from witnesses after a fatal police shooting in antioch. claudine wong has been at the scene all morning and has what investigators are focusing on. >> reporter: take a look behind me. you can see the tow truck in place and it looks like they are about to tow the car that has been inside this garage here at this home on the 4800 block. we have seen that car close up through our camera lens and can see some kind of damage to the the front windshield and the hood. not sure if those are bullet holes or what kind of damage. clearly that has been the focus of investigators. the coroners van was also here, what we believe to be the coroners van. it has left. police not saying much at this point. they have said despite earlier rumors this was not a hostage situation that led up to the officer involved shooting. we do not know what led up to the gunfire. here's what we do know. this ad at -- this happened at

4:00 yesterday afternoon. witnesses told the local paper the man involved lived on this street. also said he had lived in the neighborhood long. >> i just hard two shots and then i heard a hail of shots. probably about i don't know probably about 15-20 shots. >> family members identified the man as denny gomez. he work as a barber in the area and was not a troublemaker. >> he's not a violent person. he's not a violent person. i mean i don't know what you would call this a bad day. but he's not a violent person. this is definitely not denny. >> reporter: again still a lot of questions at this hour about what exactly happened out here in antioch. they have been out here all night collecting evidence and again this area does remain

taped off. we will continue to keep an eye on this situation. we'll give you new pictures as they tow that car out of that garage. hopefully we can see better the damage to that car. live in antioch claudine wong. yesterday's police shooting is the second one of the week in antioch. on monday police shot and injured paul morales while serving an arrest warrant at his home. morales was armed with a gun and began fighting with officers. an officer shot him. he is expected to survive. san jose house fire is under investigation this morning. it was reported just before 8:30 in an empty victorian home. the first fire crews on the scene saw this. smoke pouring out of every window. nearby homes were evacuate. dozens of firefighters fought those flames for two hours. >> you wonder if somebody was

in the house. you worry about the people. and so it was scary. >> no one was inside. the cause of the fire is still under investigation but fire officials say they don't think it was suspicious. san jose firefighters will be going door to door to get more information about two arson cases. tuesday morning the fires damaged two buildings and forced about 20 people out of their homes. investigators say both fires were set in recycling bins. first one near oak grove high school. second one near coy drive. $500 reward is being offered in the case. new this morning fair feel police have arrested a pastor on charges of child molestation. robert ruark was arrested last

night. clergy tipped off the police. alleged abuses date back to 1994 with victims as young as 13. many of the alleged molestations happened in the church. 6:05. later this morning suspended sheriff ross mirkarimi goes back on the witness stand in his ethics hearing. last night he admit he bruised his wife's arm last new years eve. claudine wong -- allie rasmus is live. >> reporter: this ethics commission hearing resumes at 9:00. as you mentioned ross mirkarimi will be back on the stand to continue defending himselfs. it's his only chance to fight to keep his job as san francisco sheriff. ross mirkarimi has been suspended from that post since march because of a domestic violence incident with his wife. >> you realize it's an abuse of

power? >> yes. >> reporter: mirkarimi took questions at around 8:00 last night. during that tough questioning he admitted to bruising the arm of his wife eliana lopez after getting in an argument with her on new years eve. he pled guilty to one misdemeanor false imprisonment. but during the questioning he said he was wrong to react the way he did during that argument but he implied he shouldn't lose his job over it. >> i think that the sheriff is the leader of the department and should lead by example. and if that also means that the sheriff can demonstrate redeeming behavior. >> reporter: commissioners have diseased 45 -- decided a 45 second video can be used in the

trial. now meanwhile the man that suspended sheriff ross mirkarimi without pay mayor ed lee will be testifying today. first up we are supposed to hear from ross mirkarimi. live in san francisco allie rasmus. republicans are vowing to make their fight against president obama's health care law a major issue in the november presidential election. coming up at 6:15 how republicans are using the supreme court ruling upholding the law in their campaign against it. the latest polls show a majority of americans don't support the health care law as a whole but they do like many of the individual provisions such as no more denials for preexisting conditions or dropping coverage when people get sick. hospital administrators say health care reform should take pressure off emergency rooms where the uninsured go for treatment. and they say as more people get health insurance medical groups will need to hire more doctors.

