oscar grant's family responding to a request for a new trial by johannes mehserle. the family is furious that he is trying to overturn his conviction. >> it's been three and a half years since oscar brant was killed but his family and friends stood on the courthouse steps and it was very, very clear that emotions are still very raw. johannes mehserle's new court appeal has stirred number again. former b.a.r.t. officer went to court this week to ask for a new trial but the family of oscar grant was not there because they say no one told them it was happening. frustrating for a family who traveled to los angeles for weeks for the mehserle trial back in 2010. >> as you know, we trawsmed and down the highway, 400 miles. >> that's right. >> never missed a day in court. never. and for them to allow this to come next door to our house and

not tell us that johannes mehserle is in court and not give us the right to be there angers us. >> reporter: mehserle's attorney says that his client is keeping a low profile now but if is conviction is overturns he wants to go back into law enforcement. >> to allow someone back on the force like that would be a disgrace to our community, to our society, and it would be a slap in the face to me and my family. and the community. >> reporter: the appeals court has 90 days to make a decision but grant's friends and family say they no longer trust the system. >> we were asked to trust the process. is justice prevailing? no. we are not getting no just cyst. >> if johannes mehserle is listening, the community, the family and friend of oscar grant, we are not going nowhere. we are not going nowhere. we're going to follow you and make your life miserable like

you made wanda's life miserable, like you made our life miserable. >> reporter: we could not reach the office of the district attorney. he said this could be a very long road. he he can expect the appeal to go all the way to the supreme court. here is a look at the timeline. he shot oscar grant. riots followed in oakland. mehserle was arrested on a murder warrant. his trial was moved to los angeles. the jury convicted him of involuntary manslaughter on july 8th. mehserle was released from jail six months later and was in court wednesday when his attorney asked that his conviction be thrown out. you can go to ktvu.com to see more video from this morning's emotional news conference. you will find it on the home page under the bay area news tab. uc berkeley officials say that time is running out for them to start planting crops at

a research farm where protesters have been camping for two and a half weeks. police have chained the gate leading into the land known as the gill tract. they allowed protesters to leave but not return. however, protesters were just hopping the fence to get back inside. protesters we spoke with did not want to give their names. >> we have the land. u c has been demand that go we leave the land in order to negotiate but we are calling their bluff. >> reporter: the unfortunate says it has been difficult to negotiate with the protesters because they have not one clear leader and one thing is not negotiable and that is who controls farming on the land. the list of possible witnesses was released in the last half hour for former sheriff ross mirkarimi's trial. >> mayor ed lee, his wife, i

willian ya lopez and the woman who took the video of the crying lopez, the mirkarimi's family neighbor. the ethics board is expected to meet again may 9th. the security and exchange securities are looking into a $2 billion loss by the nation's largest bank. j p morgan chase lost $2 billion. the bank ceo says it was due to a risky portfolio designed to hedge against a risk that the company takes against its own money. the chairman of the sec says it's too early to comment but confirms that regulators are looking into what happens i think it's safe to say that all the regulators are focused on >> this some lawmakers say this is evidence that banks are still making risky bets and the losses reinforce the need for more and heavier regulation. however, j p morgan chase's ceo is a critic of increased

regulation on the banks. gas prices are climbing here in california even though they are falling in many other parts of the country the reason ace simple case of supply and demand. new at noon, ktvu's paul chambers joins us live to tell us why this is happening and why prices are expected to go up even more. paul? >> reporter: good afternoon, tori. in our state, gas prices is 4.25. many people are depending upon their car which means that gas consumption is up and so are the prices. >> here in walnut creek, people are fed up with the ever rising prices at the pumps. >> that's a big bite out of my pocketbook. that's why i ride my motorcycle. >> aol a stay at home mother. i don't have a job and it takes $80 to fill number. >> the am price for average gas in the bay area is around 4.25 pairly cheaper than last month but nationally, gas prices are down since the same time last year by a little more than 20

cents a gallon. still, people we spoke with don't care because with the warmer weather comes an increase. >> 4.25 and the summer season has not hit yet. we know that the gas prices will get ramped up by summer and will be over 5 there are. >> actually, the prices at the pump may jump sooner than he thinks. gasprices.com said that refineries have been shut down for maintenance, that means that the special california blend is going to rise. >> it's too expensive. i hope we will not get worse because we will be investing in bikes. >> if i can afford it and if they worked efficiently, it would be nice to have an electric car at this point but unfortunately, there is so much focus on gas that it does not feel like they are really working on them. >> reporter: now, the possibility of gas prices going up any day now, people are hitting the pumps just in case that happens so they make sure that the tanks will be full for

