year ago. >> hers says sierra and i got this. >> feels like someone grabbed my heart and took a part of it and they won't let go. i feel there is something missing. >> reporter: the family is asking volunteers to continue the search until sierra is found. meanwhile fines plan another vigil here at washington high school for next friday june 1st. we are live in fremont. >> all right. we go to robert honda live in san jose with the lengths that investigators went to make that arrest. >> reporter: the suspect is going to be officially charged in court for murder and kidnapping this thursday and right now he is in custody here at the santa clara main jail. today we fund out more details about what led to the arrest. >> investigators believe they

have a lot of evidence linking the 21-year-old to the kidnapping murder of sierra lamar. the teen disappeared on her way to school on march 16th. today the mother of the suspect spoke to us at their mobile home park. she said her son said he was fishing during the time lamar wenting missing, one that's been searched several times. >> he is -- it's hard to believe all this but i don't know what happened. >> reporter: investigators don't believe it as we reported at five the sheriff's department said they have dna evidence linking him to belongings found in lamar's bag and physical evidence connecting him to his red jetta. they said they have been watching him around the clock at his mobile home. >> we had an undercover team inside the mobile home park

inside an vv like they were residents. >> reporter: the sheriff's department is investigating the suspect in three assaults in 2009, one involved a stun gun and day the sheriff said in that case they have evidence linking him to that attack. the sheriff's department said it believes lamar was a random victim and didn't know the suspect. >> her mother had a message today for the suspected killer. >> have a plea to him, to please, please give the information if you have -- that you have to lead us to sierra to help end this nightmare. >> reporter: news of the arrest and murder charge spread quickie today at the high cool where sierra was attending school when she disappeared. parents are glad somebody is in

custody. >> reporter: volunteers promise they won't give up on their search. another effort is planned for tomorrow. today people spent so many hours looking for her, hugged each other at the search center. >> we opened and let everybody know we are here not to support only the family but the community. they are coming out and show their support. >> the search -- volunteers will hold their regularly scheduled search tomorrow morning at eight. our coverage continues on the website. you will find more of the video of the suspect's arrest and more details about the progress of the investigation. >> the laura accused in a deadly hit and run appeared in court this mourning. police arrested 32-year-old spencer smith last thursday. he made a brief appearance today in court in pleasanton. police identified him as the owner of a car connected with

the crash that killed a 57-year- old may 15th. >> he is very, extremely stressed and this is a horrible event in someone's life. horrible event for the person who was killed no question but you ask how spencer is doing he is hurting. >> smith is now free on $60,000 bail. his attorney said arraignment was put over until june 27 president. >> oakland city leaders are talking about banning protesters using home made shields in demonstrations. rob roth is in oakland where he spoke to a member of the occupy movement defending the use of the shields. >> reporter: right now here in side the city hall the council public safety committee is considering a new law. it's aimed to ban protesters carry what should call tools of violence. police have been seeing more subpoena more of these home

made shields. this man said he is a protester who has brought it cut from a can to demonstrations. he said they are necessary because police have used weapons to control crowds. >> the people that had shields, they were able to stop some of those from hitting other people. >> reporter: city officials say the protesters use them to advance on police lines. city councilmembers are considering a new ordinance to ban protesters from bringing the sheils, clubs, paint cans and other dangerous tools. >> we don't want people who really are justin tent on doing harm to use that as a cover for really destroying a lot of innocent people's property. >> i think it's a bunch of bull. it's another way for the city to try to remove more of our rights. >> reporter: here at this shoe shine shop, ground zero for many protests you can see a cracked window. the owner said it was from a protest in february. he supports the proposed ban on

protest item that would carry a thousand dollar fine and six months in jail. >> i don't think it's fair for them to carry sticks and stuff because they get out of hand. >> reporter: the proposal could go to the full city council in two weeks and could be law perhaps by july. occupy protesters say if it does become law they will find other ways to get the message across. reporting live. rob roth. >> the alameda da has dropped robbery and hate crime charges against three occupy protesters. they were accused of surrounding a woman who criticized their demonstration insulting her perceived sexuality and taking her wallet. one of them pleaded guilty in a separate case. he was ordered to stay away from the plaza as part of his probation. a business located in the middle of the occupy protest is now closed. we found this notice at the

coffee shop near the plaza. it said it was a business decision. they it say the coffee stop experienced a up if sales during the protests but that was not a factor in their decision to close. >> a san francisco jury found a richmond man guilty of murder in a shooting that had a ripple effect on night life in the city. the 22-year-old was convicted of shooting killing a 19-year- old outside club suede on february 7th 2010. the city's entertainment commission came under criticism for not doing enough to crack down on violence in nightclubs. a judge later ordered that the club be closed. sentencing has not been set. >> a sacramento jury has convicted a man of rape in part because of a 17-year-old jailed as a witness. the unidentified teen spent 27 days in juvenile hall to ensure her testimony. she said she was working as a

