instructions on hearsay evidence. >> can't discuss anything because of the gag order. we have a lot to say after. >> reporter: the jury will be going through the weekend. flames destroyed a house today in vallejo. the fire broke out this afternoon as the empty house quickly went to two alarms. when firefighters arrived the house was fully on fire. nobody was inside the house but neighbors say squatters had moved in and that a dog may have been trapped inside and killed in the fire. the cause of the fire is under investigation. the two men accused of beating a san francisco giant's fan appear before a judge today in los angeles and said they are not guilty. we were in the courtroom to tell you about the change coming to one of the suspect's legal team. >> reporter: that's right. louis sanchez had been represented by a private

attorney, today he stepped down. the prosecutors released this document laying out the charges, the men are facing. marvin norwood and louis sanchez entered court in blue uniforms. they were charged with assault, battery and mayhem for the beating of brian stowe. >> [inaudible] >> reporter: during the pretrial hearing that ended earlier this month sanchez had been represented by a private attorney. today he stepped aside saying he would only agree to represent him for the pretrial part. >> [inaudible] many. >> reporter: in that prosecutor has a chance to preview some of the evidence likely to come up including witnesses who say san chess was abusive toward giants fans during the game and that aggression escalated in the parking lot. they will play tapes of the

defendants in police custody. >> [inaudible] . >> reporter: both men will face trial here in convicted. sanchez faces 11 years, norwood9. both men face separate federal firearm charges. those cases could bring another ten years if they are convicted on those. we are live in los angeles. ktvu channel 2news. >> in oakland police are looking in to the death a woman who was found in the hills. it was found about 1:30 this morning at mountain boulevard. that's right next to highway 13. the unidentified woman had been shot at least once. police have not released information about a possible motive or suspect in that shooting. and at 5:30 a body found near the oakland coliseum. who first saw it and called

police. and in oakland police are looking for the owner of a home in east oakland where hundreds of marijuana plants were found after a electrical fire. broke out about 7:30. we were there as police brought out 300 marijuana plants as well as fans and lamps from inside the home. they say that the plants have a street value of $30,000. the illegal growing operation was pulling so much power that it sparked the fire in the electrical box outside the house. police haven't made arrests. >> the trial on lawsuits filed by the victims of the 2010 san bruno explosion have been delayed at the request of attorneys the judge moved the trial date from july 23rd to october 9th. lawyers say they have a lot of pretrial material to get through. hundreds of survivors have sued. several investigators say a weak weld and aging gas pipeline led to the leak that triggered the explosion.

the organizers of that sit in at a elementary school have scheduled a march for tomorrow to protest school closures. this morning they were holding a volunteer summer school at lakeview. one of five schools the school district has closed. they have been holding that sit in there for a week now. the district said it doesn't have the money to keep the schools open. former teacher said the district owes $120 million to its creditors and the answer is simple. >> stop paying the debt, the banks got bailed out. 16 trillon. we wrote wells fargo and said you got bailed out 50 billion. that's 500 times more than the oakland school debt. the bank should step up. >> the march is for tomorrow at noon. more details on the protest. the school district said the closures were necessary because of declining funds and

unrollment and by consolidating to a manageable size we can invest more in the remaining sites and offero richer programs and services for children. they said the district hopes to work out differences with those protesters. >> okay so a year ago today it was about 90 degrees in some parts of the bay area. today some of those same locations were in the mid60's. alex is at sear's point where nascar is in town and says why this is the kind of weather that's a break for fans and the drivers. >> reporter: normally it's sweltering near nascar weekend but today a much different story. it drizzled out on the track for a short time today and many of the fans had to bring jackets and sweaters. qualifying round kicked off today with fans in the stands bundled up under cloudy skies. for one woman from newark the cool weather was a welcome relief. >> i love it. it makes the race more fun.

has gone down to defeat. backers of the proposition gave up today. it's losing by 27,000 votes. supporters of the one dollar per pack tax say they don't believe there are enough yeses to close the gap. the opposition campaign said it'll wait for all the votes to be counted before declaring a win. >> the president courted latino voters in florida today. he spoke to the national association of latino elected officials and the audience cheered when he talked about proposed legislation to provide a path to citizenship more young undocumented immigrants. >> we should have passed the dream act a long time ago. it was written by members of both parties. when it came up for a vote a year and a half ago republicans blocked it. the bill hadn't changed.

