this morning, the secretary announced new actions that my administration will take to mend our nation's immigration policy. and to make it more fair. more efficient, and more just. specifically for a certain time. >> it came in the past hour. the president's policy change to start changing illegal immigrants. that's one of the top stories. good afternoon, i'm claudine wong, in for tori campbell.

more on the president's announcement in just a moment. but first, developing news where a strange smell is coming from the east bay refinery. he joins us live with more on the source of that smell. john? >> i'm just outside the gates of what happened here. where i am now. i can tell you that there is no smell. i just got off the phone with the plant official who tells me that the leak may continue for at least another 24 hours. the wind is blowing northeast as you can see from the smoke there. and towards rodeo. as we showed you earlier today on chopper 2 this morning, it began at 7:00. the crews sprayed down the tank, that ruptured. right now they are trying to empty that million gallon tank.

we just spoke to the health officers. >> people could definitely feel nauseous from these odors as they can get headaches and they can have a stinging eye. and an odor like this, they could trigger their asthma or something. >> reporter: so they were also advising anyone with respiratory issues to leave the area of the smell and go up here towards san francisco. so far there are no reports of any serious injuries, even at the scene where the levels were reporting less than one half. we've gotten reports of stinging eyes and nausea from as far away across the delta. again, this is expected to continue and diminish into tomorrow afternoon. people with serious sensitivities are asked to leave, go up the windows, or stay indoors. i'll be staying on this incident and we'll have the very latest coming up at 5:00. reporting live in the health and science center, ktvu

channel 2 news. >> thank you, john. there was a great view for the people in the apartment complex this morning in the south bay. coming up in about 10 minutes, what caused it. had and this morning they announced a major change in the immigration policy, making it for the people in the u.s. no longer need to fear deportation. during the rose garden statement about an hour ago, the president said that the u.s., they will stop deporting and begin granting work permits. and the policy, they will affect the illegal immigrants that came to the u.s. as children and since lead the law- abiding laws. >> effective immediately. the department of homeland security is taking steps to lift up the shadow of deportation from these young people. they will be able to request temporary relief from deportation proceedings. >> reporter: the policy will

affect as many as 800,000 immigrants. protesters are upset with the obama administration and policies, which took over the campaign office in oakland. they join us live from oakland with how they are reacting to the announcement and how long they still plan to stay. tara? >> well, how long they plan to stay is unknown at this point. they are not going anywhere,est debt -- despite their announcement. they would not allow citizenship. but give work permits to the people you see here. staging a sit in. they won't leave because they made a pledge last year with regards to the great depressions, not following on through. president obama needs to help illegal immigrants creating minor offenses like the ones you see on the fliers. >> he needs to implement policies that will immediately

deliberate the people. we don't just want an announcement to acknowledge us. but we want the direct action through the policies. >> and the group says that since this is an election year that the president is trying to get the vote. but the congresswoman, the announcement is encouraging. >> that is a good first step. but again we need to pass the dream act. i hope that the senate will be able to pass it and hope that the republicans, they will allow that bill to pass the house. >> reporter: and it is part of the national effort to disrupt the offices from ohio to denver to l.a. now, the obama campaign staff will not show up here today. we're told they will allow the students to stay, but hired security to oversee the students. they are not allowing them to eat. and they will be inside. as we understand one of the gentlemans inside, they asked to go to the bathroom, which is in the hallway. when they went out to do that, security would not let them

back in. so it will be interesting to see how it develops. but these folks will be here to stay. we are live in oakland, ktvu channel 2 news. >> all right, thank you for the update. well, about 100 people held the immigration rally this morning in los angeles and they marched to a federal building in a show of support for changes to the immigration policy. many said that they will be happy today's announcement achieves the goal of the dream act. the immigration policy will apply to people that were born here or came to the u.s. under the age of 16. they must be 30 years old or younger now and they have lived in the u.s. continuously for at least five years. they must be in school or the high school graduate or served in the military. they also can't have a criminal history or be a threat to national security. well, flames gutted seven businesses early this morning in the strip mall, which broke out just before 1:00 this morning at the mall on

