new law passes here. >> two early morning fires at a san jose high school. why the campus is now a crime scene. >> and the campus closure is looming for san francisco city college. ktvu channel 2 morning news continues. >> good morning, to you. welcome to a brand new day and a new month it's friday, the first day of june i'm dave clark. >> and i'm pam cook. let's start with weather. it's a pretty cool june i would say so far. >> for the coast. inland it will be hot. the fog is back. it will be cool the next couple of days for early june. now we ended may on a very hot note. especially inland. temperatures 90 to near 100 degrees. that fog has come screaming back. 60nd and 70 -- 60s and 70s coast and bay. we are looking at highway 4. the traffic looks good. a little bit of slow traffic in

antioch. in bay point we look pretty nice. also this morning we are taking a look at 880. both directions look fine. let's go back to the desk. new this morning an arson investigation in san jose. emergency crews still on the scene of two suspicious fires on the campus of evergreen high school. they were first reported at 2:30 this morning. one fire burned a dumpster the other damage the the outside of the campus library. nobody was hurt but they have strong evidence the fires were intentionally set. find out what may help track down that arsonist. 6:01. suspended sheriff ross mirkarimi is facing new action in the misconduct case against him. claudine wong is in san francisco right now with the details of what is next. claudine. >> reporter: it's all up to the

ethics commission now. the question whether or not ross mirkarimi will be able to keep his job as sheriff. we do have a better idea of the grown work. all of this starts with a deadline today for the mayor. mayor ed lee needs to turn in a bill of particulars regarding the charges of the misconduct against the sheriff. then he goes from here a week after testifying against for and against ross mirkarimi has to submit declarations. both sides can decide who they want to cross examine. in terms of what evidence will be submitted certainly the city expected to to show the video of elle yen that leo pose talking about the bruise her husband made on the arm. remember this is a hearing not a trial. the commission saying it's not going to stick to strict rules of evidence and will have

hearsay. >> does it breach the trust of the public that if you believe he battered his wife. most would say yes. but shouldn't we leave it up to a recall election so the people of san francisco can vote? or do we put it to a panel that is hand picked and say let them decide what happens here. again that depends on what your position and how you view this particular case. >> reporter: so the evident area hearing will start june 19th. they have call two witnesses on that day. then it goes to another ten days. once this is all done the cases are all presented, the commission will make a recommendation and that recommendation will go to the board of supervisors. live here in san francisco claudine wong ktvu channel 2 news. berkeley already has a law that bans people from lying on sidewalks.

now voters could take that a step further. lorraine blanco is in berkeley. >> the mayor thinks citing on the sidewalks is particularly a problem here. lying on the sidewalk is from 7:00 a.m. to 10:00 p.m.. when enforced the city could close up. the mayor plans to bring it up to the june isth. we talk to -- so was the student sitting and studying. i guess after they approached them they would choose not to give them a ticket. i can see it being forced unfairly. >> reporter: if approved breaking the law would be considered an infraction and cost you $50.

for a repeat offender it becomes a misdemeanor. live in berkeley lorraine blanco. 6:04. two separate shootings in oakland last night left three people injured. inclouding two juveniles. the first one happened on 61st street. friends of one of the victims drove him to the. a second victim reportedly in his 20s he was rushed to ambulance. another juvenile was shot and injured in a separate shooting. it happened on 93rd avenue about 9:45 last night. alabama ambulance rushed that victim to the -- an ambulance rushed that victim to the hospital. police in santa clara are investigating a sexual assault. a woman told police that she

was assaulted on park avenue around 3:00 yesterday morning. now police only have a vague description of the suspect. they are asking minute with information to give them a call. police start to investigate yesterday afternoon. now police moved war the house. look at them the guns were drawn. after getting reports of dangerous dogs on that property. they found two men that had been burned on their arms. they can also smell chemicals in the air. the may jobs report is out and the numbers are below expectations. u.s. employers created 69,000 jobs last month. that is the fewest in a year. that is according to the labor department this morning. coming up at 6:15 we will go live to the washington, d.c. bureau with reaction to the job figures.

it's just again having to deal with high pressure that is on the move. it's not parked over us like it was yesterday. unseasonally strong. our temps will go from up here to way down here. especially inland. thick fog on the coast. cooling begins. still 90s inland. 90s and if you are far enough away upper 90s. i think you will notice a drop in temps today. definitely on saturday and no doubt about it on sunday into monday. fog, sun, cool for some. hot for others between. mild to warm. coastal fog is really starting to thicken up. there is a lot out there. 50s, 60s, 70s coast and bay. 80s and 90s to near 100 degrees anywhere. 72 oakland. 74 for hayward. 94 gilroy. 90 livermore. 80s low to mid peninsula. and then on the coast 60s or very low 70s. fog on the increase and moving