for driving a get away car during a bank robbery. that ended with the other suspect killing himself after exchanging gun fire with police. the 37-year-old pleaded no contest in september to second degree murder. he will likely seven less than half that sentence because of time already served. >> a judge today sentenced a activist to six months for a strange attack on a singer from vietnam. about a hundred people from all over the country gathered at the san jose courthouse in support of the man. he was convicted of dressing up like a woman and then spraying some kind of irritant at a singer during a concert in the south bay. his supporters say the singer concert were part of a propaganda campaign. >> american veteran of vietnam i fought for freedom over there. why shouldn't i help here? >> with time served he will serve 54 days in the jail for

that attack. a federal government report released today had dire warnings for the california coastline because of global climate change. they said ocean levels could rise six inches in the next 20 years and three feet in the next 90 years. this comes from the national research council the reporting arm of the national academy. the report was designed to give people a heads up on how to deal with the flooding and erosion that the higher water will bring. >> we talked about it at the top of the newscast, the cool weather. let's check in with mark and doesn't feel like summer. >> just a couple days ago we were looking for the ac, now trying to turn up the heat with temperatures dropping a good -- just two days ago they were 30 degrees warmer. today the clouds and a few light showers, sprinkles, main focus has been -- as expected up to the north. up toward eureka. at least in the short term the chance we could have a few

sprinkles or at least drizzle pop up across parts of the area. here is the latest with the cloud and as we look at the buoys we have a bit of a breeze. winds gusting to 15 miles an hour right around the bay bridge. in the short term we do have a baseball game with the giants visiting the a's and look for more cloud cover and the chance of a few sprinkles and want to bundle up with temperatures in the upper 50s. . here is the satellite and radar. you can pick out the frontal system over northern california, just to the north of the bay area, producing significant rainfall up toward eureka and crescent. here say closer inspection. this front will move through over the next three to six hours and as which result we will hold onto the cloud over and bring in the chance a few sprinkles or at least drizzle. first thing tomorrow morning, showing you this. the cloud cover, and drizzle. temperatures bundle up once again for saturday morning.

a fedex driver hit him while turning in to a driveway. we flew over the scene after the accident happened. he was pronounced dead at the scene. the driver was not injured. >> sunnyvale police released the name of a man shot and wound yesterday by police. the gun fire came after a chase that ended around 1:30 yesterday morning. that was just a block from the home of the 34-year-old suspect. he is in the hospital and police gave his condition only as stable. he is charged with evading, resisting arrest and violating probation. authorities aren't sure if a body found is that of a santa rosa man who fell in the water two weeks ago. a fisherman found the body this morning. that's where a 22-year-old went in to the water while climbing

on rocks. a friend said he hit his head and a wave took him into the ocean. an autopsy has been scheduled for monday. >> defense secretary today spoke to mental health professionals trying to stop veterans and soldiers from committing suicide. he said commanding officers must make clear that seeking help for the stresses of war is sign of strength, not weakness. >> there are as i have said, no easy answers to the problem and the challenge of suicide. >> pentagon stats indicate that the rate is about one suicide per day this year. he noted more than half of the military members who committed suicide have no history of deployment. he calls the problem the most challenging one he has faced on the job. congress appears to be close to a deal to keep student loan interest rates doubles. sources say the agreement will cover the bill's six billion

body found in a local waterway. the man's body found today was spotted by an amtrak employee. mike has been there at the scene all day where investigators are still trying to answer questions. >> reporter: and that employee you are talking act was rolling dauntless tracks here behind me when they spotted that body right in this canal, it connects to the oakland estuary locate add round that bend. as you can see, the tide is in. at the time when it was seen it was out and only a few inches of water were right through the waterway. the conductor of the train spots a body inside a canal and calls the police. the time 10:30 a.m. the location, just authority of the oakland coliseum. >> appears he had been there. >> reporter: detectives arrived started to look for clues. the body was face down, half in the water, half out.

the coroner arrived, rubber boots in hand and the body was removed. >> the body was clothed. we don't have anything more than we believe it's a man. >> we just gave them a couple boards to put the body on. >> reporter: officers rolled the boards over from the business where fred worns and just like detectives, he wonders how the body came to this spot ; by car, trainor way of the water. >> tide comes out and down here so sometime this is full. then it drains out. you never know where it came from. >> reporter: the coroner transimportanted it by midafternoon and detectives looking for leads in the investigation. >> any time there is a homicide we count on the community to come forward and give us clues and leads, any information in all of our cases, that's generally one of the bingest assets we have.

