samaritan stepped in. lorraine blanco reports that even police acknowledges that he may not have done the right thing. lorraine. >> reporter: the suspect got away this morning, but police acknowledged the good samaritan may have saved lives. just before 10:00 last night a woman in a black hoody and gun demanded money. when she pointed the weapon at the clerk a truck driver that happened to be delivering gas grabbed the suspect from behind. he knocked the firearm out of her grasp. >> we always told people money is not worth someones personal safety. but this time the suspect demonstrated actions where the coworker believe and acted in fear of coworkers safety. that the suspect was going to pull the trigger. >> reporter: an employee here tells us there is surveillance video of the crime.

the manager is the only one that access to it and will be here later. she is 527 wearing a black hoody. overnight a firey freeway crash in oakland. the driver in jail. we first showed you this at 4:30. an suv caught fire about 3:00 this morning after it flipped on southbound 880. it landed on the other side of the guardrail. barely missing falling 40 feet down the side of the freeway. the driver escaped this wreckage before it burst into flames. >> white car. i believe it was a nissan. swerved toward me i just freaked out. then i found myself upside down. the chp arrested the driver on suspicion of dui after they

gave him a breathalyzer test. no one else was hurt. three weeks ago today a gunman walked inside oikos university in oakland and opened fire killing seven people. now students are finally getting ready to return to campus. the school will reopen its doors today. new vow nursing students will find their classes at uni tech college in fremont. a dean for the school also tells us counselors will be there to help. >> they invested their money and time. they have to be able to finish what they started. >> school founder and president visited the campus yesterday. he did speak to the media. he is scheduled to talk tomorrow. a very unusual bay area

protest in albany. alex savidge is out there. he's joining us now to tell us why a group has taken over farmland and they are planting their own garden. >> reporter: good morning, dave. occupy protestors have created an urban farm out here. they have taken over this piece of land and started planting crops on the land. they are planting everything here from carrots to broccoli and corn. this land is called gill track. it was being used for agricultural research. but yesterday afternoon about if t hundred protestors -- about 200 protestors broke in and set up shop. there is talk of more housing and grocery stores as well. occupy protestors are telling me they are trying to keep this piece of land pristine. >> they are only about making money. and it has been profitable for

them to sell off land they don't want in order to you know give et to construction or whatever with high price and make a lot of profit. and we just are sick of the deprivization of our unit and construction of the -- >> reporter: i did put in a call trying to get a comment. so it's unclear if the uc berkeley police department plans to take any action here. i do understand speaking to some of the protestors police have stopped by twice yesterday afternoon telling the folks here they are trespassing and they need to leave. but the protestors tell me they have no plans to leave. they are not budging and plan to continue forming out here. we will sty on come of this morning.

o.k. protestors want to shut down the golden gate bridge on may 1st. those union workers are in contract negotiations with the bridge district. the occupy organizers say they will only try to shut down traffic on the bridge if those employees decide to go on strike. there. george zimmerman is out of jail. new video from overnight shows the neighborhood watch volunteer being released on custody. >> he walk down and awe augite paper bag. on friday he awaits his second degree murder trial. >> we have several options where he will be. at least one of those are out of state. i want to make sure wherever we place him he is secure. like we talked about many times there is a lot of well emotions

president usual running meat. the mother of a pastor is dead after being shot right outside her son's church in colorado. that happened yesterday afternoon in a suburb outside denver just as services were ending. now police say there was an argument between two people in the parking lot of the church. it's not known if the pastor's mother was targeted or if she was just caught in the cross fire. an off duty police officer ran outside the church and shot and killed the suspected gunman. 6:16. president obama targeting foreign regimes that use technology in human rights abuses. let's go to alison burns in our washington, d.c. bureau with the big announcement the president is making at the holocaust museum this morning. alison. >> reporter: dave, pac is touring -- president obama is touring the holocaust museum this morning. we are getting a look at the podium necessary morning that

he will use in his speech. this morning president obama announces sanctions for using technology to carry out human rights abuses. he is targeting countries like iran and syria that use technology to sensor opposition movements. he will also announce the first ever intention movement. in countries around the world and he is going to use this mornings speech to call for peace negotiations in sudan and south sudan where violence hassest coolated in in recent weeks. we'll have more live coverage of the presidents speech at the holocaust museum during my next update if about an hour. for now we are live in washington, d.c. alison burns. time is 6:17 north carolina is threatening what it calls special actions to destroy south korea's government. north korea's threat was

covered by their state media this morning. in it they warn south korea's government would be reduced to ashes in minutes in an unprecedented strike. north korea has made threats like that in the past but it has not followed through on any of them. there is a new report that pg&e has discovered an old document showing the pipeline that exploded in san bruno had a history of problems. the san francisco chronicle reports that the 1989 memo details an investigation into a leak on the pipeline about nine miles south of where the san bruno explosion occurred. according to the document the leak was likely due to a defective weld on a seam running along the pipe. that is the same time of failure sited in the san bruno disaster. school buses are posing a possible safety problem. they say 5,000 international buses could stall without

warning. so far three incidents have been reported involving buses built in 2008. no accidents or injuries have been reported. 6:18. a very important meeting tonight involving one of california's largest school districts. the mount diablo district has 32,000 students. the school board will talk about several big issues tonight. the board will also talk about hosting public forums on construction projects from measure c. that is the initiative passed by voters in 2010. the district may also raise tax rates in order to speed up those construction projects. myth busters is taking its show on the road. the discovery channel is taped here in the bay area but it is now part of an exhibit in chicago. the first stop of a planned national tour to allow people to participate in busting science myths. the show uses science to determine the truth behind urban legends. the exhibit in chicago runs through september 3rd.

