for witnesses following castro valley's first homicide of the year. police say they are looking at several calls of crimes of opportunity where a man's body was found last night just after midnight. they say they plan to question anyone who recently visited the home. including a group of men who took off from the house when deputies arrived. >> we know there were many many people in the house over the course of the last few days from the calls that we've gotten from concerned citizens regarding activity at that house. >> reporter: deputies say one of the people who lives at the house is on probation and hasn't been found yet. the victims identity won't be released until an autopsy which is set for tomorrow. happening now the city of richmond is meeting at this hour to consider a first of its kind ballot for tax on soda and other sugary beverages. the idea is to fight obesity. this new tax would not be a one size fits all, ken wayne reports. >> reporter: the city council

is meeting in the council chamber behind me the idea is to tax sugary drinks a penny an ounce. so this 12-ounce can of 7-up would cost 12-cents more. and a drink at a movie theater would cost 4-cents more. >> reporter: it's a full house at the council meeting, the city council is considering whether to put a beverage drink. supporters say it would help richmond's kids. >> soda tastes good but it's not good for you and we do have a lot of overweight and obese children walking our city and soda isn't contributing to it. >> reporter: the tax could generate two to $8 million a year. money that could be used to support sports and nutrition programs for children. >> i mean they grow up drinking soda, they're not going to stop buying it because of a penny tax. >> reporter: one business could be even forced to leave town.

over. the car's driver told us he's from australia. we asked him what happened? >> i'm new to the country, so these roads, being on a different side of the road it's pretty terrible. >> reporter: authorities say a passenger in the car the driver's wife was air lifted to the hospital with moderate injuries. two people from the north bay are being called heros for rescuing two wheel bound individuals from a burning van. someone with a cell phone recorded all that happened. it happened monday morning in vallejo when a paid solano van caught fire at the gate way plaza shopping center. bill putnam is a 70-year-old cab driver he was among the first to help. >> i knew it was going to go at any time. that's why we had to do it right away or forget it. >> we got the wheelchair ramp up and wheeled them up. a couple of friends of mine picked them off the wheelchair ramp and set them on the ground. >> it's a team effort.

>> yeah, yeah, the bus lady driver everyone helped us get one of them off. >> the fire may have started in the battery. a judge in san francisco ruled today a contested video tape of suspended sheriff mirkarimi's wife showing an injury to a neighbor can be shown in court. only still photos have been released. they show lopez crying and pointing to the bruise. mirkarimi is fighting city hall in an effort to get his job back. a group of protesters marched through albany tonight to the plot of uc land that they were occupying. about 60 people marched down san pablo shortly before 6:00 tonight but they didn't try to reenter the land which is now surrounded by a chain link

fence. early yesterday morning, uc police cleared demonstrators from the giltrack hillside. arresting nine people in the process. protesters said they wanted to grow food for surrounding communities and also try and prevent development. uc davis chancellor linda katehi took responsibility today for that pepper spray incident on campus. >> we made mistakes of judgment and mistakes of execution, so did campus police. >> reporter: katehi went before lawmakers and said she agreed with an independent report that sited poor administration. katehi said she authorized police to remove tents put up by student protesters but not the use of pepper spray. the chancellor added that she is now working on policy changes for future protests. at 10:30 tonight a protest

the person who appears to be a white man in his late teens or early 20s. state officials announced 20 arrests. attorney general camela harris says undercover agents confiscated weapons and bought more than 3 pounds of heroin during the undercover investigation that lasted more than two years. agents targeted carlos jose moreno who they say was a large scale heroin and meth distributer in san jose, east palo alto, palo alto, and redwood city. a federal panel is backing the first rapid over the counter hiv test. the fda panel voted unanimously today in favor of the oraquick hiv test. the test using a mouth swab and produces results in 20 minutes. the test is not as accurate as those given by professionals. the fda is set to make a decision later this year. the price of health care is going up.

probably for 30 years. >> reporter: wade domes had just found out that the federal environmental protection agency has announced that california's water ways are 170% more polluted than scientists had previously thought. >> i'm surprised. i wasn't aware of that and i'm sure most of the public is not aware of that. >> reporter: it's not that there's just more trash in the water, there is. but now there's also better in- depth monitoring and that has resulted in the worsening findings. >> this is a huge, huge deal. >> reporter: jerry bloomingdell is one of the investigators, we took him to the mouth of the san joaquin river to find out more. >> we have ammonia, pesticides that come from run off from the fields and surprisingly a lot from urban gardens and we also have trash, trash impairments went up 76%. >> reporter: pending action

out in the panhandle, 65. mid-70s as you head toward fremont, you get the low 80s. further inland or north toward santa rosa you might pop an 82 or 83-degree reading. i think you have to go a little farther to get the 85. a nice weather forecast for you tomorrow. tree pollens are trending high. you knew that. grasses are starting to come on a little bit. forecast highs tomorrow 77 in fairfield, 65 in vallejo. certainly warmer than it was on sunday and monday. air quality remains great because of those winds. no inversion, the fog is out there so the air quality has been good. along the coast you have cool temperatures, 60, 65 degrees. the five day forecast with your bay area weekend coming into view. it looks like it warms up nicely for the weekend.
