witnesses said the white suv was speeding when it killed two people on their bike. now police have made their decision about the teenage driver. good evening everyone i'm frank somerville. >> and i'm julie haener. police in concord are now recommending charges of vehicle manslaughter against the 17- year-old driver. the teen was behind the wheel of an suv that hit and killed a father and daughter riding their bikes two months ago today. it's a new development we first reported this afternoon on ktvu.com. ktvu's eric rasmussen is live now in concord where he met

with the attorney for the victim's family, eric. >> reporter: julie, the family attorney wants this 17-year-old driver charged as an adult for the crash that killed a father and daughter right back here in this sidewalk. that's up to prosecutors today we spotteded the young driver back on the road. -- spotted the young driver back on the road, this time as a passenger. the 17-year-old at the center of a two month police investigation ducked behind a car then got in the passenger side of a cadillac escalade. it's a similar year and model to the white suv he was driving on tree boulevard in april when he crashed into three family members riding their bikes on the sidewalk killing 41-year- old solei murray and his 9-year- old daughter hedessa. before they drove off today we tried to talk to the teen and the woman that was with him. >> i just wanted to see if anybody wanted to say something. >> reporter: now the young

driver may have to answer to authorities. >> add a degree of negligence to that and it could be a higher degree. >> it's going to be sad if the district attorney of contra costa county treats this as a juvenile case. >> reporter: but attorney for the victim's family michael cardosa wants the family with him. >> the family thought enough of him to put him in a heavy vehicle and on the street. and he drove the way he drove, that's an adult crime and it should be prosecuted as a adult crime. >> reporter: the juvenile division told me this case still has to be looked over and there's no time line on deciding what charges will be filed. in five minutes an elderly woman struck and killed by a bicyclist. what we learned about her and the intersection where it happened. a new attorney is taking

over the case of the man accused of kidnapping and killing sierra lamar from morgan hill. mandel is leaving the case sighting an unspecified conflict of interest. torrez next court appearance has been postponed to july 21st. the family of a 15-year-old who was shot and killed in south san francisco earlier this week has now hired a well known defense attorney and he and the family says they want some answers. new informations tonight, amber lee is at the location where all of this happened with what she's been able to learn, amber. >> reporter: frank, we're at the gas station where the 15- year-old boy was shot and killed by police. family and friends wrote these messages for the boy they said had struggles but didn't deserve what happened to him. emotionals ran high as these teenagers told us they're trying to come to terms with

the death of their friend derek daine. one of the teenagers tell us that many teenagers often get -- >> reporter: officers say gayne pulled out a gun while the other teenager complied. officers shot gayne. >> reporter: john burres told us he's been hired by gaynes family because they question the death of their son. >> they want to know if he was profiled and what justifies the shooting of him. >> reporter: friends and family packed up items from a memorial at the request of gas station owners. >> nobody knows the whole story. i just wish they would tell us

everything exactly what's going on. >> reporter: a worker here at the gas station told gaynes was a familiar face in this area and that he never caused any problems. attorney burress told us his job is to try to get to the bottom of what happens before the gaynes family decides what to do next. reporting live here in san francisco, amber lee, ktvu channel 2 news. at 10:30 tonight, the question excessive force after a string of police involved shootings in the last week. and workers end a four day strike at a airport hotel. the workers have been picketing outside the double tree hotel on gateway place about 250 cooks, dish washers, bellhops and maids all walked off the job on monday. they're fighting a proposed wage freeze and health contribution.

the walk out came as a surprise to the hotel. workers could be paid millions of the dollars in back pay. the ruling in alameda county superior court involves 18,000 engineers and scientists. the workers had argued that the furloughs were illegal and did not actually save the state money. an exclusive ktvu field poll shows that governor brown's approval is falling. the latest rating shows 40% now disagree with his job performance with 34% that approve of what he's doing. governor brown wasn't too popular at this rally outside the capital today. home health care workers are trying to convince him not to move forward with a 7% cut in services. one woman said she used to be a health care worker and now she needs one. and says any cuts in service will be painful.

>> my work is going to have to find another place to work, that's going to leave my hanging and it causes a domino effect. >> inside state senators are working on the budget that's due next friday. san francisco state senator mark leno says the passage of governor's tax hike is crucial to saving education. more details now, our ktvu field poll shows bleaker numbers when it comes to the legislature. just 19% of those surveyed said they approve of the job state lawmakers are doing. 64% disapprove. the state legislature hasn't had an approval rating above 80% since 1988. the unemployment picture brightened with the latest picture from labor numbers. applications dropped by 12,000. jobless claims also fell slightly. on wall street the dow finished

