now will challenge similar immigration laws in five states. both sides did agree that it's high time for congress to finally pass a comprehensive immigration reform bill. rita williams, ktvu channel 2 news. presumptive republican presidential candidate mitt romney did not announce a comment until late this evening. >> the country would be better serve first-degree the country was actually fulfilling his campaign promises. >> reporter: romney later said the supreme court should have given states more latitude to deal with immigration. president obama did not talk directly about the decision. but said he was pleased the supreme court struck down key parts of the law.

mr.obama said nobody should live under a clout of suspicion because of how they look. the court struck down mandatory life in prison without the possibility of parol for juveniles convictedded of murder. 28 states have such laws, california does not. the justices also declared a 100-year-old montana law limiting corporate campaign spending unconstitutional. the ruling reaffirming the a 2010 decision that found the first amendment allows corporations and unions to spend as much as they'd like to support or oppose politicians. the challenge of the health care act focuses largely on the laws requirement that most americans buy health insurance or pay a fine. a ruling is expected this thursday. and coming up in eight minutes tonight, a plan to freeze tuition rates at california universities and why the deal depends on voters. in antioch, police say they

shot and wounded a man wanted on child abuse charges. initial reports say that he was shot in the stomach. when police got there they say morales was armed with a gun and started fighting with an officer and that's when officers shot him. he is expected to survive. san mateo county sheriff deputies are releasing few details on an incident where one of their investigator opened fire on a vehicle. authorities say it happened around 2:00 this afternoon when investigators with the county's narcotics and vehicle task force tried to pull over a stolen vehicle. that's when they say the driver rammed them and one of the investigators opened fire. sheriff deputies say they don't believe anybody was hit, one person was detained and questioned but it's not clear if an arrest was made. a 47-foot long whale washed up on a beach at the point rays

national seashore. it turns out it's a rare research. >> reporter: when one whale washed up into public views here at point rays after being hit by a ship the discovery caused an outcry. this photo taken by the national park service shows a hiker looking at a juvenile thin whale with a fractured spine and broken ribs. it washed up thursday. >> it was hit by a boat and that's kind of unusual. usually you don't have contact like that. >> reporter: in the small town of point rays, local residents call the incident a rare occurrence. but marine biologists have a different opinion. >> i would say a big concern is that the cause of death for

large whales in this area is ship wrecks and over the past few years we've seen blue whale, hump bake whales and now a thin whale all struck by ships. >> reporter: it takes a massive amount of force to break a whale's rib. this is why, this is the rib of a blue whale that came to shore. the one that died was feeding at the time it was hit. possibly in the crill waters where three major shipping lanes converge. >> it would be very sad if that's going to be an occurrence here. >> reporter: on the east coast whales are protected by speed limits by large votes and there's talk about doing something similar here on the west coast. now right now several endangered species of whales are feeding off the california coast and scientists are concerned there will be more focused on eating crill than on

new at 10:00, police have arrested man for sexual assault. the suspect is a convicted rapist and one of many sex offenders who live just blocks from the campus there, matt. >> reporter: frank this is where the sexual assault occurred just blocks away from santa clara university. suspect was arrested nearly three weeks after the crime but it brings up concerns about several sex offenders living near by. santa clara is considered a quiet safe place for the thousands of university students and residents living in the city. but that imagine was shattered in the early morning hours on

may 31st when a 20-year-old woman was walking home. >> the suspect stepped from a darkly lit area, struck the victim on her head, knocked her to the ground and then pulled her back into the darkness where he could commit his sexual assault assault. >> reporter: investigators credit dna evidence with helping them capture the suspect 52-year-old leonard easton last week. santa clara university students were cautioned by e-mail. causing students to take extra steps to stay safe. >> every woman that's walking home we make sure they are escorted. >> reporter: easton is a sex offender with a prior rape conviction. he's listed as a transient. but he's not the only sex offender who ended up in santa clara. the website shows alameda just

