of the fires could have been a lot worse. let's go to bill martin with how the conditions are affecting firefighting. >> this day wasn't saturday when we had the red flag warning. fire conditions this time of year are high but this particular day the winds aren't aren't that strong, and the humidity not that low. you can see the heat in the central valley. there are the 90s. most of us in the 70's. wnw is a west wind. west northwest. it's blowing moist cool air on shore. firefighters had a bit of a helping hand from nature. the current temperatures, fairfield at 91, san rafael, if this was 48 hours ago or beyond when it was very hot and the red flag warning it would be another story. here is the deal. this just shows where we are. we are in the dry summer part of it it. we are heading for fire season. when the winds come up and the temperatures come up on a day

like today we would have had real problems. fortunately the weather cooperated. when i come back we will talk about a bit of a warm up and a cooldown. >> a frightening situation today after a boat with three people on board exploded on the river near antioch and alex is here now with dramatic pictures. he says how the three were all able to make it back to shore. >> reporter: the owner grabbed several life jackets before they jumped into the water and swam safely to shore this afternoon. that empty boat, carrying 200 gallons of fuel floated in to the shoreline. this 30-foot long yacht exploded into a fire ball this afternoon on the river. even set fire to part of the pier as well. we got these photographs taken just after the flames broke out. the owner wayne carroll was

taking two people for a test drive when it burst into flame. >> it's just a boat. who cares. i'm happy. . >> reporter: he said the boat was having engine trouble so he was heading back to shore when there was an explosion in the motor. everybody abandoned ship and he remembered to grab three life jackets before jumping off. >> it's a lucky day. he -- though he refused medical treatment he had his hair was singed and he had a close encounter with fire. >> reporter: while it was still on fire it hit the pylons, caught them on fire. the sheriff's department moved in quickly to make sure they could tow the boat out before it floated into it that restaurant. they took it into open water where they put out the flames. the yacht burned down to the waterline and eventually sank. now that burned out yacht is down at the bottom of the river out in that direction and investigators say the owner will be responsible for

recovering it. in the meantime all three on board shaken today but everybody expected to be okay. we are live in antioch. >> if you see flames and smoke this week in the hills near dublin it's the yearly controlled burn at camp parks. we flew over the area today while crews burned dry grass. that is set to take place through friday. it's interned to reduce fire hazards. in our next half hour the fire season is already creating a fiery political debate. why the government is facing criticism for its response. >> now information tonight on the investigation into the oakland fire that shut down bart and caused a traffic night mare. today agents met at the burn site. experts will join the agents tomorrow morning to help determine what caused the fire. you will remember early last thursday a center under

construction went up in flames. it forces people to find other ways to travel. we are just minutes from an ethics hearing focusing on the suspended sheriff's actions involving his wife. david stevens is live in the city and -- rob roth and he and the mayor have already been trading barbs. >> reporter: the commission hearing is about to start at any time at city hall. we are being told that while the two will be called to testify, it probably won't happen this evening. the suspended sheriff had hard words for the mayor and others trying to remove him. >> the mayor is throwing whatever they can against the wall, piling on a huge amount of smear. >> i consider this to be a very serious matter and i don't use smear tactics. >> reporter: we spoke to reporters after addressing the board of supervisors.

the mayor said he is prepared to testify and explain why he this the suspended sheriff should be removed. >> as one of the top law enforcement officials for the city he shouldn't have engaged in beating his wife. >> reporter: he pled guilty to falsely imprisoning his wife in a case where he admits he grabbed her arm in anger. earlier today he appeared briefly in court to give the judge a progress report on communities and counseling. he said he plans to visit his son but is focused on trying to get his job back. >> i can be still the kind of sheriff the people of san francisco voted me into being that i'm democraticly elected. >> reporter: the commission plans to hold three hearings over the next two weeks.

much of today could center on various legal matters involving stat mints different witnesses. they don't make the ultimate decision on his future. that is up to the board of supervisors. reporting live. rob roth. >> investigators are trying to solve a mystery tonight after someone found a body that may have been weighted down in the oakland estuary. >> police found what appeared to be feet from a person out of the top of the water here. >> reporter: the body was head down about five feet from a pier. police say it appeared to have been in the water for several days and witnesses said they saw weights attached to the body. they say they have seen a red car parked near the pier for three days. investigators are interviewing people on boats in the area and the coroner is working to try to identity the body. a sheriff's boating unit today made a sweep of a south bay reservoir searching for

sierra lamar. they have searched it already looking for any sign the missing teen but for the first time they are using advanced new technology. that equipment picks out rocks, tree trunks, even shadows and creates a 3d image. >> once we do that we will come back with the full team and dive. not that they didn't have faith in the old equipment, they just want to be 100% sure. >> reporter: once the sheriff's team completes the sweep they will head to another reservoir to continue with the search. >> a south bay child molestation suspect facing possible life in jail made his first court appearance today. robbered honda live in san jose with why prosecutors say there are likely more victims. >> reporter: we are at one of the places where he worked and where the da's office said he found one of his victims. today he was in court to face charges connected to his