jefferson street. they flew over that area and took a look at the heavily damaged businesses. they are not surprised no one spotted the fire until it was burning well. >> it sits back and off the roadway, kind of back into the dark there, kind of towards the back of the complex. so it could be, you know, a pretty good head of steam going on through there, before someone would notice. >> one firefighter slipped and sprained his knee, but expected to be okay. still, no word on the cause where investigators can't go into the actual scene yet because the structure is too unstable. well, investigators are trying to find out the cause of the huge fire in oakland that lead to the transportation meltdown. we have a live look from west oakland and the scene of the fire. what happens next in the search for answers? >> reporter: well, they say that the feds will be here right now with the certified fire engineers and the senior

special agents. you can see the barricades, moving it up around the construction site and the security guards. they are all throughout this side here. all to preserve the scene. here at this point, agents from the bureau of the firearms, they are waiting for clearance from the structural engineer before stepping into the property. they say that the damage from the inferno is now in the millions. it is under the construction near the west oakland station was planned to be the senior apartment complex with 120 units of housing. that they reported being chased out by three men, right before the fire started early yesterday morning. because of the scope of the fire, the estimated amount of property damage and the impact the fire has on the community, that they will be taking over the investigation. providing federal resources to determine the cause and origin of the fire. >> we'll go on in for you and examine the area that we have the chemists. we can bring in the forensic mappers, where we have the fire

protection engineers. and the team could be up to 22 members. >> the special agent tells us that the technology is so precise that they could find a single wire in the multitude debris left behind. no word on when the engineers will arrive here. once they arrive and deem it safe for investigators, they will start work inside. reporting live in oakland, ktvu channel 2 news. >> all right, thank you. well, the investigation, while it continues, commuters were simply relieved to find bart running normally. the trains are on time. commuters are glad there are no repeat, forcing more than 110,000 people to find another way to get across the by bay. >> it's nice to see them work here. it's a little interesting to be able to cut the bridge here. it wasn't too bad. but that fire was just crazy. >> as a precaution, they inspected the tracks early this

morning. they wanted to make sure there were no lingering effects that knocked out power to the rail and shut down the services across the panhandlers too. a key vote today on the budget as the deadline approaches. the complaints coming from both sides of the aisle. and take a look outside. it's warm out there, it's just going to get hotter. the heave wave is on the way. we'll tell you how long to expect it to come up. and the weather will likely be perfect for the u.s. open all weekend long. we'll need to show you who qualifies first. we'll take a look at the leader boards.

leaders plan on meeting this afternoon on the future base. they plan to seek jobs in any of the redevelopment plan, which is set for 2:30 this archaism that will be in oakland. the president says to turn to their homes here in the apartment complex evacuated after the gas leak there. it all happened around 1:30 this afternoon. the van crashed and then moved off here, causing the big leak. they capped the leak just before 3:30 this morning and shortly after that, they were allowed to return to the home. but they could take a few more

hours to complete it for you. arresting two survivors of the deadly explosion last year where a third person died. the 22-year-old and the 23-year- old are both charged with murder and drug manufacturing. investigators say that in may of last year, they were using the liquid to make the oil when it exploded, killing the 35- year-old. police say that they acted with the disregard for the human life and that lead to their death. >> it is official, the huge fire here is now being investigated as an arson. they were there on wednesday, shortly after starting. and they are confirming that the fire was deliberately set, but they are not elaborating. the fire destroyed two units. no one was hurt, but eight of them were displaced. >> the overnight fire for you. that fire broke out around 11:00 last night on 98th avenue. firefighters had to break on into that home here despite the

flames. no one hurt had, but the cause is still under investigation. and a child playing with a candle appears to have set off the house fire. that started around 6:00 last night at the home on the court. now, one person living in the home was treated for smoke inhalation and the flames did cause the major damage. they still have not released that official cause, but the homeowner says that the son was playing with a candle while she was sleeping. and our time is running out for state lawmakers as they work against the constitutional deadline to pass a budget for the next fiscal year. democrats who control both houses are trying to work out a deal with governor brown. they want him to back off on the proposed cuts to welfare. in the meantime, they complain that they have not had enough time to review the plan they will be asked to vote on. >> they asked us to vote on something that we have not had an opportunity to read. >> and there are republicans, they got the bills. but that will be the main budget bills about 24 hours ago. >> the other sticking point.

