man, and 19 years old. a man who fled from police last night was arrested after a officer fired his gun. sergio angel arruda was booked into the jail last night on charges of evading and resisting arrest. police say the officer opened fine after sergio angel arruda made threatening gestures with his hands. closing arguments today for the man accused of killing a high school student. he was shot and killed in 2006. he was a popular student who played football. smith was arrested after coming forward as a witness to the shooting. investigators say smith knew details only the gunman would know. time is running out for investigating police misconduct during occupy protests. a judge set today as the deadline but the city has yet

to comply. ktvu's rita williams is live with what she learned today from officials. >> reporter: police have more than a thousand complaints against officers alleging misconduct during the occupy protests. some complaints are already six months old and haven't been investigated. >> there is no political will in oakland to do the job right. >> reporter: a frustrated judge over seeing the police department issued this ult mating, telling the department to come up with a written plan by today to clear the back log. >> they made the judge angry because they will not do their job. the department has been under court order to reform. that includes investigating all complaints in six months. that hasn't happened again. although the department has as many officers investigating

complaints as it does solving violent crimes. though the city is telling the judge today it plans to hire outside investigators. the city or taxpayers also paid $100,000 for an independent investigation on how the department handled occupy protests. officials say the report is not ready yet. >> i am positive they have it. >> reporter: and they are not releasing? >> they are not releasing it. >> reporter: one of the attorneys who brought the lawsuit thinks it is because the reports is negative. a spokeswoman said the report will not be ready for a week or two. as for the complaints against officers, a official told me they will meet the deadline today set by the judge. rita williams, ktvu channel 2 news. there is still no agreement tonight between university of california at berkeley

twitter is expected to become a key tool as the election kicks into high gear. in the last election twitter was still new. now twitter gets tweets and they could be effective in getting a message across. no word on whether scott thompson still have a job. one of the company's largest share holders called for the firing by this morning because of inaccuracy in his resume. so far yahoo hasn't comments. a jury ruled in favor of oracle in its lawsuit against google. oracle claimed google stole some of oracle's technology.

hundreds of businesses are at risk of closing due to lawsuits all filed by the same attorney. business owners are accusing him of trying to exploit the american with disabilities act. ktvu's cara liu has more. >> reporter: this store contacted us about a lawsuit they are facing. the business next door, as well as others, they are all in the same boat. >> reporter: they work 11 hours a day, six days a week. but that could soon change according to her son-in-law. >> she was in shock. she couldn't eat. sleep. >> reporter: she was slapped with a lawsuit, claiming she doesn't accommodate disabled

customers. >> theythey are living day by day. late on rent also. >> reporter: they aren't the only one. the owners are also getting sued. so is the hair salon and so is this store next door. >> i have two parking spots. we don't know what to do. >> reporter: the man behind the lawsuit is a attorney based in the sacramento area. he filed thousands of lawsuits over american's with disability act compliance issues. he says by phone he was fed up with the lack of access for the disables. he admits filing a lot of lawsuits and making a good living wage, she says many businesses have been forced to shut their doors. >> the reality there are individuals who are