actions while working with at risk children. it was business as usual today at the achieve kids facility in san jose, a facility for the disabled. the santa clara da said 33-year- old waking bailey sexually assaulted an 18-year-old student. today he was charged with molesting two young girls in his care while employed at a similar facility. one accused him of molesting her over several years starting in 2009. he was ordered held without bail. the prosecutor said he targeted the most at risk victims and believe will are more. >> given the nature of his employment. he had access to many disabled children, disadvantaged youth. we hope anyone with information will share it. >> reporter: his former mother- in-law said the charges made up. >> he would never mess with no kids. he would never mess with no

kids. >> reporter: why do you think this happened? >> they trying to make an example. >> reporter: a woman said that the da and police are framing him. >> they have no proof, no evidence of anything. they are just coming up with stuff, going after these random at risk kids, trying to get them to admit to something that he hasn't done. >> reporter: bailey returns to court in a week to give a plea. at six we will look at how he was able to work even after allegations were made public three years ago. live in san jose. >> a former san jose police officerra set to be sentenced tomorrow after being convicted of sex acts with two teen boyes. he plead no contest. he was a campus officer at a high school. he met the boys on the internet. he faces four years in jail and will be required to register as a sex offender. >> the wife jersey sandusky

took the stand today in her husband's child molest indication case. she testified in her husband's defense. she said she never saw or suspected any inappropriate behavior. a long time friend also testified today as a character witness. >> think a lot of the kids were crazy about jerry. >> why would they say this? >> dollar signs. i don't know. >> reporter: sandusky is being tried on 51 counts of abusing ten boys. if convicted he faces the possibility of life in jail. tomorrow a judge is expected to issue a decision involving the seniors accused of carrying out a prank in heritage high school. it led to 50 being suspended banned from graduation. they put a lamb to a post and ran around the campus with their feet covered in washable

paint. some parents say the school's measures went to far. a judge is expected to decide if they will take back the suspensions or at least seal the records of them it. >> reports out of the middle east about the health of the former egyptian president. a statement is reporting he is clinically dead but a member of the council of the armed forces said that's not true. he said he is in critical condition after having a heart attack and stroke today ate prison hospital. he was sentenced to life earlier this month for failing to stop the killing of protesters during last year's up rising. officials have reported his health was going down. >> i don't want to believe it happened. >> the family of a woman killed in a horrible accident at a bay area dump shares their memories. this as we learn more about the driver of the truck involved. >> and who was behind the wheel when this car landed in that it swimming pool and why the police are involved.

. a worker at a waste management plant run over and killed by heavy machinery. we are in san leandro with what she has learned about the victim and what happened. >> reporter: frank we are told the mood here at the facility is somber. some of the people witnessed the accident that happened inside and there was a lot of tears and grief counselors on site to help everybody cope with the loss. >> it's hard to take in because of how it happened. it's still like surreal. i kind of don't want to believe it happened. >> reporter: she and her sister are still in shock that their mother is gone. she was 66 years old and a very active woman who loved traveling and going to the gym. her daughters say she loved her job as a traffic director at

the waste management facility. >> always very careful. very smart, very smart. >> reporter: yesterday afternoon she was directing traffic when the driver of a front end loader hit her. the driver said he didn't see her. she was taken to the hospital where she died later this night. cameras captured video of the incident. an investigation is being done. >> it's a loss we all feel and something that with are touched by and we send out our sympathies to her family and hope that we can do anything we can. >> reporter: a waste management spokesperson said the driver has worked there for 22 years and has a clean record. the agency said only 22 people work in the division and it's a very tight knit group aware of safety on the job. the daughters are waiting for answers. >> we don't know all the details so i don't want just to

assume. i have to get all the details first. >> reporter: she leaves her husband of 40 years, two daughters and five grandchildren. reporting live, ktvu channel 2news. >> water service has been restored to a neighborhood after a water main break. the six inch waterline broke around 10:30 last night. its right in the middle of the condo complex. it cut off water to 20 homes. we just spoke to east bay mud and service has been restored to all the homes. the police and fire departments put out sandbags and no homes reported damage. a 23-year-old woman is fighting for her life after her car went through a fence and into a pool. it happened north of san diego. investigators say the woman's 33-year-old boyfriend was driving at a high rate of speed when he lost control of the

