of ross mirkarimi and you can watch the eliana lopez. the two men accused of beating a giants fan at dodger stadium were back in court today for day two of their hearing. ktvu's christien kafton is live outside the los angeles courtroom where we learned how the whole thing may have started. >> reporter: yeah. i was inside the courtroom as the testimony came tie an end. the highlight -- came to an end. the highlights, the list of injuries brian stow is facing, injuries to his skull and he will need lifelong medical care. this afternoon prosecutors walked witnesses through the fight opening night of 2011. the judge is allowing us to use audio but not faces. >> you said you heard the noise. >> yes. >> what did that sound like?

describe that. >> a really loud hit. sound. >> reporter: the suspects marvin norwood and louie sanchez watched as witness after witness described men matching their description picking fights in the parking lot. witnesses saw men watching the description of the suspects and they appeared to be drunk and high. the defense said there were a number of fights that night and worked today to prove the witnesses couldn't identify louie sanchez and marvin norwood. >> the person that you say you observed punch the giants fan that you believe is brian stow, did you get a good look at that person? >> i saw a side view. >> you never saw a front view? >> nope. >> reporter: brian stow was not in court today and we didn't see his family here. they are planning on bringing more witnesses to the stand,

including friends of brian stow who were with him the night of the attack. we will have coverage, including more tonight, rita williams will have a wrap up here in los angeles for you coming up at 10:00. live in los angeles, christien kafton, ktvu channel 2 news. the man accused of killing sierra lamar goes to court. coming up in 10 minutes the suspect didn't enter a plea but what did happen in court is significant. police are searching for three surviving suspects following a jewelry store robbery. a shooting that jewelry store. police say four people entered the store to rob it. one was armed. one of the victims shot the robber. owners of nearby businesses reacted to the news. >> i am sure he is not happy

romney 32%. there is a surprise when it comes to the undecided voters. more voters are undecided than in previous surveys. 17%. lawmakers will see a pay cut under a decision made today. >> the state is going under. there will be significant reductions. it will have to come from public employees. recordless of where they are. we start here. >> they voted 5 to 1 in favor of the cut. takes effect december 3. today's decision will reduce the check by $5,000. some law makers are asking the state attorney general to review the decision. a bill passed today by the senate would make it illegal for lawmakers to accept gifts, included in the list, tickets to parks, race tracks or

sporting events, spa treatments and golfing, skiing, hunting and fishing. a small group gathered this afternoon to try to draw attention to a lack of help in dealing with problem mortgages. >> the demonstration at the bank of america branch was part of a national effort called the home defender's league. they are calling for a moratorium on foreclosures and for families to be allowed to rent their homes after foreclosure. this man built this cross and has been maintaining it for 30 years, why he can no longer go up here. >> a warm up today. a cool down tomorrow. i will let you know how much cooler.

the man accused of killing sierra lamar appeared in a courtroom today. antolin garcia-torres is scheduled to enter a plea instead the judge granted a request to extend. >> the district attorney gone all in in the murder conviction. they believe they have a strong case for murder. >> antolin garcia-torres is scheduled to be back in court july 12. the parents of a medical student beaten last year filed a lawsuit against the club and the owners. he died of head injuries after

being beaten inside the club. the club had no security and should be held responsible. no one has been arrested thus far in connection with the case. law enforcement officers dismantled a homeless camp. the camp has a long history. each time police moved the homeless out they returned. today's action served as straining for more -- as training for more removeles next month. >> -- removeles next month. >> there are an estimated 11,000 homeless people in san jose. 20% rise since the economy plunged. a world war ii veteran built a cross on a hillside 20 years ago and been maintaining it but ktvu's rob roth talked

to the man and tells us the man is no longer permitted on the property where the cross sits? rob? >> reporter: you can see the cross on this hillside for miles away. it is made of painted rocks and 100 feet long and the man who made it is now heartbroken. >> reporter: he built this cross 31 years ago and been maintaining it. >> this means a love symbol. too much hate in the world. the owner of the property the cross sits on says he can't go up there anymore and the world war ii colonel can't talk about it without breaking down. he created the cross in 1981 as a tribute to those who died during world war ii. gathering 3,000 rocks. he would hike a half hour to take care of it.

>> perhaps that is the reason i am 94 years old. for 31 years i have been climbing the mountain. >> reporter: he says the previous owner allowed him to make the cross and the current owner permitted him to maintain it till a few weeks ago. he is concerned about liability if something happens to him. for neighbors the cross is hard to miss. >> still a nice hillside. >> it adds to the character of the area. unique. >> reporter: in time vegetation will cover the cross. >> i get so upset. i can't talk. >> reporter: he hopes maybe some organization will buy the property ask maintain the process -- and maintain the cross but the land is not for sale. rob roth, ktvu channel 2 news. californians don't appear

to be supporting the idea of legalizing marijuana for recreation use. there is support for legal medical marijuana for the severely ill. san francisco bay area is the only region where 55% favor recreational legal use. court struck down part of the defense of marriage act. the court ruled that the law which defines marriage as a union between a man and a woman is unconstitutional. the judges did not rule on whether they have the right to marry but they said it is unlawful. >> every year we pay thousands of dollars extra in taxes because we are a same-sex couple. >> they called the ruling a dangerous decision that could

threaten your religious predom. facebook stock rose today but shares are still down two weeks into the ipo. facebook closed at $29.60. up 5%. it is down 22% from may 18 of $38 a share. the san francisco zoo has four mew penguin chicks. they are on display now on penguin island till the end of june when they will head off to fish school where they will learn to swim. they are expected to return around the end of july. warm day for them. ktvu's chief meteorologist bill martin tells us how hot it got today. >> 95. it was up there. warmer than all week. today the warmest day of the