california's budget wednesday. trailer bills need to be prepared with the budget and printing them is taking time. just what's in those bills is something of a mystery. democrats are working on them behind closed doors. one new twist became public today if voters do not approve a tax increase the school year could be cut by as much as three weeks. the california state universities systems may be getting a break and it too depends on november's vote. under the agreement between governor brown and democratic leaders tuition breaks would freeze. uc was considering a tuition hike and uc had a 9% increase in the works. the sacramento beat reports that ammiano has decided the marijuana regulation bill needs more review. coming up tonight at 1030, a

crucial deadline is looming. the northern california city that's working right now to try and avoid becoming the biggest yet to file for bankruptcy. investors reacted negatively today to europe's debt crisis. the dow dropped 138 points a loss of about 1%. nasdaq fell 56 or nearly 2%. there are concerns europe's peace meal approach may fail. facebook's number two executive sheryl sandburg became the first. founder mark zuckerberg called her his partner and central to the company. facebook today polled a new feature, it's called find friends near by. the feature raised questions about how it would be used and by whom. there are also privacy concerns. facebook told a writer it was testing out the find friends near by feature. a sex trafficking sweep

here in the bay area has rescued several children in some cases as young as 15 years old. ktvu's paul chambers tonight with exclusive video of the operation. he also tells us authorities didn't just target prostitutes on the street. >> it's called operation cross country, the purpose to target child prostitution. >> many of these people are taking young children and enslaving them. >> reporter: locally 77 people were arrested last week in the nationwide sweep. six children ranging in age from 15 to 17 were arrested too. people using websites like craigslist and my red book. >> we started out with a warrant and arrest of people wanted for human trafficking, pimping, and those sorts of crime. >> reporter: more than 100 bay area officers were involved in the three day operation. it led to the arrest of adult

prostitutes johns and pimps. in san francisco, oakland, richmond, san rafael, san jose and castro valley. now that they are off the streets it's up to local district attorneys to keep them behind bars. >> the da's office is in fact, very committed to prosecuting all of these criminals and making sure that our kids are in fact, safe. >> how we take care of these young ladies after they've been rescued is a critical key to operation cross country being successful. >> reporter: all those rescued were taken into protective custody and given the resources that will hopefully keep them off the streets. americans bought new homes in may at the fastest pace in more than two years. the increase suggests that u.s. housing market is growing despite weaker job growth. sales of new homes increased

to 7.2% in may. a public utilities agency in hawaii today approved the transfer of three linai utilities to ericic ellison. it's not exactly clear what the billionaire plans to do with linai. the sale price has not been disclosed although maui news reported the asking price was 500 to $600 million. tropical storm debby seems to be trapped over florida. over 5,000 homes and businesses are without power. the government has declared a statewide emergency. florida does not rain after a drought but too much rain can bring even more problems. and we had temperatures today that were slightly warmer than they were yesterday. kind of a cool weekend, these are the highs for today and they are below the average for

it's been a roller coaster of a day in the trial of lynch. he's is man accused of beating a priest that allegedly molested lynch as a child. ktvu's janine de la vega tells us a surprising development caused the case to take a new turn. defense attorneys for lynch were reeling with frustration when they left the courtroom this afternoon. they called retired priest lidner a coward for taking the fifth amendment and refusing to testify. >> we want a full cross- examination, we want a chance to have the truth. clearly what happened is nobody is interested in the truth. the prosecution certainly is.