>> reporter: again detectives call on this a suspicious death investigation. the name of the victim isn't known and the cause of death is expected to be determined after an autopsy expected to be done on monday. live in oakland. >> tonight we are hearing the brother of rich the man just release from prison for the chowcilla bus kidnapping. he served 35 years of a life sentence for taking part in the kidnapping of the bus driver and a bus full of kids in the central california town of choccilla. his brother runs a motorcycle repair shop and said richard has a lot of adjustments to make. >> he doesn't know how to use a computer that well and he hasn't tried to use one at all. trying to figure out the tv reremote. he has health issues. we are looking into getting health care for him and he

needs to go to the dentist. >> a third brother, james remains in jail. he and frederick woods were the other two involved. just in time -- mary married her long time partner in washington dc. they have two children. the former vice president and his wife released a statement saying in part they have been in a committed relationship for many years and we are delighted they were able to take advantage of the opportunity to have that relationship recognized. he is a conservative but has been more moderate with gay issues. it appearance the president's endorsement of gay marriage hasn't shifted america's views on the subject. a new poll finds that 42% of americans oppose gay marriage. 40% support it. 15% are nuetral.

coming up, there are new reasons to celebrate during this weekend's gay pride celebration. the historic changes the gay community has seen since last year's parade. >> a san francisco couple accused of vigilante justice appeared in court. rob roth was in the courtroom where attorneys for the two said the victim an alleged pimp had several enemies. >> reporter: the bayview where authorities say a couple shot to death a man who was apparently pimping their teen daughter. they pleaded not guilty to murder. the judge wouldn't low allow cameras in court as they entered their pleas of not guilty to charges they shot to death calvin snead. he is an alleged gang member they believed turned their 17- year-old into a prostitute. the couple faces special circumstances which could make them eligible for the death penalty. relatives of the couple declined to speak with

reporters but their attorneys said evidence shows plenty of other people apparently wanted him dead. >> they have found bullet pieces in him that are the result of prior gang activity and in addition there is indications that he beat the daughter of my client. >> the prosecution has provided insufficient evidence to show our clients were the only one was a motive. >> given what we know today, we have a very, very strong case. >> reporter: the da said evidence shows the couple worked together to kill him and they shot and wounded him in los angeles last month. but would a jury convict the parents for murdering this man? >> i would hope that a jury will look at it and shoo see that while we may have a great deal of sympathy for what happened and the frustration of the parents, it's still not acceptable behavior. >> the police have blinders on

. an update on a disturbing story we first brought you last night on the news. a dead baby found in a plastic bag. the body was found near the town of newcastle . the case is being investigated as a homicide but it may not stay that way. >> reporter: a white fence surrounding empty lots, the gates lead to nowhere and most of the green hills is covered with long and dry grass. >> sometimes people just drive

around and figure this is a remote area, there is nobody around here. >> reporter: people who live in the area say this undeveloped subdivision is often used asomugha a trash dump. dead animals have been found but they say they couldn't imagine being the one to find a baby. >> no, that, that scares me. >> don't know what i would do. >> reporter: the sheriff a department said a woman walking her dog yesterday afternoon, smelled a strong smell from a plastic bag along this road. she stopped a deputy patrolling the area and said that the bag should be checked out. the deputy did and found a dead baby inside. >> take the child to a hospital,. >> fire station. >> police station. any place and somebody will help you. you know, deal with the situation. this is uncalled for. >> reporter: the coroner said the baby was near term, about three to six weeks early. investigators say it's to early to tell if the babb write was born dead or alive. for now, the case is being

investigated as a homicide. >> it's just sad we have people that do horrible things like this. >> reporter: in newcastle. ktvu channel 2news. >> now if homicide is ruled out in this case the person who left the baby could still be charged with dumping human remains. >> almost half a million chevies being recalled. gm is voluntarily recalling it's chevy cruise because of the risk of engine fire. it's caused the least 30 fires but nobody has been hurt. gm will send notices to owners next month and said it should take a half hour. there are also two safety investigations that affect ford and chrysler. investigators are looking in to complaint that the power steering can fail on 83,000 ford explorer suv's from the 2011 model year. there have been 15 complaints where drivers reported problem was the steering, nobody was

had not hurt. the chrysler proper is about engine problems. so far no recalls in either case. >> the bay area is about to get millions of dollars in grant money for two major transit projects. they are part of a half billion dollars in federal transportation funds awarded for project across the country. $15million will go to the port of oakland for rail improvements. another ten million is go to the mta for transit improvements. >> it's a little good news and bad news from food companies when it comes to healthy breakfast for kids. a yale university study has found the united states food companies making breakfast cereal healthier. but they are off setting that by targeting kid was more ads for their unhealthiest products. both weather and red wine may be triggers for those who
