we have learned that one man is dead tonight after a worker at a jewelry store opened fire during a robbery attempt at a strip mall in san ramon. good evening, everyone, i'm frank somerville. >> i'm julie haener. one would be robber was shot and killed. police in san ramon are looking for three other people involved in an attempted strong robbery at a jewelry store. new information from ktvu's heather holmes. she arrived not long after the shooting, and joins us live to tell us how the robbery was foiled. >> reporter: julie, if you take a look, you can see that vessel

shots here in the shopping center, they remain blocked off tonight. they'll remain inside the gold n treasures jewelry store. san ramon police talk with witnesses about the violence that erupted around 4:30 this afternoon. >> there was one person shot. they've been taken to a local hospital. >> reporter: police say the person shot was one of four people who stormed the jewelry store looking to rob it. before they got away with any of the jewelry, or vintage coins, an employee pulled out a gun. at least one shot was fired. >> strong people. >> reporter: her parents who own the family run business are not the type to back down. she rushed to the store after getting a call about the shooting. >> we weren't allowed past the crime scene. i was allowed to hug them, say

i love you, that's about it. >> reporter: the other three suspects fled. friends with the owner of this store. he says most in the industry, including himself have a weapon onsite and are not afraid to use it. >> if somebody came to my store and tried to rob my, that's going to happen to him too. i'm going to do it. i don't know about him. how? we don't have any other ways to protect our stores. >> reporter: now again, just about 20 minutes ago, we learned that the suspect that was shot inside the jewelry store has died. police tell me that they are looking for a white four door sedan, a late '90s model. at least one of the suspects might have fled in. they're also reviewing surveillance footage. reporting live tonight, heather holmes, ktvu, channel 2 news. stunning new developments tonight in the bryan stow saga. the two men accused of beating the giants fan at dodger stadium last year were in a los

angeles courtroom today. rita williams tells us, prosecutors played an audiotape of one of the men acknowledging his involvement. >> reporter: inside a los angeles courtroom today, marvin norwood admits he was involved in the beating of giants fan, bryan stow. investigators played a tape of a call they say norwood made to his mother on a cell phone he borrowed from police, after his arrest last july. >> i got arrested for that dodger stadium thing. there's really not much i can say over the phone. i was involved. >> reporter: in a preliminary hearing today, a string of witnesses, the judge would not allow us to show, testified that norwood and codefendant, nory sanchez had spent much of the dodger's opening game tossing peanuts or soda at giants fans. >> because they were just thugs

and they were looking for trouble and he and other witnesses said sanchez was the aggressive one. >> in my opinion he was very drunk. >> he was trying to come at the giants fans. he seemed very irate. >> reporter: the hearing is expected to last three more days, it will determine if there is enough evidence to try sanchez and norwood for mayhem, assault, and robbery for the attack in the parking lot after the game on bryan stow. stow, a paramedic, and father of two from santa cruz was list with a disabling brain injury. his family says he doesn't know what happened to him. rita williams, ktvu, channel 2 news. more details now. both defendants also faced federal gun charges for weapons that police say were discovered in norwood's home. both men are convicted felons and are thus barred from possessing guns. at ktvu.com you will find a

bryan stow tab with images from today's court proceedings. a husband and wife indited with a large marijuana traffic -- indicted with a large marijuana trafficking ring. the indictment accuses steven ortega is and his wife of furnishing marijuana growers with equipment from their stores in exchange for a share of the proceeds. some 28 other people including the ortega sons are implicated in the transfer. a long time bay area prosecutor is suing. he claims that now dismissed rape charges brought against him were politically motivated. the charges were dismissed last october. he alleges defamation and says his reputation has been permanently damaged. he's seeking unspecified damages. he has been indicted on charges he used a gun among other

things to sexual assault a colleague back in 2008. he was fired, but an arbitrator ordered he would be reinstated with back pay. he remains on paid leave. republican presidential candidate, mitt romney is in the bay area today for an exclusive fundraiser. lloyd lacuesta tells us about 300 people attended tonight's event. >> reporter: frank, just about 10 minutes ago, mitt romney left his three hour fundraiser here in hills borough. attendees we talked to had nothing but praise for the republican nominee. >> condi rice was unbelievable. we had some illluminaries and mitt is hopefully the next president of the unite. >> he has very good business sense. he is fiscally responsible. i just think he has a passion