car. the driver was able to escape but his girlfriend was trapped. a neighbor dove into the pool and pulled her out. one resident said the driver said he was traveling at speeds of up to 90 miles an hour. >> we have always thought that some day this could happen because of the -- they call it the roller coaster road. kids in high school and everything and that's when the driver called it. >> reporter: police took the driver in for questioning. >> in the central valley a tank explosion today killed one person and left another with severe burns. they were both working on a gas tank in the city of arvin in kern county. they thought it was empty and may have been welding part of it. according to witnesses the blast blew the tank 30 feet into the air and launched one of the men even higher. berkeley now adopted an aggressive plan aimed at eliminating its use of all nonrepsychable waste. they are trying to cut down on

their use of plastic waste. as part of the project berkeley plans to figure out how much plastic waste it produces, where it goes and how they can eliminate it. the university hopes to eliminate all it by 2020. >> san pablo has closed a budget deficit balanced it's budget for the fiscal year. the new budget is based on midterm adjustments which include one million dollars in additional revenue from casinos to total about 13.5 million. other midterm adjustments include $270,000 of utility user tax that has gone uncollected on water bills. they also factor in the layoffs of three public works maintenance employees to save about $357,000 a year. >> we have talked about the fire in napa and diablo.

>> it's fire season but we have a weather pattern as shone by today. this really not a bad, bad fire danger situation. we will see a bit of a on shore flow, more fog and low clouds and mild temperatures with higher humidity. again that doesn't mean no fire danger, but it does give us a bit of a break compared to saturday. even sunday was pretty hot inland. outside we have the big winds and they are blowing on shore and we have the nice cool pattern. asset heat is just about that line. you get to sacramento there is the low 90's but around are the bay lots of 80s. a couple low 90's but just a much -- could be much warmer into the summer solstice. you expect very high temperatures. that is what we saw saturday. the cooler pattern will continue in to the extended forecast. that means i don't think we will see many 90's. i think today and tomorrow probably the warmest days of the week and then temperatures will trend down.

patchy fog. right now its clearing the coast. fog again tomorrow morning, patchy and then temperatures tomorrow will end up like this. mostly in the mid50s and upper 50s. forecast as we go through tomorrow is going to be for sometime to show up right here. there is fog along the coast. that's 7:00 a.m. tomorrow morning. then it goes away. so it's a nice beach day at the coast. the 90's tomorrow in the central valley. we will still see 90's around the bay but mostly lots of 70's and 80s. tomorrow very similar day to what we had today. as you move through bay area micro climates, upper 70's, low 80's into the valley and san jose. it's not bad with this it weather pattern. out toward pleasanton temperatures start to cap out in the upper 80's and low 90s. not unusual for this time of year. through time it tomorrow themselves inland will be on

. more on developing news, where a two alarm house fire drew a quick response from crew we sent ken wayne and he is live there now. >> things looking much better right now. we are on mount diablo scenic highway. the highway patrol is posted here to keep people out of the area because it's a very narrow road and firefighters are still working back there.

this fire started about 3:00 this afternoon in an unoccupied home. there are about three rental properties and the fire started in one of the buildings and spread to neighboring grass land. we talked to a neighbor just a hundred yards from where the fire started and he said he heard a popping noise and then saw the flames. >> i was in my office which overlooks the canyon and i heard a noise, looked out and there was a ball of flame over the house. >> reporter: what kind of noise? >> sort of a pop. it was just sort of a -- >> reporter: you heard a pop and then saw a big fire ball? >> it was a fire ball. it was not a w isp that developed, it was a immediate fire ball. >> three houses on that property. one of them is a complete loss, the other two intact. about two acres of wild land

burned. >> reporter: about 50 firefighters immediately responded to the fire along with cal fire air craft. they put a lot of resource on this right away to try to keep it from spreading into the wild land area that is next to it the neighborhood. the cause of the fire is still under investigation but fire crews will be out all night long to make sure from thereare no hot spots. they don't want it to flare up. you can see we have another fire truck that is leaving the scene but from thereare some crew that will remain here into the evening, possibly all night long to make sure this fire is completely out so that it doesn't rekindl tomorrow, another hot day. you can see i'm sweating, standing here. so it's warm out here. we have wind earlier this afternoon but this fire is out. that's a good news. live in diablo. >> now to oakland where the city is on the verge of gaining or losing the best proposal so

the protest ers are trespassing and could be removed if they don't leave. they say they will continue with their plan to close five schools to better use resources after enrollment went down. >> we have 101 schools which is twice as many as a district this size. we needed to close them to free up resources, we were spread to thin and needed to invest more in a smaller number of sites. >> it doesn't make sense considering that every start of the school year the classes always over full there. is always another second or third grade. every year that has been the case. >> reporter: daniel said it's sad he may have taken his last class here, today he was holding up a a sign. not so fast say some of the parents and community organizers, they are promising to stay here until the district changes its mind.