6:19. sal knows the truth about the morning commute. how are we looking? >> i with doing pretty well. we check on a report on a crash on 80 at powell. didn't find it. that is good news for the commute. let's go autoto the mccarthur maze. traffic looks good on 80 coming around to the bay bridge toll plaza. looking at interstate 880 north and southbound here. it looks good. the a's are playing at home this evening. you might want to expect a little bit of traffic this afternoon. this is a look at westbound 580 just a little bit of slow traffic on the dublin grade. eastbound 580 a crash on the right shoulder not causing a big traffic jam as we look at 880 near hayward and union city it looks good. san mateo and dumbarton bridge moving closer to the peninsula. at 6:20 let's go to steve. all right sal a lot of low

you know there will be counselors here on hand. a concert at noon we are told we spoke to a school dean this morning. but for nursing students the memories are too painful. they will actually be heading over to the campus the uni tech campus in fremont. everyone will head through the doors here where there are so many flowers at the front door it's hard to make it through. seven people lost their lives in one of the deadliest shooting rampages in college shooting history. we talked to the dean how the small korean christian school plans to move forward. >> we will do our best comfortable the victims family. >> reporter: former student juan go faces seven charges of murder. three charges of attempted more. police say he went on a shooting rampage because he was disgruntled. angry about not being refunded his tuition when he dropped out

of the program. we spoke to the school dean this morning he said there will be no memorial but there will be a concert. tomorrow the president will be addressing the immediate late in the morning. live from oakland i'm tara moriarty. happening right now protestors have taken over a piece of farmland that is owned by uc berkeley. ktvu alex savidge joins us now from albany with how they would like to see the land put to use. alex. >> reporter: good morning, pam. another show down between occupy protestors and uc berkeley. what they have done is taken over this piece of land that is owned by the university and they have turned it into a farm. they begun to plant vegetables here. things like carrots, corn, and squash and off in the distance you can see they set up tints here as well. the goal is to try to save this land from future development by

the university of california. yesterday afternoon it was about 200 protestors or so that broke into this gated piece of land on earth day. they came inside and they set up shop and began to take down some of the weeds in this area and planting those vegetables. uc berkeley police have come by telling folks they are trespassing and do need to leave. occupy protestors say they will not move from this piece of land. >> the plan is to stay. we're staying. there is no plan of any kind of locking the gates and not letting them in. this land will be open. we will let them in. the plan is to just farm. and you know we are not going to panic. we are not going to dispurse. we will be there. we will farm. we will continue working. more and more of the community will join us. >> reporter: this morning i did put in a call at the uc berkeley police trying to figure out what kind of plan

they have to deal with the farm. so far i have not received any comment from them. officers have stopped by here. we have seen them driving around this piece of land. the farming will continue later on this morning. they will continue to develop this piece of rabid. so far only an acre has been farmed. at # more people expect to show up and more farming will take place here. for now we are live in albany this morning. the first hearing to determine the future of suspended sheriff ross mirkarimi starts this afternoon. today the san francisco ethics commission is expected to decide how witnesses will be heard and how testimony will be viewed. once the panel is finished, it will make a recommendation to the board of supervisors. the supervisors will hole a hearing to decide the fate of mirkarimi. ed lee suspended mirkarimi without pay after he pleaded not guilty to false

there is plenty to go around. cooler today. as the high pressure system gets knocked off toward the oats. there will be two systems this week. one coming in from the west and cooler system dropping down from the north. combination will give us a big- time cooling trend. i don't think theyly merge. west, southwest fairfield to 5. gusts to 32. they had gusts to 37 and there is a definite sea breeze for almost everybody on the wind directions today. 50s on the temps. mainly mid 50s. i doubt they go anywhere on these temps. speaking of fairfield sunny and windy. that is the forecast today. although that are one of the few observations that said clear. 55-64 at noon. 71 only for a high today. lots of yellow. so a big cool down. not only 50s, 60s by the coast. here's our system rounding the base of that. that is the low. that could give us the cloud cover starting tuesday night

mercedes celis. she was found missing saturday morning when he parents went to wake her up. they are cooperating with the investigation. the fbi, border patrol and u.s. marshals have all joined that search. 6:47. more revelations this morning coming out in the expanding secret service sex scandal. so far the case involves 12 receive yes service agents -- 12 secret service agents and 11 personnel. it's predicted that number will keep rising. the 12th secret service agent is being implicated in a separate incident from the others. he's being investigated for misconduct at the hilton hotel where president obama later stayed. tonight the city council will debate a proposed ordnance to regulate massage parlors. some neighbors say they suspect the businesses are engaged in prostitution. the contra costa times report