>> reporter: the prosecution is accusing lynch of attacking lidner. the prosecution told the judge the priest would probably lie on the stand. >> he's concerned that there's going to be a perjury investigation and what's interesting is he's never been convicted and he's never admitted it. >> reporter: defense attorneys told judge cina it will hurt their case if they are not allowed to cross examine lidner. that mean it is jury will have to ignore the priest testimony from last week. >> i think it is a -- when we are supposed to get the opportunity to question him and cross examine him and we don't get to. >> reporter: the defense filed a motion for a miss trial late this afternoon but the judge

denied it. defense attorneys plan on filing yet another motion for a mistrial first thing tomorrow morning. reporting from san jose, janine de la vega, ktvu news. a san jose man is facing 15 years in prison after he was convicted of posing as a licensed doctor who treated patients for toenail fungus. kerry silverman owned a chain of laser centers called shiny toes. the centers operated in beverly hills and manhattan. silverman was arrested last july and convicted last friday. hayward police announced they are getting more than $3 million from the federal government to hire new officers. the $3.6 million grant will pay for nine new officers and focus on reducing teen crime and truancy. the department says they plan to fill the positions. today mark it is third

anniversary of the death of singer michael jackson. the doctor who gave him the shot was found guilty of involuntary manslaughter. conrad murray was then sentenced to four years in jail. a deadline just 90 minutes away, the last minute fight on the way right now to try to avoid bankruptcy in the city hit hard by bankruptcy. a work of art is lost and that is causing some real heart ache at a bay area middle school. we are on the scene of developing news, what we've learned right after the break.

they took down the crime scene tape that was right behind me. all of their investigations seem to be focusing on the house right there with the dormer window. neighbors we spoke to said they saw investigators going in and out bringing out evidence bags. we have video that we can show you, our photographer got this video. this is the suspect vehicle. i talked to a representative from the contra costa sheriff's department who told me that what they are investigating is of a serious and sensitive nature and that he didn't want to give out too much information to not jeopardize the case but he did tell me that they are detaining two men who are potential suspects in this case. they are also questioning a woman who is a potential victim in this case. no one with any serious bodily injury, but this did go out on police scanners as a potential

abduction. we don't know if it was a potential stranger abduction or if they knew each other. contra costa police department not confirming that it was an abduction but that's what went out on the police scanner. they are focusing their investigation on the house behind me. that's where investigators spent a couple of hours tonight going in and out of there collecting evidence. neighbors here that i talked to said they didn't really know what was happening expect that they saw all the police activity. again, contra costa county sheriff's deputy did tell me that they are investigating something that is of serious and sensitive nature. they are not looking for any suspects at the moment. they do have two people detained they are questioning and also a woman who is a potential victim who they are questioning in this case. reporting live in san pablo, noelle walker. the clock is ticking for stockton as city leaders try to

that way you can be connected any time, any where. students at a middle school in san francisco were stunned when they heard the news, a mural they had worked on for a year and a half was gone after work crews painted over it. ktvu's david stevenson tells us it all happened because of a major miscommunication. >> reporter: with students out of school workers at horseman school are installing new interiors and producing out the outside. but school district officials today told us the summer face left went a little too far when crews painted over a school mural. >> i think we were all a little bit shocked. >> reporter: guadalupe guerrero says it was an honest mistake, the entire school is being painted including one western wall with an older mural. >> that western wall has been there for a while, there needs to be some plastering and we will probably only be able to save a small section of that.

one of the attorneys for jerry sandusky says he plans to file an appeal for the former penn state assistant coach's conviction on child sexual abuse charges. a jury convicted sandusky on 45 of the 48 counts against him last friday night. sandusky will appeal on the basis of ineffective counseling. sandusky is on suicide watch. a stunning claim today for the attorney for former moss

boss whitey bulger. the government promised bulger immunity. bulger was a fbi informant. 21-year-old david mendez and ramirez are charged with assault with a deadly weapon in this case their feet. a passing motorist took this video of the men fighting with the driver of another vehicle patterson. patterson has also been arrested with assault stemming from an unrelated incident last month. in news of the world tonight in mexico, officials say three federal police officers were shot and killed at the international airport during an attempted drug bust. the two suspects had been identified as federal officers apparently working for a drug gang. they got away. the shooting happened in a food court outside security

