smith was charged with the hit- and-run of a man visiting from china. he was struck and killed by a vehicle and that driver never stopped. >> yesterday saw dublin police officers in the neighborhood just waiting. >> reporter: waiting for smith to come home because officers had connected his 2012 mercedes benz to the crime scene. officers found a vehicle inside smith's garage with extensive windshield and front end damage. they later towed it away. >> i thought wow he's never had the car in the garage, for them to have to get it out of the garage i was like wow. >> reporter: neighbors say the news comes as a surprise. >> i do not believe that man ran over somebody and kept going. and that person is dead. >> accidents happen, bicyclists can sometimes be at fault, you never know. >> reporter: smith was arrestedded and released on bail. he's facing possible charges of vehicle manslaughter and leaving the scene of an accident. >> that should never happen. you need to take responsibility of the things you do. >> if you hit somebody and it's

an accident just stop and try to get help because you know, hiding your car yourself going to be found. they can easily trace the car. >> reporter: smith is expected to go before a judge tuesday morning in this case. live in san ramon, i'm paul chambers. we now learned the name of a man who was struck and killed while riding his bicycle. the man was riding his bicycle southbound when a car going about 55 miles per hour drifted on to the shoulder and crashed into him. he died there at the scene. today the highway patrol identified the victim at 56- year-old alfredo hernandez of napa. the driver 20-year-old cami motts told officers she may have fallen asleep behind the wheel. it happened on california street just north of austin. a woman inside the car

fiscal responsibility. the money has not yet been spent. a dispute over flood control levees is heating up at the capital. 31 members of the house introduced the bill that will change how the corp. of engineers regulates levees. state officials say the trees are vital to wildlife habitats and may actually make the levees stronger. consumer advocates submitted signatures for a -- this internet video shows supporters of the measure delivering signed petitions to the reg star today. the group consumer watchdog says they collected 800,000 signatures statewide to get the initiative placed on the november ballot. the measure will have insurance companies justify any rate increases. the dairy's were cleared

after investigators with the world health organization confirmed what u.s. lab officials said earlier. that a diseased cow had a form of illness that involved the spontaneous mutation of a protein gene and that the disease did not make any people sick. one dairy was not publicly identified. they had been closed since april 24th. a dairy in fresno county is free to start selling raw milk products again after the state lifted a quarantine that lasted for more than a week. dangerous bacteria were found in products. there were several reports of illnesses. this was the second recall of organic pastures products in six months. here we are, and i bet you're thinking about one thing at home, the weekend. >> the weekend is here basically for people at this point as you head home from

things are back to normal in san jose's willow glen neighborhood. after a scare that a suspicious package triggered an evacuation there this morning. they evacuate add two block raidous around that business and brought in a robot but did not find a package. they did find a note threatening the owner of the business. >> she found a note eluding to the fact that there was a bomb

at her busy. officers arrived on scene and found the note and a white powdery substance in the front door and back door. >> reporter: police tested that powder and said it was not harmful. they lifted the evacuation order about noon. maryland's highest court ruled that same-sex couples can divorce in that state everyone though they are not yet able to legally get married there. the state's court of appeals voted unanimously today to let all couples with a valid marriage license from another state get a divorce in maryland. this comes after a maryland judge denied a divorce back in 2010 between two women who were married in california. same-sex marriages are set to begin in maryland next january. president obama's announcement supporting gay marriage has led to a huge spike on you tube. the video sharing website has seen a record number of searches and a record number of up loads on the subject.

the republican controlled u.s. house today defied president obama and passed a sweeping defense spending bill. the $640 billion measure is $8 billion over the budget cap that congress and the president agreed to last summer. it includes $554 billion in baseline military expenditures and $88.5 billion for the war in afghanistan and counter the terrorism. this measure now moves to the senate. president obama has promised to veto the bill. a military judge is considering whether the separate the trial for five guantanamo bay prisoners charged in the september 11 attacks. some defense attorneys have asked for separate trials. the lawyers have until the end of this month to respond to the judge's orders. the medals are on pack, the preparations are under way. coming up we'll tell you what

