elections than the democrats right now. >> and a lot of the polls say most americans support repealing the obama administration's health care. yet people like some of the individual points that are in it even mitt romney talked about his replacement plan would include some of the more positive points. but then the question is how would he pay for it. >> reporter: exactly. and if you go and listen back to the statement yesterday at the white house by the president, you can see how he seguewayed and taken off a list of provisions that democrats argue was popular and they are counter argument is if you elect republicans, they might take away this and take away that and take away this provision and keep your kids on 26 years old or take away the doughnut hold or prescription drugs for seniors. so there's a whole host of things both sides have you know i think both of them arguing that they can benefit from this in november. we will see. one thing i've been geeing a lot of e-mails and messages-- getting a lot of e-mails and messages is because the supreme

court ruled yesterday that individual mandate is actually a tax, that it shouldn't have been constitutional and never should have gotten out of the congress because the provision actually originated over in the senate. i put up a piece on my blog that you can find and shoots that down and sounds convenient sounds easy enough but it doesn't hold any political water right now. >> all right talk a little bit about john roberts? i think he was the surprise in yesterday's ruling. the fact that as one analyst said he took a walk over to the liberal side. why do you think he did that? >> reporter: well, you know, there's been a lot of vilification of the chief justice the citizens unite and more but if you look at this week he led the court on majority strike down most arizona immigration law, and then he side with liberals. why? no one knows only he knows and his clerks know. but certainly, it's a reminder that sometimes you cannot just say because this judge justice
7:49 am
was appointed by a republican or democrat that's where they are going to end up. there's some currency of thought and i am not a lawyer or legal expert but some people say the move by the chief justice to very definitively say in the ruling that you cannot use the commerce clause for the individual mandate that may actually shut off efforts by future administrations on the democratic side to do things like that. so, we will have to see how it plays out. in the end i. think what the message from the chief justice is was just because the you don't like a law doesn't mean it's unconstitutional. >> and he as he said in the hearings he's there to call the strikes and the balls. >> reporter: exactly. and there are a lot of democrats who threw that back in his face in the last couple years and accused him of leading the court way off to the conservative right. and saying he was becoming judicialally activist. but you look at some of the decisions this week on the arizona law and on the obama health law, i am not sure those