trying to cash in by selling misspelled t-shirts on the like. president obama called mitt romney today to congratulate him on clinching the nomination. the white house says he told romney he looks forward to a debate about the nation's future. romney's camp said the call was quote brief and cordial. a new ktvu field poll on two propositions california will decide next week. in seven minutes, term limits in sacramento, and why some say an effort to toughen them may actually weaken them. and a tax on cigarettes and a shift in where the voters stand. a shooting outside one oakland high school briefly put that school on lockdown. it happened next to park and mcarthur about 3:15 this afternoon. just 15 minutes after the school set out. a 17-year-old student from oakland high was shot in the leg. a bullet also lodged in the wall of a bathroom near the football field. the gunman was last seen

running away from that intersection. a four-alarm fire in san jose forced at least seven people from their homes this afternoon. the fire damaged two homes on confer lane. one person was at home when the fire was reported, but made it out safely when a neighbor woke the person up. no word yet on what caused the fire. continuing coverage now of the search for sierra lamar. some 100 volunteers looked for evidence of the missing 15-year- old today in various spots in southern santa clara county. torrez is charged with kidnapping and murder. he is due in court tomorrow to enter a plea. divers will resume searching the reservoir for where torrez reportedly went fishing around the time lamar disappeared.

a pass in union negotiations even though workers said they wanted the talks to continue. members of one of the supermarket units planned to authorize a strike. the impasse declaration caught them by surprise and makes no sense. management says the union's refused to recognize the company's financial problems and are asking for changes that would further increase costs. fewer years in sacramento. the results of an exclusive new ktvu field poll on prop 28's term limits and the lawmakers we found on both sides of the issue. back here in just ten minutes, with tomorrow's forecast, we're going to see temperatures in the 90s. a home invasion robbery in this quiet residential neighborhood. police told us thieves are targeting this area.

a frightening home invasion robbery in an upscale neighborhood that's usually pretty quiet. amber lee live in livermore, where police tell hire the area has become a real target now for thieves. >> reporter: frank, we're in a neighborhood known as sunset eves. neighbors put up this crime alert following a series of burglaries, and just yesterday morning, a home invasion robbery. reginald court is a quiet cul de sac. a woman behind the door

declined to speak with me. police told us the couple in their 60s who owns the home called 911 to report they had been robbed by two men. >> they were wearing masks over their face. they forced entry through the residence, they were also armed. they bound the victims and they also put something over their heads. >> reporter: police say the husband and wife may have been targeted because they're owners of a card club. we've learned the target is a casino. >> they were very selective in what they took. >> what did they take? >> that's not being disclosed yet. >> reporter: i reached the husband by phone tonight, and he told me, he doesn't know who the suspects are. >> we were just really shocked that it's just too close to home. >> reporter: this neighbor spoke with us, but asked us not to identify her. >> we all have security systems. and we're probably a little bit lazy in how we use them, and when we use them, but i can tell you from this point on, we will be using them.

>> reporter: police also say there's been six burglaries in the area in the last month. >> i guess i'm not surprised. i know crime is everywhere. >> reporter: police are not saying if there is surveillance video of the home invasion robbers. they're asking anyone with information to contact them. in oakland, police say a man wanted for a home invasion robbery is off the streets tonight. the suspect is identified as 26- year-old air lando wesling. during the standoff, others inside the home were safely evacuated as well as neighbors. san francisco flies are looking for a taxi driver who they say attacked one of his customers with a tire iron.

it happened early this morning. police say the two were fighting over the fare when the taxi driver hit the customer. the victim, a 25-year-old man is expected to be okay. the driver is described as an asian man between 30 and 35 years old. 5'7" and weighing about 150 pounds. two men have been arrested in connection with a deadly shooting earlier this month in san francisco's westin edition. they have been charged with murder. they have not entered a plea. they're accused of shooting james earl lee and a 27-year- old woman. lee died at the hospital and the woman survived. the alameda county district attorney has cleared a berkely police sergeant in the shooting death of a business student. police were called to a computer lab on campus last november when someone saw a person with a gun. officers say christopher travis pointed a gun at them, and refused commands to drop it. now the d.a.

