when they were called after nine this morning to a homeless camp. the fire burned around two acres and now investigators looking in to the cause. >> since it's a homeless camp and leads us to the suspicious is started maybe cooking source or some type of heat source. >> reporter: it's the third fire at a homeless camp in the past month. officials say there are 60 camps in san jose that house up to 900 people. him are floors and walls built up and shelves, mattresses, beds, pretty much whatever you can put in they can -- very creative. >> reporter: firefighters say besides putting out fires they handle medical calls in the camps. this man who didn't want to be identified said he realizes it's dangerous but he survives by minding his own business. >> their probably is their problem. >> reporter: they want to prevent the homeless from setting up camps. three clean ups have happened in the last month and more are scheduled. even when tents and belongings

are taken they return. >> we are working with programs and they approached the homeless people 30 days in advance of the clean up to start a relationship with them to let them know there are alternatives to camping. >> reporter: on july 1st more people will be added to a homeless outreach team. they want to help people get out of camps for good. reporting live . >> fire investigators are trying to determine what sparked a two alarm fire that destroyed a vallejo home this afternoon. firefighters say when they arrived the empty house was fully on fire. neighbors say squatters had been living there. nobody was hurt but there is some concern a homeless man's dog was left inside the house. police in oakland say an amtrak conduct ear spot aid body in the water. the body was found just before 11 this morning, partly

causing problems in oakland and san jose. >> a activist was sentenced to six months in jail for an attack on a singer from vietnam. about a hundred people from all over the country gathered at courthouse today in support of the man. he was convicted of spraying a tear gas like substance at a singer during a south bay concert. he and his supporters say the singer was part of a propaganda campaign. >> as an american veteran of vietnam, i fought for freedom over there, why shouldn't i help here. >> after time served he will spend 54 days in the jail for the attack. >> late this afternoon a judge was asked to declare a mistrial in the case of a man accused of beating a priest who he said abused him when he was young. robert honda is live in san jose where he just got hold of the prosecution's response to

that request. >> reporter: the trial was expected to belong and count controversial but here, this controversial case could be headed to a end. when will lynch's defense team came out after their meeting they were up beat. >> no question. >> reporter: the attorney showed us a copy of a complaint filed today, a motion for a mistrial based on misconduct by the prosecution. the motion is based on the incident at the heart of the case, lynch accused of beating up the priest in may of 20 so. lynch claims he and his brother were raped by the priest. the prosecutor said it's lynch not the former priest on trial and in make that point said he is a child molester and would probably lie about it on the stand. >> then she questioned him and sure enough he lied about a very material fact in this specific instance if he had molested will lynch and she

continued. based on that, the fact he perjured himself the trial should have been stopped,s case dismissed. >> reporter: the da responded calling the motion frivolous saying if ray prosecutor believes a witness may be untruthful and tells the court that the prosecution is preincluded from calling that witness at all. the da said the claim is not supported by case law, statute or common sense. the defense says it's prepared to continue if the judge sides with the prosecution. >> which will go forward with the trial. it'll start again. at that point there may be additional motions filed. >> reporter: harris said lynch will be satisfied regardless because his intense was to put the focus on the retired priest and he has done that. live in san jose. >> facebook has agreed to pay $20 million to settle a class action lawsuit over the use of people's names and faces in

have stalled because of opposition from banks ando lenders. the associated press has learned it would prevent them from foreclosing while loan changes are going on. it would also let people file lawsuits against lenders who break state laws and would require them to have a single point of contact for borrowers. leaders of the high speed rail authority are making a last minute push ahead of the vote for funding. state lawmakers will vote on issuing $2.7 billion in voter approved bonds for the high speed rail. the government would contribute another 3.3 billion. high speed rail chairman dan richard has posted a youtube video about the project. >> we actually operate high speed rail on existing rail lines wherever possible and we avoid the cost to the taxpayers of having to build an entirely brand new set of tracks. >> the current price tag for the rail project is $68 billion. >> after two weeks of vote

. a couple accused of kill age man they believed was their daughter's pimp plead pleaded not guilty. they are accused of killing him on june 4th. the couple is now being held on two million dollars bail. their 17-year-old daughter and three other children are staying with relatives. >> the two men accused of that beating of giant's fan brian spowe were back in court for the first time since a judge ruled there was enough evidence to go to trial. they pleaded not guilty to charges of assault, battery and mayhem. also today the attorney representing sanchez stepped aside saying he only agreed to represent him for the pretile. they are expected to get started in august. a leading sporter of