6:12. a roadside memorial that honors a novato teenager that died in a drunk driving crash has disappeared. they have been placing candles and flowers for two years. the teenager was killed in may 2010 when he was riding in a car with a classmate that was drunk. all traces of that memorial were gone. the police, the park rangers, public works crews say they did not remove it. reservoirs will be searched again on monday for signs of sierra lamar. the dive team will surge the uvas reservoir where antolin reportedly went fishing. sierra lamar's family and friends are not giving up hope finding her alive. they will hold a rally tonight at 7:00 at her old school. washington high school in fremont. some 400 people attended the vigil there in march.

shortly after the 15-year-old disappeared. meantime the suspect garcia torres made a court appearance yesterday. he was charged with one count of murder ever. they seem to be confident they can get a murder conviction. garcia torres did not enter a plea. his attorney was given six more weeks to prepare his case. a judge has ordered two oakland motels to shut down for one year. oakland city attorney says the economy inn on east 12th street and the national lodge on international boulevard have been hubs for prostitution. neighbors and area businesses are cheering the decision to close the motels. an attorney for owners says that he will appeal. >> i disagreed with the judge. i told her clearly they haven't had a single act of prostitution since late last year. >> it wasn't until we got a preliminary injunction that

they began to pay attention. but we need to shut them down. >> the judges ruling states that the motels must close by july 31st. each must pay a total of $45,000 in fines and the city's legal and police expenses related to the case. 6:14. a federal judge orders an investigation into recent police shootings in oakland. the judge is threatening huge fines if the police department doesn't take immediate action. now this judge is overseeing the mandated reforms that stem from an oakland police department scandal almost ten years ago. there have been three police shootings in oakland this year. in one case the suspect was killed. this mornings jobs report worse than economists predicted. ktvu alison burns is in our washington, d.c. newsroom with how many jobs were added last month and the reaction. alison. >> reporter: pam, economists were forecasting 150,000 jobs

added. it was half that. the labor department says 69,000 jobs were added last month. the unemployment rate picked up to 8 .2%. 13,000 government jobs were lost. and there were big losses in construction. it's clear layoffs are increasing and advocates for the unemployed tell us it's getting harder for people that have been out of work for a long time to find new jobs. >> we still have more than three unemployed workers for every job opening. and they are competing against a lot of other folks that are just looking to change jobs. >> reporter: economists say this jobs report and those over the next several months will have a huge impact on the presidential race. we'll take a closer look at how president obama and mitt romney are responding during my next update in about an hour. reporting live from washington, d.c. alison burns. 6:16. defense secretary leon panetta says he doesn't expect the u.s. to take military action in

syria without support from the united nations. panetta you see him here yesterday meeting with troops in hawaii says they are making a contingency plan. but possible military intervention would only happen with broad international support. united nations high commissioner wants the international community to support a peace plan and also investigate the killing of more than 100 civilians in syria last week. a seattle man is being called a hero to stop the gunman that opened fire inside a cafe. he shot six people on wednesday killing five of them. investigators say 56-year-old lawrence adams fought back. they say he picked up bar stools and threw them at him even when the gun was pointed at him. police say it was enough to allow three people to run to safety. he later killed himself. adams was not hurt. 6:17. there is a record setting wild fire in new mexico and it is still spreading this morning. it's in the hela national

forest. it's the largest in new mexico state history and only 5% contained. during the night it grew to more than 190,000 acres. that is more than 300 square smiles and has been burning for for than two weeks. peanut butter sandwiches are a staple of many researchers. they pulled 36 foods between and 2010. more than half -- there is several ways the chemicals made it into the peanut butter it could have been through dust and passed along through the air, water, and soil. the levels are not high enough to be harmful. >> that is interesting. 6:18. i'm sure moms are making sandwiches this morning. getting people out the door. how are we doing on the roads?

difference in the temps today. anywhere from 60 to 100 degrees if you are up toward lake county and also into sacramento valley. cooling trend will start for the coast and bay today. i think a little bit today and more likely as we go into the weekend. satelloid does show -- satellite does show there is a system coming in. it's up here. can we get to the computer? i could do a little dance. the system right there will start to increase the fog it has already done that. it's not making much of a push. 50s on the temps or near 60. fairfield 59. they were 60s last hour. system right there is moving and bumping the high pressure system along. it takes a day before the high temps come down. cooling begins for some. it will still by warm to hot inland. temperatures really topped out yesterday. cooling trend will take us into a bigger drop on saturday. and then sunday i think