with a 46 point gain after being up as much as 124,000. the shares dropped after ben bernanke said spending is holding back the economy. >> notably households and business still appear quite cautious about the economy. >> reporter: bernanke offered no immediate action to fuel the economy. the fed chairman also told the economy in congress the european economic crisis still poses risk to the u.s. financial system and needs to be monitored very closely. in 15 minutes one bay area city that appears to be bucking the trend and seeing a bit of a boom in business right now. a 92-year-old grandmother hit and killed by a bike rider in el cerrito. she was on her daily walk on a marked crosswalk on bruster. neighbors say that intersection is a dangerous one. she came to el cerr to the --

cerrito in 1950. raised her children, formed friends ships. gene smith walked every day, avoiding speeding cars and bicyclists. all the while staying active, saying hello. >> i would be working my yard, she would come in and talk to me, ask what i was working on. >> reporter: 5:30 last night, gene smith slowly made her way down the street. at the same time 400 feet away police say a bicyclists was headed downhill north on arlington. it wasn't until the bicyclists was 100 feet out that he saw smith crossing the street, less than 10 seconds later, impact. >> we saw a bicycle lying flat on it sight. >> reporter: sergeant maples says that smith died at the hospital. the bicyclists suffered nonlife threatening injuries and should

new at 10:00, the fbi and department of justice say two bay area man are guilty of conspiracy for rigging bids at auctions of foreclosed homes. jana katsuyama live in oakland tonight and tells us the fraud was widespread. >> reporter: that's right, the u.s. attorney has actually filed the charges here at the federal building in oakland and it turns out this goes far beyond those two men. there are among two dozen people the investigation found cheating, homeowners and lenders right here in the bay

area. felony charges filed in oakland named two investors, keith slipper and douglas ditmer. since the housing crash, auctions like this one have been held throughout the country. the men created fraud between june 2007 and january 2011. the conspirators agreed to pay off and cheated homeowners out of fair market prices. the two men are among people who have agreed to testify. >> there are people who are taking advantage of homeowners and now lenders. >> reporter: oakland real estate attorney says one problem with the foreclosure boom is that the auctions are not well regulated. >> where's the oversite? to determine who these bidders are and what their relationship

is. i wouldn't be surprised if it's not happening far more often. it's just these people probably did it so aggressively that they got caught. >> reporter: this is part of president oe what's what -- president obama's fraud stoppage task force. the east contra costa fire district says lay offs and station closures are expected. the fire district would have taken in about $100 million over the next 10 years if measure s had passed. now the district is considering its optioning including laying off 16 firefighters and closing three stations. just 44% of voters said yes to the parcel tax.

56% voted no. it also required 2/3 approval. lynn woolsey has picked someone to replace her. she has endorsed jared huffman. san jose police announced the arrest of a suspect in an apparently unprovoked attack. investigators say kevin dixon beat a man unconscious. dixon is now facing felony battery charges. he's currently being he'll without bail and is expected back in court tomorrow. the alameda county district attorney has declined to file charges against most of the protesters arrested last month at an occupy the farm demonstration in albany. charges will not be filed against seven of 10 protesters arrested for unlawful assembly and trespassing as uc berkeley's 10-acre track.

in a separate action, eight protesters are being sued by uc regents in an effort to ban them from trespassing or farming on that site. this was a pivotal day on the case of bryan stow. today for the first time a witness identified one of the men as stow's attacker. ktvu's christien kafton said that witness is the sister of one defendant and engaged to marry the other. >> marvin norwood is engaged to marry norene sanchez. she testified her brother spent much of the game harassing fans. >> he was rude, loud. >> when you say rude what do you mean by that? >> pretty much saying boo, boo giants. >> besides saying boo giants was he saying anything else?

>> [ bleep ] the giants >> reporter: she and her brother overheard a group of giants fans that she says were trash talking. she and her brother pursued the men, with norwood close behind. she was alarmed when the men told them to get them out of area. >> not until i actually seen blood on marvin's hand when we were just about exiting the stadium. >> reporter: eventually police arrested marvin norwood and sanchez. >> we got into a fight. i don't think it was with them, i really don't. >> i don't think so either. >> reporter: in the courtroom, prosecutors also played a tape of the two suspects in jail talking to each other. that tape was muffled and hard to understand but the judge said he would not release the

transcript because it could sway potential jurors. our coverage of the bryan stow case continues on ktvu.com. you will find more video and testimony from inside the courtroom. there is word tonight that a pending sexual harassment lawsuit involving a woman who used to work for the golden state warriors and monte ellis has been settled out of court. an attorney for erica smith would not confirm or deny the settlement but did say the case was dismissed which happens after a settlement. era smith claimed in her lawsuit that ellis had texted her a picture of his genitals it has a study shows that more people than you think are sending out explicit messages. 10% of people 55 and older have

traffic slowed in saulsalito today. a pipe broke at about 2:00 on bridgeway near harbor drive. crews temporarily capped the line but then had to shut off water service in the area about 5:00 this evening so they could work on a permanent fix. a well traveled road is closed tonight so pg & e can repair a natural gas line. two or three westbound lanes of ignacio road are set to remain closed until 6:00 tomorrow morning. one lane is open to accommodate traffic. pg & e says crews are fixing what it calls a nonhazardous leak. despite the weak economy it turns out there's one city in contra costa county that's seen a real economic boom. john sasaki tells us what sets pleasant hill apart from the