as found sergeant tucker had no other option than to fire his weapon and no charges will be filed. an exclusive new ktvu field poll shows voters by a wide margin support proposition 28 which reduces the maximum time state lawmakers can serve in sacramento. 52% say they support term limits. 28% are opposed. a sizable number, 22% are undecided. as ktvu's ken pritchett reports, it will actually keep them in longer. >> reporter: it's a game of musical chairs. turn out in one house, go to another. switching seats with tom torlickson. >> back and forth. i don't think that's what the

voters had in mind. >> reporter: right now, lawmakers can serve 14 years in the legislature. but only 6 in the assembly, and 8 in the senate. all 12 years could be spent in one house. >> proposition 28 making it seem like legislators will serve for a shorter amount of time. >> reporter: she supports term limits, but is against 28. she says if lawmakers can stay in one house 12 years that makes it easier to stay longer without run forgot a new seat. >> look at the damage we're causing to this state. >> reporter: saying if prop 28 was in place, he would have stayed in the assembly, and gained more experience. >> california is a huge state. we're the ninth largest economy in the world. >> reporter: the questions for voters are how do they see prop 28 as a tougher, or weaker stance on term limits?

the oakland police department accepted a donation today to help keep its helicopter in the air. a nonprofit called fueling california is giving oakland police $10,000 in fuel. they say that's enough to keep the chopper running about 80 hours. police say the helicopter is a valuable tool, and helped officers on the ground make 476 felony arrests last year.

san francisco mayor ed lee said today the city is ready to do some hiring. after years of budget problems, lee says his new budget will include money for training 300 new police officers and 84 new firefighters. the mayor says the city is speciousing an economic recovery, and needs to replace several hundred officers who plan to retire. he's scheduled to present his budget to the board of supervisors tomorrow. there is a new push tonight to try to improve security at an old cemetery in martinez after van calls broke into -- vandals broke into graves there, and even opened up a coffin. it's just the latest in a rash of problems. >> they came in through the fence. >> reporter: the caretaker says a hiker on a nearby trail first alerted him someone had broken into two crypts at the st. katherine cemetery in martinez. >> the door was completely off the hinge, and the two coffins were out. one was off to one side, and the older one was opened.

it was an old wooden one. that was the grandmother of the poppy family who lives here in martinez. >> reporter: it's by far the worst case in a rash of vandalism at the catholic cemetery, home to pioneers and soom of martinez's first residents. >> it's horrible. >> reporter: the grave has now been bolted, and wedged shut. some brass handles were taken during the crime. >> there's the youth, and there's the homeless population, and there's crimes of opportunity. >> reporter: with a limited bunt, he says securing -- budget he says, securing the cemetery isn't easy. a grandmother says she is

appalled and is pushing to raise money for surveillance cameras here at the cemetery. today marks ten years since the last piece of steel was hauled away from ground zero in new york, following the september 11 attacks. on this anniversary, a group of first responders and recovery workers was cheered, as they returned to the site in manhattan. the men and women were honored at an event at the national september 11 memorial and museum. michael bloomberg along with rudy giuliani and george pataki attended the event. in all, 1.8 million tons of steel and concrete were hauled away from that site. a new source of funding to help keep california state parks open. plus a new effort to deture spoking. where voters stand on a controversial increase in the

rng we have an update now to a story we first told you about earlier this month, a 12-year- old boy is back home tonight after suffering a very serious injury during a little league game. talking about the pitch that changed his life. >> reporter: frank, this is the field where the 12-year-old was hit three weeks ago and suffered that serious injury. it's also the field where the young pitcher made a triumphant return. last night, brendan o'neal threw out the first pitch for his team's championship game. his team went on to win the petaluma national little league title. >> a fairy tale finish for the

poor kid who had a very serious injury. >> reporter: he was hit right between the eyes. the impact shattered the bones in his face. for a time there was serious concern about a brain injury. >> the sound was the ball hitting his head. that was a really, that was a hard moment. >> you know, it was an accident. brendan's injury was an accident. and i'll say it again, there's no one to blame. >> reporter: brendan now has a metal pin, and screws in his forehead. >> on that night, his life did change. he will be limited and he's 12. he has a whole life ahead of him. >> reporter: his family says the worst of brendan's medical problems are behind him. but his dreams of playing contact sports are over. >> i was bummed out, but i got over it pretty quickly. >> reporter: this afternoon, brendan opened a gift box from the san francisco giants. >> please know that the giants are thinking about you, and are hoping for a speedy recovery. >> reporter: he has been

