on the hook for $1 million lawsuit. brian lancaster is in a legal battle with his ex-wife for custody of their two boys. deputy silcox searched the name of three people in crime bases that are supposed to be used for strict law enforcement purposes. the information ended up in the hands of his ex-wife. >> totally improper, abuse of authority. >> reporter: court records say the information in data bases were e-mailed to silcox's girlfriend regina who is unauthorized to receive such confidential information. the information made its way into family court. re regina also faces a charge for disclosing personal

leave pending an investigation. rob roth, ktvu news. orinda police say they have a suspect in custody in connection with the death of a 52-year-old woman. the man went to a neighbor's house and asked the neighbor to call police. officers say they then found the woman's body on the couples' kitchen floor. her name has still not been released. the man surrendered to officers. >> we have indication they have lived here for at least since 2006. >> the chief of police says the man is now cooperating with investigators, officials say this is only the third killing in orinda in the past 13 years. the search for a man who apparently fell into the bay after last night's giants- dodgers game was called off today. it appears the man fell off the end of a pier though no one

actually saw him fall into the water. san francisco police and fire guard searched from peers 30 and 32 all the way to yerba buena island. >> the challenges are many if the current is running fast then you know he could have been pulled out quite a ways. when it's dark, very difficult to locate anybody. >> reporter: we're told the man is from woodland in yolo county and that he did not know how to swim. in the east bay a man is behind bars tonight on kidnap, torture, false imprisonment and other charges. it's a story we first brought you last night. county sheriff deputies say curtis mahagy assaulted and kidnapped his girlfriend. that suspect is being held without bail. it's been a case filled with drama but today the most dramatic moments actually came outside the courthouse. robert handa live now in san jose where the angry response

to a key ruling made today, robert. >> reporter: well the trial of will lynch continues here at the hall of justice, but it will happen here without the testimony of the alleged victim a former priest. and his departure has lynch's attorney very upset. >> who's the victim in all of this? society is the victim in all of this. society is the victim ere's a m in los gatos who is a rapest and molests children and is allowed to go free. society is the victim here. >> reporter: although lynch is the man on trial for attacking father joe lidney in los gatos in 2010, lynch claims the priest raped him and his brother and wanted that to be revealed in court. the judge told the jury it must disregard lidner's prior testimony including his testimony of the account.

police are offering a reward for information in a sexual assault case. a woman went into a restroom and saw a woman was inside. when she turned around to leave, he grabbed her and began the attack. the man was an african american man 30 to 39 years old. the victim says he spoke with a jamaican accent. a nationwide sex trafficking sweep that netted dozens of arrests here in the area. it involved children who were forced to walk the streets. paul chambers is live, he spoke

to advocates who helped the minors. >> reporter: police arrest a prostitute and her john. they were just two of 71 people arrested locally as part of a nationwide sting. often time the prostitutes are looked at as criminals. in fact, one expert says they are the victims. >> they don't see the money, they don't see the profits of this exploitation. >> reporter: many women begin at a young age. in the bay area, six children were rescued from a life of prostitution, four of them are now getting help from bay area women against rape or bawar. >> we're the first crisis response, we stabilize them. >> reporter: the group was out last week with police as the young women were taken off the streets. >> as they are pulled in from the command postwe come up with food, water, clothing. some of the kids haven't eaten

in days. >> reporter: they keep supplies at hand that way they can deliver the items to exploited children. but often times the children return to a life of crime. mims says the organization will be there for the children who often times get stuck in the life of crime. most of the local advocacy groups offer a hot line and say they offer free counseling, they are always there for their victims. paul chambers. we are now getting word that acclaimed writer nora ephron has died. her son tells the new york times that ephron died of leukemia. nora ephron was 71 years old. happening now the city of stockton is preparing to take steps toward preparing the

biggest city ever to declare bankruptcy. the city council is expected to vote later tonight so it can operate under chapter nine bankruptcy protection. among other things this budget plan calls for more than $11 million in cuts to city employee compensation and retirement benefits. >> we're talking about some people in their later years of their life that can be substantially affected by the medical plan and their medical care. >> if it was their relatives right now, blood relatives they would not be doing what they're doing. they would be fighting like us right now to stop this from happening. california's legislature is set to vote tomorrow on 21 so called trailer bills made necessary by the state budget approved last week. republicans in sacramento are upset saying they're not getting enough input in the budget process. >> most of this stuff is coming in in the dark of night. now maybe we're having a little

bit of time to review and maybe find it and shine the spotlight on it. but it is still not open government. >> voters approve proposition 25 in 2010 which allows the assembly to pass the bills with a simple majority. the vote on the trailer bills is set for 9:00 tomorrow morning in both the senate and the assembly. democratic leaders say they have four items on their agenda before the start of the summer recess scheduled for july 6. first finish up the budget process. second pension reform, third home foreclosure relief. and fourth high speed rail funding. the public got a chance to comment today in sacramento about the affects close sures will have. california has 50 historic parks and they are concerned about what will happen to the sites and artifacts if the