is facebook fading? a poll of 1,000 americans find interest is dwindling. many people say they find it boring in a response to

advertising on facebook is as dismal as it ipo. lloyd lacuesta is at menlo where he's been asking people about the poll. >> reporter: you can call it a thumbs down. we found a majority of people saying they have not cut back on using facebook but a few said they have a certain amount of facebook fatigue. >> takes up too much time. you can get started. i only go once a week maybe to check things here and there. >> i think facebook is something that's very trendy and i think people start to realize that it's not really as cool as it used to be or it's not really that new anymore. >> reporter: the poll by the reuters news agency says one out of three surveyed are spending less time on facebook than they did six months ago. and four out of five said they never bought a product or service advertised. >> people aren't on there to

shop. it's not like google or something where they are potentially looking to buy something or looking for a product. they're on there to communicate with their friends. >> if they put more ads there. i can see people dropping and going to google plus. >> reporter: facebook has 9 million users and reported $4 billion in sales last year. but last month general motors said it would stop paid advertising on facebook. >> advertisers once they realize they're not getting the value they're going to pull off and advertise some where else. that means the advertising is a risk. >> reporter: the poll points why the the market has not been good to the ipo. facebook has issued no comment. the poll does indicate that more than 50% of those surveyed have a favorable impression of

million. obama raised 60 million last month. in recent dates we have seen a flurry in officer involved shootings. the day before it was castro valley, and south san francisco. and there were two more in vallejo toward the end of next month. officers are trained to neutralize threats but all of these shootings are raising questions. >> reporter: a 15-year-old boy was shot and killed by an officer after he allegedly pulled out a gun. the same happened on tuesday when a suspect allegedly tried to shoot at an officer. the back to back shootings led to questions by family members and friends about whether officers are shooting first and asking questions later. >> they are trained to use

force depending on the threat level they perceive. there's been five officer involved shootings compared to five all year last year. >> year to date we have recovered 400 firearms so what we have is an epidemic in terms of the amount of guns that are out on the street. >> when you're looking down the barrel of somebody elses gun you have to use deadly force unfortunately. >> reporter: tony rob era er -- rib era says officers today are more aware there's more illegal guns on the street but he says that does not make them more likely to reach for their own. >> if they're pointing at you. when do you neutralize the threat. >> there's no waiting for a stand off or drop it or i will shoot. >> reporter: when they draw their gun, they're shooting to neutralize a threat. patti lee. we have more details on the person that was shot by oakland police last night.

today police identified him only as a 22-year-old from san leandro. he is currently hospitalized in stable condition. a second suspect was detained at the scene. a disabled man visiting san francisco from poland is asking for help after an especially adapted bicycle was stolen. the bicycle was locked in the entry of a home. someone broke in and took the bike from a stair way. the victim was riding in a cross country charity tour and unless that bike is recovered he says he'll have to finish the ride in a wheelchair. so she asks for nothing. all she does is give hugs. the woman known as the hugging saint is visiting right here in the bay area and she is attracting some huge crowds. and back here in just 10 minutes, your bay area weekend is here. one of the days is going to be significantly warmer than the other. i'll show you which one, i'll see you back here in a few minutes. new surveillance cameras coming to buses and trains. they'll stop suspicious activity electronically.

an armoured car and a passenger car collided today. it happened just before noon on deer valley road south of antioch. according to a sheriff's deputy it appears that the armoured car left the road, hit a telephone pole then swerved back across the road hitting the smaller car. the driver of the smaller car was hospitalized with nonlife threatening injuries. a new type of camera is causing a stir with nummi riders. images are going to be analyzed by software. humans can only watch a video surveillance screen for about 20 minutes before they start

fm is the latest radio station to have their accounts breeched. mountain view's linkedin is working to glean information's into yesterday's cyber attack. the company said a total of 6.5 million pass words were stolen and published online. linkedin has yesterday to say how the hackers accessed the pass words or what information was compromised. looks like the nuclear power plant will be shut all summer. repairs still aren't finished. state officials warned there could be rotating blackouts if there's a heat wave in san enofre remains shutdown. we have fog returning to

this. as you go into tomorrow morning. you see the fog working its way in. i don't think we're looking at fog in the livermore valley. by the afternoon the fog goes away but it hangs at the coast and that's where it will be saturday when the wind start to blow the other way and warm things off. fog right at the peninsula kind of where it was last night or this night. 60s out in golden state park. mid-60s as you head out toward the -- out toward livermore you're in the upper 70s. maybe some 80s. high pressure turns around and things start to get nice. it's pushing fog in tonight and that starts the cooling for tomorrow. that sea level gap is really what sets all the cooling up as the moisture sets in.
