school trying to build support. parents say they will spend their fourth night here and a rally just ended. parents and teachers are protesting the closure of this school and four others in the district. at 3:00 p.m. this afternoon a dozen police officers came to tour the building after a security alarm had gone off. >> you are here and they are here to make sure, you know, no one is hurt. anything like that. >> reporter: police say they are not going to remun the encampment. they say they will leave only when they reverse their decision to close the schools. >> this is power to the peaceful. we want to show our children how to stand up for what is in the best interest of the community. >> reporter: at this point it

is unclear if police will return later. a negotiator has been brought in. the last thing they want is a violent confrontation. rob roth, ktvu channel 2 news. right now we are following a developing story in the east bay, a accident caused a traffic problem for folks heading towards walnut creak on highway 24. a big rig over turned on 24 just east of the tunnel. happened a few minutes after 4:00 this afternoon and the result is it is blocking two lanes. officers expect the big rig will be cleared about 6:45. no word on how it flipped over but as you can see here, it is causing a backup right now for folks heading through the tunnel.

school district officials say 51 students who were suspended this month for a prank will now be allowed to take their finals and graduation. they were suspended afterimaters at heritage high school decided the prank went too far. the students who took part were banned from graduation ceremonies. word of a rescue at china camp state park. witnesses say a husband and wife were mountain biking when the woman crash and fell 100 feet. it took half an hour for firefighters to reach the woman. a helicopter plucked her out and flew her to an ambulance. she suffered minor injuries. the family of a bicyclist is suing a website they say encourages dangerous and deadly competition. ktvu's alex savage is live with

the change they are seeking. alex? >> reporter: this is the lawsuit filed today. it is a website where they post their ride times. but after a deadly bike accident one family wants the website held responsibility. >> reporter: the father says they pushed his son to ride his bike dangerously fast and he says the company bears some responsibility for his son's death. we talked to him today after they filed the lawsuit. >> they provide the means, motivation and resources for encouraging bicyclists to race down dangerous streets, in populated areas. >> reporter: the family says she was trying to regain his record time when he was killed in the crash two years ago. he was going 40 miles per hour down this steep hill when he

had to avoid a car, hit the breaks and lost control. the family was motivated to sue after hearing this bicyclist was competing when investigators say he hit and killed a pedestrian this year. >> they cannot dare people to do reckless things. >> reporter: this attorney admits bicyclists need to ride responsibly. >> is our client's son absolutely innocent? we are not saying that but they have to change their ways. >> reporter: a spokesman said based on the facts involved in the accident pthe law there is no -- accident and the law there is no merit. this lawsuit is not seeking a specific amount in terms of damages. we are live tonight, alex savage, ktvu channel 2 news.

developing news where a landfill worker suffered traumatic injuries this afternoon. a working was hit by a front end loader. she was rushed to the hospital. no word on her condition. the facility was injury free for six years till today. >> we are very proud of our safety record. our employees hold themselves to a high standard. safety comes first. for two to be involved is sobering for all of us. the employee who is in the hospital is in everyone's thoughts. >> cal-osha are at the facility investigating what happened. a man is under arrest after he burglarized a home this morning. police say a resident woke up to find a man in his living

room. the man ran away but police found him. he was arrested. police say nothing was stolen from the home. a court in san francisco over turned a judge's order to release a defendant on the condition that he write book reports. he was arrested in march. he was ordered to read every day and spend 30 minutes every day writing reports. a court over turned the ruling. lamakers in -- lawmakers will consider whether to give laid off teachers more leeway in unemployment benefits. they are expected to take up the bill on wednesday. a former bay area sports radio talk show host filed suit

against knbr. he was fired in april after 25 years on the air. he is suing the station and the owner for $10 million. the suit claims he was fired after the station found out he had parkinson's disease and type 2 diabetes. the wife of suspended san francisco sheriff ross mirkarimi won't have to return for two more months. the judge gave her permission to stay in venezuela till august 19 august 19th. ross mirkarimi plans to travel to venezuela to visit his son. mayor ed lee suspended maces massachusetts after he pleaded guilty to false imprisonment. the san francisco ethics commission hearing begins tomorrow. lawmakers are working out the final details of the budget that they passed last week.

there are 22 trailer bills that still need to be passed. governor jerry brown wants more cuts but democrats are resisting cutting programs further. >> my preference would be we don't touch cal works because we already made suts in this area. >> lawmakers hope to get the complete budget plan by june 30. stock in apple jumped today after the company would set a new record for annual profits. they said we believe apple is poised to make the highest net income ever. the report sent stock up 11 points to chose at $586. oracle released its earnings

la vega is live in san jose with the one thing that has impacted gas prices. >> reporter: there are three gas stations and all are selling for under $4 a gallon. at this arco station, a gallon for $3.81 a gallon. that is a big drop from a month ago and other stations, it is even lower. >> reporter: filling up isn't as painful as it was a month ago. she noticed the drop. >> it costs $80 right now, before it was over $100. >> reporter: the average cost of unleaded in san jose is $4.01 a gallon. that is 14 cents less than san francisco. we found the price of $3.62 at this gas and shop in san jose.

there were a line of cars waiting to fill up there. >> i noticed in the gas stations where i live at they are too high so i come here for $3.65. >> reporter: this fire in february at a bp refinery drove up prices because there was concern over fuel prices. >> now that it has returned to production supply is building and it is alleviating the high prices. >> reporter: across the state the average price has gone down 9-12 cents a gallon. she hopes it stays that way. >> my husband is the only one working and i have a part time job. every little bit counts. >> reporter: unless the major issues -- they expect the prices to stay in the upper $3 range for the summer. janine de la vega, ktvu channel

move across the bay. lafayette low 80s and temperatures tick up towards the central valley, you will see low 90s. most of us tomorrow mid-70s and low 80s. warmer than today but nothing like they were on saturday. which we were incredibly warm. clear lake 90 degrees. 89 fairfield. 78 vallejo. around the bay 70. milder and cooler. the forecast in the valley, 84 in san jose. good air quality. i stress that because after the weather saturday, you get a couple days like that, you get bad air quality. that really didn't happened. we got the clean atmosphere with us all week and a lower fire danger. >> sounds good.