. recalling 250 suitcase after they were found to have high levels of chemicals linked to cancer. they were found on the handles of the suitcases. the maker said a test showed they pose no health hazard and the recall is to address consumer concerns. the compounds are normally found in plastics, rubber and oil. >> the governor is jumping back into the long running battle over flame retardants in furniture. he wants them applied to products. he said studies suggest that the chemicals harm human health and the environment. another black eye for the secret service as new reports come out of wild partying by the agents on martha's

vineyard. it was just a few months ago that the service got in a scandal. now the secret service raising noise on martha's vineyard. they allegedly trashed rental homes and got into brawls. however a secret service spokesperson said the agency has received no complaints about agents behavior on the vineyard. >> the san jose city council voted to approve 8 5,000 dollars for maintenance of the stadium used by the giants farm team. the team is owned by the san francisco giants and today's decision comes despite the giants involvement in a lawsuit against the city which seeks to block an a's move to a proposed downtown ballpark. leaders plan to continue to look into how the team is involved in the lawsuit. they say it could affect if the city renews the team's operating agreement next year.

. firefighters are making good progress with what they call the old fire in san diego county. it's now 75% contained and

could be fully contained by later this evening. here is what else we know. cal fire is reporting 907 acres have burned. 200 construct ears in danger and evacuations in effect. that fire and others around the west are causing the debate in the capitol. the united states government is taking heat for how it's responded both now and in the past, particularly here in california. >> reporter: one united states congressman said the forest service should have done more to prevent this year's historic fires happening. back when southern california burned badly in the early 2,000's. the latest report tonight said more than 330,000 acres of new mexico have burned. 256 homes destroyed as the fire will continue to spread to the south. united states congressman steve pierce is making made lines saying the united states forest service didn't respond

properly. . . >> we are are burning down the forest, burning down people's homes, we have had deaths in colorado. these are significant management questions. >> reporter: the man in charge of the forest service disagrees. >> they were in on it right from the start and had crews on the ground and they were making good progress and then what happened? the winds started. >> reporter: he said then the fire got away. 800 acres in our state are burning too just 30% of that fire ask contained. the congressman said the forest service has been to slow to thin forest to prevent these types of fires in the first place. he said the agency was ordered to do so after the rash of fires in southern california in the early 2,000's. there seems to be agreement that the forest service is responding okay now.

there are 5800 firefighters onto ground fighting the fires, and 12 of the fires are uncontained. >> several bay area hospitals are praised for protecting the lights of gay patients and employees. washington dc based nonprofit human rights campaign foundation is honoring the hospitals. according to the foundation they are among 71 facilities nationwide with the highest levels of support for gay employees. >> the number of young people from the ages of 19 to 26 with medical insurance has jumped from 64 to 75%. a government survey said the increase of more than 3 million people is tied to one part of the health care overhaul. insurance companies now have to allow young adults to stay on

their parent's coverage. it's a provision that's popular. a court ruling on a challenge to that health care law is expected any time now. accord agoing to a new study people battling drug addiction with public health service are more likely to get treatment. the study looked at data and found those who get health care through public programs like medicare and medicaid are 90% more likely to get help. that is mostly because of increased out of pocket costs and the stigma for those with private insurance. >> the number of children in the hospital with high blood pressure has doubled in the past decade. researchers say not only are more children having it they say children cost more to treat and stay in the hospital longer. they found that the 3% of children have high blood pressure much of which is

obesity related. the c dc said a third of people from two to 19 are over weight. ? we have an important recall to tell you about. belaire lighting is recalling 100,000 outo door wall mount lanterns because of a dangerous wiring system. they made the announcement just today. a short in the wiring can cause the lanterns to catch fire, shock or burn. they were sold at low's from june 2006 through may of 2012. people should stop using them. >> let's talk more about the weather because it's absolutely beautiful out there. >> yeah. just about perfect and it's warm in the inland bay valleys but not as hot as it was over the weekend and we have cooler weather headed our way after tomorrow. as we go outside we have temperatures in the santa clara valley in the mid to low 80s. i have gusts to 17 miles an

hour, that's the authority wind. you are seeing something like this coming this direction. i have a westerly wind at the golden gate bridge and that's affecting cooler moisture and we have air quality not to bad. into tomorrow its almost a repeat of what we saw today. temperatures, same kind of fog foot print. fog in the morning, then rapid clearing. these were the highs and the highs tomorrow, they will be about the same. they are -- low 90s inland, lots of upper 70's and low 80s. that's the take away. the real cooling starts after tomorrow. as you move through the bay area micro climate we are further north. around berkeley in the mid-70s, lafayette in the mid80s. pittsburgh 87. clayton the 90's. that's where the heat is. after you get past the mountain, ono the back side of hamilton, north and east of -- the low 90s. that's tomorrow which is a lot