in tonight's special report, 54 state park all expected to close just before fourth of july due to state budget cuts. these days the only hope to keep them open is coming from donors but everyone then for how long? ktvu reporter robert handa examines the cost to pay to keep parks open in our special report. >> reporter: twin lakes state beach in santa cruz may be the most unusual california state park slated to close july 1st. while some parks can shut gates. >> how do you close a beach like this? there's no walls or fencing we can close. >> reporter: for the state closure means no services such as restrooms, life guards or rangers. >> july 4th weekend is one of our biggest weekends down there. you're going to have people, campfires on the beach and all the rest of the stuff. there's law enforcement issues, garbage issues, everything else. they can't put a fence around that thing. >> reporter: some state park facilities have been saved mainly by nonprofit groups but

some of those rescuers warn they're not providing a solution just a reprieve. santa cruz mission was rescued temporarily by a deal between friends of the park and the santa cruz mission. >> it's not a sustainable way to run our park system. we're very lucky that this is a supportive community but the state park system is here for all of california and we believe that there needs to be funding that comes from a statewide basis. >> reporter: the nonprofit save our shores is also seeking donations to help pay for reduce services at twin lakes. while state officials believe these arrangements are models for the future. save our shores lost its state funding this year. >> so while we're being looked to as the partners to help clean the beach up, there's no funding for us to do this. >> reporter: some visitors are skeptical. >> it might be a little hard to

meeting. last week administratorred met with students. parents were told if students continue to miss class next school year the parents could be taken to court, fined of $2,000 and made to spend one year in jail. students can also be fined and lose privileges such as driver's licenses. restored battleship that has spent the last decade at richmond will head to los angeles to become a floating museum. it would have stayed in the bay area but the san francisco board of supervisors rejected a resolution to move the iowa to the city as a floating museum. the bay area will get its last look of the u.s.s. iowa as it passes below the golden gate sunday afternoon. in arizona, wildfire fueled by hot winds is threatening several communities tonight and also forcing evacuations. the gladiator fire broke out sunday. it has now grown to 10,000 acres and is only 5% contained.

the towns of battle flat and crown king have been evacuated and people in two other communities have been ordered to get ready to leave. 640 people are currently fighting the fire which has destroyed four homes so far. authorities in colorado say a man using a camp stove accidentally touched off a 7,000-acre wildfire. more than a dozen homes have been evacuated in larma county. firefighters are worked in steep rugged terrain. the man who started the fire faces a $300 fine and also may have to pay restitution for some of the damage. as we showed you earlier in this newscast it's graduation day for a lot of students today and that continues on through the weekend. let's go to bill martin where all the families and students will be having outdoors. >> the weekend is going to be nice. we had a mild week with winds. but now the weekend is starting to warm up and it looks great. especially sunday which will be warmer than saturday. we have some winds offshore.

let's take a peak over here by redwood shores. this is a live weather center. redwood city right now, winds are gusting at 20 miles per hour. water temperatures 67 degrees that's pretty warm. we'll check out this sensor we have winds gusting to two. these are westerly winds and they are importing cooler air. temperatures in concord 77 degrees. as we go into the next couple of days temperatures are going to warm up as winds die down. santa rosa had 80 degrees, 76 in livermore. these are other current temperatures around the area. you get the feel for it. the forecast for overnight lows on the cool side, 49 in vallejo, 50 in fairfield and the weather system to the north of us way up there that's the one i'm tracking. that one is basically as it moves in here is going to cool things off. but not for the weekend as we go into next week. so next week looks a little cooler with more fog. this high pressure is going to stay over the top and give us a really, really nice bay area weekend.

neighbors concerned that a measure taken to slow down traffic could actually be causing more harm than good. ktvu's jade hernandez is in berkeley where a woman was killed and a young child is still in critical condition tonight, jade -- >> reporter: frank neighbors are out here tonight making sure that this round about is cleaned up. others say that reflectors and signs like these don't keep the round abouts from causing other accidents like the deadly one this morning. pieces of the cadillac were peeled off away from the trees it smashed into. the young woman who was a passenger died here near the corner of california street in alston way when the driver failed to navigate the round about, hit the curb and lost control. the woman graduated from uc berkeley last saturday. john simon a neighbor reacted to the accident
