monterey. just yesterday the coast guard lifted a ban. it was put in place after five people on board the low speed chase died during the race. the coroner identified the bike rider killed on highway 1 yesterday. authorities say the 85-year-old was riding with a group of bike riders when he was hit by a car. the chp said the driver swerved to try to avoid him but clipped him before crashing his car in. he was pronounced dead at the scene. no charges are expected. today california joins several other states in refused to turnover a lethel injection drug to the government. the drug is a key ingredient in the lethel injection process but it's only made outside the united states. back in march a judge ruled that they shouldn't have

imported and ordered that states give it up but california and other states contend they aren't bound by that ruling. they are also urging the fda to appeal. >> a scary end to a flight for more than 150 passengers on a flight into miami. the flight had just landed when a passenger jumped up and rushed to the cockpit door. passengers subdued ryan schneider until authorities boarded. he may have been drunk and he isn't onto no fly list but the fbi is investigating. the man accused of murdering a little boy in new york decades ago is on suicide watch tonight. etan vanished while walking to the bus. police arrested pedro hernandez on a tip. the suspect's family came to court where he was scheduled toaa appear but he was in the hospital after making statements about killing himself. he was arraigned from his hospital bed and charged with second degree murder.

marriage supporters. a judge ruled the defense of marriage act violated the constitution when it denied federal benefits to a same sex spouse married under california law. it is the second such ruling here in california. a san francisco judge declared the law unconstitutional back in february that. is under appeal to the court of appeals. a santa clara jury found aself proclaimed freedom fighter guilty of two felonies in an attack on a singer that happened during a concert last summer. we are have video. it happened in santa clara last july. he was convicted yesterday of felony use of tear gas along with assault and other charges. prosecutors say he is a activist who dressed up like a woman when he attacked the singer. he faces more than three years in jail when he is sentence. >> the dangers of texting driving are well known but can you get in trouble for texting to a driver?

a new jersey judge said no. his ruling today dismissed a lawsuit against a woman who texted her boyfriend as he drove. he crashed seriously injured two people. the couple said she was electronicly present and should have known her boyfriend was driving but the judge said she had no control over when and how he would read the text. >> the sheriff's department and volunteers are still searching for sierra lamar. the results of the search. >> the new eastern span of the bay bridge nearly complete the next giant project is the tran bay transit center. come with us. we love gardening...

coverage continues. this is ktvu channel 2news at five. >> once again south bay crews take to the waters searching for sierra lamar hoping this time is different. in the end their search for the missing teen had disappointing results. robert honda live in morgan hill with how search efforts continued in the middle of emotional turmoil capped off by the find a body in the east bay. >> reporter: the worry about the identity of the body found in pleasanton just added to the week. the volunteers center here is closed right now but has been a day of search related activity here and on the water. the sheriff's dive team wrapped up a week long search at around five today. the team has been searching for 15-year-old sierra lamar. an monday a 21-year-old was arrested and yesterday charged

gotten started at the jay constevens winery on watsonville road and a rally of hope is scheduled for next friday in fremont. live in more began hill. >> this sunday marks 18 years since a 14-year-old was killed inside her home in castro valley. jennie lynn's family will lead the vigil to remember her. they hope to put new attention on the case as investigators are still trying to find the person who killed her. the sheriff is expected to speak at the vigil. it'll be followed by a candlelight walk. the service starts at 6:30 an the library. in just over three hours now one of the main routes out of san francisco to the bay bridge is going be closed for work for the new bus and train terminal. tom is at the site of that new terminal and shows us what is being done. >> reporter: one thing is for sure . you can't build a

transit center unless first you dig under this and a lot of other streets. this temporary steel bridge is essential to make room for a massive bus and rail center. a lot of it has taken place in the three blocks that will be the site but to make one giant calf eastern first street is one of three nah must be replaced steel bridges. this one will be lifted in to place over the weekend for a tuesday morning reopening. the center is the key facility in the four billion dollar development. >> three out of every four who come to work in downtown use public transit today. >> reporter: to bring in more jobs more must be put in a more convenient location. >> by bringing caltrain into downtown we project that caltrain rider ship will be increased by more than 67%. >> reporter: just to set the stage for all future development here it's a really big dig. >> it's about 65 feet.