parks should close. the mayor of danville has a new job tonight as contra costa sheriff supervisor. candyce anderson took the oath in martinez this morning. she was scheduled to take office in january following the june election but incumbent district two supervisor gail ukima passed away in may and anderson was appointed to replace ukima. anderson says she wore a red suit in memory of her friend. organizers of a sit in se they plan to make their concerns known at tomorrow's oakland school board meeting. today we saw a lot of parents and children at the site which organizers are calling the people's school. they say they'll meet at lake view tomorrow at 4:00 in the

afternoon before heading to the school board meeting which begins at 5:00 p.m. an east bay pharmacy is set to be part of a test of federal authorities to gauge the demand for free hiv testing. mike's pharmacy hopes to offer these tests before the end of summer. it's one of seven locations where the test will be available. it takes only 20 minutes and involves just a swab inside the mouth. >> to make this test available to people that they can find treatment and counseling they need. >> the centers for disease control estimates 1.1 million americans are infected with hiv, but as many as 20% don't know they carry the virus. the red cross announced it is sending five people to colorado to help with relief efforts there. one of the volunteers who is going explained why he helps. >> i think about the smiles, i

mean when you see somebody who is just, their livelihood is totally destroyed and you're able to give them the hope that it's not and they can see that tomorrow will be a better day. >> reporter: volunteers and staff spent part of the day assembling what they are calling comfort kits filled with toiletries everyone stuffed animals for the kids. at least 5,000 people are under evacuation orders as firefighters in colorado work to save hundreds of threatened homes. we have new information tonight about a fatal fire in oakland. firefighters responded to the home on kingsland avenue at 4:30 this morning which was fully engulfed in flames. authorities say 30-year-old brandon crawford and another man was found unconscious on the second floor. crawford later died. a neighbor told us the house had fallen into disrepair since the owner died and the home was foreclosed on. >> they were gradually moving

on. as time moved on, they were leaving. there was quite a number of people there, i don't know how many. >> reporter: the second man remains in critical condition tonight. no one else was inside the home at the time. investigators say the power had been cut off. fire investigators are looking into three early morning fires. they say two of them are suspicious. the first was a kitchen fire at a home, it started just after midnight and is considered accidental. investigators say the two other fires on spinaker and goyle drive were found with two burning containers outside the home. the three fires displaced at least 20 people. zynga announces new games, david stevenson explains what they are and why they come at a critical time.

the redwood city police department rolled out a new program that will allow people to video chat with a police officer. an officer will be available monday through thursday from 9:00 a.m. to 5:00 p.m. to help residents report nonemergency crimes or answer questions about police services. the state supreme court issued a key ruling today on air quality. the justices said regulators can implement pollution rules based on technologies that yet don't exist. the lawsuit was filed in los angeles for pollution causing in paint. it turns out that a large cube that was built near the state capital is part of an anti global warming campaign called cut your cubes. organizers say the structure represents the space taken up

by one metric square of carbon footprint. the spirit of spider man invaded san francisco today as hundreds took part in a volunteer day. more than two dozen volunteered pitched in at golden state park's pioneer meadow. they cleared out blackberry and weeded around young trees. san francisco was one of 10 cities nationwide where people helped spruce up their community. >> young people like this, just to see them making me feel good. to see them working, that really makes me feel good. >> 300 children and teens also participated in volunteer projects at chrissie field. one of the bay area's landmark restaurants has made the list of top dining destinations in the country. according to trip advisor.com, le bernardin in new york city

was the top of the list. followed by gary danko in san francisco. followed by le cirque in las vegas. we've got some warmer temperatures there. higher temperatures by a few degrees and it's going to warm a couple of degrees every day as we head into thursday. when you have 82 degrees at sacramento, that's not that hot. we look at the bay area proper we're 73 in san jose. a hot spot typically 76 degrees. i expect livermore to be 86 degrees easily. temperatures will remain mild but they did warm today. they're going to warm tomorrow by another five or 6 degrees. but it never really gets hot until you go into the far eastern parts of the golden gate valley. the forecast as we warm into thursday, friday, saturday sunday temperatures cool again. it is all subtle changes. it is all subtle changes because of high pressure to the

north but as it comes a little bit south it cools us down. as it nudges north, it warms up a little bit. but on the weekend it nudges down again. subtle changes, no major heat up, no heavy winds just kind of subtle pattern. tomorrow morning fog right along the coast and it's been there and it's been clearing and that's unusual. we've had a lot of fog typically in june and july. we're not seeing that this year, we've had a lot of fog like this that burns off rapidly. tomorrow at the beach the fog clears away. temperatures warm, oranges are 80s so you can see a lot of those tomorrow. a little bit warmer, yellows are 70s. as you march through the bay area microclimates with good air quality and no fire danger for the most part. you're looking at upper 70s in places where there should be mid-80s and mid-80s where you would expect mid-90s. and not a lot of wind to speak of and this is a pattern that's going to stick with us. the high pressure sticks around
