&e $20 million in two separate actions. they ordered them to pay $16.76 million to failure to conduct gas safety tests as far back as 1993 and $3 million for failing to comply with a records search. san francisco sheriff ross mirkarimi has lost his bid to be reinitated with pay -- reinstated with pay. a judge ruled he will not lift the suspension. he was suspended after pleading to domestic violence charges. they will begin proceedings monday on whether to remove him from office. people opposed to marijuana

other over the other pass. >> both have pluses and minuses. they take us through san jose, which is challenging going through a city. >> this afternoon they boarded to recertify. caltrans spent the day tackling a dirty problem alock highways. they always set aside one day a year on cleaning up trash around earth day. here you can see employees picking up trash. they say they spent $50 million removing litter during the last fiscal year. these oysters are on the menu for a scientific study, the clues they are giving scientists about a oil spill.

san jose police say a homeless man is behind bars for the death of his wife. officers say he was arrested yesterday. his wife was found on south second street monday night suffering from severe burns and she died at the hospital. police say witness statements and evidence are what led them to the man.

a dive team returned in morgan hill today in the search for sierra lamar. they used sonar to transmit underwater images. only on 2 tonight, a womb says she was -- a woman says she was bitten over a parking space in san francisco. and today she showed us her wounds. it happened tuesday night when she asked a woman to move her car because it was blocking her driveway. police arrested her for assault with a deadly weapon. dianne feinstein wants democrats to block votes on a controversial concealed weapons bill. it would require states to honor concealed weapons permits from other states. dianne feinstein says that

means someone can carry a gun in a state where they don't qualify for a permit. two years ago scientists showed us how they would test oysters from the gulf of mexico to make sure they are safe following the bp oil spill. ktvu's david stevenson has more. researchers say it has taken two years to calculate how the bp oil spill hurt marine life. >> when we look for the metals we cut through this section of the shell here. >> reporter: he showed us samples of american oysters pulled from louisiana, alabama and florida. >> when we look at shells collected in august 2010, after they had sat in the spill for a

summer, and there are elevated levels of metals. he says 90% show tisher alterations -- tissue alterations. >> they are layers on each other. an animal with this type of tissue will be the handicap. >> reporter: they tried to reassure visitors that the seafood is safe to eat. he says much more research is needed. >> how serious it is for the ecosystem and humans is difficult to say right now. but it is of concern. >> reporter: restaurants tell

us it is not a concern in san francisco because their seafood is cost on this coast. david stevenson, ktvu channel 2 news. sales of homes in the bay area hit their highest mark in five years. 7700 homes sold last month. that is up 9%. a quarter of existing sales were foreclosures and 19% were short sales. a smitty approved -- a committee approved two bills today. a bill would band lenders from filing notices of default while trying to help bowerrers trying to avoid foreclosure. after several extensions and last minute negotiations a deal could not be reached

reached and escrow failed to be reached. they closed their doors after 91 years. the greenest federal buildings opened today in sunnyvale. nasa celebrated today. the building generates more power than it consumes using solar and fuel cell technology. it shows nasa is not just about launching into space. >> landing on the earth and acting like what it found, a natural world. >> the building uses 90% less portable water than buildings of its size. controllers check weather pattern and aadjust -- adjust the heating and cooling. san francisco is second to new york city in its eating