the berkeley postoffice, the downtown berkeley postoffice is on austin way is expected to close. that building was built in 1919 and is on the market now. a spokesperson for the usps says all carrier and bulk mail operation will move to the berkeley delivery unit. the renaissance style building is on the national register of historic places. there is late word tonight that a publishing giant the chairman of the board of the hearst corporation has died. he died in palo alto after suffering a stroke. george hearst was the grandson of the original owner. it also owns 15 other newspapers and 29 tv stations. teenagers hiding what they do online from their parents. fire work stands all set up and ready to go. the cities where so called safe and sane fireworks are legal

a recent survey of teen internet behavior released today suggests you don't know much about what your teen is doing online. that survey found 70% of teenagers had hidden their online behavior on the internet in 2012. that's up from 2010. teens lied about accessing sites with simulated violence and sex and have a variety of tactics to avoid being caught by their parents. new at 10:00 the fourth of july is still more than a week away but the fireworks stand are already up and ready. noelle walker explains just because you can buy them in some bay area cities doesn't mean it's legal to use them

city and -- experts say utah is the driest they have seen in about 20 years. and in colorado eight fires continue to burn out of control. late today four massive c140s were sent in the fight the waldo fire. the largest fire is the high park fire. so far that fire has burned 83,000 acres. yesterday marked the fifth anniversary of the start of the destructive angora fire in south lake tahoe. that fire burned almost five square miles and destroyed homes and buildings. recovery efforts are still ongoing as trees burned removed and seedlings planted. one california lawmakers said today he gives government agencies a c minus grade for preventing future fires in the tahoe basin. he says small landowners, those

with less than 3 acres should have more power to thin out trees trees. >> they say a healthy forest should have 50 to 75 trees per acre and many of the acres around the tahoe basin have 500 trees plus. >> reporter: but there are environmental concerns, fewer trees would allow more run off into lake tahoe affecting its clarity. it's pretty breezy out there right now. temp chus chus -- temperatures did warm a few degree. we go out to the antioch area, winds gusting to 21 miles per hour. they're coming out of the west- southwest. those winds are going to come down a little bit tonight and it's going to get chilly. that's why it was cool and that's why there's still a slight chance for a little bit of drizzle or something as that system slides through. once it's out of here which is on its way now, things will start to warm up.

that's why i'm calling for temperatures five to 6 degrees warmer for tomorrow. the extended forecast it doesn't get hot. we kind of stay in this mild warming trend. it's not going to go into the mid-90s, it's going to be in the mid-80s on the warmest day which looks to be thursday right now. san francisco mid-60s, berkeley 68, 67, you get out to lafayette and it's 70s. out toward the livermore valley, morgan hill upper 70s, maybe a couple of hour -- low 80s will start to show. then warmer again on wednesday so it's a slow warming trend. the high pressure center is building this way. it's a weak one but it will warm us up as we go through time. the computer model lays out like this, 7:00 a.m. tomorrow morning there might be a little drizzle along the coast. this is fog. we had fog returning this evening to the coast. the fog returns but watch what happens around noon. it goes away. the high pressure isn't establishing itself that firmly so that the inversion isn't

that strong, so i think this whole week is going to be marked by a little bit of fog but then clearing. so that's unusual for this time of year out in the avenues, out toward stinson beach and bodega bay. this time of year the -- that's how it goes tomorrow. there's fog out there now but the fog should be gone, say 9:00, 10:00 in the bay area. forecast highs tomorrow, we have an 81 in brentwood, and 72 in santa cruz. still good air quality, and that is the upshot to this type of pattern. it sort of pulls the fire danger not off the table but it helps it a lot. the air quality is great and you're going to see this the five day, the sunday comes in with your weekend in view there. that's just upper 70s in our warmest cities so it's going to be a cool weekend as well. >> it's been so mild so far for summer. >> last we have some heat but this week boy it's mild. a new study about the 2009