the weekend. >> thank you, paul. president obama has accepted the vice president's apology for forcing his hand on same sex marriage. biden pushed the issue to the forefront when he said he was comfortable with same sex marriage with a tv interview. immediately, reporters began hounding president obama for his position on the issue that forced the president to move up his planned announcement that he now supports the right of same sex couples to marry. now that president obama has announced his support for gay rights, gay advocates say that it's now time for him to sign a federal law. job discrimination based on sexual orientation is already illegal in d.c. and california. a federal bill would protect workers in 29 other state

republican mitt romney is trying to shift his campaign focus back to the economy as he continues to shrug off reports that he bullied a former high school classmate. five of his former classmates say that in 1965, romney and a group his friends tackled and cut the hair of a fellow student who was rumored to be gay. romney has apologized. he says he does not remember the incident but also does not dispute that it happened. president obama is in noon time after a record-breaking fundraiser in los angeles at the home of actor george clooney. the president raised nearly $15 million last night for his reelection campaign. that's believed to be a record for a one-night fundraiser. most of the money was raised through an online raffle for a chance to attend the dinner. the president is in reno today where he'll call on congress to take additional measures to help struggling homeowners refinance their mortgages.

train service along the murder caused major delays. a train hit a parked pickup truck around 5:00 a.m. near gillman street in berkeley. the train was headed from sacramento towards san jose. no one was injured. authorities say that it appears the empty truck was parked too close to the track. >> police closed the b.a.r.t. station around 4:40 after a stabbing inside a paid area. a woman as arrested and accused of stabbing a man. the victim was taken to the hospital. trains passed through the station without stopping for about 45 meant but reopened in time for the bulk of the morning commute. we checked late this morning with oakland police and they still want your help to find a missing 11-year-old boy. jerry walker ran away from his

west oakland group home wednesday night. he attends lahime school. investigators say that they think that jerry ran away because he was about to be disciplined at school. he could still be in west oakland or may try find his way to eastmont mall. if you have any information, you are asked to calloakland police. the continuing search for a missing teenager sierra lamar is getting attention. america most wanted will highlight the case tonight at 9:00 on the lifetime network. sierra lamar's family was interviewed last month. she disappeared on her way to school nearly two months ago. tomorrow, volunteers will search for clues again. rescuers are searching a kayaker who disappeared while kayaking. they are using scanning sonar

in the water. the search teams found the missing man's kayak and locate the his pickup truck and boat trailer but, so far, no sign of the firefighters. family members called the sheriff early yesterday when he failed to return from his trip and his name has not been released. a canfield college student who died in a sailing disaster will receive a college degree post humous degree. there will be a new scholarship fund in his honor. fromm is one of five people who died in a yatch race along the san francisco coast. large waves forced their boat to crash into the island. four people who got paddling in san francisco got into trouble and had to be rescued. this is video you will only see on channel 2. the victims got caught in a rip tide as soon as

they got past the golden gate bridge. one of the paddlers called 911 for help. by that point, they were as much as a half mile past the golden gate. >> yeah, the coast guard and firemen, they were amazing. we could got get back. we had no control. we were drifting further out into the ocean. they totally saved us. >> a fishing boat got to the paddlers before the fire boat. three of the victims are tourists, one from san francisco. the group brought along a dog but no one was injured. a squatser in the south bay is causing concerns for a nearby resident. the squatters have become increasingly aggressive. they set up an elaborate camp along coyote creek along with barbecue, entrance gate. they plugged into electrical supplies and using water from a nearby fall cement some accuse the squatters of break-ins and

unruly passenger for a forced landing. the jet landed safely in boston yesterday afternoon. the passengers say in the middle of the satellite, 40- year-old michael ensaccalo got out of his seat and tried to open the cabin door. the lone flight attendant restrained him but not until he actually unhooked one of the latches. his family believes that he was having a seizure. he was exhibit viewed by federal officials and faces charges of interfearing with a flight crew. a study by the navy shows that its use of sonar could harm more wildlife than thought. it could cause more than 60,000 dolphins to lose their hearing. public meetings will be held next month in hawaii and southern california. ahead, another check on wall street after the j p
