office. that is where the secretary was working. >> she was there and he brought her to here and then -- there this is where it all happened. >> reporter: now the classroom sits empty, the surviving students attending class in fremont. the school plans to build a peace garden out front so nobody ever forgets the seven people who died here. more on that at ten. >> gun fire near a union city high school this afternoon had students rushing for safety and caused the lockdown of james logan high. sal is here now and says even though the shooting wasn't actually at the school it turns out a student was hit. >> reporter: the shooting sends a lot of students in to a panic and interrupted a day of test. a student was shot a few block away from campus near 14th and h street. police say since it was so

close to the high school they locked down the school and also locked down a nearby elementary school. >> we can did have a number of witnesses have come forward and given some information. we have a -- somewhat vague suspect description. >> reporter: police say the shooter is a heavy set latino man in his 20s driving a white pickup truck a tool rack. he was said to be wearing a yellow construction vest. word of the shooting spread to parents, many who came to the school. >> i was around the corner and heard someone talking about a shooting here. i headed straight theory. >> i got a call and we decided to go and get my daughter. >> reporter: the latest update on the condition of the shooting victim is that he is in serious but stable condition. school officials have not released his name. live in union city. ktvu channel 2news. >> oakland city officials say news reports that the 100 lock plan to fight crime has been abandoned are not accurate. the plan was first called

focusing in 5% of the city in which 90% of the violent crime happened. the mayor said it was only set to last 90 days. that period is now over and city leaders say the plan is being changed. meantime the mayor said she has a planner plan to get 1 1,000 jobs for oakland youth. >> we will make sure 50% of those jobs come from youth in those 100 block areas. i want them off the streets, i want them at work. >> both the mayor and police chief howard jordon are scheduled to address the city council on the matter tonight. >> the united states agriculture department said that a dairy cow in central california tested positive for mad cow disease. the company said the cow was randomly tested at its facility. the u.s.d.a. said it was disposed of properly and that the public was never at risk because the cow was not in the food supply. officials say the animal didn't get the disease from eating

infected feed and an investigation is underway. the san bruno city council will meet in an hour to talk about what to do about the remains of that pipeline from the explosion that killed eight people and hurt many more back in 2010. the city council is considering three different plans, leaving the pipe in the ground but filling it with concrete. removing part or completely tearing it out. >> a city torn wants a copy of a tape. the tape shows the sheriff's wife. only still pictures have been made public. the attorney filed papers asking the court that the abuse case forward the tape. the court no longer has a company so if the request is granted. the tape will have to come from prosecutors or police. the ethics commission is set to meet again on may 8th. scandal forces the

she was attacked. >> i need to focus on my recovery from both the assault that -- ha that abusive relationship and how my heart and my --. >> reporter: now the decision is who will replace her. >> they could appoint somebody to hispanic to replace her. >> reporter: jose with the county hispanic chamber of commerce said she represented his community in district 2. the board hasn't sing manied out a replacement. >> they have 60 days to make an appointment to replace her or else the governor will do it and we plan to make an appointment. >> reporter: the board said whoever is picked will serve in that seat until voters pick a permanent reblazement in november. one supervisor suggested picking a former supervisor who

once held the seat. he said she is unlikely to run in november. they will discuss the selection process at a meeting next week. >> an 8-year-old is in protective cust by after police say they found him in a suspect meth lab. napa police found him after they arrested the child's mother. they found the boy inside an apartment along with chemicals, glass ware and other items generally used in meth labs. >> the sailboat that ran in to the rocks is heading back to it's owners. it's a story we followed live last night when a special helicopter hoisted the 38-foot racing yacht off the rocks and transported it to half moon bay as part of a delicate operation. five people on board were

killed when large waivers hit the sailboat. >> new, vandals hit a community garden and nursery in san francisco. it's a place that volunteers just recently helped clean up. reporter rob roth says what has been lost and what will happen next. >> reporter: nothing much to saving back here. >> reporter: christian vargas as looking at the damage today more than 4,000 plants, destroyed. in the back of the garden which is part a state park heavy tables were own testified. >> somebody just to come down here and destroy everything that we have been working for for so long just hurts. >> reporter: members of the organization that runs the garden started the long process of cleaning up. >> all the plants have fallen out of their containers, they are drying up. you know we will be lucky if we can save half of what was here and it's a huge loss.

>> reporter: with just a little more than a week ago more than 150 volunteers came to help spruce up the community garden in the bayview district. it was parts of a project to get it ready for earth day which was that past sun. the vandals happened the night of earth day. this man said he has been planting vegetations for more than a decade. . >> we spent a lot of money to support the garden and pay a yearly fee for this stuff and the kids come down and destroy it. it's bad for the neighborhood. >> reporter: tomorrow high school students expected to volunteer to help with the clean up which could take weeks. gardeners say it'll take much longer to regain what was lost. >> mothers with babies in strollers rally add at san francisco stay hall, part of the walk around the block for child care. they say they worry proposed state budget cuts to child care will affect beyond the lives of children. >> parents won't be able to

. a rising star received a song at san jose city hall for his high school -- from his high school choir. he was honored for his success on american idol. he said his classmates were inspirational. >> i love seeing people that have that love for music and just do what they do no matter what. no matter how big or small just -- sing in your room or on a tv show. >> the 17-year-old made it to the top eight before he was voted off american idol earlier this month. >> i think it he has a career ahead of him. joe is filling in. giants in action. >> they are cold tonight.