and transport are too important to the u.s. economy to be hand strung. last week a senate committee approved doubling the security fee on plane tickets to $5. the industry says the fees continue to go up people will find alternatives to the airlines. uc berkeley looking at new options to dealing with the rising demand for student housing. cal is looking at turning future housing projects over to private developers. the university says the biggest problem is finding sites to develop and keeping costs affordable for students. 6:22. same sex couples cheering federal appeals court ruling. how it involves government benefits and what may happen next in the legal fact. more trouble for my daughters boyfriend justin bieber. the injuries he suffered after one of his concerts got dangerously out of control. >> it's a pretty good drive on 680 as you pass mission

there is a little bit of a backup in the cash lanes. if you are using fast track there is no backup. 6:25. the former rutgers university student the one that used a web cam to spy on his gay roommate turned himself in at the jail. he reported to a county jail in n yesterday to begin his 30-day sentence. he was convicted of intimidation own invasion of privacy after his roommate committed suicide. now with good behavior ravi could be out in 20 days. the battle over the defensive marriage act could be appealed in court. ruled the federal government should not be allowed to deny benefits to legally married same sex couples under the law. 17 people in massachusetts sued but same sex couples across the country including here in the bay area are following that case closely. >> every year john and i pay thousands of dollars extra in

taxes because we are same sex couple. that is because we are not treated equally under federal tax law. >> yesterday's ruling will not be enforced until the supreme court weighs in. that means legally married same sex couples will not be allowed to collect benefits until then. 6:26. doctors telling singer justin bieber take it easy after he suffered a concussion. justin bieber ran into a glass wall during a concert he was giving in paris. he told tmz he felt light headed but was able to finish his last song before going backstage and passing out briefly. he did post a message on twitter saying he's doing okay. the incident comes a day after several of his fans were hurt in norway while attending his free concert. graphic testimony in the bryan toe case. witnesses are talking about last years vicious beating that happened outside of dodgers stadium. >> we are live in san jose where firefighters say someone

it's 6:30. new think morning san jose firefighters responding to two suspicious fires on the evergreen high school campus early this morning. ktvu tara moriarty joins us now from the scene with more on this arson investigation. >> reporter: firefighters believe that someone intentionally set these fires and if you look behind me you can see the charred dumpster. that was the first fire firefighters came across. the second happened over to the left here against the wall of the library through this gate that is locked where the paint has melted off of the stucco. just after 2:00 this morning crews were tipped off about the fires by an alarm company. control panel in front of evergreen valley high school pointed them in the direction of the dumpster and 40 feet away they spotted that other blaze that started in a pile of wood. now fire officials say it looked suspicious so an arson investigator was called to the scene. >> we do know there were surveillance cameras in the area. the fire investigator will

reveal the tapes. >> reporter: crews had the fire contained within 15 minutes. it took more than an hour to get it under control. it took time to find the fires. nearly four dozen crews had to come to the scene because the fire was pretty involved by the time they found it. there is damage but it's only on the outside of the billing. no one was hurt. investigators are going to be looking at surveillance video to see if they with provide them with more clues as to who set the fire. tara moriarty channel 2 morning news. a bicyclist was killed overnight in a head on crash with an suv. it happened just before midnight on old river road in holly dale. chp says the cyclist did not have a light on his bike and he was riding against traffic. the rider was a man in his 30s. the driver is cooperating with police and has not been arrested. ordnance that would crack

down on band handlers in berkeley is moving forward. lorraine blanco is there this morning with the proposal that would ban sitting on sidewalks. lorraine. >> reporter: pam, when it's busy out here on telegraph you will see plenty of people sitting on the sidewalk. that's why it has been hard for us to find anyone that supports a ban on sitting. lying on the sidewalk is already prohibited from 7:00 a.m. to 10:00 p.m.. an ordnance written by tom bates. when enforced people can simply sit up. this potential law would close the loophole making it illegal to sit on the sidewalks in commercial areas. the mayor plans to bring up the measure on june 12th. we talked to one commissioner who says the plan that is not what berkeley is all about. >> he was just gathering and talking and communicating. you know. it's just like stupid. >> reporter: the mayor saws it would make the streets more presentable and enjoyable for

he suffered permanent brain damage in the attack. he's not able to walk or talk. 43-year-old stow is the father of two children. now our channel 2 website has more information on the bryan stow beating case. go to ktvu.com click on the bryan stow tab. there is a hopeful news about the san jose man that survived a week without water after crashing his car. 25-year-old michael sanchez junior was found comatose in the woods earlier this month. now although -- last month that is. although he's still in the hospital and cannot speak, his sister tells the mercury news he is more alert. sanchez was able to communicate by blinking to yes and no questions. altered photo using the image of a murdered vallejo police officer may have cost one man his job. coming up how the foe tow was linked to -- photo was linked to the trayvon martin shooting. firefighters will mark the first anniversary of the two

colleagues that were killed on duty. vincent perez and anthony valerio died as they battled a house fire. the ceremony tomorrow will include a moment of violence and also a memorial garden and plaque a their fire station. a mother in concord is angry his school did not notify her that he had been choked in class by other other students. the student sent a text to his mother said he was choked and threatened by three students. the school says bullying is not tolerated and a school official apologized for not notifying the boy's mother sooner. concord police are now investigating. san diego teenager never needs spell check on any of ore home work. >> g-u-e-t-a-p-e-n-s.

