molestation case against a teacher shocked parents and could lead to charges against the school administrator. he is a charged with abusing five students. police arrested him in january after a parent of one of the alleged victims came forward. i today i found new details the da. prosecutors say a student made a claim about chandler to a school administrator in october but the administrator never reported it. >> they have a reasonable suspicious that abuse has happened, they are under the obligation by law to report that to law. . >> reporter: that student is now one of the alleged victims in the case. the lead prosecutor said chandler is also charged with abusing another child just weeks after the initial report was made to the school administrator. >> one count alleges a crime was committed between december and january. >> reporter: state law requires any suspected abuse to be

reported. failure could lead to a charge, a year in jail and a thousand dollar fine. >> any parent would be disappointed to feel that their child is in an environment where laws are not being followed. >> reporter: parents were upset as school administrator was told by a child about possible abuse but didn't go to police. >> i'm going do be really upset. i would be going straight to the police about it. until the school district or somebody do something. >> reporter: the district attorney would not identity the administrator or say if charges would be filed. reporting live. >> the director of educational services for the evergreen school district sent us this statement. i want to first say that the district is committed to providing a safe learning environment for students and also that it's committed to complying employee's responsibilities with regard to california's mandatory

reporting obligation. he adds that administrators required to report allege ages of abuse immediately and a follow up is supposed to be done with in 36 hours of the report. coming up, graduation is hanging in the balance. a legal fight a group of students waged today after school officials say a pramk got out of hand. >> an attempted murder suspect shot by sheriff's deputies. it's a developing story we have been following. john is live where he is finding more about the overveiled shooting. >> reporter: i want to show you can see some of the evidence markers in the street. on queen street and some of the crime scene techs working on figuring out what happened there and what that evidence means. this started about 4:00 this afternoon when a couple of deputies came to the house, they tried to arrest the attempted murder suspect and that attempted murder suspect got in a vehicle and aimed that

car at the sheriff's vehicle. those sheriff's deputies opened fire, apparently hitting the suspect at least once, but he was still able to drive away. this is -- some of the video from earlier when everything was still very, chaotic. the individual drove across 580, ended up at another apartment complex, where he was under someone's porch for a while and then the sheriff's deputies got their it turn to doing on him, get him out, the dog bit him and they were able to arrest him. this is someone that it the sheriff's department had been wanting to get for some time. jd nelson told us about this it. >> about a month ago he is the suspect in an attempted murder where he fired through a door, of a woman -- struck the woman in the arm and then -- a couple weeks after that, he was -- in the city of alameda, led

deputies on a high speed chase where he drove 90 miles an hour down the wrong way. we discontinued that pursuit because of the safety of the public and then here we are today he is in castro valley. >> and here is video from the chopper showing the individual being arrested, taken away on a gurney. jd nelson said its someone they wanted off the street because he had no regard for human life. shooting through someone's door. hitting them. driving the wrong way on a street at 90 miles an hour. they are happy to get him off the street. as you can see this scene here is still very active. we will be here gathering more information for you bring it to you later tonight. live in castro valley. >> it's election night and you have less than go hours to cast your ballot. a lot aren't even showing up. lloyd is in san jose where the

early votes being processed and some are still dropping off their ballots. >> reporter: there was a time when people walked into a voting booth on election day. now as you can see they have this set up where people can drive up with their ballots, this is a office in san jose and in the largest county in northern california most voters vote by mail. >> take my time. i don't feel pressured and if i make a mistake i have a chance to fix it. >> people should show up to a booth, show identification that they are who they are supposed to be. >> reporter: malin ballots are already being processed. . for this election 72% of the voters requested mail in ballots. one of the highest levels in the state. some 129,000 balances were returned before today.