showered with gifts from bay area teams. >> i think everybody happened for a reason. i'm here because i'm supposed to be here. >> reporter: brendan says he's thinking about trying out for track this fall at petaluma junior high school. and says he will probably follow in his father's footsteps and take up golf. san jose mayor chuck reed is standing firm against activists who want him to support same-sex marriage. reed says he supports domestic partnership laws for gay couples, but not same-sex marriage. they decided they shouldn't force him to do something he opposes. a busy day in sacramento. the state senator approved a ban on repair therapy which claims to make gay people straight. it would prohibit such therapy from minors.

supporters of the bill say the therapy is dangerous, and has led to attempted suicide. some opponents say it would interfere with a parent's right to seek care for their child. a bill requires the department to modernize its fee collection and to allow residents to donate to parks by buying special license plates or checking a box on tax returns. that bill now goes to the state senate. the so-called middle scholarship act passed the assembly on a 15-4 vote today. that bill would cut tuition by 2/3 in the uc, and csu systems for students who's families make less than $150,000 a year but don't qualify for financial aid. a separate bill that would generate $1 billion to pay for the relief by eliminating a corporate tax break has not yet

been voted on. an exclusive new ktvu field poll shows bay area voters are in favor of proposition 29, which would increase taxes on cigarettes. john fowler tells us, an effective advertising campaign could be narrowing that lead. >> reporter: our exclusive ktvu field poll shows among bay area voters 68% in favor. 27% against. statewide, 50-42. it would add $1 to the cost of a pack of cigarettes. >> i'm hoping younger kids will think twice if it's a dollar more a box. >> smoking is not healthy for the person doing it as well as the others they're around. >> reporter: younger people are overwhelmingly in favor. but older citizens were more likely to oppose. >> i thought it was a little too excessive. >> reporter: 55% of women favor the tax. >> i happen to think smoking is one of the worst things that you can do.

>> reporter: some don't like a new bureaucracy it would create. >> that's what bothers me, it's not the right time for creating more state employees. >> we've got enough taxes in the state of california already. >> reporter: big tobacco's advertising may be narrowing the lead, sewing doubt. y where the -- >> knowing where the money is going to. >> there's a lot of times this is what happens when they say they're going to up a tax. where does that money really go? >> reporter: it's supposed to fund research into cigarette related diseases, and cancer. our poll also found that more in person voters oppose it. so turnout on tuesday could be key. john fowler ktvu, channel 2 news. researchers at the university of california san francisco say they've discovered a possible new target for an hiv vaccine or treatment. the researchers studied monkeys with a virus similar to hiv. they found monkeys with more of

a certain type of immune cells in their stomachs had a much lower level of the virus. researchers say if a treatment were to be developed it could possibly lead to an hiv vaccine. the findings were published today in science translational medicine. federal regulators rejected an attempt to rename high fructose corn super. - - syrup. the food and drug administration turned it down saying it defines sugar as a crystallized food, not a syrup. for the past 18 years the meat industry has tested for just one strain of e. coli, but starting on monday, six strains will be tested in the trimmings that become ground beef and hamburger.

this is aerial video of hemet high school, where nine people were hospitalized after a driver ran through a red light, and d plowed through a crosswalk full of students. the highway patrol says the driver is an 11th grader at the school. eight of the nine injured people are also students. the other is a 60-year-old man. three of those students are hospitalized in critical condition tonight with head injuries. a parolee somehow managed to bypass security at the san diego airport and managed to board a plane. he got onto a united express jet even though he had no

boarding pass and no ticket. duncan was discovered and arrested. duncan said he was just trying to get back home to alaska. there was a close call on the taxiway of o'hare airport today. a wing clipped the jumbo jet as the smaller plane was taxiing. in the netherlands, sentencing a former liberian president to prison. he was convicted of horrific crimes that the presiding judge said put taylor in a class of his own. some 50,000 people were killed,

and many more mutilated. the court ruling allows his attorney to reopen the case. assange has been under house arrest for two years, and insists he's innocent. in spain, volvo is testing a car guided by cameras, radar, and laser sensors. the test driver said it was fun to see passing motorists look surprised as she read a magazine. volvo claims the cars will cut down on accidents caused by driver fatigue and distractions. google announced it is providing zaget ratings for restaurants free of charge. it has ratings plus recommendations. google bout zagut last fall. it will continue to sell its popular guide books, which rate restaurants in more than 100 cities around the world. a new milestone for one of san francisco's tallest towers.