welcome back. good morning, to you. here's a quick look at some of the top stories. only 69,000 new jobs were created in may. a lot less than the 150,000 economists were expecting. labor department also said the unemployment rate tick the up 8.2%. >> oakland police are investigating two separate shootings both involving juveniles. the first happened on 63rd street. a 15-year-old boy and man in his 20s he was shot there about 9:00 last night. another juvenile was shot a short time later on 93rd street. we don't know the condition of the victims or what may have led up to the shootings. >> police in vacaville say a possible drug lash may have caused an explosion that blew the windows out of a house. two men were injured. they told police they have had

been cooking. narcotics officers were trying to determine if they were cooking food or drugs. those men could possibly be arrested. >> san francisco mayor ed lee is facing a deadline from the ethics commission as he pushes forward on charges of misconduct for sheriff ross mirkarimi. claudine wong gins us live from the city with what is expected to happen today. claudine. >> reporter: the commission has asked the mayor to turn in today what is calling a bill of particulars about the charges of official misconduct against the sheriff. first witnesses are being told they need to testify by june 19th when the evident area part gets under way. now the commission just met on tuesday. kind of lay out the ground work. this is unfamiliar ground for everyone. so the commission wanted to set up rules on how this will go down. what the commission is already refused to do is keep this

video private. this is video of eliana lopez just released to the public yesterday. talking about the bruise on her arm. owe know the -- we know the mayor considers it a key piece of evidence. >> the question is for his retention as the sheriff in san francisco will those effect see this tape. the defense will try to keep it out. i don't think they will be successful in keeping that tape away from the panel that will decide whether mirkarimi should remain sheriff of san francisco. >> keep in mind this is a commission hearing not a trial. the commission is setting the rules. for example mirkarimi's attorneys wanted all this to be decided only if the case is proven beyond a reasonable doubt. the standard is instead a lower one. calling for a proponderance of evidence. they will allow hearsay in.

made to police. former presidential candidate john edwards' is free this morning from his corruption trial after a mistrial was disclaired and he probably will not face trial again on the charges. the justice department hasn't said yet if they want a retrial. a source familiar with the case says it probably won't happen. jurors say they couldn't decide if edwards' illegally used donations to hide his pregnant mistress. republican presidential candidate mitt romney accused president obama of wasting taxpayer money. he used the announcement with a visit to the solyndra company. >> the president fails to understand the basic nature of free enterprise in america. he thinks government dominated decisions like this makes america stronger. they make us weaker. >> romney's camp gave no public notice before yesterday's press conference. the president's campaign spokeswoman issued a statement

saying in fact both republican and democratic administrations advanced solyndra's application. 6:48. let's get you going to where you need to go. sal, what is happening? >> you know right now traffic is a little bit busier than it was. we are looking at system of the freeways. 80 westbound is getting busier although it's not stop and go heading out to the bay bridge toll plaza. when you get to the toll plaza there is not much of a crowd at all. we had an earlier crowd and it seems to have dispated quite a bit. also the morning commute looks pretty good in the south bay. this is northbound 101, 280 there is slow traffic approaching the 880 interchange. let's go to steve. >> sal, thank you. fog is on the coast. some of that is very shallow. there will be a big, big spread on some of the temps today. anywhere from upper 50s and 60s to mid 90s for some. but the fog is back. pollen index for those suffering from the allergies

the trees were kind of knocked down a little bit. they have gone back up. cedar, juniper and olive. grass continues to be high. there is good news and bad news here on the pollen index. good news is temperatures will go down. bad news is the wind will pick up. high pressure will still give inland temps today. 80s and 90s by the coast. the fog will make a big difference. the system right there will sweep in here for a dramatic drop in our temps as we get toward sunday and monday. possibility of rain to the north. that would be in lake county and mendocino county. 50s on the temps. low, mid to upper. the system that is moving is bumping the ridge of high pressure out of the picture. it will still give a pretty good warm pattern for inland temps today. the cooling has begun coast and bay as well. temperatures will fall off the tables as we head toward the latter part of the weekend. sunshine mild to warm or hot