6:14. real chaos in a southern california courtroom where a student was charged with

sexually abusing his classmates. look at this sheriffs deputies had to drag 18-year-old fernando out of the courtroom. there is his family members. they were rushed out of there as well. four students are claiming they were attacked by salgato and three other minors. the teacher is also facing charges. the teacher knew about the incidents but never reported it. secretary of state hillary clinton is in st. petersburg russia today. both secretary clinton and the russian foreign minister will attend the meeting in geneva. in the past russia has refused to go along with what it calls external interference in syria's affairs. europeans have reached an agreement. they met for several hours before announcing they will use

the continents permanent bailout fund to help the struggling banks. the move was designed to help spain but will also help italy as both countries face rising loan costs. the 17 legallers also agree to form a joint banking supervisory group. republicans say they need a sweep of congressional seats in the white house to repeal health care reform. republicans have a new plan of attack after yesterday's supreme court ruling. alison. >> reporter: dave, republicans are seizing on the message today that health reform means new taxes. when the supreme court upheld that several individual mandate, the ruling said congress can require americans to get health insurance under its taxing authority. under the law people that don't get insurance will have to pay a penalty. >> president said he would never raise taxes on the middle class. this is a middle class tax

increase. >> reporter: house republicans have set a vote for after the fourth of july break to repeal the law. democrats in the senate won't let that happen. george muller says repeal would be devastating for american families. >> that would just open all out health care threats to women with preexisting conditions. to children that get kicked off their parents policies. and small businesses that using the tax credit to provide health care for their employees. >> reporter: as for the impact of the ruling on presidential politics, mitt romney's campaign says he raised more than $4 million after the ruling was announced. reporting live from washington, d.c. alison burns ktvu channel 2 news. well happening now the launch of a delta four rocket scheduled to carry a spy satellite into space we are looking at live pictures right now liftoff was delayed this morning but that was after several alarms went off. it looks like they got everything worked out.

the launch happened i goes moments ago is what it looks like. we are taking a live look at that. some sources say this is the last of the cold war era. stealth satellites to be put into space. a group that was arrested during a major occupy protest in oakland is filing a civil lawsuit. more than 400 people were arrested during the january 28th demonstration. 18 people are suing the city of oakland and county of alameda. they claim police had no cause for the arrest and they should not have been jailed. they will also gather this afternoon on the steps of city hall at 2:00 to talk about their lawsuit. time is 6:18. marin county judge will consider a request from accused serial killer naso to examine dna evidence. now naso is charged with killing four northern

california women between 1977 and 1994. jury selection is expected to start november 7th. a man was found unconscious and bleeding at an east bay bart station. now the police want your help. this happened at 7:00 p.m. last tuesday at the del norte station. when the agent went to check it out they found a 46-year-old man badly injured but the man can't remember what happened. investigators say they think the man may have been injured by two men that were fighting or he was a victim of a robbery. 6:19 is the time. back to sal. >> we are looking at the east bay and south bay where the heaviest traffic always tends to be. starting off with live pictures interstate 880 doesn't look all that bay also the morning

good morning. lots of low clouds this morning. sea breeze in place. 50s, 60s coast and bay. 70s mainly inulin or very low 80s. 6:24. president obama will fly to colorado today to tour the damage caused by the huge wild fires. the fires have grown so big take a look at this. you can see the smoke from space. these are new pictures from nasa. coming up in just about ten minutes we'll have a live update on the fire from colorado springs. a fundraiser will be held this sunday for survey ors of -- survivors of an apartment fire in san francisco. that fire severely damaged the building. about 37 people lost their homes in that fire. the chronicle reports many have found new places to stay, but others are still in need of permanent housing. is a family of 12 is currently in public housing on treasure island. fundraiser will be held at the

casa nova lounge. a bicyclist is in critical condition at highland hospital with life threatening injuries after crashing on a notorious road in the east bay. this is redwood row. it goes from oakland to castro valley. with the scenic views it's a popular recreation spot for cyclists and motorcyclist that like going down hill fast. but there is a concern that it may be dc -- may becoming too dangerous. >> it's not that smooth. it can shake you up a little bit. >> last couple of turns there have been packs of bikes that take up the whole lane. >> one of the curves there is a roadside memorial. it's for a rider killed six months ago when the car crossed the center yellow lines. america's top gym list