they are all on how to distribute the money that need to go to the local community and the departments. the nation's hospitals today, they sent a letter to the white house, rejecting the compromise on birth control. the letter from the association said that mr. obama's proposal to have the cost instead of catholic institutions, they would be, "unduly cumbersome. that the government should either broaden the exemption for the religion employers or pay directly for the birth control coverage. and they will get to serve drinks past midnight. they decided to grant that to push back last call to 12:30. a few months ago, they set the 11:30 cut off time because of the series of fights at that bar. and the man at the top of the leader board is getting ready to tee off for the next hour at

some of the current numbers. mainly in the upper 60s to the 80s. right now it is 82 degrees in fairfield. currently checking in at 74. san francisco in the upper 60s and santa rosa in the mid-80s. right around 85 degrees. your forecast headlines for today, mostly sunny. we'll call it mild to warm this weekend and temperatures are peaking. as we head into saturday, we'll begin to cool things off by sunday. if you really want to cool it off, you might like your extended forecast with the fog making a huge comeback into next week. with that temperatures for today, they will be warmer. that means temperatures are inland, approaching the lower 90s this afternoon. and the biggest deal, that's set for tomorrow for the first half of your weekend, the strong high pressure will return, generating the warm offshore flow. with that you can see the temperature ranging from the upper 70s with the coastline. the warmest locations will be inland. reaching the triple digits. right around 100 degrees to 102 well inland.

that's for saturday and with that, the high fire danger, which is a red flag warning not in place right now. but it will begin this evening, lasting until 9:00 this saturday morning for the north bay hills where you could have the winds gusting to 40 miles an hour around the peaks and dropping the humidity levels. there is a big chance that it could be expanded to the cloud -- to include the east bay hills and expanded more into saturday afternoon as you'll be watching out for that. basically clear skies with the forecast models as you can see tomorrow afternoon, the bright red contour that links on up. and the warmest locations tomorrow, right around 100 degrees. your forecast highs for this afternoon, san francisco at 71. san jose, 83. san mateo, 89 and santa cruz is just -- cruz is just beautiful with your five-day forecast always in had view and it will be a hot one for saturday as you can see the temperatures are ranging from the 70s to the beaches. no fog for you and then the inland spots are right around 100 degrees. if you want to cool things off, you might be embracing the fog,

especially as you head into monday and tuesday and more cooling expected. basically a one-day deal. it won't be an extended three- day deal, but still warm enough. >> i do like how it is still in the 80s. >> exactly. we're not talking about 20 degrees or anything like that. >> all right. it looks good. thank you. the city is playing hardball with the san jose giants. they have been playing at the stadium for years. the major league stars like these have played for them in the past, but the mercury news is reporting that the city leaders would like to take on the team's lead, which is subsidized by the city. the giants will pay $1,000 a month in rent and the team is represented by the proxy group, which is suing the city to block their efforts on building a new stadium to bring in the oakland a's. today is the day that they will be racing on into disney land's california adventures. pixar's cars has come alive at california adventures with the jump start of a battery.

all right, let's take a look at your numbers and yes, things are looking good. the dow is up 91 points and investors seem to be feeling pretty good because of the nasdaq, they are also up. they are hoping for a big stimulus. google is investing in the schools in their own backyard. google is donating about $1 million to the mountain view

wisdom school district, which matches the largest donation in district history. in had some case, google of last year. now, the money will be spent on helping teachers identify which students have mastered a subject and which still need help. well, federal funding delays could increase the cost of san francisco's central subway. elected officials have said that the federal government, they would pick up. $942 million of the total cost. less than 14% has been sent to the project and sending e- mails, indicating local leaders are worried that if they don't arrive by september, the delay could add as much as $4 million a month to project costs. and the suspected car thief will be facing charges after the high-speed chase ended in gunfire in vallejo. the officers say they spotted a stolen car and tried to stop the driver, but they took off. but the chase ended in vallejo at the connector ramp of interstate 80 and interstate 80

here. the man tried to ram them with their car. and so they opened fire. the suspect was not shot, but they were injured by the flying debris. well tonight, the 7th generation circus performer will be going to walk a tight rope across niagra falls. they say that he is not worried. there is a tight rope going right across the screen there. he said that he has been preparing for the walk of the lifetime since he was just six years old. he is going to begin in the exist then get on the tight rope for you and walk about 1,800 feet, ending up in canada, 30 minutes later. but the tight rope, they will be roughly the size of your wrist and it is 20 stories up. but for the first time, he has agreed to be attached to the wire to prevent people from seeing him fall. and that's if tragedy should strike. today on ktvu channel 2 news, investigators are near the big fire at the bart station. which snarled the morning commute. are they any closer to pinning