the nasdaq is getting ready to say how it plans to pay back people who lost money due to technical glitches on the first day of trading. the wall street journal reports they may have lost $100 million due to the delay if trading. all of this as facebook stock fell nearly 4% today and closed below $26 a share. >> the battle over california's proposition eight that bans same sex marriage now going to the united states court. the court in san francisco said today it would not review the february ruling by a three judge panel. that declared the proposition unconstitutional. supporters say they will appeal it now to the high court. both sides say they are ready for a final decision. the slopements come as san jose is in the middle of a heated debate over gay marriage. community groups say they want

more than just symbolic support. >> reporter: the flag is usually a happy occasion but today mixed feelings. you can see the people that have gathered at the certify nonny that got underway just a few minutes ago. this is the 11th year it's been raised at city hall. always in june to remember gay pride month. this year it was supposed to go with the resolution supporting same sex section marriage but that was put on hold after the mayor declined to join a pledge of support by other mayors angering many. on top of thaws heard the proposition now appears to be going to the supreme court. the mayor said any statement by him is irrelevant. a leader call that a cop out. >> he comes to these events, even after coming to the events as many times as he has, he still doesn't see us as equal

citizens. he is the mayor of san jose and has a responsibility to up hold the constitution. >> no, i don't think it is important for me to make a statement. my personal beliefs won't determine the outcome of case. if it's a civil right and is decided by the courts those are the people who are paid to make the decisions and the federal decision the courts get the last word. >> now he said the city will support whatever decision comes from the court. one other issue is adding tension, some criticized the mayor but believe the issue was brought up today to try to influence the election. >> supporters of home care rallied in sacramento today to fight against cuts. members of the service employees international union set up a tent at the state capitol. they are asking lawmakers to reject the governor's proposal to cut funding by $225 million

for inhome supportive services. they have until june 15th to vote. general hospital celebrated a major milestone in its rebuilding project. the final steel beam was put into place bearing the signatures of hundreds. it'll also increase the number of bed from 27 to 60 and up to 120 in the event of a disaster. >> that's really important because san san francisco general is the hub during a disaster. >> they say the building should be done in may of 2015 and licensed and ready to move in by the end of 2015. >> a man is under arrest tonight in connection with amuletly million dollar ponzi scheme. he used his company to steal 20

. a jury convicted a man of first degree murder for the stabbing death of his former lover. prosecutors say the 35-year-old stabbed and killed a man

outside the man's apartment in the diamond district in 2009. his attorneys wanted a conviction of involuntary manslaughter, they say he did it in the heat of passion and was under the influence of alcohol and drugs at the time. >> tonight five states holding primaries including california. ken wayne is at the big board now with the latest returns across the country. >> reporter: we are getting the raw numbers in right now. let's take a look at the map. these are the five state that are having primaries today including california where the polls still open but we have results in from new jersey where the polls are closed and here is how things look. of course romney is the gop nominee and he has 82% of the vote. santorum who dropped out has 5%, gingrich has 3%, ron paul who is still technically in the race has 10%. the polls in south dakota

just closed about 15 minutes ago. the results are in so far there. romney with 64%, santorum 13%. gingrich 4%, ron paul something of a spoiler has 13% of the vote at this point. then we want to go to montana, where the polls are still open actually. let's see if there are numbers there right now. no we don't have them. i wanted to go to new mexico, still learning new technology. romney the results, 79% of the vote there, that's where the polls closed a short time ago. santorum has 8%, gingrich has 4%, ron paul has 9% will in new mexico. we are also watching wisconsin, this is a very, very close race. no official results are in from wisconsin. we can show you? pictures of the voting going on there. that is republican governor scott walker, the tar get of a

the suspensions wouldn't be lifted but the transcripts would be put on hold until they were able to make up any tests they have missed so far until a hearing is held next week. as you they were suspended after a prank went bad and led to vandalism. >> initially they were suspended five-days but this morning the school district relented and let them serve their suspension on campus and take finals tomorrow and thursday and if the teach he is agree they will be allowed to retake missed finals. however, they will not be able to take part in graduation on saturday. >> what is it to teach us that all the people that are hiding and didn't come forward and is lying about it they get to walk but the people that were honest and truthful to the whole situation didn't get to walk. that's not teaching us a lesson, that's teaching us to lie. >> i don't think that the