prostitute when she was assaulted. another prostitute also testified. >> more than a dozen babies in solano exposed to tb. health officials say 15 in the icu at fairfield's north bay medical center were exposed to someone with a active case of that disease. it happened between march 31st and april 2nd and from april 11th to the 19th. officials say the risk of contracting tb is small. facebook is already the focus of an investigation now on just it's third day of public trading. securities regulators in massachusetts today suspect is investigating if the bank warned certain clients that it's future earns were being downgraded. shares fell 8% today. >> google's block buster

purchase of motorola is now a done deal. the $12.5 billion deal is the biggest in their history. it gives the company ownership of valuable patents for it's mobile phone operating system. >> today tesla set a date for its new car to hit the road. the electric car maker said customers will start to drive away in the new car on june it '22nd ahead of schedule. it'll start at a invite only event event. they said it mope hopes to sell five thousand. the shares jumped 7% today to $30 and 79 rent cents a share. >> the welfare to work program apparently working. the institute of california said cal works helped families in need get back on their feet. the report shows about half of those have been on it for less than two years. the study comes as lawmakers

marked harvey milk day. he would have turned 82 today. he was assassinated back in 1978. at this hour san francisco's castro theater is paying try but to a screening of milk based on his life. >> new at six it was a story that shocked the world more than 30 years ago. a school bus in the central valley hijacked, 26 children kidnapped buried alive. today the driver who saved them was laid to rest. ken pritchett was the only reporter as he was remembered. >> reporter: perhaps there never was a mano linked to a school bus and onto day his friends and family said good- bye that old bus was there at his gravesite, along with the children now grown that he saved. >> i loved him. he was very special. i -- everybody else.

>> reporter: three gun men walked the bus on a rural road and forced them into two windowless vans, the bus ditched in -- the kidnappers drove for 11 hours before putting them in a van buried in a quarry and covering it with dirt. it was a five million dollar ransom plot filed when the driver two other boys dug their way out. >> he was very calm. just followed instructions, not to put us in danger, to make sure we were safe, not to put us at risk. >> reporter: he was called a hero but his wife of 69 years said he never felt that way. >> no he didn't. he said -- i was just doing my job. >> reporter: a job he retire from in 1988. this bus which still runs after all these years is not just a symbol but also another story. the driver bought this bus in the years after the kidnapping and kept it on his property

until very recentury. he kept the bus as a memory of one extraordinary day, those at his service remember his 91 years, as a honorable man. >> what a man. that's ed. >> reporter: ken pritchett. ktvu channel 1 news. >> the kidnapper was three bay area men in their 20s who said they hatched the plot after losing money in real estate. they were sentenced to life in prison and so far have been denied parole. >> after months of desperation it's finally official. the warriors moving back to san francisco. the mayor joined team executives this morning to make the announcement. the warriors are set to move to or acle arena. by the team --.

wind will be the lead story. the wind is mixing out the marine layer and keeping the fog from being substantial along the coast. the winds going to 21. concord to near 30. you can't quite see it. they are gusting to near 30. the winds are out. the winds backed down a little tonight but pick up again tomorrow. the forecast -- a lot like today. the temperatures in the 70's. couple low 80's. as we head into tomorrow we will wake up with fog, temperatures like these. these were the highs from today. the highs tomorrow will be similar to these. we will see a lot of upper 70's. away from the coast and 60s around the bay. about 73 in san jose for daytime high which is what we had today. more of the same. kind of a windy, mild spring like weather pattern. the winds, these are the overnight lows, winds that will continue overnight into tomorrow are stirring up the tree pollen and the grass

pollen. a lot of people as you go out and about. you notice the sneezing, tree pollens high to method rail. the winds mix it up. tomorrow more of the same. pollens little more noticeable. extended forecast into a cooler period as we go into thursday and friday. when i say cooler but not that much cooler, kind of -- 70s and mid70's. gusts tomorrow could make it to 30 miles an hour by the two, 3:00 hour. we go into the -- the forecast highs for tomorrow. we are looking at what we looked at today. it's kind of same old pattern really but the winds, on the bridges they are coming out of the west and northeast. some of the bridges noticing wind advisories, the san rafael bridge. the yhp issues those, the weather service doesn't. the forecast highs are out there and they will look ache lot like today and the five-day forecast with the bay area weekend in view is one of those deals like last week where it cools off, especially on friday. starts to peak up for the bay