in napa, a school already facing money problems is facing another blow tonight after 40 laptop computers were stolen over the weekend. why the reaction from some of the fourth graders was somewhat surprising. >> reporter: the principal showed us the locked mobile metal cabinet that had been sitting in a classroom. the 40 laptops that were inside

is missing. >> stealing from these kids is robbing their education and hope for learning. you just can't even believe that anybody would choose to do something like this. >> reporter: the computers were mac pros, just like this one, they're worth $1,000 each. but invaluable for the students who use them. >> of course their purchased to go on for years. this really effects hundreds and hundreds of kids. >> reporter: police are investigating the black smudges on the cabinet, where they dusted for fingerprints. >> a lot of the kids immediately started rallying together, what can we do to earn money to buy computers back for the school? >> reporter: parents are getting onboard too. money is tight for the school districts it may be up to them to find the money to replace them. >> they're really important to our work, so we do need to

replace them somehow. >> reporter: the school says the thefts are forcing them to find new ways to keep their computers secure. a wide receiver on the oakland raiders is set to appear in san francisco tomorrow on a misdemeanor dui charge. an officer pulled over darius heyward-bey last month. the officer reportedly spotted him speeding and weaving. he was arrested after the officer said he failed a field sobriety test. an 8th grade boy has made it all the way to the semifinals of the scripps national spelling bee. >> he correctly spelled the world tertiary and passed a written test to become one of the 15 semifinalists.

nick lambert spelled his word correctly as well, but he didn't pass the written test and was eliminated. the semifinals are tomorrow in washington, d.c. san francisco's 1 rincon hill has achieved another milestone. the building has now installed the largest number of seismic sensors of any high rise in california. this is the first time the california and u.s. geological survey collaborated on such a project. >> floor by floor, that's how dense the array is, and how complete the information is. go floor by floor and see how it reacted. >> when the building shakes, the data collected by the sensors will be instantly available to the public on the internet for free. it is pupping season in golden gate park.

that's architecting over top of us. the days are getting longer. the jet stream is receding to the north. as you get warmth from down here, and cool air up here. the jet system spreads to the north. here's what we're checking out tomorrow. patchy fog, not a lot. temperatures warmer tomorrow. your bay area weekend, going to be just a little cooler. instead of 90s, we're back into the 80s. a nice looking forecast ahead. the air starts to sink. when the air sinks, it warms. it starts to work its way offshore, and takes that fog, and pushes it away. that's classic summer heat wave. if this high was real strong and it's air was sinking hard and fast, we would be looking at record heat. these highs have varying strengths. the one that is going to hit tomorrow, the next day, not very powerful. but it will increase the temperatures. the forecast for tomorrow, a little fog showing up right around here in half moon bay. it's gone, and you see the fog kind of try to work its way

back in. by the afternoon, temperatures into the 90s in the central valley. when you look at these temperatures it really shows you kind of a summer pattern. cool coast. warm here, and very hot to the inland valleys. forecast high tomorrow in napa, 88, 85 in vallejo. a nice looking forecast for your thursday. friday is not going to be that much cooler. probably drop a degree or two. but friday is going to be a carbon copy of what we have tomorrow with a little more fog. you go to the bay area weekend, you can see the weekend come into view. we are looking at temperatures a little cooler, but pleasant. that means just a little more fog. next two days, warmest of the week, slightly cooler for the weekend. a wildfire burning in new mexico is now considered that state's biggest ever. it's better thanking in the gila national forest. it began as two separate

the san francisco zoo is celebrating four new additions to penguin island. the chick broke through its egg ten days ago, and visitors to the zoo could see the chicks now before all four attend fish school in july, where they will learn to swim. zookeepers are hand feeding them to better monitor their health. mark is here now. all eyes on tim lincecum. i guess if there's any headline tonight it's that he pitched a little better. >> yeah, i was thinking maybe