morning, to you. thank you for joining us. it's a friday it's june 29th i'm dave clark. >> and i'm pam cook. >> we have new details from antioch. claudine wong is out there at the scene to tell us why police opened fire yes afternoon. >> reporter: we do have new information and video to show you. i want to show you what is happening. police have given us a better way on what happened out here yes afternoon giving us more on the events that led to the fatal shooting of a 35-year-old man. let me give you a look at video we shot within the last 30 minutes. it focused around a yellow corvette that had been sitting in the garage of the home. neighbors tell us the man that lived there as denny gomez spent a lot of time working on that car. and he was in or near that garage when he was shot and

killed. police now telling us that gomez had called police yesterday. he was distraught and told them he was going to kill himself and told them he was going to killed a police officer and says he may have already killed a police officer. it took the place time to track down his name and address. now police say once they figured out where he was. he came out of his house. officers tole him to put the gun down. neighbors describe hearing a volly of gun -- volley of gunfire. >> i heard two shots and a hail of shots. >> he's not a violent person. i don't know what you would call this a bad day. i don't know. he is not a violent person. >> reporter: the directors

office is now -- the district attorneys office is investigating this. in the meantime the evidence gathering continues. police say they could be out of here until 10:00. >> now yesterday's police shooting is the second one of the week in antioch. monday police shot and one paul moral buzz -- moral less had a gun and started fighting with police officer. the officer shot him. he is expected to survive. richmond police are welcoming for a it -- the by boy was walking with his mother and friends and police say the shooter who was actually on a bicycle opened fire at a car but missed. the stray bullet hit the kid. >> they threw themselves to the floor. when they got up the little boy realized on his right side in the back was burning. he said it hurt. that's when they saw the blood

coming out. >> now investigators found the suspects bicycle but have not made an arrest. they are also looking for the intended target that was driving a black ford fusion. the cars rear window was shot out. time now 6:33. happening in florida. with are live right inside the crop. the judge revoked simmer moon's bail. zimmerman wants another chance at freedom while he awaits his trial. now zimmerman's lawyer is also raising concerns about a witnesses testimony. he's also trying to block the release of more jailhouse phone calls in the case. again, we are live in the

courtroom as the bond hearing for george skimmer man is under way. we'll keep you posted on that case. back here at home emotional day of testimony expected that of a child of a man charged with beating his. now while he won't. >> the state has announced last minute deals to keep most california state parks open. however some parks still face an uncertain future. tara moriarty joins us now from benicia. >> reporter: this sign says what has weighed upon many park goer minds for some time. park closed due to budget cuts. now a short-term plan has saverred this park from closing

on monday. we don't know how long. 70 of california's 278 state parks have been slated to close july 1st in an effort to save $22 million. as of yesterday they signed 40 agreement with partners including nonprofit and local goths to keep the parks open. another 25 are still being investigated. the vallejo times is reporting city negotiations will continue over a short-term plan to maintain trash and other services. volunteers are collecting gate fees. because the park receives federal funding it has to remain accessible for pees. governor brown says it takes from other important purposes or many violate the states agreement. now if you would like to know the other areas that are in

see the thick haze the smoke has left behind. hovering over the city. we are at an air forsake that has turned -- you can take a look at the emergency responders. they are meeting to figure out how to combat the blaze. their plan of attack for today. they are meeting and deciding how best to really try to knock down these flames that are still recking. the fire is on 15% contained. residence here that have evacuated tens of thousands of them are still waiting for word as to the condition of their homes and when they can return. dave. >> sandra, i know they are still trying toy your out how the fire started. we are also.

it has come roaring back. rom thompson said he had another tenth of an inch of rain. the hills are still green up there. i believe that. they've had a lot of rain up there. for us the end result is an increase in the fog. also lifted a little bit. temps came down yesterday. another four to eight degrees cooling inland. shallow marine layer has really lifted. that's allowed the sea breeze door to open up wide. west, southwest 24 travis. that is getting up there in the turbo charge category. not quite yet but it's strong. west ten or west five or even at napa airport. 50s or low 60s. 250s, 60s, 70s or very, very low 80s for some.

suspended sheriff returns to the stand in his ethics hearing. allie rasmus is at san francisco city hall this morning with the pointed questions is being forced to answer. >> reporter: that hearing starts at 9:00 a.m.. first up -- he is doing this to save his job as san francisco sheriff. mirkarimi supporters greeted him with cheers and applause. after attorneying took care of legal details, mirkarimi began taking questions from deputy city attorney peter keith. mirkarimi admitted during that questioning he bruised the arm of his wife after get into an argument with her on new years eve. back in march he pled guilty to a misdemeanor false imprisonment count because of that incident. during that questioning he defend himself and the ability
