found in a waterway near the oakland colyseum. ktvu's mike mibach joins us live now. what can you tell us, mike? >> reporter: homicide detectives have been called to the scene. we just confirmed that with a lieutenant with theoakland police department. we are on the 5900 block of paulsi am way. this is a pretty big ditch that goes to the oakland estuary. about 150 yards is where all the activity is seen. a couple of members of the media are down there, also the alameda county coroner's van just arrived. it was about 10:30 when police received a report reportedly from a passenger on an amtrak train that saw a body in this waterway. when officers arrived on scene, they, indeed, found that body. they believe the body had been here for about one week. they did not say if that body is a male or a female.

they also did not say it was a homicide investigation. they just wanted homicide detectives to come here and examine the scene. the crime tape is up. we are being kept about 50 yards from the actual scene. the body has not been removed. that lieutenant that i was talking to earlier said that this waterway to my left sometimes goes four to five feet deep. obviously that's not the case. that's when the tide comes in. they are still trying to figure out if the body has been dumped or floated in from the estuary. we'll try to determine more in the next few hours. reporting live here in oakland, mike mibach, ktvu channel 2 news. >> thank you, mike. the two men accused of beating giants fan brian stow were back in court this morning in los angeles and said they were not guilty.

new at noon, ktvu's christian paxon joins us live from l.a. to let us know about a change in the legal team for one of the spo 2:00 suspects. good afternoon, christian >> reporter: yes, we were here earlier today for the arraignment. you can see some jurors coming back from the lunch break. luis sanchez has been represented by gilbert quinones who stepped down. he told me earlier that he always planned to represent sanchez in the preliminary phase but when that went to court, he would step down. the first order of business was to get the public defender to represent sanchez. both men were wearing blue jump suit. assault and battery for the opening day 2011 beating of brian stow and the most serious charge, mayhem. >> both of you are charged in count 1 with the charge of

mayhem and violation. >> reporter: sanchez faces enhanced sentencing because prosecutors say he was the one who inflicted great bodily injury on stow leaving him with permanent brain damage. both men entered not guilty pleas today. they are scheduled to be back in court july 24th. a trial could start as early as august. if convicted, norwood could serve nine years in prison, sanchez 11. both men still face a federal charge of firearms charges. that case will take place after the criminal case here in l.a. county court. they would face another ten years on top of whatever they face for the beating of brian stow. we'll bring you the latest at 5:00. for now, we are live in los angeles. >> thank you, christian. stay with ktvu channel 2 news for continuing coverage of the brian stow case. we'll have more at 5:00 p.m.

and you can find the latest video on ktvu.com. the parents of a girl charged with killing a man are back in court. we have more on why this couple is getting so much support. >> reporter: good afternoon. i just stepped out of a news conference with paul gascone. the defendants pleaded not guilty. this happened in the visitation valley of san francisco and meat avenue near jennings court just after 2:00 in the morning on june 4th. lupe mercado and barry gilton have been charged with the murder of calvin sneed. both say that sneed forced

their daughter into prostitution. the district attorney says that they understand the parents' frustration if sneed were the pimp. however, the defense says they have had evidence that others who wanted to kill sneed. >> there were bullet fragments in him as a result of prior gang activity. >> there were other people with motive to kill mr. sneed. and the evidence produced so far does not prove that my clients are involved in this crime. >> we have evidence that the parents were in l.a., they actually attempted to kilt victim in l.a. there was a shooting there. >> reporter: the two will be back in court on monday in this case. i will tell you we will have more coming up tonight at 5:00 when ktvu's rob roth will continue the story. live in san francisco, i'm paul

chambers, ktvu channel 2 news. >> thank you, paul. oakland police are investigating a homicide. a victim with at least one gunshot wound was found around 1:30 this morning at mountain boulevard and joaquin miller road right near my way 13. it is believed that the victim is a woman. police have not released details of the homicide or the struck tim's identity. about 100 people are gathered at the san jose courthouse in support of a vietnamese activist. the protesters say that lee tong should be given leniency. they say he should not be sentenced for splaying a chemical sub sentence into the face of a ville napese singer. as can you see from news

chopper 2, firefighters poured water on a one-acre fire. a battalion chief says this is the third fire at a homeless camp in san jose in a month the cool, damp weather may have helped those firefighters this morning. the clouds are causing some arriving flights to be delayed an average of three hours and 41 minutes right now at sfo. ktvu's meteorologist rosemary orosco says that there could be some rain later. she is up with the details on the forecast for your neighborhood. oakland police spent the night pulling some marijuana plants at an east oakland home. they were discovered and an electrical fire broke out at a house in oakland. police hauled 300 marijuana plants as well as fans and lamps from inside the house. they say the plant have an estimated street value of $30,000. the illegal grow operation was

pulling so much electricity, it sparked the fire in the electrical box outside the house. >> i had the smoke thing and came out here and put out the fire because we thought everybody -- because the poles were on fire. i thought everybody was going to go up. >> reporter: police have made no arrest and have not released information about who owns the house. this weekend, work crews hope to reopen the sidewalk area at san francisco's pierre 29. a ktvu news crew went inside the building heavily damaged by wednesday's fire. the fire tore holes in the roof and collapsed part of a facade. investigator looking for the cause of a fire are checking on construction in the building a few hours before the fire started. the fire took out an electrical circuit that serves alcatraz tours on pier 31 and other businesses on pier 33. they are now running on generators. this is going to be a busy

weekend for an elite team federal investigators, investigating the huge fire next to the b.a.r.t. station. investigators hope to know by sunday or monday if it was arson or an accident. attorneys are being told to stay close to the courthouse as jurors continue deliberations in the jerry sandusky child sex abuse trial. it is day 2 of deliberations. jurors stayed until 9:30 last night considering the 48 charges against the former penn state assistant football coach. this morning, they revisited testimony from two key witnesses who gave different accounts of an alleged assault in a penn state shower. sandusky is accused of sexually abusing ten boys over a 15-year period. yesterday, after deliberations began, one of sandusky's own adopted children stepped forward and said he was also a

victim. san francisco's ethics committee has released some of suspended sheriff ross america mirkarimi's texts with his wife. one message, america rimy said, quote, i-america rimy said, i think we need to organize our side. he called the case, a witch hunt protesters are trying to draw attention to the closure of five elementary schools. for weeks, they have been holding a sit-in at lake view elementary. the district says it does not have the money to keep it open. but former teacher says the answer is simple for a district that owes $120 million to its creditors. >> the banks got bailed out 16
